The Regular meeting of the Westfall Township Board of Supervisors was held Monday, October 7, 2019 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.
Those present were Chairman, Robert Melvin; Vice Chairman, Jerry Dotey; Supervisors; Robert Bostinto and Paul Fischer; Solicitor; Robert Bernathy; and Secretary, Jodi Manheim; Zoning Officer, Jeff Cammerino. Also present were Road Master, Bill Schneider; EPRPD Chief; Chad Stewart; Westfall Township Fire Department Assistant Chief; Mike Pflanz; Emergency Management Coordinator, Mike Fischetta; Larry Oellerich; Mike Gable, Boucher & James; Pat Moran, Phantom Fireworks; MaryAnn Hubbard; Penn State Extension; Joseph Pereira, AT&T; Robert Kidwell; and three members of the general public.
Supervisor, Paul Schaldonat was absent.
EXECUTIVE SESSION: The last executive session was held on and August 5, 2019 at 6:45 pm for litigation.
APPROVAL OF AGENDA:
A motion was made by Supervisor Bostinto to approve the agenda with no changes. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

September 9, 2019-Regular Meeting Minutes: A motion was made by Vice Chairman Dotey to approve the September 9, 2019 Regular Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with all in favor.
September 16, 2019-Joint Meeting Minutes: A motion was made by Supervisor Fischer to approve the September 16, 2019 Joint Meeting Minutes. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
TREASURER’S REPORT: Scott Myer gave the report through September, 2019. A motion was made by Supervisor Bostinto to approve the Treasurer’s Report through September, 2019. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

WESTFALL FIRE DEPARTMENT REPORT: Assistant Chief Pflanz gave the report for the month of September, 2019 which reflects the following: Assist EMS-2; Automatic Fire Alarms-7; Environmental Rescue-1; Investigation Chief-1; Investigation-2; MVA-4; Structure Fire-4

Training for the month: 4 in house drills for total of 83 training hours; 1 member is currently enrolled in part 1 of 2 of vehicle extrication class at the pike county training center which is a total of 48 hours; 9 members attended the Orange County Parade which was also Warwick FDs 150th celebration. The members came home with 2nd best appearing out of county apparatus; we now have both ambulances back from all major repairs
A motion was made by Supervisor Fischer to approve the Westfall Fire Department report for the month of September, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.
HIGHWAY DEPARTMENT: Mr. Schneider gave the report for September, 2019 which reflects the following:
- Driver Training on new Peterbilt
- Cold Patching throughout the Township
- Trimming and mowing of Township Right of Way
- Doug Miller Road and Decker Lane Paving-shouldering done
- Trench dug for cable line to sub-station for police department
- Maintenance on shop/door repair
- Maintenance on equipment
- Repair drainage ditches
- Mr. Schneider met with the Penn Dot Representative to review paving projects for 2020
- Mr. Schneider attended the monthly Road Task Force Meeting
- Mr. Schneider met with the Workers Comp Insurance Representative for shop inspection
- Worked on salt shed area/brush-chipper
- New tires on 2015 Dodge 450
- Pedestrian Tunnel has been painted
A motion was made by Vice Chairman Dotey to approve the Highway Department Report for September, 2019. The motion was seconded by Supervisor Fischer and carries with all in favor.
BUILDING/ZONING REPORT: Jeff Cammerino gave the report for September, 2019 which reflects the following:
7 Building Permits totaling $4,687.50; 1 Mechanical Permit totaling $124.50; 3 Zoning Permits totaling $425.00. Total Fees collected $5,237.00.
A motion was made by Supervisor Fischer to approve the Building/Zoning Report for September, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Chairman Melvin thanked Mr. Cammerino enforcing the sign ordinance and cleaning up illegal signs.
EMERGENCY MANAGEMENT: Mike Fischetta gave the report for September, 2019. There were no calls for the month of August, 2019. EMA was scheduled to attend a joint emergency services meeting with the National Park Service on October 2nd which was postponed due to an emergency in the park. Work is continuing on the Township EOP and we will be submitting an application this month to the National Weather Service to be recognized as a Storm Ready community. Mr. Fischetta will be updating the Supervisors during this process on the progress of the application.
For informational purposes there will be siren maintenance and testing for the emergency warning sirens in Matamoras Borough on October 31st. This will be conducted by Matamoras EMA. Some township residents may hear short activations throughout the day.
A motion was made by Vice Chairman Dotey to approve the Emergency Management Report for the month of September, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.

OLD BUSINESS:
2008 Chevrolet Truck Bid Proposals: Chairman Melvin opened the one bid received. The bid was from Center RV, Inc.-Mike Veneziano in the amount of $4,107.00.
A motion was made by Supervisor Fischer to reject the bid due to failure to meet the minimum bid amount of $8,500.00. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
Brief discussion followed.
A motion was made by Supervisor Fischer to re-advertise the vehicle in the Pike County Dispatch, Pocono Record and Times Herald Record with a minimum bid amount of $5,000.00 with the same specifications as previously advertised with a bid cutoff date of October 31, 2019 at 3:00 pm. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Freightliner-Advertise for Sale: No bids were received. A motion was made by Supervisor Fischer to advertise the Freightliner for Sale on the Municibid website with a reserve of $30,000 with a bid ending date of October 31, 2019. Bids to be reviewed for disposition at the November 4, 2019 Regular Supervisor Meeting.
NEW BUSINESS:
Pike Health Properties/Westfall Senior Center-Bond Release Request No. 1: A letter dated September 10, 2019 was received by Kiley Associates, LLC to confirm inspection and work completed. A motion was made by Vice Chairman Dotey to approve the bond reduction request No. 1 in the amount of $102,314.68 with a remaining bond amount of $1,249,410.54. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Pike Health Properties/Westfall Senior Center-Bond Release Request No. 2: A letter dated October 2, 2019 was received by Kiley Associates, LLC to confirm inspection and work completed. A motion was made by Vice Chairman Dotey to approve the bond reduction request No. 2 in the amount of $15,040.47 with a remaining bond amount of $1,234,370.08. The motion was seconded by Supervisor Fischer and carries with all in favor.
Penn State Extension Presentation-MaryAnn Hubbard, Representative: Ms. Hubbard presented a folder to each Supervisors with several programs to work together with and to assist with different matters within the Township. The folder was placed out for public inspection at the Township Office.
Non-Uniform Pension Plan-Minimum Municipal Obligation: Chairman Melvin stated Roth & Roth, Inc., Non-Uniform Pension Plan Actuary has provided the Minimum Municipal Obligation for 2020 which shows zero. He noted the plan is fully funded at this time with no funding obligation to the township.
No action taken.
Mill Rift Fire Department-Outstanding Invoices: A motion was made by Supervisor Fischer to approve payment of the Verizon Phone Invoice in the amount of $250.59 and the Rohrer Bus Invoice in the amount of $69.56. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
A motion was made by Supervisor Fischer to discontinue the Verizon Phone services to the Mill Rift Fire Station after final payment has been received. The motion was seconded by Supervisor Bostinto and carries with all in favor.
A motion was made by Vice Chairman Dotey to approve payment of fuel oil purchase from Deer Park Oil for heating of Mill Rift Fire Department Building and Sub Station adjacent to Township Building not to exceed the amount of $2,500.00. The motion was seconded by Supervisor Fischer and carries with all in favor.
SUBDIVISION REVIEW and ACTION:
TowerNorth Land Development-Cell Tower Plan-Letter from Planning Commission dated September 26, 2019: Representative: Joseph Pereira, AT&T
Mr. Pereira explained the plan to the Board. It was noted there will be no impact to adjacent property owners, fenced in facility, non-lit tower and enhancement to communications. Mr. Pereira explained the lightning suppression. He noted the following:
- Tower is grounded
- Lightning rod, antenna and cable and separately grounded
- Perimeter of property is protected
- Grounding rods in place for each carrier
He also noted there will be a small generator for AT&T for emergency services and that all systems have battery backup for 6 to 20 hours. Mr. Pereira also noted there are no other towers in the area to accommodate AT& T and to provide service to this area.
There were no objections from the public.
A motion was made by Vice Chairman Dotey to approve the TowerNorth Land Development Plan with the following conditions:
- All comments on Kiley Associates, LLC review letter dated September 19, 2019
- All conditions set forth in Special Exception Zoning Hearing held on July 24, 2019
- Pike County Planning Agency review and approvalThe motion was seconded by Supervisor Fischer and carries with all in favor.Phantom Fireworks Land Development Plan and Lot Consolidation Plan-Letter from Planning Commission dated September 26, 2019: Representatives: Robert Kidwell, Solicitor; Pat Moran; Michael Gable, Boucher & James, Inc.Mr. Kidwell addressed the Board and explained the plan which is to add a 4200 square foot storage building to the property. Mr. Gable explained the Land Development Plan and the Lot Consolidation Plan. He stated the Lot Consolidation Plan was completed in the past but a deed was never recorded. Mr. Kidwell provided a Draft Lot Combination Deed to Solicitor for review.Chief Stewart asked if there would be an alarm and if so, an alarm permit will be required prior to obtaining a Certificate of Occupancy. The Board added condition “L” to the list of conditions of approval.A motion was made by Vice Chairman Dotey to approve the Phantom Fireworks Land Development Plan and Lot Consolidation Plan with the following conditions:
- Proposed Lot Combination Deed to be submitted to the Township for review and approval by the Township Solicitor
- All comments listed on the Kiley Associates, LLC review letter dated April 5, 2019
- Applicant to provide confirmation of no percussion fireworks to be stored in the proposed structure
- Sprinklers are required
- Applicant to provide study to confirm impact on adjacent properties in event of explosion including projectile impact
- Automatic Roof Vents required
- Applicant to provide study confirming blow out walls and design to accommodate explosion
- Water Authority verification of gallonage and pressure
- 24 hour video surveillance of entire site including interior and exterior
- 30 day recording to be preserved of surveillance areas
- Conditional upon Pike County Planning Office review
- Alarm system to be installed in proposed building and alarm permit shall be obtained before issuance of Certificate of Occupancy.
The motion was seconded by Supervisor Bostinto and carries with all in favor.
EXECUTIVE SESSION: An executive session was called at 7:43 pm for the purposes of personnel matters.
The meeting was called back to order at 7:56 pm. No further action taken and no decisions made.

A motion was made by Supervisor Bostinto to approve the agenda with no changes. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
PUBLIC COMMENT: Mr. Dalton addressed the Board and referred to a letter he submitted to the Township regarding a parking issue which took place on Pond Drive in early August. He asked the Board to consider a “No Parking” Ordinance. Vice Chairman Dotey explained there was an anniversary party held at one of the residences on Pond Drive and that it was a temporary situation. He then stated the Board would take the matter into consideration.
Discussion followed. Solicitor Bernathy stated that input from the Township Engineer would be needed and that the Board would need to understand all conditions of the situation. If an ordinance were to be put in effect, it would be township wide. Solicitor Bernathy appreciated Mr. Dalton’s concern. He also confirmed with the Jodi Manheim that no other complaints were received. Vice Chairman Dotey stated the people parking moved after they were directed by the Police Department.
Brief discussion followed.
Solicitor Bernathy confirmed the incident did not result in any injury or accident. He confirmed with Mr. Dalton there was no total obstruction of the road. Solicitor Bernathy once again, stated his appreciation

August 5, 2019: A motion was made by Supervisor Schaldonat to approve the August 5, 2019 Regular Meeting Minutes. The motion was seconded by Supervisor Bostinto and carries with three in favor and one abstention. Supervisor Fischer abstained due to his absence at the meeting.
TREASURER’S REPORT: Scott Myer gave the report through August, 2019. He noted that income and expenses are in line for this time of year.
A motion was made by Supervisor Fischer to approve the August, 2019 Treasurer Report. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

WESTFALL FIRE DEPARTMENT REPORT: Assistant Chief Pflanz gave the report for the month of August, 2019 which reflects the following: Assist Police-1; Automatic Fire Alarms-6; Brush fire-1; Flooding Condition-1; Landing Zone-2; MVA-6; Structure Fire-2; Water Rescue-1; Vehicle Fire-1; The total fire calls- 32.

We will be attending the orange county fireman’s parade in Warwick on Saturday September 28 with engine one.
We have been awarded the 2018 FEMA Assistance to firefighter’s grant which will help us replace all of our aging SCBAs (18).

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for August, 2019 which reflects the following:
- Tree Trimming/Right of Way Clearing throughout the township
- Pot hole filling throughout the township
- Bush hog on Bluestone Boulevard, Cummins Hill Road, Old Milford Road, Pine Hill Farm Road and Roberts Lane
- Installed culvert pipe on Sand Pit Road
- Remove tree on Doug Miller Road
- Removed trees for Salt Shed Base construction
- New Peterbilt back to Bonhams for adjustments on equipment
- Paving complete on Decker Lane on Saturday
- Paving being done on Doug Miller Road today-being completed tomorrow

Salt Shed Upper Portion of Structure-Clear Span Quote: A motion was made by Supervisor Schaldonat to approve the purchase of the Salt Shed Upper Portion of Structure from Clear Span Fabric Structure International through the Sourcewell Program as per the quote dated August 8, 2019 in the amount of $45,754.00. The motion was seconded by Supervisor Fischer and carries with all in favor.

Mill Rift Substation adjacent to Township Building: A motion was made by Vice Chairman Dotey to approve the Eastern Pike Regional Police Department to occupy the substation next to the Township Building in accordance with the same terms of the lease of the lower level of the Township Building with the exception of human occupancy. The building will be used for evidence and vehicle storage only. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
Solicitor Bernathy confirmed with Assistant Chief Pflanz this action will not jeopardize the Westfall Township Fire Department’s service area and will not affect funding for the Department.
NEW BUSINESS:
Penn DOT Winter Maintenance Agreement Renewal: A motion was made by Supervisor Fischer to approve the renewal of the Five Year Winter Municipal Agreement. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
Pike County Association of Township Officials Annual Convention: A motion was made by Vice Chairman Dotey to approve the attendance (Dotey, Fischer and Cammerino) and cost of $200.00 for the Pike County Associations of Township Officials Annual Convention to be held at the Best Western Inn on October 4, 2019. The motion was seconded by Supervisor Fischer and carries with all in favor.
Dirt, Gravel and Low Volume Roads-Training Course: A motion was made by Supervisor Bostinto to approve the cost of $$125.35 for motel cost plus meals, mileage and gas cost for Highway Department Employee, Richard Ransom to attend the training session to be held at the Pine Barn Inn in Danville, PA on October 30 and 31, 2019. The motion was seconded by Supervisor Fischer and carries with all in favor.
Fee Schedule Revision-Resolution: This matter was tabled.
PSATS Unemployment Compensation Group Trust-2019 Ballot for Election of Trustee and Pennsylvania Townships Health Insurance Cooperative Trust-2019 Ballot for Election of Trustee: A motion was made by Supervisor Fischer to vote for Michael Keller for Trustee for the PSATS Unemployment Compensation Group Trust and Pennsylvania Health Insurance Cooperative Trust. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Pike Health Properties, LLC-Collateral Assignment of Development Agreement and Consent to Assignment (Exos Commercial Lending, LLC): A motion was made by Supervisor Schaldonat to approve the Assignment and to execute same at the time Solicitor Bernathy receives the revised Assignment reflecting the revision of Section 7 entitled Choice of Law; Jurisdiction to reflect that the Agreement shall be governed by and construed in accordance with the substantive laws of Pennsylvania rather than New York in the event that any dispute arises from or is related to the assignment of any of the other loan documentation. The motion was seconded by Supervisor Fischer and carries with all in favor.
Application for Part Time Highway Department Employee: A motion was made by Supervisor Fischer to approve hiring Johnathan D. Crawn as a Part Time Highway Department Employee for snow plowing at a rate of $15.00 per hour contingent upon all Employee Manual provisions and a criminal background check. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Secretary Vacation Dates for Approval: A motion was made by Supervisor Schaldonat to approve the following vacation days for Jodi Manheim:

SUBDIVISION REVIEW and ACTION:
Noll-Minor Subdivision: A motion was made by Supervisor Schaldonat to approve the Noll-Minor Subdivision Plan with the following condition:
- Proposed Deed showing easement over Lot 1A to be provided to the Township for review and approval.
- The motion was seconded by Vice Chairman Dotey and carries with all in favor.
Noll-Component 1 Sewage Planning Module: A motion was made by Supervisor Fischer to approve the Component 1-Sewage Planning Module for the Noll Minor Subdivision. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
Pike County Environmental Enterprises, LLC-Land Development Plan: A motion was made by Supervisor Bostinto to approve the Pike County Environmental Enterprises, LLC-Land Development Plan with no outstanding conditions. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
Paddlers Point-Garden Apartments-Conditional Use Application-Schedule Hearing: A motion was made by Supervisor Schaldonat to schedule the Paddlers Point-Garden Apartments-Conditional Use Hearing for Thursday, October 3, 2019 at 7:00 pm. The Regular meeting of the Westfall Township Board of Supervisors was held Monday, August 5, 2019 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.
Those present were Chairman Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Robert Bostinto, Paul Schaldonat; Solicitor; Robert Bernathy; and Secretary, Jodi Manheim; Zoning Officer, Jeff Cammerino. Also present were Road Master, Bill Schneider; EPRPD Chief, Chad Stewart; Westfall Township Fire Department President; Bill Koferl; Westfall Township Fire Department Chief; Fred Jacobs; Emergency Management Coordinator, Mike Fischetta; Joe Hudak, Kiley Associates, Inc; Attorney John Stieh; Mike Gable, Boucher & James, Inc.; Marie Hollberg and approximately 5 members of the general public.
Supervisor Fischer was absent.
EXECUTIVE SESSION: The last executive session was held on May 20, 2019 at 7:29 pm for personnel matters and August 5, 2019 at 6:45 pm for litigation. Chairman Melvin stated no decisions were made.
APPROVAL OF AGENDA:
A motion was made by Vice Chairman Dotey to approve the agenda with no changes. The motion was seconded by Supervisor Bostinto carries with all in favor.
PUBLIC COMMENT: Marie Hollberg, owner of 127 Decker Lane, addressed the Board. She came forward with photos of a problem with her retaining wall and basement regarding flooding. She stated that there has been a re-routing of water onto her property since an adjacent property owner built a home and since the township did some recent pipe work. Solicitor Bernathy stated this matter seems to be a trespass of water issue between she and her neighbor and suggested Ms. Hollberg hire legal counsel. Brief discussion followed. Solicitor Bernathy then suggested Ms. Hollberg hire a professional to prove the source of the water and then come back to the Supervisors with the information.
No further comment.

July 1, 2019-Regular Meeting Minutes: A motion was made by Vice Chairman Dotey to approve the July 1, 2019 Regular Supervisor Meeting Minutes. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
July 9, 2019-Special Meeting Minutes: A motion was made by Supervisor Bostinto to approve the July 9, 2019 Special Meeting Minutes. The motion was seconded by Supervisor Schaldonat and carries with three in favor and one abstention. Chairman Melvin abstained since he was absent for the meeting.
TREASURER’S REPORT: Scott Myer gave the report for June, 2019 and through July, 2019.
Chairman Melvin stated he had a meeting with Mr. Myer regarding the proposed 2020 budget items. He noted all is on track to lower mils and will be discussed at the budget workshops.
A motion was made by Supervisor Schaldonat to approve the June, 2019 and July, 2019 Treasurer Reports. The motion was seconded by Supervisor Bostinto and carries with all in favor. `

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for July, 2019 which reflects the following:
- Pot Hole Patching done within the township
- Culvert Pipe Replacment on Old Milford Road and Glass House Hill
- Lawn Maintenance Done at municipal grounds
- Sign/Repair Replacement
- Tended to heavy storms-tree clean up and wires down
- Cleaned culvert pipes and ditches after storms
- Maintenance done on equipment
- New truck has arrived-training
- All poles for traffic lights removed from 6 & 209
- Meeting was held with Pike County Light and Power regarding new gas lines in Westfall Township-Stella, James, Elizabeth Streets and Blue Ridge Avenue

A motion was made by Vice Chairman Dotey to approve the Highway Department Report for July 2019. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
BUILDING/ZONING REPORT: Jeff Cammerino gave the report for July, 2019 which reflects the following:
9 Building Permits totaling $7,324.50 in fees; 4 Zoning Permits totaling $475.00. Total Fees received for the month of July, 2019; $7,399.50. Total Outstanding Fees: $475.00
A motion was made by Supervisor Schaldonat to approve the Building/Zoning Report for July, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.
EMERGENCY MANAGEMENT: Mike Fischetta gave the report for July, 2019. There were no calls for the month of July, 2019. A significant storm passed through the area on July 26, 2019. After the storm EMA toured some of the affected areas of the Township and did a damage assessment. During that event EMA was on scene of a large tree down across Delaware Drive that was blocking the roadway in both directions and coordinated with PENN DOT and Comm Center as to when the roadway would be reopened. Notification was made through social media as well as the fire department.
A motion was made by Chairman Melvin to approve the Emergency Management Report for the month of July, 2019. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

OLD BUSINESS:
Salt Shed Base-Proposal Bids: Three sealed bids were received in accordance with the advertising requirements. Chairman Melvin opened each bid envelope and read each bid. The bids were as follows:
- Lattimore Construction, Inc.- $228,000.00
- Morgan Site Contractors-$106,453.22
- NE SODEN, INC.-109,850.00
Solicitor Bernathy asked if anyone in the audience was present from the bidding contractors. No one was present.
A motion was made by Supervisor Schaldonat to award the bid to Morgan Site Contractors, Inc. in the amount of $106,453.22 contingent upon township engineer review with official notification to be given and if bid is not completed in accordance with bid requirements provided, a special meeting of the Supervisors will be scheduled. The motion was seconded by Supervisor Bostinto and carries with all in favor.
2008 Chevrolet Truck Bid Proposals: Chairman Melvin opened the one bid received. The bid was from Center RV, Inc.-Mike Veneziano in the amount of $5,107.00.
A motion was made by Supervisor Schaldonat to reject the bid due to failure to meet the minimum bid amount of $12,000.00. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Brief discussion followed.
A motion was made by Supervisor Schaldonat to re-advertise the vehicle in the Pike County Dispatch, Pocono Record and Times Herald Record with a minimum bid amount of $10,000 with the same specifications as previously advertised with a bid cutoff date of September 5, 2019 at 3:00 pm. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Emergency Access Road-Cost Proposals: Three contractors were contacted by phone to submit written quotes. Two written proposals were received. Chairman Melvin read both proposals which were as follows:
- Morgan Site Contractors in the amount of $20, 398.00
- Lattimore Construction in the amount of $37,500.00
Chairman Melvin stated the scope of work is the same for both bidders.
A motion was made by Vice Chairman Dotey to approve the lowest cost proposal which is from Morgan Site Contractors in the amount of $20,398.00 subject to the contractor signing a contract prepared by Solicitor Bernathy. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
Flood Gate Demonstration: A motion was made by Supervisor Bostinto to remove this item from the agenda. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
Advertise Joint Workshop Budget Meeting with Matamoras Borough: A motion was made by Supervisor Schaldonat to advertise the meeting for September 16, 2019 @ 7:00 pm in accordance with the Regionalization Agreement amendment. The meeting will be held at the Westfall Township Municipal Building. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
Township Building Remodel-Relocation of EPRPD: Vice Chairman Dotey stated all is going well with the project. He noted that 90% of the drywall is up and the electrical work is being finalized. The concrete work has also been done.
No action taken.
Emergency Services-Meeting with Samaritan EMS: Chairman Melvin explained the township has been contacted by Samaritan EMS to meet to discuss EMS Services in Pike County. A meeting will be coordinated and held in the near future which will be attended by Vice Chairman Dotey.
NEW BUSINESS:
Freightliner-Advertise For Sale: This matter was tabled.
Mill Rift Substation adjacent to Township Building: Vice Chairman Dotey stated this matter needs to be coordinated at the time the Eastern Pike Regional Police Department relocates. Whether the building will be used for the Police Department or the Fire Department will need to be decided. Chairman Melvin stated his concern from a hazard insurance coverage stand point. Mr. Koferl stated the equipment stored in the building covers this end of Mill Rift and the department needs one bay for a deep truck. Solicitor Bernathy stated the dissolution is still in process and needs to be finished.
This matter was tabled until the September 9, 2019 Supervisor Meeting.
Zoning Ordinance-Temporary Use Permit: Vice Chairman Dotey suggested extending the time limit for temporary use food cart zoning permits. Solicitor Bernathy suggested the Board involve the Planning Commission and put some more thought into it. Mr. Cammerino stated an amount of vendors could be regulated. Mrs. Manheim stated there have been many inquiries regarding this use. Chairman Melvin showed concern of impacting the businesses who pay taxes to the township. Brief discussion followed. Vice Chairman Dotey stated that no changes should be made to the ordinance at this time.
No action taken.
2018 Financial Statement Approval: Chairman Melvin stated the draft submitted by Kirk Summa & Co. is materially correct with no major findings.
A motion was made by Supervisor Schaldonat to approve the draft 2018 Financial Statement. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Schedule Budget Workshop Meetings: A motion was made by Vice Chairman Dotey to schedule the budget workshop meetings for October 9, 2019 and October 16, 2019 with both meetings to be held at 7:00 pm. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
Letter of Support from Planning Commission Re: Monroe County Local Share Grant Application: A motion was made by Vice Chairman Dotey to approve the application and letter of support. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Monroe County Local Share Grant Submission-Resolution 2019-2: A motion was made by Supervisor Bostinto to approve Resolution 2019-2. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
United Way Day of Caring: A motion was made by Supervisor Bostinto to decline the invitation and to send a thank you letter to the Delaware Valley School District. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
SUBDIVISION REVIEW and ACTION:
Westfall Town Center-Grocery Store-Land Development: Representatives: Attorney John Stieh and Michael Gable, Boucher & James
The Board was in receipt of a recommendation letter dated July 24, 2019 from the Planning Commission.
Mr. Stieh explained the project and noted the following:
- The proposal location is the previous Kmart store in the Westfall Town Center
- 70,000 square feet will be a grocery store
- 40,000 square feet will be retail space
- Truck access is being amended
- 2 new loading ramps are proposed
Mr. Gable explained the traffic pattern change and loading dock additions. It was noted that approval from Pike County Conservation District and the Pike County Planning Office have been obtained.
Brief discussion followed regarding lighting. Mr. Gable stated the lighting will all be fixed when the tenant occupies the space.
Solicitor Bernathy stated there are no other issues and no conditions.
A motion was made by Vice Chairman Dotey to approve the Westfall Town Center-Grocery Store-Land Development application with no conditions. The motion was seconded by Supervisor Bostinto and carries with all in favor.

- Specification Package for base of proposed salt storage building: The Board is still waiting for the specification package from Kiley Associates, LLC for advertising. This matter was tabled until the next Special Meeting.
A motion was made by Vice Chairman Dotey to schedule/advertise a Special Meeting for the purposes of discussing the Specification Package for base of proposed salt storage building and any other business that may come before the board for Tuesday, June 9, 2019 at 7:00 pm. - Modification of Township Building/Police Department Relocation: Vice Chairman Dotey stated one quote was received from the one contractor that responded to the township after calling the three contractors which is required by Second Class Township Code. A written quote was received from Thomas Lamb, Contractor, at a rate of $30.00 per hour for approximately 150 to 200 hours to include the electrical work at a rate of $35.00 per hour for approximately 40 hours. Most (90%) of the materials needed for the job will be purchased by the Township from the Home Depot at a discounted rate of $3,979.00. It was noted that the cost of the labor and material would comply with the Second Class Township Code Sections 3102 (a) and (b.1).
A motion was made by Vice Chairman Dotey to approve the written quote from Thomas Lamb at a rate of $30.00 per hour for approximately 150 to 200 hours to finish the lower level of the township building to include the electrical work at $35.00 per hour for approximately 40 hours subject to the Contract prepared by the Township Solicitor and for the purchase of the materials from Home Depot at approximately $3,979.00. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
- Pedestrian Tunnel: Discussion was held regarding graffiti in the tunnel and tunnel drainage. It was noted that Mr. Shay has agreed to assist with placing a drainage pipe to alleviate the water issue. Discussion followed regarding the possibility of having Eagle Scouts volunteer to paint. Mrs. Manheim was directed to contact the Township’s Insurance carrier to check the coverage for volunteers. Chairman Melvin stated this matter is not urgent at this time and there are many projects of more importance to be done.
Mr. Schneider agreed to obtain a price on graffiti-proof paint. This matter was tabled.
- Emergency Access Road: Mr. Schneider stated he has a specification sheet and will obtain three quotes from contractors next week. This matter was tabled.
- Act 537 Special Study-Letter and Survey to Residents: Chairman Melvin explained a letter will be sent to the residents regarding the sewer expansion project. The draft letter was sent to the Board for review and approval.
A motion was made by Chairman Melvin to approve the project as designated. The motion was seconded by Supervisor Fischer and carries with all in favor.
- Easement Agreement: Solicitor Bernathy provided the Easement Agreement for the Heaters Hill Emergency Repair to the Board for disposition. He also thanked Mr. and Mrs. Ellison for the easement.
A motion was made by Supervisor Bostinto to approve the Easement Agreement for signatures. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
NEW BUSINESS:
- Amendment #1 to Pike County Scenic Rural Character Preservation Program Grant Contract: A motion was made by Supervisor Fischer to approve the Amendment #1 to the Pike County Scenic Rural Character Preservation Program Grant Contract. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- 2009 Chevy Silverado -350 4X4: Brief discussion followed. A motion was made by Supervisor Schaldonat to approve the sale/advertising of the vehicle including plow and spreader with a minimum bid of $12,000 with sealed bids to be opened at the August 5, 2019 Regular Supervisor Meeting. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Plow Driver Application: A motion was made by Vice Chairman Dotey to hire Mr. James Scheuer as a part time snow plow driver at a rate of $15.00 for a non CDL Driver per hour subject to a background check and all requirements in the Township Employee Manual. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Grant Writer Services-Contract: Solicitor Bernathy reviewed the contract submitted by Mr. James Martin at a cost of $1,250.00. A motion was made by Supervisor Fischer to approve the contract at a rate of $1,250.00 with Mr. Martin. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Flood Gate Demonstration: Mr. Schneider explained that within the next two weeks there will be demonstration by Morgan Site Contractors of the flood protection system. This matter was tabled and will be placed on the agenda for the July 9, 2019 Special Meeting.
- Flood Insurance Renewal: Discussion followed. The insurance coverage is only for building coverage and not contents. Mrs. Manheim was directed to contact the township insurance agent to check the availability of content coverage. This matter was tabled until the July 9, 2019 Special Meeting.
- Correspondence from Pioneer Construction-Delaware Drive Construction/Mill Rift: Chairman Melvin read the letter regarding the one lane closure in Mill Rift due to slide remediation to make the public aware of the situation. No action required.
- Pike County Light and Power Light –Six Month Update: Mr. Grandinali gave a six month update to the Board and noted the following:
- Fully staffed-four customer service representatives
- Full underground and overhead crew
- Gas technician on call
- Focusing on the main line which is the back bone of the electric system
- Inspected over 1700 poles
- Will be replacing over 500 poles
- Tree trimming completed
- Drone flew over service territory looking for hot spots and top of pole inspections
The Board thanked Mr. Grandinali for the update.
- Letter from Ms. Houlden regarding Reuben Bell Drive: Chairman Melvin read the correspondence regarding the request of center line painting on Reuben Bell Drive. Brief discussion followed.
A motion was made by Chairman Melvin to send a response letter to Ms. Houlden to thank her for bringing this matter to the Board’s attention but the Second Class Township Code does not require lines to be painted and that there was no line painted previously on Reuben Bell Drive. The motion was seconded by Supervisor Bostinto and carries with all in favor.

Westfall Township – Salt Shed
Westfall Township Board of Supervisors are soliciting bids for construction of new salt shed. The following Project Description is based on information currently available. Each Bidder should evaluate the work involved prior to submission of a proposal. The project briefly described is:
Construction of a foundation for a 25’ x 40’ salt shed with gravel access and turnaround at the Westfall Township Municipal Complex.
Bid packages may be obtained at Kiley Associates, LLC, 536 Purdytown Turnpike, Lakeville PA 18438; 570-226-5810, during normal business hours, 8:30 AM to 4:30 PM weekdays. A NONREFUNDABLE fee in the amount of Ten Dollars ($10.00) is required for one electronic et of the Project Documents. All checks shall be made payable to Kiley Associates, LLC. A Prevailing Wage determination has been requested from the PA Department of Labor and Industry and Prevailing Wage Rates apply to this project. The determination is included in the complete RFP.
Westfall Township will receive bids until 3:00 PM, Friday, August 2, 2019 at the office of Kiley Associates, LLC, 536 Purdytown Tpke., Lakeville, PA 18438.Bids received after the specified time will not be accepted. Bids will be publicly opened and read aloud during the regular meeting of the Westfall Township Supervisors at 7:00 PM on Monday, August 5, 2019. Bids may be held by the Supervisors for a period not to exceed seven (7) days from the date of Bid Opening for the purpose of reviewing the Bids and investigating the qualifications of the Bidder, prior to the award of the Contract. Westfall Township will award the bid to the lowest responsible bidder, reserving the right to waive any informality and accept or reject any and all Bids. A bid bond for 10% of the bid amount shall be provided with the bid. Performance and Payment bonds in the amount of 100% of the contract amount shall be provided by the successful bidder within 20 days of the award. The sealed bids must be marked “Westfall Township Salt Shed”.
Any Requests for Information (RFI) must be directed to Kiley Associates, LLC, and include specific identification of the Project by name. All inquiries must be made in writing; email inquiries are acceptable. No inquiries will be accepted after Friday, July 26, 2019 at 4:00 PM.
