The Regular meeting of the Westfall Township Board of Supervisors was held Monday, June 4, 2018 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.
Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Paul Fischer, Robert Bostinto and Michelle Wilkins; Solicitor; Robert Bernathy; and Secretary, Jodi Hulse. Also present were Road Master, Bill Schneider; Westfall Township Fire Department Chief; Robert Llewellyn; Sargent Zegarski, EPRPD, Emergency Management Assistant; Michael Fischetta; Treasurer, Scott Myer; Attorney Miles Wren, Michael Gable; Boucher and James, Michael Kelly, John Fuller, P.E., Thomas Murante, James Mauer; McGoey, Hauser and Edsall and Martin Springstead. There were approximately 10 members of the general public present.
Zoning Officer, Wayne Rohner was absent.
EXECUTIVE SESSION: The last Executive Session was held May 7, 2018 @ 8:12 pm for personnel and May 22, 2018 at 4:30 pm for personnel.
APPROVAL OF AGENDA:
A motion was made by Supervisor Fischer to approve the agenda with no changes. The motion was seconded by Supervisor Bostinto and carries with all in favor.

MINUTES:
A motion was made by Vice Chairman Dotey to approve the May 7, 2018 Regular Supervisor Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with four in favor and one abstention. Chairman Melvin abstained due to his absence at the meeting.
TREASURER’S REPORT: Mr. Myer gave the report through the month of May, 2018.

Westfall Fire Department: Chief Llewellyn read the report for May, 2018: 3 Automatic Fire Alarms, 5 Motor Vehicle Accidents, 2 Assist EMS, 1 Assist PD, 1 Vehicle Fire, 1 CO Alarm, 3 Brush Fires, 2 Utility/Tree Down, 6 Chief Investigation and 7 Structure Fire. Total calls for May, 2018 were 31; 132 calls YTD
The EMS Report for the month of May, 2018 was as follows: 54 Calls in Westfall Township, 14 Calls in Dingman Township, 10 calls in Milford Township, 11 calls in Milford Borough, 10 calls in Matamoras Borough, 1 call in Blooming Grove, 2 calls in Shohola Township, 2 calls in Delaware Township, and 2 calls in Orange County, NY. Total calls for May, 2018 were 106. Total EMS calls YTD are 560.
The combined Year to Date calls are 692.

A motion was made by Supervisor Fischer to approve the Westfall Fire Department report for the month of May, 2018. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
HIGHWAY DEPARTMENT: Mr. Schneider gave the report for May, 2018 which reflected the following work done:

- Helped Penn DOT and Pike County Power and Light with storm clean- up (1017 and Bluestone Boulevard)

A motion was made by Supervisor Bostinto to approve the Highway Department Report for the month of May, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.
BUILDING/ZONING REPORT: Wayne Rohner was not present. Jodi Hulse gave the report for the month of May, 2018 which reflected the following:

2 Zoning Permits-$75.00 fees

A motion was made by Vice Chairman Dotey to approve the Building and Zoning Report for the month of May, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.
EMERGENCY MANAGEMENT: Mike Fischetta was present and gave the report for the month of May, 2018 which reflected no calls for the month. He also gave the Supervisors a description of the March calls as per their request.
A motion was made by Supervisor Wilkins to approve the EMA Report for the month of May, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.

OLD BUSINESS:
- Conditional Use Application-Malibu Land Holdings, LLC: This matter was handled just prior to the meeting at the Public Hearing-Court Stenographer was present.
- Proposed Fire Code Enforcement Ordinance: This matter was tabled.
- Emergency Access Road-Township property-Delaware Drive to Decker Lane: Solicitor Bernathy stated the deeds are prepared and have been read for the subdivision and lot combination. A motion was made by Supervisor Wilkins to refer the subdivision and lot combination application to the Planning Commission for review and recommendation. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Revision of previous motion-Peterbilt purchase (cost adjustment): Mr. Schneider explained that the previously approved cost estimate is for a truck which will not be available in time for this coming winter season. He obtained a quote for an aluminum body Peterbilt with upgrades. The difference in price is $9,752. Mr. Schneider stated the Peterbilt will be ready for delivery by fall of this year. Solicitor Bernathy noted the estimate is exempt from bidding and approved through the Costars program.
A motion was made by Vice Chairman Dotey to approve the purchase of the Peterbilt Chassis according to specifications from Hunter Truck Sales and Service dated 5/16/18 in the amount of $112,056.00 which is an increase of $9,752.00 from the previously approved truck purchase price. The motion also includes the approval to obtain a loan in the amount of $168,650.00 ($112,056.00 Chassis and $56,594.00 accessories) from the Municipal Authority of the Township of Westfall. The motion was seconded by Supervisor Fischer and carries with all in favor.
A motion was made by Chairman Melvin to approve the payment of the $50,334.00 truck purchase from the general fund. This purchase was approved at the May 7, 2018 Supervisor Meeting. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Hiring of Township Highway Department Employee: A motion was made by Supervisor Fischer to hire Mr. Martin Springstead at an hourly rate of $17.50 contingent upon all conditions in the Employee Manual including a background check and drug/alcohol testing with an effective date of June 25, 2018. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Emergency Services: Discussion held regarding issues. Jodi Hulse stated that the Board is still waiting for a response from Dingman Township and that Milford Township and Delaware Township would like to be involved in the scheduling of a meeting. This matter was tabled until a response is received by Dingman Township.
- Decker Lane Project: Jodi Hulse stated there are estimates provided by Kiley Associates, LLC for engineering costs ($26,300) and for project costs ($88,000) for this project. Mr. Schneider explained that if the Board does not decide to move forward with the project then there would be no need to have the engineering done and pay engineering fees. Discussion followed. Vice Chairman Dotey stated that the project needs to be done. Chairman Melvin questioned the need and the cost of the project. Additional discussion followed regarding potential easement agreements. Solicitor Bernathy requested maps of the area so that he may get a better understanding of the project and provide an opinion to the Board. Mr. Schneider stated he would obtain the maps from Kiley Associates, LLC for Mr. Bernathy’s review. This matter was tabled until the July 2, 2018 Supervisor Meeting.
NEW BUSINESS:
- Zoning Change-Application-Senior Health Care Solutions, Inc: Representatives: Michael Gable, Boucher and James; Attorney Miles Wren and Michael Kelly, Senior Health Care Solutions, Inc.
Solicitor Bernathy stated this discussion is on an informal basis and the application will need to go before the Planning Commission. Mr. Gable explained the proposal. He noted the subject property is part of a previously approved Land Development Plan for Rivers Edge. The proposal is for a zone change for a parcel of land which is currently zoned R-1 and C-2 which is located on Rivers Edge Drive off of Reuben Bell Drive. The applicant is looking to change the partial R-1 zoning to C-2 zoning to permit a 70 bed nursing home and 50 unit assisted living center. Discussion followed regarding the need for such facilities. Attorney Wren noted the applicant is very successful and has 24 facilities in operation currently. Chief Llewellyn noted the concern of the lack of emergency services volunteers and the number of calls these facilities would create. Mr. Kelly stated they would contract with outside emergency service providers. Chairman Melvin confirmed with Mr. Gable that this property is not located within a flood zone. Additional discussion held regarding the lack of emergency services.
Mr. Gable noted there will be a Subdivision and Land Development application submitted in the future for this project.
A motion was made by Supervisor Bostinto to refer this matter to the Planning Commission for their review and recommendation. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Office Water Cooler Issue: A motion was made by Vice Chairman Dotey to approve the purchase of a small refrigerator for bottled water at the Township Offices at a cost not to exceed $300.00. The motion was seconded by Supervisor Fischer and carries with all in favor.
- Paving Projects-Part of Heaters Hill and Part of Reuben Bell Drive-Bid Advertisement: A motion was made by Supervisor Bostinto to approve advertising for bids for the T-447 Part of Heaters Hill Paving Project and the T-452 Part of Reuben Bell Drive Paving Project with all sealed bids to be received by the Township Office by Thursday, June 28, 2018 at 3:30 pm and sealed bids to be opened at the July 2, 2018 Regular Supervisor Meeting. The motion was seconded by Supervisor Wilkins and carries with all in favor.
SUBDIVISION REVIEW and ACTION:
- Community Self Storage, Inc-151 Reuben Bell Drive-Minor Land Development-Letter from Planning Commission: Representatives: Thomas Murante, Owner and John Fuller, P.E.
Mr. Fuller presented an overview to the Board of the application which is for a storage facility.
A motion was made by Vice Chairman Dotey to approve the Minor Land Develoment Application for Community Self Storage, Inc. with the following conditions:
- All comments noted in Kiley Associates, LLC review letter dated May 9, 2018
- It is the opinion of the applicant/applicant’s engineer that no sprinkler system is required and that the applicant will inform the fire department at the time of building permit application
- The fence line will be installed on the property line and not in the township right of way
- Fire alarm, access to hydrant (knox box on gate) and yelp device installation
- Wall construction will meet criteria for exemption of sprinkler system
- Applicant will have fence installed prior to land development approval at his own risk
- All comments noted in Pike County Office of Community Planning correspondence dated May 15, 2018

- Twin Tiers Hospitality, LLC-Best Western Inn-Minor Subdivision Application/Sewage Planning Module Application-Letter from Planning Commission: Representative: James Maurer, McGoey, Hauser & Edsall
A motion was made by Supervisor Wilkins to approve the Minor Subdivision Application for Twin Tiers Hospitality, LLC-Best Western Inn with the following conditions:
- The final plans will be sealed
- Applicant to provide existing deeds, easements and maintenance agreements/proposed deeds, easements and maintenance agreements
- Component 1 Planning Module exemption from the PA DEP
- Applicant to provide proposed easement over pond for fire protection purposes for the Best Western Inn

The Regular meeting of the Westfall Township Board of Supervisors was held Monday, May 7, 2018 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.
Those present were Vice Chairman, Jerry Dotey; Supervisors; Paul Fischer, Robert Bostinto and Michelle Wilkins; Solicitor; Robert Bernathy; and Secretary, Jodi Hulse. HIGHWAY DEPARTMENT: Mr. Schneider gave the report for April, 2018 which reflected the following:
- Department installed culvert pipe on Decker Lane and worked on drainage issue
- Cold patch was applied to township potholes
- Pot holes were patched in Pond Eddy
- Hot patch was applied to areas on Malibu Road
- Tree removal was done on Bluestone Boulevard in Township Right of Way
- Maintenance was done on spreader
- New tire ball joint was installed on front of the back hoe
- Department was called out twice for trees down on roadways
- Price quotes obtained for Freightliner and Pick Up Truck purchase
- Maintenance done on compost area

OLD BUSINESS:

- Proposed Fire Code Enforcement Ordinance: This matter was tabled.
- Emergency Access Road-Township Property–Delaware Drive to Decker Lane: This matter was tabled.
- Workshop Meeting-USDA loan information (held on April 12, 2018): Supervisor Bostinto explained the loan program which is available thru the USDA.
No further discussion and no decisions were made.
- Workshop Meeting-with Shohola Township Supervisors (held on April 26, 2018): Vice Chairman Dotey explained the issue of the lack of EMS coverage in neighboring areas. Chief Llewellyn noted that 59% of all EMS calls were out of the Westfall Township area. Vice Chairman Dotey stated the Board is reaching out to Dingman Township and Milford Township to organize a meeting for further discussion. Solicitor Bernathy stated a letter has been sent from his office to Dingman and Milford Township.
No further discussion and no decisions were made.
- Decker Lane Stream Location-Kiley Associates, LLC-proposal for environmental design and permitting services: Vice Chairman Dotey explained this is one of the projects which needs further evaluation. This matter was tabled until actual costs of project are obtained.
- Heater Hill Creek Gravel Bar Removal-Kiley Associates, LLC-proposal for environmental services: Vice Chairman Dotey noted this is part of the same project as the Decker Lane Stream Location. This matter was tabled until actual costs of project are obtained.
- Pond Drive-dredging of pond estimate: This matter was tabled until actual costs are obtained.
- Truck Purchases-Specification and Bid Prices: Discussion followed. Solicitor Bernathy noted there is no bidding requirement since the purchases are approved and handled through the COSTARS bidding program. Vice Chairman Dotey stated the Township may obtain a loan from the Municipal Authority of the Township of Westfall. Scott Myer confirmed the Township has the funds available to purchase both. Vice Chairman Dotey stated the Board will decide at a later date.
A motion was made by Supervisor Bostinto to order both the 2019 Freightliner including the chassis, dump body and snow plow at a cost of $159,898.00 and the 2019 Ford F-350 Pick up Truck with plow and spreader at a cost of $50,334.00 with payment source determined at a later date. The motion was seconded by Supervisor Fischer and carries with all in favor.
NEW BUSINESS:
- Building Inspection Underwriters-Pennsylvania Department of Labor & Industry Audit: Vice Chairman Dotey thanked Steve McLaughlin for maintaining a great job in handling the Township’s Building Department and that the audit results were very good.
- Discussion regarding proposed revision to zoning ordinance to change the definition of number of dogs for “kennel”: Solicitor Bernathy read the section of the zoning ordinance defining a “kennel” as “11 or more dogs, six months or older”. Supervisor Wilkins referenced a recent zoning hearing which addressed complaints of a property housing ten large dogs. Brief discussion followed. Ms. Waizenneger suggested any more than three dogs should constitute a “kennel”. Discussion followed regarding the nuisance of the dogs referenced in the recent zoning hearing. Solicitor Bernathy noted there were no “attacking dogs” discussed as part of the hearing. He also read part of the Zoning Ordinance which states five acres are required for a “kennel” use.
A motion was made by Supervisor Wilkins to send this matter to the Planning Board for discussion and recommendation of reducing the number of dogs for a “kennel” use. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Pike County Power and Light Company-Steve Grandinali: Mr. Grandinali came to the Board to do a “re-cap” of the last large storm of the season. He noted the following:
- There was a wide spread impact
- The main line from Matamoras Bridge to Milford and up Route six lost half the circuit
- Damage assessment crews were lined up
- 95% of power was restored within 24 hours
- Harlan Contractors were hired
- General Technicians and a third customer service representative was recently hired
Vice Chairman Dotey thanked Mr. Grandinali for doing a great job during the storm. Supervisor Bostinto thanked Mr. Grandinali for removing trees on electrical strands in the Mill Rift area.
- Thank you to Township Residents/DV High School Warriors Football Team/Business employees for road side clean up on Route 6 & 209 and Reuben Bell Drive: A motion was made by Supervisor Fischer to approve the cost of posting a “thank you” in the Pike County Dispatch. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Letter from Upper Delaware Council-Requirement for submittal of all plans located within delineated river corridor: Solicitor Bernathy stated there is question as to whether this is applicable. This matter was tabled and will be added to the next workshop meeting agenda for discussion.
- Penn DOT-Information session regarding SR 06 Section 408 Project: Representative: Roman Prokopovych, P.E.-Jacobs and Jennifer Borino, P.E. Civil Engineer, Penn DOT District 4-0
Mr. Prokopovych addressed the Board with an update since the design phase of the project. He noted the project location as east of the DV school campus driveway through the Kmart Plaza. Four signals would be upgraded. Eight signals will have battery back- up and a wireless communication system. Mr. Prokopovych stated the project should be awarded to contract at the end of August, 2018 and will be started in March of 2019 with an estimated completion date of September/October of 2019.
Discussion followed regarding construction of sidewalks by the school. Mr. Prokopovych stated there are no sidewalks included in the plan design and that there would be permitting issues.
Mr. Prokopovych also noted there will be no physical changes to the roadway from the I84 ramp to Price Chopper.
Discussion followed regarding the installation of a street light at the Price Chopper intersection. Mr. Williams stated the installation will be included in the plan as long as it is within the limits of work. He noted the cost of the lighting would transfer to the township.
Chief Llewellyn confirmed the opticom systems would remain.
Mr. Williams stated there will be new paving markings made of thermal plastic which are longer lasting.

“Shredding” Day: Supervisor Bostinto asked the Supervisors and the public if anyone is interested in having the portable truck service come and offer shredding services. Brief discussion followed.

- Resignation Letter dated May 7, 2018 from Robert Ewbank, Emergency Management Coordinator: A motion was made by Supervisor Wilkins to accept Mr. Ewbank’s resignation effective midnight July 31, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.
Mr. Fischetta stated he may be interested in the position but would check with the other assistants and get back to the Board.
- Non Uniform Pension Fund Proxy: A motion was made by Vice Chairman Dotey to send the proxy voting form voting for all nominees listed and to abstain from other items listed for votes. The motion was seconded by Supervisor Wilkins and carries with all in favor.
SUBDIVISION REVIEW and ACTION:
- Malibu Land Holdings, LLC-Schedule Conditional Use Hearing (letter from Planning): A motion was made by Supervisor Wilkins to schedule/advertise/order stenographer services for the Malibu Land Holdings, LLC Conditional Use Application for June 4, 2018 at 6:45 pm. The motion was seconded by Supervisor Fischer and carries with all in favor.
EXECUTIVE SESSION: An executive session was called at 8:12 pm for the purposes of personnel.
The meeting was called back to order at 8:26. Vice Chairman Dotey directed Ms. Hulse to set up interviews for the Highway Department job opening.

The Regular meeting of the Westfall Township Board of Supervisors was held Monday, April 2, 2018 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.
Those present were Chairman, Robert Melvin; Vice Chairman, Jerry Dotey; Supervisors; Paul Fischer, Robert Bostinto and Michelle Wilkins; Solicitor; Robert Bernathy; and Secretary, Jodi Hulse. Also present were Road Master, Bill Schneider; Westfall Township Fire Department Chief; Robert Llewellyn; Zoning Officer, Wayne Rohner; Treasurer, Scott Myer; John Dalton, Joe Hoehmann and Kelly Hoehmann. There were two members of the general public present.
EXECUTIVE SESSION: The last executive session was held March 5, 2018 at 7:46 pm for the purposes of litigation regarding Malibu Ranch
APPROVAL OF AGENDA: No changes were made to the agenda. A motion was made by Vice Chairman Dotey to approve the agenda. The motion was seconded by Supervisor Wilkins and carries with all in favor.
PUBLIC COMMENT: Mr. Dalton addressed the Board with concern regarding the Police Department funding split between Westfall Township and Matamoras Borough. He referenced a presentation he submitted in 2014 to the Board. Mr. Dalton suggested the Board consider contributing ½ % more towards the split. He also suggested the Board take into effect the amount of police calls, census figures and road miles. Mr. Dalton stated the Board should be prepared for a request from Matamoras for an increase in the Westfall Township contribution toward the funding split.
Chairman Melvin stated that all is negotiable and that he remembers Mr. Dalton’s presentation and will take it into consideration.
Mr. Dalton asked about the house in front of Price Chopper which has been secured with boards. Solicitor Bernathy noted that unless the structure is dangerous there is nothing the Township can do and the position of the Township has not changed since Mr. Dalton’s last inquiry.

A motion was made by Supervisor Wilkins to approve the March 5, 2018 Regular Meeting Minutes. The motion was seconded by Supervisor Bostinto and carries with four in favor and one abstention. Chairman Melvin abstained due to his absence at the March 5, 2018 meeting.
TREASURER’S REPORT: Mr. Myer gave the report through the month of March, 2018.
A motion was made by Vice Chairman Dotey to approve the Treasurer’s report through the month of March, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.
POLICE REPORT: No representative present. No report submitted. Chairman Melvin directed Ms. Hulse to ask Chief Stewart to submit the report for March, 2018 as soon as possible.

The EMS Report for the month of March, 2018 was as follows: 50 Calls in Westfall Township, 8 Calls in Dingman Township, 8 calls in Milford Township, 18 calls in Milford Borough, 12 calls in Matamoras Borough, 3 call in Shohola Township, 1 call in Delaware Township, 1 call in Greene Township and 5 calls in Orange County, NY. BUILDING/ZONING REPORT: Wayne Rohner gave the report for March, 2018: One zoning permit was issued for the month of March, 2018 with a fee of $100.00.
A motion was made by Supervisor Fischer to approve the Building/Zoning report for the month of March, 2018. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
EMERGENCY MANAGEMENT: No representative present. Ms. Hulse read the report submitted by Mr. Ewbank. There were three calls during the March 2nd and 3rd storm.
The Board directed Ms. Hulse to send a letter to Mr. Ewbank to ask for clarification of the calls for the month of March.
A motion was made by Supervisor Fischer to approve the report for March, 2018 and to send the letter. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
HIGHWAY DEPARTMENT: Mr. Schneider gave the report for March, 2018.
Mr. Schneider reported the following for the month of March:
- Department handled all storms throughout the month
- Salt was ordered
- Department did maintenance on equipment
- Mr. Schneider had meeting on March 27, 2018 with PCCD, Army Corp of Engineers, Kiley Associates and Supervisor Dotey regarding issues on Decker Lane, Pond Drive and Bluestone Boulevard
- Cold Patching was done throughout the Township
- Trees were cleared from storm damage from the roadways
- Fire Tower road Maintenance/plowing was done
Discussion followed regarding a complaint received about trees on cable wires in Mill Rift on Delaware Drive (Penn DOT roadway). Mr. Schneider asked the Board if he could hire a tree removal company to remove the trees. Solicitor Bernathy stated that indemnifications and waivers would be required from Penn DOT. Supervisor Fischer noted another area of Delaware Drive near Decker Lane where there is a tree laying on a wire.
Discussion followed regarding a tree on Bluestone Boulevard within the township right of way on a township road.
A motion was made by Chairman Melvin to approve the cost of tree removal up to $1,000 to remove the tree on Bluestone Boulevard. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
A motion was made by Supervisor Fischer to send a letter to the cable company and Penn DOT to alert both of the trees on the cable on Delaware Drive in Mill Rift and Delaware Drive near Decker Lane. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Discussion followed regarding compensation for part time employees when performing tasks other than snow plowing.
A motion was made by Supervisor Wilkins to approve the hourly rate of $15.00 for part time employee compensation while performing other tasks than snow plowing. The motions includes the requirement that the employee must pass the vetting process as per the township employee manual. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Mr. Schneider also attended the Penn DOT District 4-0 meeting in Dunmore on March 26th.
- He confirmed with Chairman Melvin that all guide rails have been replaced throughout the township except for the area of the slide on Bluestone Boulevard.
- Mr. Schneider also met with Joe Hudak, Kiley Associates regarding reducing the cost of the proposed highway department building. Mr. Hudak is working on a revised figure.
Discussion followed regarding the need for two new township vehicles. Mr. Schneider stated in 2008 the Freightliner and the pick-up truck were purchased. The Freightliner has been out of service quite often lately due to problems with the electric units which has been repaired. He noted that without this truck it is hard to keep up with the snow plowing.
Chairman Melvin directed Mr. Schneider to obtain a quote with specifications for the purchase of a new freightliner by the May 7, 2018 Supervisor Meeting. Solicitor Bernathy confirmed the vehicle is covered under the state bidding process and would be exempt from the bidding process.
Chairman Melvin also directed Mr. Schneider to obtain a quote with specifications for the purchase of a new pick-up truck by the May 7, 2018 Supervisor Meeting. Mr. Schneider noted the need for a smaller truck in areas like Pond Eddy and in the case of trees down for maneuvering.
A motion was made by Supervisor Fischer to approve the Highway Department Report for March, 2018. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

OLD BUSINESS:
- Proposed Marijuana Facilities Ordinance #171: This matter was handled at the public hearing held just prior to the meeting at 6:45 pm
- Proposed Fire Enforcement Ordinance: This matter was tabled.
- Emergency Access Road-Township Property-Delaware Drive to Decker Lane: Vice Chairman Dotey said the correct map has been emailed from Kiley Associates. Solicitor Bernathy requested a full size copy of the survey. Ms. Hulse agreed to obtain one from Mr. Hudak and forward it to Mr. Bernathy.
- Decker Lane and Pond Drive Flooding Issue/Bluestone Boulevard-PCCD Meeting (held March 27, 2018): Vice Chairman Dotey stated he met with Kiley Associates, Army Corp of Engineers, Pike County Conservation District and Mr. Schneider regarding three project which need to be addressed; Decker Lane, Pond Drive and Bluestone Boulevard. Discussion followed regarding the Decker Lane area and the repairs which need to be done to alleviate flooding issues. Mr. Dotey explained that the stream that comes down must be put back into the original stream bed which flows into the Delaware River. The representatives from the Army Corp of Engineers and PCCD agreed. Solicitor Bernathy noted there may be an easement acquisition required. He requested to see the plans. Chairman Melvin noted the Board needs to obtain the cost estimates and make a decision to prioritize the projects and invest in the right areas.
Discussion followed regarding the swale and rocks installed in the Decker Lane area. Mr. Schneider explained the PCCD coordinated with Kiley Associates for erosion control and recommended the swale and the stone size. Chairman Dotey said the size of the rocks will make a bigger flooding problem and that something needs to be done. Solicitor Bernathy questioned the engineer/PCCD recommendation and the failure of same. Mr. Hoehmann stated that Ms. Enslin from the PCCD told him that the PCCD handles only erosion control and not flooding. Chairman Dotey noted the PCCD is aware of the township wanting to remove the rocks from the swale and that they have no objection. Brief discussion followed.
A motion was made by Supervisor Wilkins to direct the highway department to remove the rocks in the swale and place the rocks on the sides of the swale on Decker Lane as long as erosion protection is not affected. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Fire Tower Road: Brief discussion followed. A motion was made by Chairman Melvin to remove this matter from the agenda. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

- Schedule/Advertise Workshop Meeting-Informal Session with Charles Garnett-USDA-April 12, 2018 at 11:00 am:
A motion was made by Chairman Melvin to schedule/advertise the workshop meeting with the representative from the USDA for April 12, 2018 at 11:00 am for the purposes of discussion of loan options for the proposed highway department project. The motion was seconded by Supervisor Fischer and carries with all in favor.
5. Schedule Special/Workshop Meeting with Shohola Township Board of Supervisors-regarding emergency services: A motion was made by Supervisor Wilkins to schedule/advertise the workshop meeting with the Shohola Township Board of Supervisors regarding emergency services. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
6. Milford Water Authority-Vacancy on Board: Ms. Hulse stated there is no vacancy on the board at this time so the motion to advertise the vacancy from the March, 2018 Supervisor Meeting must be withdrawn.
A motion was made by Supervisor Bostinto to withdraw the motion made at the March 5, 2018 Supervisor Meeting to advertise the vacancy on the Milford Water Authority Board. The motion was seconded by Supervisor Fischer and carries with all in favor.
NEW BUSINESS:
1. Schedule Clean -Up Day: A motion was made by Chairman Melvin to schedule/advertise the yearly clean-up day for Saturday, May 19, 2018 from 8:00 am to 2:00 pm free of charge to Westfall Township residents only with the same restrictions as the previous year. The motion was seconded by Supervisor Wilkins and carries with all in favor.
2. DEP Policies: Solicitor Bernathy explained two DEP Polices (385-2208-003 and 385-2207-001) which have been advertised for public comment. This information was provided to the Board by Chris Wood, SEO, by email this past week. Solicitor Bernathy briefly explained the policies but needs more information before the Board submits any comment which is due by April 9, 2018. He said he would contact Mr. Wood to obtain more information and then speak to Mr. Melvin.
A motion was made by Vice Chairman Dotey to designate Chairman Melvin to send a comment letter to the Department of Environmental Protection by April 9, 2018 after obtaining clarification from Solicitor Bernathy. The motion was seconded by Supervisor Wilkins and carries with all in favor.
Discussion topic changed to Highway Department employees.A motion was made by Supervisor Fischer to advertise the highway department laborer vacancy position to include the benefits package, CDL license required, compensation to commensurate with experience and applicant must comply with employee handbook requirement/policy. All applications to be submitted by April 30, 2018. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

The Mill Rift Fire Department report for February, 2018 was approved on motion by Supervisor Fischer. The motion was seconded by Supervisor Wilkins and carries with all in favor.
HIGHWAY DEPARTMENT: Mr. Schneider gave the report for February, 2018.
Mr. Schneider prepared information and attended the workshop meeting on February 13, 2018. The department did cold patching throughout the township. They handled ice storms during the month of February. Mr. Schneider attended the monthly road task force meeting. The department plowed and did clean up during the recent heavy snow storm.
Discussion followed regarding an issue with Route 84 closure during the recent storm. The fire department was asked to block the road closure. Chief Llewellyn suggested this matter be addressed by the Supervisors for the future. The fire department does not have the man power to be sitting at a road block in a storm for 20 to 30 hours. Mr. Schneider stated he would bring this matter up at the next Road Task Force meeting.
A motion was made by Supervisor Bostinto to approve the Highway Department Report for February, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.
BUILDING/ZONING REPORT: Wayne Rohner was absent. Ms. Hulse read the report for February, 2018. There was one zoning permit totaling $75.00 in fees for the month of February, 2018.

EMERGENCY MANAGEMENT: Mr. Ewbank read the report for February, 2018. There were no calls for the month of February, 2018. Mr. Ewbank has two reports from Pike County Light and Power. He said there were construction crews on Cummins Hill Road today due to the recent poles and wires down from the snow storm. PCPL also stated that the Heaters Hill repairs would be completed by this evening.

Kiley Associates, LLC is in the process of revising the map so that Solicitor Bernathy can proceed with the legal documents. No action taken.
- Township Building-Parking Lot Lighting: This matter was tabled. No new installs are being done by the electric company at this time since they are setting up new installation crews.
- Price Chopper Intersection-Lighting Quote: This matter was tabled. No new installs are being done by the electric company at this time since they are setting up new installation crews.
- Decker Lane and Pond Drive Flooding Issue/Bluestone Boulevard-PCCD Meeting-March 7, 2018 at 9:30 am: Ms. Hulse stated this meeting date is changing due to the recent blizzard. The meeting will be coordinated with Vice Chairman Dotey once new dates are provided. Chairman Dotey noted these three areas need to be addressed and the projects need to be done.
- Delaware Valley School District/Westfall Township Draft Lighting Agreement: Solicitor Bernathy stated he has reviewed the agreement and it is acceptable.A motion was made by Supervisor Bostinto to approve the Delaware Valley School District/Westfall Township Draft Lighting Agreement. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Status of Malibu Appeal: This matter was referred to the executive session to be held at the end of the meeting.
NEW BUSINESS:
- Connexicore-Frank Segarra-Drone Technology Information: Supervisor Bostinto stated that Mr. Segarra is not present due to the recent storm. Discussion followed regarding the necessity of drone technology within the township. Chief Llewelyn noted the drone is a great tool but not a necessity. Vice Chairman Dotey asked if the tool could have been used in the past. Mr. Koferl said no. Mrs. Abadessa stated there may be a warrant issue. The board decided to drop the subject and no action was taken.
- Schedule/Advertise workshop meeting-municipal expansion-informational meeting with Charles Garnett-USDA: This matter was tabled until the April Meeting on a motion made by Supervisor Bostinto. The motion was seconded by Supervisor Wilkins and carries with all in favor. Ms. Hulse will obtain dates for the meeting in April.
- Schedule/Advertise Special Meeting with Shohola Township regarding ambulance services: This matter was tabled until the April 2, 2018 Supervisor Meeting due to the recent storm.
- Milford Water Authority-Vacancy on Board: Supervisor Bostinto stated he spoke with Tim Gardner and Mr. Gardner noted a vacancy on the Board for a Westfall Township resident.A motion was made by Supervisor Wilkins to advertise the vacancy for the Milford Water Authority Board. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- MRM Property & Liability Trust-Proxy-Authorization-Harrison Township and West View Water Authority: A motion was made by Supervisor Fischer to approve the proxy for voting purposes for all matters at the April 5, 2018 MRM Property and Liability Trust meeting. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- MRM Property & Liability Trust-Proxy-Authorization-Pine Township, Hempfield Township and Municipality of Murrysville): A motion was made by Supervisor Bostinto to approve the proxy for voting purposes for all matters at the April 6, 2018 MRM Property and Liability Trust meeting. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Marijuana Facilities Ordinance-Letter from Planning Commission-Schedule/Advertise public hearing: A motion was made by Supervisor Bostinto to schedule/advertise a public hearing for the proposed Marijuana Facilities Ordinance for April 2, 2018 at 6:45 pm. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Temporary Driver Appointment: A motion was made by Supervisor Fischer to appoint Chris Morgan and Pat Cordova as temporary drivers for the Highway Department at a rate of $20.00 per hour with copy of current driver’s license and addition of the drivers to the township insurance policy. The motion was seconded by Supervisor Wilkins and carries with all in favor.
SUBDIVISION REVIEW and ACTION:
- GO 24 Store-Final Minor Land Development-Revision to move location of Fire Hydrant-Letter from Planning Commission: Representative-John Fuller, P.E.
Mr. Fuller explained the plan to the Board and stated that he was here for any questions.
A motion was made by Supervisor Bostinto to approve the GO 24 Store Final Minor Land Development-Revision to move fire hydrant with the conditions listed on the February 27, 2018 correspondence from Kiley Associates, LLC. The motion was seconded by Supervisor Fischer and carries with all in favor.
Mr. Koferl addressed the Board and said he is available as a temporary driver. A motion was made by Supervisor Fischer to appoint Mr. Koferl as a temporary driver at a rate of $20.00 per hour with a copy of current driver’s license and addition of the driver to the township insurance policy. The motion was seconded by Supervisor Wilkins and carries with all in favor.
EXECUTIVE SESSION: An executive session was called at 7:46 pm for litigation purposes to do with the Malibu appeal.

The Regular meeting of the Westfall Township Board of Supervisors was held Monday, February 5, 2018 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.
Those present were Chairman, Robert Melvin (arrived at 7:30 pm), Vice Chairman, Jerry Dotey; Supervisors; Paul Fischer, Robert Bostinto and Michelle Wilkins; Solicitor; Robert Bernathy; and Secretary, Jodi Hulse. The motion was seconded by Supervisor Fischer and carries with three in favor and one abstention. Supervisor Wilkins abstained since she was not in attendance as a Supervisor at the meetings on January 2, 2018.

Supervisor Bostinto questioned employee benefit costs. Chief Stewart suggested the matter be discussed at the Police Commission meeting since the Secretary of the Police Commission could provide any financial information needed.

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for January, 2018.
Mr. Schneider stated the department applied material to all roads for four storms. They maintained all equipment and cleared culverts for storms. Pot holes were filled. Mr. Schneider attended the Road Task Force Meeting for January. He also met twice with a representative from Pike County Power and Light regarding the lights in the parking lot at the township office building. Mr. Schneider noted that Kiley Associates, LLC has been working on the Decker Lane issue. He noted that salt has been ordered and that he may need to order from a private distributor due to the recent amount of storms in a short period of time.
A motion was made by Supervisor Bostinto to approve the Highway Department Report for January, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.
BUILDING/ZONING REPORT: Wayne Rohner gave the report for January, 2018. He confirmed there were 1 electrical, 2 mechanical and 1 Planning Permit for the month of January, 2018 totaling $863.50 in fees.
A motion was made by Supervisor Fischer to approve the Building/Zoning Report for January, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.
EMERGENCY MANAGEMENT: Mr. Ewbank read the report for January, 2018. There were no calls for the month of January, 2018. Mr. Ewbank updated the point of contact information for the Verizon Wireless account to Jodi Hulse and himself.

OLD BUSINESS:
- Proposed Fire Code Enforcement Ordinance: This matter was directed to executive session to be held later in the meeting.
- Emergency Access Road-Township Property-Delaware Drive to Decker Lane: This matter was directed to executive session to be held later in the meeting.
- Township Building-Parking Lot Lighting: This matter was tabled. Mr. Schneider is waiting for a quote from Pike County Power and Light. Supervisor Bostinto directed Mr. Schneider to also obtain a quote for a light at the Price Chopper intersection
- Municipal Expansion-Highway Department: Supervisor Bostinto stated that he has been in contact with Charles Garnett at the USDA regarding possible financing for this project. This matter was tabled until the next workshop meeting.
A motion was made by Supervisor Bostinto to schedule a Supervisor Workshop for February 13, 2018 at 6:00 pm. The motion was seconded by Supervisor Wilkins and carries with all in favor.
NEW BUSINESS:
- Letter from Planning Commission-Component 2-Sewage Planning Module-Sylvan Ridge Farm-232 Cummins Hill Road-Resolution 2018-3: A motion was made by Supervisor Bostinto to enact Resolution 2018-3 to approve the Component 2 Sewage Planning Module for Sylvan Ridge Farm. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Open Space Grant Bank Account (2011): Mr. Myer explained that this account has been inactive for several years and that the grant money was spent. The balance was actually money that came from the general fund originally.A motion was made by Vice Chairman Dotey to close the account and move the balance to the general fund. The motion was seconded by Supervisor Fischer and carries with all in favor.
- Change December 25, 2018 Planning Meeting to December 18, 2018: A motion was made by Supervisor Fischer to change the December 25, 2018 Planning Meeting to December 18, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Letter from Westfall Municipal Authority-Vacancy on Board: A motion was made by Vice Chairman Dotey to appoint Supervisor Fischer to the vacancy on the Municipal Authority Board. The motion was seconded by Supervisor Bostinto and carries with three in favor and one abstention. Supervisor Fischer abstained.
- Approval for Wayne Rohner, Zoning Officer to attend FEMA Course-February 26, 2018 through March 1, 2018-Cost $200: Secretary Hulse noted there was also a course at Middle Smithfield Township for Zoning March 6, 13 and 20th that Mr. Rohner is also interested in attending. The cost is $75.00. A motion was made by Supervisor Fischer to approve the payment for both courses. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Resignation Letter dated January 25, 2018-Richard Mai: Vice Chairman Dotey read the letter. A motion was made by Supervisor Fischer to accept Mr. Mai’s resignation effective March 28, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Decker Lane Drainage Study-Kiley Associates, LLC-dated February 5, 2018: This matter was tabled until the February 13, 2018 Supervisor Workshop Meeting.
- Sketch Plan-Informal Presentation-Westfall Senior Center Facility-Senior Health Care Solutions, LLC: Representatives: Michael Gable- Boucher & James and Michael Kelly-Senior Health Care Solutions-Mr. Gable explained the proposal to the Board along with presenting a proposed plan. He noted the following:
- Proposed location behind Lowes
- Area is in flood plain-area will be filled in
- Easement to be obtained for emergency access
- Public water and sewer
Chairman Melvin joined the meeting.
- 70 beds to be provided
- There is a need for skilled nursing beds
- Fire suppression system
- Mr. Sullivan and Pike County Commissioners have put a lot of work into this proposal
- Proposal is not assisted living
- Proposal resembles hotel
- Private dining
- Recreation activities
- Creation of 105 full time jobs
Discussion followed regarding flooding concerns. Mr. Koferl noted the increase in EMS calls.
Mr. Rohner confirmed the nursing home use is permitted in the C-2 Zone. Solicitor Bernathy noted this proposal is informal and that the applicant will need to go through the formal process and that the Supervisors will not pre-judge the matter. The only issue the Supervisors noted was flooding.

SUBDIVISION REVIEW and ACTION:
- Delaware Valley School District-CTE (Career Technical Education) Addition-Final Land Development Plan: Letter from Planning Commission: Representatives: Don Flynn, Burkavage Design Associates; Jeffrey Jerome, Greenman-Pedersen, Inc.; Dr. John Bell:
Mr. Jerome explained the addition to the vo-tech area of the building.
Chief Stewart stated that the school district has agreed to grant camera access to the Police Department for emergency purposes only. Mr. Bell stated he spoke with Chief Chad Stewart earlier in the day and they have come to an agreement.
Supervisor Fischer brought up the side walk issue. Discussion followed. Mr. Bell noted that Penn DOT made the school district move the trees from the right of way. He stated that he is not sure that Penn DOT would allow the sidewalks. Additional discussion followed.
Mr. Bell pledged to put funding towards the bond amount to install the sidewalks at some point in the future.
A motion was made by Vice Chairman Dotey to approve the Final Land Development Plan for the CTE Addition to the Delaware Valley High School Complex with the conditions noted in the January 29, 2018 Planning Commission letter to the Board of Supervisors. The motion was seconded by Supervisor Wilkins and carries with all in favor.
A motion was made by Chairman Melvin to approve the waiver request from Section 305.1 of the Subdivision and Land Development Ordinance in regard to posting a financial guarantee for the project. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
EXECUTIVE SESSION: An executive session was called at 8:05 pm for personnel and land exchange purposes.

TREASURER’S REPORT: Mr. Myer gave the report through the month of December, 2017. He noted that income is over budget for the year and that the income for the delinquent taxes was a large amount. He also noted that the income for permits and real estate transfer tax income were higher than budgeted. Mr. Myer also stated there is $46,000 left over from 2017 in the Capital Road fund for future projects.
Vice Chairman Dotey, Chief Llewellyn and Bill Koferl left the meeting due to an emergency (7:35 pm).
Discussion followed regarding Fire Tower Road.

He ordered 200 tons of anti-skid and 175 tons of salt which have been delivered and stockpiled. Mr. Schneider stated that the department maintained all equipment after each storm. He also contacted Pike County Light and Power regarding the parking lot lighting. No response from PCPL at this time. Mr. Schneider will contact the company once again.
A motion was made by Supervisor Bostinto to approve the Highway Department Report for December, 2017. The motion was seconded by Supervisor Fischer and carries with all in favor.

NEW BUSINESS:
- Letter of Interest from Michelle Wilkins for Supervisor Vacancy: Chairman Melvin explained that Ms. Wilkin has been on the Westfall Planning Commission for several years. Brief discussion followed.
A motion was made by Chairman Melvin to appoint Ms. Wilkins to fill the Supervisor vacancy through December 31, 2019. The motion was seconded by Supervisor Fischer and carries with all in favor.
- Letter of Interest from Gregg Noll for Supervisor Vacancy: Chairman Melvin thanked Mr. Noll for his interest and asked if he would be interested in being appointed as a Planning Commission member. Mr. Noll agreed to accept the position.
Ms. Wilkins verbally resigned from the Planning Commission and will follow up in writing with the Township Secretary. A motion was made by Chairman Melvin to accept Ms. Wilkins resignation. The motion was seconded by Supervisor Fischer and carries with all in favor.
A motion was made by Chairman Melvin to appoint Mr. Noll as Planning Commission member. The motion was seconded by Supervisor Fischer and carries with all in favor.
- Appointment of Supervisor to fill vacancy: This matter was addressed earlier under “New Business”

- Storage Tank Liability Insurance: A motion was made by Chairman Melvin to reject terrorist coverage for the underground storage tank liability insurance policy and to bind coverage with Endurance American Specialty Insurance. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Resolution 2018-2—In opposition of the House Bill 1920 (PN 2146), entitled the “Wireless Infrastructure development bill”: Solicitor Bernathy explained the Resolution.A motion was made by Supervisor Fischer to approve the Resolution 2018-2. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Letter from DVSD-Approval from LED Light Installation and township billing/reimbursement: Discussion followed.A motion was made by Chairman Melvin to conditionally approve the project subject to terms set forth in an agreement between the parties. The motion includes sending a letter requesting the school district to forward a proposed agreement. The motion was seconded by Supervisor Fischer and carries with all in favor.

MINUTES: A motion was made by Vice Chairman Dotey to approve the October 10, 2017 Budget Workshop minutes. The motion was seconded by Supervisor Bostinto and carries with three in favor and one abstention. Supervisor Buchanan abstained due to his absence at the meeting.
A motion was made by Supervisor Buchanan to approve the November 6, 2017 Regular Meeting minutes. The motion was seconded by Vice Chairman Dotey and carries with three in favor and one abstention. Chairman Melvin abstained due to his absence at the meeting.
TREASURER’S REPORT: Mr. Myer gave the report through the month of December, 2017. Mr. Myer noted the budgeted income has been met for the year. Also, delinquent tax income is $150,000 over budget and transfer tax is $50,000 over budget. He also noted expenses are under budget.
Chairman Melvin explained the changes made to the Non Uniformed Pension Plan Ordinance earlier in the evening at 6:15 pm at the public hearing. A motion was made by Vice Chairman Dotey to make a payment of $80,000 to fund the plan properly. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Chairman Melvin directed Ms. Hulse to contact Roth & Roth, Actuary to obtain paperwork to be submitted to Mr. Myer for payment in accordance with the motion.
The Treasurer’s Report through December, 2017 was approved on a motion by Supervisor Buchanan. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

A motion was made by Supervisor Buchanan to approve the Westfall Fire Department Report for the month of November, 2017. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Mill Rift Fire Department: Chief Lamb gave the report for the month of November, 2017, which stated as follows:

Chief Lamb confirmed the department has approximately ten certified drivers at this time.

A motion was made by Supervisor Buchanan to approve the Mill Rift Fire Department Report for the month of November, 2017. The motion was seconded by Supervisor Bostinto and carries with all in favor.
HIGHWAY DEPARTMENT: Mr. Schneider gave the report for November, 2017. The Department continued clearing the township right of way from trees and brush. They cleared culvert pipes throughout the township. Mr. Schneider and the department cleared debris from shoulder of roads on Roberts Lane, Phillips Lane, Old Milford Road and Pine Hill Farm Road. They also maintained the compost area. The department installed the last spreader for the winter season and maintained equipment. Mr. Schneider attended the Road Task Force Meeting for November, 2017. He also met with Joe Hudak and Will Whitehead, Kiley Associates and Ellen Enslin, Pike County Conservation District to discuss drainage issue on Decker Lane. The department installed matting directed by the PCCD on Decker Lane. The project is to be continued.
A motion was made by Supervisor Buchanan to approve the November, 2017 Highway Report. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
BUILDING/ZONING REPORT: Wayne Rohner was absent. Chairman Melvin read the report for November, 2017 which reflected 1 building permit and two zoning permits for the month which fees totaled $634.50.
A motion was made by Supervisor Bostinto to approve the Building/Zoning Report for November, 2017. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
EMERGENCY MANAGEMENT: Mr. Ewbank was absent. The report submitted reflected no calls for the month of November, 2017.
A motion was made by Supervisor Buchanan to accept the Emergency Management Report for November, 2017. The motion was seconded by Supervisor Bostinto and carries with all in favor.
CORRESPONDENCE: Chairman Melvin stated the file is in the office if anyone would like to review.
OLD BUSINESS:
- Adoption of 2018 Budget-Resolutions 2017-4 and 2017-5: Chairman Melvin read Resolution 2017-4. He noted the total mils have been reduced by 9.7% from last year and that the total mils are down 27% from 2015.
A motion was made by Supervisor Bostinto to approve Resolution 2017-4 to adopt the 2018 Budget. The motion was seconded by Supervisor Buchanan and carries with all in favor.
Chairman Melvin read Resolution 2017-5. A motion was made by Supervisor Buchanan to approve Resolution 2017-5 to adopt the 2018 Budget. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Proposed Fire Code Enforcement Ordinance: This matter was tabled.
- Emergency Access Road-Township Property-Delaware Drive to Decker Lane: Solicitor Bernathy asked if the survey has been completed with the metes and bounds description. Ms. Hulse stated she would find out the status from Kiley Associates, LLC.
- Decker Lane Drainage Issue: Mr. Schneider explained the flooding problem in the Decker Lane area. He met with Kiley Associates and the Pike County Conservation District on site. He said an engineering/study is needed which Kiley Associates submitted a cost estimate for the engineering study (dated November 30, 2017) in amount of $5,250.
A motion was made by Supervisor Buchanan to approve the payment of the engineering cost estimate not to exceed $5,250 and to direct Kiley Associates to move forward with the service. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Gambling Ordinance-Schedule/Advertise continuation: A motion was made by Supervisor Bostinto to schedule and advertise the continuation of the Gambling Ordinance Public Hearing for February 5, 2018 at 6:30 pm. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
NEW BUSINESS:
- Resolution 2017-6-Prohibiting Category 4 Casinos: This matter was removed from the agenda since the matter is not applicable to Pike and Wayne Counties.
- Informal Presentation-Art Park Lodge-Ernie Bertuzzi-Short Term Rental Cabins: Representatives: Tom Holmes and Davis Chant, Advisor
Solicitor Bernathy noted he had previously represented this applicant in a different township so if matter becomes a formal application before the Board, this matter would be referred to conflict counsel. He confirmed this was an informal presentation only at this point.
Mr. Holmes explained the proposed project to the Board. The located is at Laurel Acres which is located off of Cummins Hill Road and is an existing subdivision with a total of 123 acres. The proposal is for 20 short term rental cabins. He noted the following would be proposed:
- Art Park
- Recreational use
- Hot tubs and sauna areas
- Short term tourist use
- Cabins 400 to 600 square feet
- 1.3 acre lots
- Roads are in good shape and gravel
- Could change back to one large piece if needed
- There is a draw for short term rentals from Philadelphia and NYC areas
- Modern design
- Architecturally distinct design
- Echo flow septic systems
- Minimal use of water
- Single bath, bedroom and kitchenette
- Sculptures on property
- Two small ponds on property
- Minimal disturbance
- No campground activities
- No shooting or ATV activity
- Romantic atmosphere
- Float tanks
- Conservation bird theme
- Ice events in winter months
- Two to three million dollar investment over 3 to 4 years
- Tax revenue will be created
- CD Zone
Mr. Holmes noted short term rentals are not a use provided for in the ordinance in a CD Zone. He said this may fit as a conditional use as a resort.
The following was also noted:
- Office, garage/storage, tower house and library would be proposed
- Caretaker on site and cleaning staff as needed
- Private roads
- Open 365 day a year
- $250 to $300 per night
No comment was made by Chief Llewellyn or Chief Stewart. Solicitor Bernathy suggested that Mr. Holmes check with Wayne Rohner, Zoning Officer, for the procedure of variance which would go through the Zoning Hearing Board. He stated they may want to consider an ordinance amendment rather than variance since there may be no hardship to prove. Solicitor Bernathy said this sounds like it may be a conditional use with land development and variance or ordinance amendment for square footage minimum issue. Mr. Holmes thanked the Board and will proceed accordingly.
- Appointment of Deputy Tax Collector: A motion was made by Supervisor Buchanan to appoint Zachary Pearce as Deputy Tax Collector. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Tax Collector Bank Account-Act 38: A motion was made by Supervisor Buchanan to approve providing the Township Tax Identification Number and listing Westfall Township on the tax collector bank accounts for the collection of township taxes and school district taxes. The motion was seconded by Supervisor Bostinto and carries with all in favor.
The Board directed Ms. Hulse to provide a letter to Mrs. Pearce to confirm this approval.
- Flood Insurance Renewal Policy: A motion was made by Supervisor Buchanan to approve the payment in the amount of $2,746.00 (Option 2 on invoice) for Flood Insurance Policy to American Bankers Insurance Company of Florida. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Mid-Hudson Interpreter Service Agreement: A motion was made by Supervisor Buchanan to sign the 2018 Mid-Hudson Interpreter Service Agreement. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Route 6 and 209-Penn DOT Revitalization-Lack of Adequate Funding: A motion was made by Supervisor Buchanan to provide a letter of support to Mr. Mrozinski at the Pike County Planning Office to assist in adding this project to the Transportation Improvement Program. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Retail Liquor License #R-19761 Transfer-Garris to Patel (1002 Pennsylvania Avenue)-Schedule/Advertise Public Hearing: A motion was made by Supervisor Bostinto to schedule a public hearing for this liquor license transfer application for January 2, 2017 at 6:30 pm and to advertise accordingly. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
SUBDIVSION/LAND DEVELOPMENT/CONDITIONAL USE-REVIEW AND ACTION:
- Paddlers Point-Garden Apartments: Flood Plain Development Permit
- Chairman Melvin read the recommendation letter from the Westfall Planning Commission. A motion was made by Supervisor Buchanan to approve the Paddlers Point Flood Plain Development Permit. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Paddlers Point-Garden Apartments: Stormwater Management Agreement and Declaration of Easement
- Chairman Melvin read the recommendation letter from the Westfall Planning Commission. A motion was made by Supervisor Buchanan to approve the Stormwater Management Agreement and Declaration of Easement between Westfall Township and Paddlers Point. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
EXECUTIVE SESSION: None held.
Supervisor Buchanan asked Mr. Schneider to obtain estimates for parking lot lighting at the Township Building. He suggested obtaining quotes to add a pole with an extension arm. The cost, up to $10,000, for this was approved at the most recent Regular Supervisor Meeting.
Chairman Melvin thanked Supervisor Buchanan for his service to Westfall Township and noted that he has been a treasure to the Township. Vice Chairman Dotey, as well as Supervisor Bostinto, thanked Supervisor Buchanan.
