The Regular meeting of the Westfall Township Board of Supervisors was held Monday, January 6, 2020 at 7:30 pm just following the Organization Meeting. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Robert Bostinto and Paul Schaldonat; Attorney Chris Weed for Solicitor Robert Bernathy; and Secretary, Jodi Manheim. Also present were Road Master, Bill Schneider; Zoning Officer, Jeff Cammerino; EPRPD Chief, Chad Stewart; Westfall Township Fire Department Chief, Fred Jacobs; Westfall Township Fire Department President, Bill Koferl; Treasurer, Scott Myer; Peter Dynda; Cliff Spalding and John Dalton.  There were approximately 6 members of the general public present.

Supervisor Paul Fischer was absent.

APPROVAL OF AGENDA:

A motion was made by Vice Chairman Dotey to approve the agenda with no revisions. The motion was seconded by Supervisor Bostinto and carries with all in favor.

PUBLIC COMMENT: No public comment.

MINUTES:

December 10, 2019-Regular Meeting Minutes: A motion was made by Supervisor Schaldonat to approve the December 10, 2019 Regular Meeting Minutes.  The motion was seconded by Supervisor Bostinto and carries with three in favor and one abstention.  Chairman Melvin abstained due to his late arrival at the meeting.

TREASURER’S REPORT: Mr. Myer gave the report through the month of January, 2020.

Discussion was held regarding the financial shape of the township. Chairman Melvin stated the township is in good shape going into the New Year.  He noted that since the Earned Income Tax has been implemented, tax mills have been lowered 30%.

A motion was made by Vice Chairman Dotey to approve the Treasurer’s Report through the month of January, 2020. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

POLICE REPORT:  Chief Stewart gave the report for the month of December, 2019.  The report reflects the following:

*Participated/Traffic Control in Christmas Parade

*Conducted Traffic Control for Jingle Jog

*Moved into Westfall Township Building

Miles patrolled: 5,697

A motion was made by Vice Chairman Dotey to approve the December, 2019 Police Report. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

Chairman Melvin asked Chief Stewart to provide a punch list of any items which need to be done to the Police Department Space.

WESTFALL FIRE DEPARTMENT: Chief Jacobs gave the report for the month of December, 2019 which reflects the following:  2 Assist EMS; 4 Automatic Fire Alarms; 1 Haz Mat; 3 Investigation Chief; 3 Investigation Inside; 1 Investigation Outside; 6 Motor Vehicle Accidents; 5 Structure Fires; 1 Water Rescue; 3 Wires Down.

Total Calls for December, 2019 were 29; Year to Date calls 278; Man Hours 46.91; Year to Date Man Hours 519.91

The EMS Report for the month of December, 2019 was as follows: Delaware Township-1; Dingman Township-14; Matamoras Borough-16; Milford Borough-11; Milford Township-9; Orange County-9; Shohola Township-4; Westfall Township; 53

Total EMS calls for December, 2019: 117

Total year to date EMS calls: 1162

Man Hours: 270

Training for the month: 3 in house drills for a total of 54 training hours

Chief Jacobs submitted EMS and FIRE 2019 yearly percentage statistic reports to the Board.

Discussion followed regarding emergency service calls.

A motion was made by Vice Chairman Dotey to send a follow up letter to the Pike County Commissioners regarding emergency services issue. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

A motion was made by Vice Chairman Dotey to approve the Westfall Fire Department report for the month of December, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for December, 2019 which reflects the following:

*maintained roads after two small storms

*maintenance on vehicles

*salt and anti-skid deliveries

Discussion followed regarding Bluestone Boulevard project. Chairman Melvin directed Jodi Manheim to add scheduling a workshop meeting to the February meeting agenda and to invite Kiley Associates, LLC.

A motion was made by Supervisor Schaldonat to approve the Highway Department Report for December, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.

BUILDING/ZONING REPORT:  Jeff Cammerino gave the report for December, 2018 which reflected the following:  1 Electrical Permit-Total Fees $124.50 and 2 Zoning Permits-Total Fees $400.00.  Total fees collected for the month of December, 2019 was $524.50.

A motion was made by Vice Chairman Dotey to approve the Building/Zoning Report for December, 2019. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

 

EMERGENCY MANAGEMENT: Mr. Fischetta gave the report for December, 2019 which reflects the following:

*No calls for the month of December

*The construction on Delaware Drive has been cleared for the season and both lanes are open. They will resume construction in July.

*The department has been in contact with Matamoras Borough EMA and were asked to partner together and come up with a coordinated plan for the warning sirens, their activations and what they mean.

 

A motion was made by Supervisor Bostinto to approve the report for December, 2019. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

  1. Township Building Generator: A motion was made by Vice Chairman Dotey to obtain three written quotes by qualified contractors for a propane generator for the Township Building. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

Full Time Road Master/Highway Department Employee position available 

The following qualifications/operations are required:

*Knowledge and Experience of standard road maintenance practices and associated tools and equipment

*Must possess a Class B-Commercial Driver’s License

*Applicants must be at least 18 years of age

*Monthly reporting of all information that may be required by the Board of Supervisors

*Maintenance, Repair and Construction of township roads

*Regular Inspection of all roads and bridges

*Snow Plowing Experience is a must

*Supervisor experience in public works

* Ability to maintain all Township equipment

*Lawn & Tree Maintenance

*Demonstrate ability to work with Township Engineer on road projects/grant opportunities

-Position is salaried on 40 hours per week (7:00 am-3:00 pm Monday through Friday) with availability needed for nights, weekends and holidays when necessary

-Salary will commensurate with experience

-Health Insurance Program, Life Insurance, paid holidays/vacation and pension plan benefits

-Background check and Drug/Alcohol test required prior to employment

Please take notice that the Westfall Board of Supervisors will hold a Workshop Meeting on February 12, 2020 at 7:00 p.m. for the purposes of discussing the LSA Monroe Grant, Various road projects, Milford Township request for joint comprehensive planning, emergency ambulance services and any other business that may come before the Board of Supervisors.  The meeting will be held at the Westfall Township Municipal Building located at 102 LaBarr Lane, Westfall Township, Matamoras, PA.

The Regular meeting of the Westfall Township Board of Supervisors was held Tuesday, December 10, 2019 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

 

Those present were Chairman, Robert Melvin (arrived at 7:19 pm); Vice Chairman, Jerry Dotey; Supervisors; Robert Bostinto, Paul Fischer and Paul Schaldonat; Solicitor; Robert Bernathy; and Secretary, Jodi Manheim; Zoning Officer, Jeff Cammerino. Also present were Road Master, Bill Schneider; Westfall Township Fire Department Chief Fred Jacobs; Attorney Jason Ohliger, Mike Gable, Boucher and James and approximately three members of the general public.

EXECUTIVE SESSION: The last executive session was held on and November 4, 2019 at 6:46 pm for potential litigation.

APPROVAL OF AGENDA:

Ms. Manheim added “Resolution Number Change” as #6 under New Business. A motion was made by Vice Chairman Dotey to approve the amendment to the agenda.  The motion was seconded by Supervisors Bostinto and carries with all in favor.

November 4, 2019 –Regular Meeting Minutes: A motion was made by Supervisor Schaldonat to approve the November 4, 2019 Regular Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with all in favor.

TREASURER’S REPORT: Mr. Myer was absent. The report through the month of November, 2019 is on file at the Township Office.

POLICE REPORT:  No representative present.  The November 2019 Police Report is on file at the Township Office.

Solicitor Bernathy stated he received word of a potential inter-municipal agreement for ambulance services.

Chief Jacobs noted that the Assisted Living Center in Port Jervis is producing 6 to 10 ambulance calls per day.

A motion was made by Supervisor Fischer to approve the Westfall Fire Department report for the month of November, 2019.  The motion was seconded by Supervisor Schaldonat and carries with all in favor.

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for November, 2019 which reflects the following:

  1. Most of the month spent preparing for or cleaning up winter storms
  2. Clean up of fallen trees
  3. New salt shed is 90% full of material
  4. 300 ton of anti-skid on site
  5. New highway department part time drivers are working out well
  6. Four trucks out for storms
  7. Cleared out the sub-station for police department use

Supervisor Schaldonat questioned the timing for the flood abatement demonstration. Mr. Schneider stated he would inform the Board as soon as he received the information.

A motion was made by Supervisor Fischer to approve the Highway Department Report for November, 2019. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

BUILDING/ZONING REPORT:  Jeff Cammerino gave the report for November, 2019 which reflects the following:

7 Building Permits $5,911.50; 1 Electrical Permit $184.50; 2 Zoning Permits $150.00

Total Fees $6,246.00

A motion was made by Supervisor Fischer to approve the Building/Zoning Report for November, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.

EMERGENCY MANAGEMENT: Mr. Fischetta was absent.  The EMA report for the month of November, 2019 is on file at the Township Office.

 

CORRESPONDENCE:  On desk for review.    

OLD BUSINESS:

Salt Storage Structure-Change order approval and completion of project/payment approval: A change order was reviewed for approval which increased the salt shed base cost by $2,000 due to a change in apron material.

A motion was made by Supervisor Fischer to approve the change order and additional cost of $2,000.00 for a total cost of $108,453.22 of the base structure and to authorize payment for same and payment in the amount of $45,754.00 for the upper portion of the salt shed completion. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

NEW BUSINESS:  

Adoption of Final 2020 Budget-Resolution 2019-4 and 2019-5: Solicitor Bernathy read both Resolutions.

A motion was made by Supervisor Fischer to approve Resolution 2019-4. The motion was seconded by Supervisor Bostinto and carries with all in favor.

United States Department of the Interior/National Park Service-Visitor Use Management Plan-Fee Proposal:

Brief discussion followed.

A motion was made by Vice Chairman Dotey to approve sending a letter of objection of the amenity fee proposal and universal fee proposal to the National Park Service. The motion was seconded by Supervisor Fischer and carries with all in favor.

Flood Insurance Renewal Premium Notice: A motion was made by Vice Chairman Dotey to approve the payment of $2,913.00 for the $60,500 Building Coverage/$22,100 Contents Coverage option for the Township Building.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Newsletter: Supervisor Schaldonat addressed the Board with ideas for a bi-annual newsletter to the township residents to inform them of all going on in the Township throughout the year.  He suggested having volunteers draft the proposed correspondence and mailing out to all residents.

 

Discussion followed. Supervisor Fischer stated the website and minutes serve this purpose currently.  Supervisors Bostinto stated the same.  Chairman Melvin stated that the minutes tell all.

This matter was tabled until the January 6, 2019 Supervisor Meeting.

Road Task Force-Appointment Form to Pike County Commissioners: A motion was made by Vice Chairman Dotey to recommend Albert Schneider’s re-appointment as Road Task Force Member for the three year term vacancy to the Pike County Commissioners.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Resolution Number Change: Chairman Melvin explained that earlier in the year two resolutions were given the same number in error.

 

A motion was made by Supervisor Fischer to change the Monroe County Local Share Grant submission Resolution Number to 2019-3 from 2019-2.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

SUBDIVISION REVIEW and ACTION:  

Paddler’s Point-Garden Apartments-Final Land Development Plan-Letter from Planning: Representatives: Attorney Jason Ohliger and Mike Gable, Boucher and James Engineering

Mr. Ohliger stated the applicant is seeking Final Land Development approval for the Paddler’s Point Garden Apartment project which has received Conditional Use approval.

Mr. Gable stated he has revised the plan to address the October 7, 2019 Kiley Associates, LLC review letter.

Solicitor Bernathy stated the latest Kiley Associates, LLC review letter is dated October 29, 2019 which was just received by the township earlier in the day. Mr. Gable stated he had not received this letter from Kiley Associates, LLC.

Solicitor Bernathy read the letter and went over each comment/condition. He also addressed each comment on the September 24. 2019 Pike County Planning review letter with Mr. Gable.

Mr. Cammerino confirmed the height of the building will meet the 35’ maximum requirement.

Chief Jacobs stated that 11.5 feet access for fire truck access is sufficient.

Mr. Ohliger stated he submitted the Developer Agreement to Mr. Bernathy just prior to the meeting.

No further comment.

A motion was made by Vice Chairman Dotey to approve the Paddler’s Point-Garden Apartments-Final Land Development Plan with the following conditions:

 

  1. All comments noted on the Kiley Associates, LLC review letter dated October 29, 2019
  2. All comments noted on the Pike County Office of Community Planning letter dated September 24, 2019
  3. All conditions noted in the October 3, 2019 Conditional Use HearingThe motion was seconded by Supervisor Fischer and carries with all in favor.

EXECUTIVE SESSION: None held.

Mr. Schneider suggested the Board confirm the flood insurance coverage for the sub-station next to the Township Building. Chairman Melvin directed Ms. Manheim to contact the RC Lain Agency to obtain the information.

PUBLIC COMMENT: Robin Waizenneger from 118 Stone Ridge Road addressed the Board.  She informed the Board of the terrible road conditions on the Penn DOT section of Cummins Hill Road.  The road is closed down to one lane due to construction and she is concerned of the runoff turning to ice in the winter due to drains being higher than the road surface.

Brief discussion followed. Chairman Melvin directed Jodi Manheim to contact Penn DOT to obtain a construction schedule.

October 7, 2019-Regular Meeting Minutes: A motion was made by Vice Chairman Dotey to approve the October 7, 2019 Regular Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with four in favor and one abstention.  Supervisor Schaldonat abstained since he was absent for the meeting.

October 10, 2019-Budget Workshop Meeting Minutes: A motion was made by Chairman Melvin to approve the October 10, 2019 Budget Workshop Meeting Minutes. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Discussion followed regarding ambulance service and lack of coverage in surrounding areas. Chairman Melvin requested a list of year to date calls from Mr. Koferl.

  6. Mr. Ransom attended the 2 day Dirt and Gravel Road Maintenance Training

A motion was made by Supervisor Fischer to approve the Highway Department Report for October, 2019. The motion was seconded by Chairman Melvin and carries with all in favor.

BUILDING/ZONING REPORT:  Jeff Cammerino gave the report for October, 2019 which reflects the following:

2 Building Permits totaling $2,061.30; 1 Electrical Permit totaling $124.50; 6 Zoning Permits totaling $900.00. Total Fees collected $3,085.80.

 

A motion was made by Supervisor Fischer to approve the Building/Zoning Report for October, 2019.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

EMERGENCY MANAGEMENT: Mike Fischetta gave the report for October, 2019.  There were no calls for service for the month of October, 2019.  There were a few weather events over the last month that were closely monitored.  EMA received and reviewed multiple briefing packages from NWS Binghamton and the Mid Atlantic River Forecast Center for these events.

Mr. Fischetta stated he met with Pike County Light and Power and they will be holding a tabletop meeting sometime in January.

A motion was made by Vice Chairman Dotey to approve the Emergency Management Report for the month of October, 2019. The motion was seconded by Supervisor Fischer and carries with all in favor.

OLD BUSINESS:

2008 Chevrolet Truck Bid Proposals: Three sealed bids were received.  Chairman Melvin opened each bid and the results were as follows:

 

  1. Mike Veneziano in the amount of $4,107.00 with $500.00 deposit
  2. Gary Kaszowski in the amount of $6,077.00 with a $607.70 deposit
  3. Jersey One Auto Sales in the amount of $3,657.00 with a $500.00 deposit

A motion was made by Chairman Melvin to award the bid to the highest bidder over the $5,000 minimum bid amount, Gary Kaszowski, in the amount of $6,077.00 and to reject the other bids due to the lower bid amounts. The motion was seconded by Supervisor Fischer and carries with all in favor.

Freightliner Truck-Advertise for Sale: Secretary Manheim stated the vehicle was placed on the municibid auction site and two bids were received in the amount of $20,500 and $20,600 which did not meet the bid reserve price of $30,000.00.

Discussion followed.

A motion was made by Vice Chairman Dotey to reject all bids and to approve the keeping of the Freightliner in the township fleet of vehicles. The motion was seconded by Supervisor Fischer and carries with all in favor.

NEW BUSINESS:  

Adoption of the 2020 Tentative Budget-Approval for advertising: Chairman Melvin reviewed each item amount on the tentative budget legal notice.  He stated mills will be lowered by 1 in 2020 and that the mills have been lowered by 35% since the Earned Income Tax was enacted.

A motion was made by Vice Chairman Dotey to approve the 2020 Tentative Budget and to advertise the same in the Pike County Dispatch and Pocono Record. The motion was seconded by Supervisor Fischer and carries with all in favor.

Paving Quotes-Front Parking Lot of Township Building: Three written proposals were received.  Chairman Melvin read each proposal and the results were as follows:

  1. Warner Paving in the amount of $12,123.09
  2. Kowal Paving in the amount of $15,900.00
  3. Jagger Paving in the amount of $18,550

A motion was made by Supervisor Bostinto to award the project to the lowest bidder, Warner Paving in the amount of $12,123.09. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

Agreement for Sign Language Interpreting Services (Mid-Hudson Interpreter Service): A motion was made by Supervisor Schaldonat to approve the Agreement with the Mid-Hudson Interpreter Service for 2020.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

Westfall Senior Center-Bond Reduction Request3-Letter from Kiley Associates, LLC: A motion was made by Supervisor Fischer to approve the third bond reduction request from Pike Health Properties, LLC in the amount of $35,306.29 with the remaining bond balance of $1,199,063.79.  The motion was seconded by Vice Chairman Dotey and carries with all in favor. 

 

Mill Rift Fire Department Roof: Mr. Schneider stated there are a couple of leaks in the roof at this time.  Solicitor Bernathy confirmed there is no structural damage at this time.  Brief discussion followed.

A motion was made by Supervisor Fischer to obtain one quote to repair the roof on the Mill Rift Fire Department Building and to have the repair completed as long as the quote is under the advertising requirement amount of $11,100. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Fee Schedule/Proposed Burning Ordinance-Schedule Workshop Meeting: Discussion followed regarding a proposed burning ordinance.  Chairman Melvin stated the Supervisors put a lot of time and effort into this subject in the past and there was great opposition.  The ordinance was never put into effect.  Mr. Cammerino stated there have been recent complaints regarding burning of garbage in the township.  He would like there to be regulations in effect.

Mr. Schneider stated his concern with leaf removal if an ordinance was put in effect. Mr. Fischer stated he has no problem with tabling this matter.  Mr. Koferl stated an ordinance will not stop people from burning.

No further comment/public comment. This matter was tabled.

Discussion followed regarding a proposed fee schedule amendment. Chairman Melvin stated he feels that the township is financially stable and that the residents pay taxes and the township collects the Earned Income Tax.  He stated the township wants to stay as business friendly as possible.  Mr. Cammerino stated he did a comparison of fee schedules of all townships in Pike County and Westfall Township’s commercial permits fees are low.  Supervisor Fischer stated costs need to be covered.

Discussion followed regarding penalty fees if structures are built without permits. Solicitor Bernathy stated the remedy is to take the property owner to court.  He stated he will need to review the proposed changes and take under advisement.

This matter was tabled until further review.

Part Time Snow Plow Drivers: A motion was made by Supervisor Bostinto to hire George Buchholz and Richard Mai as part time snow plow drivers at a rate of $20.00 per hour subject to a criminal background check and all employee manual guidelines.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Upper Delaware Council Grant: A motion was made by Vice Chairman Dotey to obtain Mr. Martin’s grant writing services in accordance with previously approved contact to apply for a grant through the Upper Delaware Council to fund the paving of the front parking lot at the township building (application to be submitted by November 15, 2019).  The motion was seconded by Supervisor Schaldonat and carries with all in favor.

SUBDIVISION REVIEW and ACTION:  

Paddler’s Point-Garden Apartments-Final Land Development Plan-Letter from Planning: This matter was tabled due to a request from the applicant’s engineer.  This matter will be placed on the agenda for the December 2, 2019 Supervisor Meeting.

EXECUTIVE SESSION: None held.
