Westfall Township in Pike County is accepting sealed bids for the following equipment:

* A 2008 Chevrolet 1 Ton Pick Up Truck with Duramax Diesel Engine; 5-speed Allison automatic transmission; four wheel drive; 8 foot bed; 8.5 foot Pro Plus Western power angle plow; Air flow Stainless steel 3 yard hydraulic spreader and approximately 125,000 miles. Minimum bid $12,000.00.

Bids must be received by the Township Secretary no later than 3:30 pm Thursday, August 1, 2019, prevailing time, at PO Box 247, Matamoras, PA 18336 or the Westfall Township Municipal Building, 102 LaBarr Lane, Matamoras, PA 18336. All bids must be in writing and be accompanied by security for the performance of the bid, if awarded, in the amount of ten percent of the bid. Said security to be by surety bond, cashier’s check or certified check made payable to the Township of Westfall.  All transfer taxes and fees to be paid by the successful bidder.  The vehicle will be sold in “as is” condition with no warranties implied or expressed. The Board of Supervisors reserves the right to reject any and all bids. Bids will be opened and considered for award at the Westfall Township Supervisor meeting to be held on August 5, 2019 at 7:00 p.m.  Successful bidder must pick up vehicle.  No delivery by seller.

MEETING NOTICE

Please take notice that the Westfall Township Board of Supervisors will hold a Special Meeting on Tuesday, July 9, 2019 at 7:00 pm for the purposes of discussion and disposition of advertising for bids for proposed salt shed base, pedestrian tunnel maintenance, flood gate demonstration, flood insurance renewal and any other business that may come before the Board.  The meeting will be held at the Township Building located at 102 LaBarr Lane, Westfall Township, Matamoras, PA 18336.

The Regular meeting of the Westfall Township Board of Supervisors was held Monday, June 3, 2019 at 7:01 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

 

Those present were Chairman Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Robert Bostinto, Paul Fischer, Paul Schaldonat; Solicitor; Robert Bernathy; and Secretary, Jodi Manheim; Treasurer, Scott Myer; Zoning Officer, Jeff Cammerino. Also present were Road Master, Bill Schneider; EPRPD Chief, Chad Stewart; Emergency Management Coordinator, Mike Fischetta; Westfall Township Fire Department President; Bill Koferl; Stephen Steeneck; Geri McKinney; Robin Waizenegger; John Dalton; Roland Edwards and approximately six members of the general public.

 

EXECUTIVE SESSION: The last executive session was held on May 20, 2019 at 7:29 pm for personnel matters.

 

APPROVAL OF AGENDA:

 

A motion was made by Vice Chairman Dotey to approve the agenda with no changes. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

PUBLIC COMMENT: Robin Waizenegger addressed the Board.  She asked if a scope of work has been submitted to the township for the Cummins Hill Road project.  Solicitor Bernathy stated that Penn Dot is not required to submit plans to the Township.  Secretary Manheim stated that no plans have been received.  Brief discussion followed.

 

Mr. Dalton addressed the Board. He stated he has attended several Matamoras Borough Council meetings over the past four years.  He noted specifically a 2014 Police Commission meeting where he submitted a presentation on Police Department funding cost split.  Chairman Melvin stated that this matter has already been addressed and fixed.  Mr. Dalton asked Chairman Melvin not to interrupt.  He noted that Matamoras Borough lost $145,000 on paper.  Mr. Dalton stated he does not agree with the revised split and he provided a spread sheet to the Board and to one member of the public, Roland Edwards.  Also noted was that Mr. Dalton would like to see 100% attendance by the Board of Supervisors and the Matamoras Borough Council at the joint workshop in September.  Mr. Dalton stated he does not want the police department to be affected.

 

Chairman Melvin thanked Mr. Dalton.

MINUTES:

 

May 6, 2019 Regular Meeting Minutes: A motion was made by Supervisor Bostinto to approve the May 6, 2019 Regular Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with four in favor and one abstention.  Chairman Melvin abstained due to his absence at the meeting.

 

May 20, 2019 Special Meeting Minutes: A motion was made by Chairman Melvin to approve the May 20, 2019 Special Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with all in favor.

 

TREASURER’S REPORT: The Treasurer’s Report through the month of May, 2019 was presented by Mr. Myer.  Mr. Myer noted that Real Estate Tax Collection is at roughly 95% and that expenses are in line.

 

A motion was made by Vice Chairman Dotey to approve the Treasurer’s Report through the month of May, 2019. The motion was seconded by Supervisor Fischer and carries with all in favor.

 

POLICE REPORT:  Chief Stewart gave the report for the month of May, 2019.  The report reflects the following:

Significant Happenings:

 

Discussion followed regarding seatbelt laws and cell phone/texting use while driving.

 

A motion was made by Supervisor Fischer to approve the May, 2019 Police Report. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

WESTFALL FIRE DEPARTMENT REPORT: Bill Koferl gave the report for the month of May, 2019 which reflects the following: Assist EMS-1; Automatic Fire Alarm-8; Chief Investigation-2; CO Alarm-2; Elevator Rescue-1; Structure Fire-3; Vehicle Fire-2; Water Rescue-2; Wire Down-1.  The total fire calls 28.

Discussion followed regarding the number of ambulance calls and the status of Commonwealth Ambulance service coverage. Mr. Koferl stated that Port Jervis Ambulance has been assisting Westfall Township.

 

A motion was made by Vice Chairman Dotey to approve the Westfall Fire Department report for the month of May, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for May, 2019 which reflects the following:

 

Mr. Schneider stated the Chevrolet Pick Up/plow/spreader is ready to be put out for bid. Also, the price for the emergency road should be under $25,000.

 

A motion was made by Supervisor Fischer to approve the Highway Department Report for May, 2019. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

 

BUILDING/ZONING REPORT:  Jeff Cammerino gave the report for May, 2019 which reflects the following:

2 Building Permits totaling $1,108.50 in fees;  8 Zoning Permits totaling $900.00.  Total Fees received for the month of May, 2019; $2,008.50.

 

Chairman Melvin directed Mr. Cammerino to address illegal signs throughout the township. Mr. Cammerino stated he has been working on businesses throughout the township.

 

A motion was made by Supervisor Fischer to approve the Building/Zoning Report for May, 2019. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

 

EMERGENCY MANAGEMENT: Mr. Fischetta gave the report for May, 2019 which reflects the following:

There were no calls for the month of May. Over the last month there were multiple severe weather events and warnings issued that were closely monitored by EMA and resulted in no action needed.  Progress is being made on updated the township’s EOP and notification and resource manual.

 

A motion was made by Supervisor Fischer to approve the Emergency Management Report for the month of May, 2019. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

OLD BUSINESS:

 

 

 

A motion was made by Vice Chairman Dotey to approve the Cable Company Contract/Franchise Agreement-Ordinance #174. The motion was seconded by Supervisor Schaldonat and carries with four in favor and one abstention. Supervisor Bostinto abstained due to his employment at Spectrum.

 

  1. Specification Package for base of proposed salt storage building: This matter was tabled until Kiley Associates, LLC provides the specification package.

 

  1. Specification Package for Modification of Township Building/Police Relocation: Discussion followed regarding legal requirements for letting of bids/advertising. Vice Chairman Dotey stated that the Westfall Home Depot is willing to make a donation of material to the township for this project. He is waiting for a call regarding the materials to be donated. The Board showed their appreciation for the proposed donation and help to the community. Further discussion took place regarding bidding requirements. Solicitor Bernathy read the Second Class Township Code and confirmed the Board may obtain at least three phone/written quotes from qualified contractors for pricing between $11,700 and $20,600.

A motion was made by Vice Chairman Dotey to obtain at least three written quotes from qualified insured contractors to include name of contractor, subject, work specifications and price of work to be done to remodel the lower level of the township building for the Police Department Relocation. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

 

 

Solicitor Bernathy directed Secretary Manheim to forward the property owner information for the preparation of an encroachment agreement.

 

 

Mr. Koferl asked about the usage of the Mill Rift sub-station adjacent to the township building. Chairman Melvin stated research needs to be done pertaining to ISO (insurance rating).

 

No action was taken.

 

NEW BUSINESS:

 

 

A motion was made by Vice Chairman Dotey to send a letter of support to the Pike County Light and Power Company for the Hometown Hero flag project. The motion was seconded by Supervisor Bostinto and carries with all in favor

Penn State Extension-PSATS Youth Service Award: Brief discussion followed regarding donations. Solicitor Bernathy stated he would need to research this matter. This matter was tabled. No action was taken.

 

 

        Stephen Steeneck and Kenneth Kirchoff-Proposed Fireworks Business: Stephen Steeneck was present.

 

Solicitor Bernathy stated that this is the third meeting Mr. Steeneck has attended on an informal basis. Solicitor Bernathy stated the following regarding Mr. Steeneck’s proposal:

  1. Proposal is informal
  2. No formal application for a temporary zoning permit or application for a conditional use approval has been submitted although same was requested from the applicant, and, as a result, there was nothing before the Supervisors to act upon.
  3. Mr. Steeneck was told not to rely on any representations made at this evening’s meeting since the proposal is informal only as noted.
  4. The proposal is repetitive and he is not presenting any new information for the Supervisors to consider.
  5. The Township Zoning Officer has gone out of his way to be accommodating-provided copies of ordinances after most recent planning meeting
  6. A conditional use is needed for the proposal of a use not provided for in the zoning ordinance

 

Mr. Steeneck stated he was told something different at the last planning workshop meeting. Solicitor Bernathy stated it has not changed.  It is a zoning matter with regard to an application for a temporary zoning permit and a conditional use application as was discussed informally at previous planning commission meetings.  Solicitor Bernathy stated that Mr. Steeneck addressing the Board of Supervisors has, without new information, no purpose and that the Supervisors have no jurisdiction over zoning and cannot act upon a conditional use application which has not been filed.  Mr. Steeneck repeatedly questioned that he is in need of clarification and proper answers.  Solicitor Bernathy stated that the zoning officer has, and will continue, to accommodate him to a certain extent as it is not the township’s position to overly assist an applicant.  Solicitor Bernathy also suggested that Mr. Steeneck obtain legal advice since he has no working knowledge of the township ordinances.  Zoning Officer Cammerino stated he just received, two hours ago, two zoning permit applications and that the proposal as changed since the applicant was last before planning and that he would review the permit applications as soon as possible.

 

No further comment.

 

  1. Pedestrian Tunnel-Reuben Bell Drive: Mr. Schneider addressed the Board and stated there is a water issue in the pedestrian tunnel at Reuben Bell Drive. Discussion followed regarding the water issue and possible lighting in the tunnel.

 

A motion was made by Supervisor Fischer to send a letter to ask Penn DOT to ask the department to take a visual of the drainage issue at the tunnel for remedy and to repair damage to the fence by the trailer park for security purposes. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

A motion was made by Supervisor Fischer to approve the Highway Department Report for April, 2019. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

BUILDING/ZONING REPORT:  Jeff Cammerino gave the report for April, 2019 which reflects the following:

10 Building Permits totaling $6,662.80 in fees; 1 Electrical Permit totaling $124.50; 2 Zoning Permits totaling $150.00. Total Fees received for the month of April, 2019.

A motion was made by Supervisor Fischer to approve the Building/Zoning Report for April, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.

EMERGENCY MANAGEMENT: Mr. Fischetta gave the report for April, 2019 which reflects the following:

There were no calls for service for the month of April, 2019. Mr. Fischetta met with Mr. Schneider on April 9th to review some specific areas of the Township that could be affected by different types of emergencies.  He also did a walk though for the sewage treatment facility.  He met with Mr. Schneider again at the township garage and went over some of the equipment and resources that are available locally from Westfall Township.

A motion was made by Supervisor Fischer to approve the Emergency Management Report for the month of April, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.

OLD BUSINESS:

            A motion was made by Supervisor Schaldonat to schedule/advertise a Public Hearing for the proposed Cable

Company Contract/Franchise Agreement Ordinance for June 3, 2019 at 6:30 pm.  The motion was seconded

by Supervisor Fischer and carries with all in favor.

Solicitor Bernathy confirmed with all that there were no bidding contractors or any interested parties present. Secretary Manheim opened each sealed bid for each project and read the bid amounts. She also confirmed with Solicitor Bernathy the bid bond amount of 10% of the total bid amount by each contractor for each project.  The results were as follows:

4. Sewer Line Extension-Addendum to Intergovernmental Agreement: A motion was made by Supervisor Fischer to approve the Addendum to the Intergovernmental Agreement to add Matamoras Borough to the Agreement. The motion was seconded by Supervisor Bostinto and carries with all in favor.

5.Pike Health Properties, LLC-Nursing Home/Assisted Living Center: Discussion followed regarding Township Engineer Inspections. Secretary Manheim stated that correspondence was received by the project engineer to confirm if township engineer inspections were required. She noted that normally the building inspector handled all building inspections and that the township engineer would be called only in case of an engineering matter or emergency. A motion was made by Vice Chairman Dotey to move forward with the normal procedure of having only building inspections at the Pike Health Properties, LLC Land Development project and to call Kiley Associates, LLC only in the case of any engineering matters/emergencies that may arise. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

NEW BUSINESS:

 

 

A motion was made by Supervisor Fischer to accept Attorney Beecher’s resignation with regret. The motion

Was seconded by Vice Chairman Dotey and carries with all in favor.

Solicitor Bernathy stated that he had a conversation with Attorney Jason Ohliger and that he would be interested in being appointed as Alternate Zoning Hearing Board Solicitor.

A motion was made by Supervisor Fischer to appoint Attorney Ohliger as Alternate Zoning Hearing Board Solicitor at a rate of $100.00 per hour. The motion was seconded by Supervisor Bostinto and carries with all in favor.

March 4, 2019-Regular Meeting Minutes: A motion was made by Supervisor Schaldonat to approve the March 4, 2019 Regular Meeting Minutes.  The motion was seconded by Supervisor Fischer and carries with four in favor and one abstention.  Chairman Melvin abstained since he was absent for the March 4, 2019 meeting.

 

March 18, 2019-Workshop Meeting Minutes:  A motion was made by Vice Chairman Dotey to approve the May 18, 2019 Workshop Meeting Minutes.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Westfall Fire Department: Chief Jacobs gave the report for the month of March, 2019 which reflects the following: Fire Alarms-5; Inside Investigation-1; Outside Investigation-4; Standby-1; Structure Fire-1; Vehicle Accidents-3. The Total calls for March, 2019 were 15.  The total fire calls year to date are 26.

The EMS Report for the month of March, 2019 was as follows: Blooming Grove Township-1; Dingman Township-7; Matamoras Borough-8; Milford Borough-6; Milford Township-3; Orange County-9; Shohola Township-2; Westfall Township-43. Total calls for March, 2019 were 79.  Total EMS calls year to date are 247.

Training for the month: 1 member attended a preventive maintenance class at the PCTC that was 16 hours long; 3 in house drills for a total of 30 man hours.  Training Hours to date-289; 3 members have started the EMT class in March-this class is 188 hours long-2 nights per week with occasional Saturdays and is about 5 months long.

 

The Departments Annual golf outing will now be in memory of Captain John Codichini. This event will be on Saturday, May 18 at the High Point Country Club.  All proceeds will go into a trust named after Captain Codichini.

 

Chief Jacobs thanked the Supervisors and the whole community for their support during this very difficult time.

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for March, 2019 which reflects the following:

*Mr. Schneider met with Mr. Maciak from Penn DOT to measure paving areas of Heaters Hill (top half), Doug Miller Road, Decker Lane and Cherry Court.

*Mr. Schneider met with Joe Hudak, Kiley Associates to locate boring site

*Mr. Schneider met with a representative from the Pike County Conservation District to go over the Bluestone Boulevard project and grant possibilities.

*Cold Patch was done throughout the township

*Maintenance on Equipment/Shop

*Shoulder Work

*Mr. Schneider met with Bonham Equipment to go over new truck body, systems and assembly

*Replaced down signs

*Cleared Culvert pipes and drains

*Cleared stone and anti-skid off of roads-broom being leased

*New pins and hydraulic bushings installed on backhoe

*Mr. Schneider attended the monthly Road Task Force Meeting

*2015 Dodge 5500 in for warranty work

*Cleared property for boring area

*Filled pot holes –Pond Eddy-New bridge is complete-large truck able to cross

 

Discussion followed regarding the Bluestone Boulevard project and the timing of Department of Conservation and Natural Resources.

 

A motion was made by Vice Chairman Dotey to send a letter to the Department of Conservation and Natural Resources to express the urgency of the approval process for the Bluestone Boulevard stream relocation project for the Health, Safety and Welfare of the community. The motion was seconded by Supervisor Fischer and carries with all in favor.

 

A motion was made by Supervisor Schaldonat to approve the Highway Department Report for March, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

BUILDING/ZONING REPORT:  Jeff Cammerino gave the report for March, 2019 which reflects the following:

10 Building Permits and 4 zoning permits for the month of March, 2019 totaling $12,902.90.

EMERGENCY MANAGEMENT: Mr. Fischetta gave the report for March, 2019 which reflects the following:

*No calls for the month of March, 2019

*Westfall EMA became a Weather Ready Nation Ambassador which is a recognition given out by NOAA. The Weather-Ready Nation Ambassador initiative is an effort to formally recognize NOAA partners who are improving the nation’s readiness against extreme weather, water and climate events. .

OLD BUSINESS:

 

  1. Cable Company Contract/Franchise Agreement: Solicitor Bernathy provided a DRAFT Cable Franchise Agreement for review of the Board. This matter was tabled and will be placed on the May 6, 2019 Meeting Agenda.
  2. Revised Engineering Fee Proposal-Salt Storage Shed: A motion was made by Vice Chairman Dotey to approve the revised proposal which includes additional boring for future Highway Department Construction in the amount of $16,480.00. The motion was seconded by Supervisor Fischer and carries with all in favor.
  3. Specification Package for base of proposed salt storage building: This matter was tabled until Kiley Associates, LLC provides the bid package.
  4. Fire Protection Contract-Compliance by Fire Departments: Solicitor Bernathy stated that significant discussion took place at the March 18, 2019 Workshop Meeting. Section 1801 of the Second Class Township Code grants the authority of the Supervisors to provide for fire protection within the township. A motion was made by Supervisor Fischer to de-certify the Mill Rift Fire Department and to have the Westfall Fire Department take over the Mill Rift territory effective May 1, 2019. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
  5. Specification Package for Modification of Township Building/Police Department Relocation: This matter was tabled until Kiley Associates provides the bid package.
  6. Bluestone Boulevard Stream Relocation Project: Discussed earlier in the meeting.

 

NEW BUSINESS:

 

            Mr. Waldron stated his client found a property which he likes for this proposal.  The property has access to

Central sewer and water.  He stated that Zoning Ordinance #124 allows for 15,000 square feet of density per

unit.  This was amended in Ordinance #166 to 2600 square feet of density per unit with a minimum of 6

acres.  His client would like to propose a zoning amendment to decrease the size of the acreage to 4 acres

and asked the Board for their consideration.

Mr. Waldron noted the following:

 

  1. 60 unit proposal
  2. 35’ high garden style apartment proposal
  3. Owner of proposed property is Damec, LLC
  4. Property is located just before Rose Lane on the right-Tax Map #099.00-01-34
  5. Contract of Sale is contingent upon approvals

 

Discussion followed regarding parking requirements and the location of the proposed project.  Mr. Koferl

questioned the location as a possible “land fill” from years ago.  Mr. Swartwood said the property is a

“Superfund site”.  Solicitor Bernathy stated the Board would take the matter under advisement.

 

No further comment.  The Board thanked Attorney Waldron for coming in.

 

SUBDIVISION REVIEW and ACTION:

 

 

A motion was made by Supervisor Fischer authorizing Solicitor Bernathy to prepare and send a letter requesting certifying that all conditions have been met. The motion was seconded by Vice Chairman Dotey

and carries with all in favor. .

NOTICE TO RESIDENTS OF MATAMORAS AND PARTS OF WESTFALL TOWNSHIP

The Matamoras Water Authority will begin flushing their hydrants on

May 13, 2019.  Flushing will be done between 8 pm to 6 am each day

until completed.  Water may be discolored during this period.

WESTFALL TOWNSHIP

The Westfall Township Supervisors will be accepting a specification package proposal from experienced contractors for future bidding of a project to remodel the lower level of the Westfall Township Building. Project layout is available at the Township Office at 102 LaBarr Lane, P.O. Box 247, Matamoras, PA 18336. Contractors submitting proposals are exempt from future bidding for said project.  The Township reserves the right to reject any and/or all proposals.   Deadline for sealed specification package proposal is May 16, 2019 at 3:00 pm by mail or in person.  Sealed specification proposals will be opened at a Special Supervisor Meeting scheduled for May 20, 2019 at 7:00 pm.

MEETING NOTICE

Please take notice that the Westfall Township Board of Supervisors will hold a Special Meeting on Monday, April 29, 2019 at 7:00 pm for the purposes of accepting resignations of Auditor, Zoning Hearing Board and Municipal Authority Board positions and conducting appointments of the vacant positions.  The Board will also conduct any other business that may come before them. PUBLIC NOTICE

Notice is hereby given that the Westfall Township Zoning Hearing Board will hold a Public Hearing on an Application filed by Centerline Communications, LLC for a special exception and variance to construct a commercial communications tower on property owned by Lawrence and Carolyn Oellerich located at 111 Westfall Town Drive (Farm Plus property).
The special exception approval is required under Section 306.B.1b. of the ordinance for property located in the C-2 Zoning District.  The variance requests a reduction of the required set back of the tower from all lot lines or similar rights-of-way a distance equal to at least 125 percent of the total height of the tower under Section 402.16.b.1.
Said hearing is to be held at the Westfall Township Municipal Building, Labarr Lane, Westfall, Pike County, Pennsylvania at 6:00 p.m. on Tuesday, April 30, 2019.
