The Regular meeting of the Westfall Township Board of Supervisors was held Monday, July 2, 2018 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Vice Chairman, Jerry Dotey; Supervisors; Paul Fischer, Robert Bostinto and Michelle Wilkins; Solicitor; Robert Bernathy; and Secretary, Jodi Manheim. Also present were Road Master, Bill Schneider; Westfall Township Fire Department Chief; Robert Llewellyn; EPRPD Chief; Chad Stewart, Emergency Management Assistant; Michael Fischetta; Zoning Officer; Wayne Rohner; Westfall Township Fire Department President; Bill Koferl; and John Fuller, P.E; John Dalton, Mark Strouse, Mr. and Mrs. Tschopp, Susan Burrows and Angela Scialdone. There were approximately 8 members of the general public present.

Chairman Robert Melvin and Treasurer Scott Myer were absent.

EXECUTIVE SESSION: The last Executive Session was held May 22, 2018 at 4:30 pm for personnel.

APPROVAL OF AGENDA:

A motion was made by Supervisor Wilkins to approve the agenda with no changes. The motion was seconded by Supervisor Bostinto and carries with all in favor.

PUBLIC COMMENT: Mr. Dalton questioned the date for the August joint meeting between the Supervisors and the Matamoras Borough Council regarding the Police Department.  Jodi Manheim said the meeting will be the third Monday in August.  Vice Chairman Dotey said the meeting date and time was never changed in the Regionalization Agreement.

MINUTES:

A motion was made by Supervisor Wilkins to approve the June 4, 2018 Regular Supervisor Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with all in favor.

TREASURER’S REPORT: The Treasurer’s Report through the month of June, 2018 was submitted by Mr. Myer’s Office and is on file.

A motion was made by Supervisor Fischer to approve the Treasurer’s report through the month of June, 2018. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

POLICE REPORT: Chief Stewart gave the report for the month of June, 2018 which reflected the following:

Significant Happenings:

-All officers attended 2 days of Legal Updates

-Attended Safety Day at Pennsylvania Welcome Center

-Conducted 6 seatbelt presentations at the Elementary School

-Attended a pre-drill conference for active shooter PJPD

-3 officers attended Taser Training hosted at Borough Hall

Supervisor Bostinto questioned the payment of State Police Fines collected within the township. Chief Stewart stated the fines should be paid to the police department from the township.  This matter will be discussed at the next Police Commission meeting.

A motion was made by Supervisor Fischer to approve the Police Report for the month of June, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.

FIRE DEPARTMENTS:

Westfall Fire Department:  Chief Llewellyn read the report for June, 2018:  9 Automatic Fire Alarms, 3 Motor Vehicle Accidents, 3 Vehicle Fire, 1 Controlled Burn, 1 Brush Fire, 2 Utility Wires/tree down, 1 CO alarm, 1 Assist EMS, 4 Chief Investigations, 1 Landing Zone, 2 Stand By Transfer, 1 Traffic Control and 1 Structure Fire.  Total calls for June, 2018 were 30; 162 calls YTD

The EMS Report for the month of June, 2018 was as follows:  46 Calls in Westfall Township,1 call in Blooming Grove Township, 1 Call in Delaware Township, 12 calls in Dingman Township, 4 calls in Milford Township, 17 calls in Milford Borough, 14 calls in Matamoras Borough, 3 calls in Shohola Township and 4 calls in Orange County, NY.  Total calls for June, 2018 were 102.  Total EMS calls YTD are 662.

The combined Year to Date calls are 824.

Training for the month: Four Drills/In-house training sessions held for 86 hours; one member tested for National Firefighter I Certification

Fundraising:   August 10-Pulled Pork Dinner

Other: Fire Department Fund Drive Mail out sent

GO 24 Store hydrant has not been completed

Port Jervis Fire Parade July 14, 2018

A motion was made by Supervisor Wilkins to approve the Westfall Fire Department report for the month of June, 2018.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Mill Rift Fire Department: No report submitted by the Department.

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for June, 2018 which reflected the following work done:

  1. Clearing of brush in sight distance on Reuben Bell Drive and throughout the township where needed
  2. Cleared culvert pipes throughout the township
  3. Installed culvert pipe on Decker Lane
  4. Worked on Bluestone Boulevard
  5. Mr. Schneider attended the Road Task Force meeting
  6. Shoulder work was done throughout the township
  7. New air compressor was purchased for the Highway Department
  8. Work done on Pond Drive
  9. Assisted with showing paving areas to bidders
  10. Patched pot holes throughout the township
  11. Cleared loose stone from roadways
  12. Mowing township rights of way
  13. Maintenance on equipment
  14. Handled tree down on Cummins Hill Road
  15. Reset traffic signal outage at Reuben Bell Drive

Mr. Schneider stated Pioneer Construction has started the work on SR 2017 in Mill Rift in the slide area. Also, salt prices have gone up from $66.00 per ton to $72.00 per ton.

A motion was made by Supervisor Bostinto to approve the Highway Department Report for the month of June, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.

BUILDING/ZONING REPORT: Wayne Rohner gave the report for the month of June, 2018 which reflected the following:

1 Building Permit-$124.50

9 Zoning Permits-$575.00

Total Fees $699.50 collected ($425.00 outstanding)

A motion was made by Supervisor Fischer to approve the Building and Zoning Report for the month of June, 2018. The motion was seconded by Supervisor Wilkins and carries with all in favor.

EMERGENCY MANAGEMENT: Mike Fischetta was present and gave the report for the month of June, 2018 which reflected no calls for the month. Mr. Ewbank attended the NYC DEP Dam Emergency Action Plan Orientation Seminar and Tabletop Exercise for the Cannonsville, Pepacton and Neversink Dams on June 5, 2018.

A motion was made by Supervisor Bostinto to approve the EMA Report for the month of June, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.

CORRESPONDENCE:  On desk for review.    

OLD BUSINESS:

Proposed Fire Code Enforcement Ordinance: Solicitor Bernathy thanked the Westfall Fire Department for their assistance in preparing a draft. This matter will be placed on the next workshop meeting agenda. 

 

A motion was made by Supervisor Wilkins to schedule/advertise a workshop meeting for July 30, 2018 at 6:00 pm. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

 

                                  Heaters Hill:  E.R. Linde Construction Corp in the amount of $94,872.40

Reuben Bell Drive:  E.R. Linde Construction Corp in the amount of $68,208.10

No other bids were received. A motion was made by Supervisor Bostinto to award the Heaters Hill Paving Project bid in accordance with the contract to E.R. Linde Construction Corp in the amount of $94,872.40.  The motion was seconded by Supervisor Wilkins and carries with all in favor.

A motion was made by Supervisor Bostinto to award the Reuben Bell Drive Paving Project bid in accordance with the contract to E.R. Linde Construction Corp in the amount of $68,208.10. The motion was seconded by Supervisor Wilkins and carries with all in favor.

A motion was made by Supervisor Fischer to schedule the hearing for August 6, 2018 at 6:30 pm. The motion was seconded by Supervisor Bostinto and carries with all in favor.

NEW BUSINESS: 

 

 

SUBDIVISION REVIEW and ACTION: 

Downtown Baseball and Softball Academy-Minor Land Development: Representatives: John Fuller, P.E., Mark Strouse, Mr. and Mrs. Tschopp

A motion was made by Supervisor Bostinto to approve the Downtown Baseball and Softball Academy Minor Land Development Application with conditions listed on the Kiley Associates, LLC review letter dated June 21, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.

Westfall Township/Ralph Burger Subdivision/Lot Combination: A motion was made by Vice Chairman Dotey to approve the Westfall Township/Ralph Burger Subdivision/Lot Combination. The motion was seconded by Supervisor Fischer and carries with all in favor

GO 24 Store-Signing of Maps after Pike County Planning Review Letter: Chief Llewellyn stated the hydrant has been installed but was not approved by the Matamoras Municipal Authority due to a connection and rotation issue. Solicitor Bernathy confirmed with Chief Llewellyn that the hydrant can be used in case of a fire.

A motion was made by Vice Chairman Dotey to approve the signing of the maps after receiving the Pike County review letter dated June 19, 2018. The motion was seconded by Supervisor Bostinto and carries with all in favor.

EXECUTIVE SESSION: An executive session was called at 7:52 p.m. for the purposes of personnel and potential litigation.

The meeting was called back to order at 8:05 p.m.

A motion was made by Supervisor Fischer to appoint Michael Fischetta as Emergency Management Coordinator effective August 1, 2018. The motion was seconded by Supervisor Bostinto and carries with all in favor.

Ms. Susan Burrows asked if she could make a public comment. The Board agreed.

Ms. Burrows, a Milford Landing resident, addressed the Board with a rat infestation problem at Staples Plaza which is affecting the Milford Landing property owners. This problems stems from the garbage disposal area near the Staples Plaza, according to Ms. Burrows.  She said that Milford Landing Association has hired an exterminator for their common area.  Discussion followed.  Solicitor Bernathy stated there would need to be findings of fact in order to enforce any action for any effect on public health, safety and welfare.  He also noted this may be a private action amongst attorneys of the two property owners.  Angela Scialdone also commented on the issue.

ADJOURNMENT: Meeting was adjourned at 8:14 p.m. on a motion by Supervisor Bostinto. Motion seconded by Supervisor Fischer and carries with all in favor.
