The Regular meeting of the Westfall Township Board of Supervisors was held Monday, March 5, 2018 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.
Those present were Vice Chairman, Jerry Dotey; Supervisors; Paul Fischer, Robert Bostinto and Michelle Wilkins; Solicitor; Robert Bernathy; and Secretary, Jodi Hulse. Also present were Road Master, Bill Schneider; Westfall Township Fire Department Chief; Robert Llewellyn; Westfall Fire Department President; Bill Koferl; Chelsea Abadessa, EPRPD, Emergency Management Coordinator, Robert Ewbank; Treasurer, Scott Myer; John Fuller, P.E. There was one member of the general public present.
Chairman Melvin was absent.
APPROVAL OF AGENDA: Vice Chairman Dotey added #8 under New Business as appointment of two temporary drivers. Supervisor Fischer motioned to approve the addition to the agenda. The motion was seconded by Supervisor Wilkins and carries with all in favor.
PUBLIC COMMENT: No public comment.
MINUTES:
A motion was made by Supervisor Bostinto to approve the February 5, 2018 Regular Meeting Minutes. The motion was seconded by Supervisor Wilkins and carries with all in favor.
A motion was made by Supervisor Bostinto to approve the February 13, 2018 Workshop Meeting Minutes. The motion was seconded by Supervisor Wilkins and carries with all in favor.
TREASURER’S REPORT: Mr. Myer gave the report through the month of February, 2018.
A motion was made by Supervisor Wilkins to approve the Treasurer’s report through the month of February, 2018. The motion was seconded by Supervisor Bostinto and carries with all in favor.
Supervisor Bostinto stated there is an issue with the police department pension fund funding and the township may need to make a contribution. This matter will be addressed in August after the state funding is in place.
POLICE REPORT: Chelsea Abadessa gave the report for the month of February, 2018. The report which reads as follows:

A motion was made by Supervisor Wilkins to approve the Police Department Report for the month of February, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.
FIRE DEPARTMENTS:
Westfall Fire Department: Chief Llewellyn read the report for February, 2018: 3 Automatic Fire Alarms, 3 Motor Vehicle Accidents, 1 Spill Control, 1 CO Alarm, 1 Assist EMS, 1 Traffic Control and 5 Structure Fires. Total calls for February, 2018 were 15; 47 calls YTD
The EMS Report for the month of February, 2018 was as follows: 34 Calls in Westfall Township, 16 Calls in Dingman Township, 6 calls in Milford Township, 21 calls in Milford Borough, 13 calls in Matamoras Borough, 6 call in Shohola Township, and 6 calls in Orange County, NY. Total calls for February, 2018 were 102. Total EMS calls YTD are 237.
The combined Year to Date calls are 284.
Training for the month: Four drills/In-house training sessions held for 82 hours
Fundraising: May 12-Annual Golf Outing-High Point Country Club
August 10-Pulled Pork Dinner
Other: Red Cross Blood Drive held on February 27; EMS Subscription drive out to residents currently; Go 24 store hydrant not installed; Best Western Dry Hydrant not repaired; Roy Rogers knox box not installed.
A motion was made by Supervisor Bostinto to approve the Westfall Fire Department report for the month of February, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.
Mill Rift Fire Department: No representative present. Ms. Hulse read the report submitted for February, 2018: It read as follows:

The Mill Rift Fire Department report for February, 2018 was approved on motion by Supervisor Fischer. The motion was seconded by Supervisor Wilkins and carries with all in favor.
HIGHWAY DEPARTMENT: Mr. Schneider gave the report for February, 2018.
Mr. Schneider prepared information and attended the workshop meeting on February 13, 2018. The department did cold patching throughout the township. They handled ice storms during the month of February. Mr. Schneider attended the monthly road task force meeting. The department plowed and did clean up during the recent heavy snow storm.
Discussion followed regarding an issue with Route 84 closure during the recent storm. The fire department was asked to block the road closure. Chief Llewellyn suggested this matter be addressed by the Supervisors for the future. The fire department does not have the man power to be sitting at a road block in a storm for 20 to 30 hours. Mr. Schneider stated he would bring this matter up at the next Road Task Force meeting.
A motion was made by Supervisor Bostinto to approve the Highway Department Report for February, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.
BUILDING/ZONING REPORT: Wayne Rohner was absent. Ms. Hulse read the report for February, 2018. There was one zoning permit totaling $75.00 in fees for the month of February, 2018.
A motion was made by Supervisor Fischer to approve the Building/Zoning Report for February, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.
EMERGENCY MANAGEMENT: Mr. Ewbank read the report for February, 2018. There were no calls for the month of February, 2018. Mr. Ewbank has two reports from Pike County Light and Power. He said there were construction crews on Cummins Hill Road today due to the recent poles and wires down from the snow storm. PCPL also stated that the Heaters Hill repairs would be completed by this evening.
A motion was made by Supervisor Fischer to approve the report for February, 2018. The motion was seconded by Supervisor Bostinto and carries with all in favor.

OLD BUSINESS:
- Proposed Fire Code Enforcement Ordinance: This matter was tabled until the April meeting. A motion was made by Supervisor Wilkins to table this matter until the April 2, 2018 Supervisor Meeting. The motion was seconded by Supervisor Fischer and carries with all in favor.
- Emergency Access Road-Township Property-Delaware Drive to Decker Lane: Vice Chairman Dotey stated he had a lengthy discussion with Mr. Hudak from Kiley Associates, LLC regarding revisions to the map. Kiley Associates, LLC is in the process of revising the map so that Solicitor Bernathy can proceed with the legal documents. No action taken.
- Township Building-Parking Lot Lighting: This matter was tabled. No new installs are being done by the electric company at this time since they are setting up new installation crews.
- Price Chopper Intersection-Lighting Quote: This matter was tabled. No new installs are being done by the electric company at this time since they are setting up new installation crews.
- Decker Lane and Pond Drive Flooding Issue/Bluestone Boulevard-PCCD Meeting-March 7, 2018 at 9:30 am: Ms. Hulse stated this meeting date is changing due to the recent blizzard. The meeting will be coordinated with Vice Chairman Dotey once new dates are provided. Chairman Dotey noted these three areas need to be addressed and the projects need to be done.
- Delaware Valley School District/Westfall Township Draft Lighting Agreement: Solicitor Bernathy stated he has reviewed the agreement and it is acceptable.A motion was made by Supervisor Bostinto to approve the Delaware Valley School District/Westfall Township Draft Lighting Agreement. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Status of Malibu Appeal: This matter was referred to the executive session to be held at the end of the meeting.
NEW BUSINESS:
- Connexicore-Frank Segarra-Drone Technology Information: Supervisor Bostinto stated that Mr. Segarra is not present due to the recent storm. Discussion followed regarding the necessity of drone technology within the township. Chief Llewelyn noted the drone is a great tool but not a necessity. Vice Chairman Dotey asked if the tool could have been used in the past. Mr. Koferl said no. Mrs. Abadessa stated there may be a warrant issue. The board decided to drop the subject and no action was taken.
- Schedule/Advertise workshop meeting-municipal expansion-informational meeting with Charles Garnett-USDA: This matter was tabled until the April Meeting on a motion made by Supervisor Bostinto. The motion was seconded by Supervisor Wilkins and carries with all in favor. Ms. Hulse will obtain dates for the meeting in April.
- Schedule/Advertise Special Meeting with Shohola Township regarding ambulance services: This matter was tabled until the April 2, 2018 Supervisor Meeting due to the recent storm.
- Milford Water Authority-Vacancy on Board: Supervisor Bostinto stated he spoke with Tim Gardner and Mr. Gardner noted a vacancy on the Board for a Westfall Township resident.A motion was made by Supervisor Wilkins to advertise the vacancy for the Milford Water Authority Board. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- MRM Property & Liability Trust-Proxy-Authorization-Harrison Township and West View Water Authority: A motion was made by Supervisor Fischer to approve the proxy for voting purposes for all matters at the April 5, 2018 MRM Property and Liability Trust meeting. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- MRM Property & Liability Trust-Proxy-Authorization-Pine Township, Hempfield Township and Municipality of Murrysville): A motion was made by Supervisor Bostinto to approve the proxy for voting purposes for all matters at the April 6, 2018 MRM Property and Liability Trust meeting. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Marijuana Facilities Ordinance-Letter from Planning Commission-Schedule/Advertise public hearing: A motion was made by Supervisor Bostinto to schedule/advertise a public hearing for the proposed Marijuana Facilities Ordinance for April 2, 2018 at 6:45 pm. The motion was seconded by Supervisor Wilkins and carries with all in favor.
- Temporary Driver Appointment: A motion was made by Supervisor Fischer to appoint Chris Morgan and Pat Cordova as temporary drivers for the Highway Department at a rate of $20.00 per hour with copy of current driver’s license and addition of the drivers to the township insurance policy. The motion was seconded by Supervisor Wilkins and carries with all in favor.
SUBDIVISION REVIEW and ACTION:
- GO 24 Store-Final Minor Land Development-Revision to move location of Fire Hydrant-Letter from Planning Commission: Representative-John Fuller, P.E.
Mr. Fuller explained the plan to the Board and stated that he was here for any questions.
A motion was made by Supervisor Bostinto to approve the GO 24 Store Final Minor Land Development-Revision to move fire hydrant with the conditions listed on the February 27, 2018 correspondence from Kiley Associates, LLC. The motion was seconded by Supervisor Fischer and carries with all in favor.
Mr. Koferl addressed the Board and said he is available as a temporary driver. A motion was made by Supervisor Fischer to appoint Mr. Koferl as a temporary driver at a rate of $20.00 per hour with a copy of current driver’s license and addition of the driver to the township insurance policy. The motion was seconded by Supervisor Wilkins and carries with all in favor.
EXECUTIVE SESSION: An executive session was called at 7:46 pm for litigation purposes to do with the Malibu appeal.
The meeting was called back to order at 8:02 pm. No decisions were made.
ADJOURNMENT: Meeting was adjourned at 8:03 p.m. on a motion by Supervisor Bostinto. Motion seconded by Supervisor Wilkins and carries with all in favor.
