The Regular meeting of the Westfall Township Board of Supervisors was held Monday, December 3, 2018 at 7:00 pm following the Public Hearing for the consideration of Ordinance #173/Evaluation-Implementation of Sewer Line Extension. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.
Those present were Chairman, Robert Melvin (arrived at 7:11 pm); Vice Chairman, Jerry Dotey; Supervisors; Paul Fischer, Robert Bostinto and Paul Schaldonat; Solicitor; Robert Bernathy; Secretary, Jodi Manheim; Treasurer, Scott Myer. Also present were Road Master, Bill Schneider; Westfall Township Fire Department Chief, Robert Llewellyn; Westfall Township Fire Department President, Bill Koferl; Mill Rift Fire Department Chief, Tom Lamb; EPRPD Assistant Chief, Eric Stewart; Emergency Management Coordinator, Michael Fischetta; Joseph Gurney, First Capital Engineering, Dipen Desai, Benjamin Ringus-Perez, John Dalton and approximately 8 members of the general public.
Vice Chairman Dotey officiated the meeting until Chairman Melvin arrived at 7:11 pm.
EXECUTIVE SESSION: The last Executive Session was held November 5, 2018 at 8:21 pm for personnel matters.
APPROVAL OF AGENDA: A motion was made by Supervisor Bostinto to approve the agenda with no changes. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
PUBLIC COMMENT: Mr. Dalton addressed the Board. He stated that he attended the Matamoras Borough Council Meeting last month and addressed the Police Department funding split and cost. He noted that Matamoras lost approximately $140,000 in the past several years since they did not address the funding split matter earlier. Mr. Dalton told the Board he gave the Matamoras Borough Council a copy of his calculations. He noted that he is curious to see the language in #4 under new business later in the meeting.
Vice Chairman Dotey thanked Mr. Dalton for his comment.

MINUTES:
A motion was made by Supervisor Bostinto to approve the November 5, 2018 Regular Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with all in favor.
November 28, 2018 Workshop Meeting Minutes: Tabled
TREASURER’S REPORT: The Treasurer’s Report through the month of November, 2018 presented by Scott Myer.
A motion was made by Supervisor Fischer to approve the Treasurer’s report through the month of November, 2018. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
POLICE REPORT: Assistant Chief Stewart gave the report for the month of November, 2018 which reflected the following:
Significant Happenings:
-Officer sent to PSP Intel in Hershey
-DV Special Education toured the Police Station
-Toys 4 kids Marine Corp drop off box at police station-all new unwrapped toys may be dropped off for children in the tri-state area
-Officers participating in No Shave November in honor of cancer survivors-All proceeds raised by the law enforcement agencies will benefit Orange Regional Medical Center’s Spagnoli Family Cancer Center
-Police Foundation is holding a Sportsman’s Raffle for a total of $1,300 in gift cards. Drawing to be held December 14th
-A reminder that we have had an uptick in Scam Calls in our area. “if it is too good to be true, it probably is”
-Have a Happy and Safe Holiday Season-Merry Christmas

A motion was made by Supervisor Fischer to approve the Police Report for the month of November, 2018. The motion was seconded by Supervisor Bostinto and carries with all in favor.
FIRE DEPARTMENTS:
Westfall Fire Department: Chief Llewellyn read the report for November, 2018: 3 Automatic Fire Alarms; 5 Motor Vehicle Accidents; 1 Pedestrian Struck; 13 Controlled Burns; 3 Chief Investigation; 1 Vehicle Fire; 8 Structure Fires- Total calls for November, 2018 were 33; 345 calls YTD
The EMS Report for the month of November, 2018 was as follows: 48 Calls in Westfall Township; 13 calls in Dingman Township; 6 calls in Milford Township; 16 calls in Milford Borough; 25 calls in Matamoras Borough; 3 calls in Delaware Township; 4 calls in Shohola Township; 1 call in Blooming Grove Township; 1 call in Wayne County; 3 calls in Orange County, NY. Total calls for November, 2018 were 120. Total EMS calls YTD are 1249.
The combined Year to Date calls are 1,604.
Training for the month: Four Drills/In-house training sessions held for 92 hours

A motion was made by Supervisor Bostinto to approve the Westfall Fire Department report for the month of November, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.
Chairman Melvin arrived and officiated the meeting at 7:11 pm.
Mill Rift Fire Department: Chief Lamb presented the report for November, 2018 which reflects the following:
11/7/18: Work Night Driver Training
11/13/18: Monthly Meeting
11/17/18: Structure Fire-Dunkin Donuts-Tanker
11/21/18: Work Night-Went over pump/eng/tanker 1
11/29/18: Work Night-Ran checked all trucks

A motion was made by Vice Chairman Dotey to approve the Mill Rift Fire Department Report for the month of November, 2018. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
Chairman Melvin asked if the department submitted their Fire Protection Contract Documents. Secretary Manheim stated that Chief Lamb submitted just before the start of the meeting. Solicitor Bernathy stated he needs to review the documents.
HIGHWAY DEPARTMENT: Mr. Schneider gave the report for November, 2018 which reflected the following:
- Sign Replacement
- Ordered signs that were knocked down by accidents
- Cleared ditches and culvert pipes
- Continued shoulder work
- Attended to one storm-called in part time help for one shift
- Metal dumpster on site for old culvert pipe clean up
- Maintenance on equipment at shop
- Maintained compost area
- Attended meeting with Kiley Associates, LLC regarding the Bluestone Boulevard project-needs to obtain survey
- Attended the Supervisor Workshop meeting on November 28, 2018
- Salt was ordered to replenish stock pile
A motion was made by Vice Chairman Dotey to approve the Highway Department Report for the month of November, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.
BUILDING/ZONING REPORT: Wayne Rohner was absent. Secretary Manheim read the report which reflected the following:
1 Building Permit-$304.50
2 Electrical Permits-$249.00
2 Zoning Permits-$150.00
Total Fees $703.50
Chairman Melvin stated that the Board needs to consider expanding the zoning hours and that the matter would be looked into and discussed at the January Supervisor meeting.
A motion was made by Supervisor Fischer to approve the Building and Zoning Report for the month of November, 2018. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
EMERGENCY MANAGEMENT: Mike Fischetta gave the report for the month of November, 2018 which reflected no calls for the month. Mr. Fischetta stated he attended the FEMA Flood Workshop on November 19th which mainly consisted of a review of the new web-based flood inundation maps FEMA is using. On November 20th Mr. Fischetta and Supervisor Bostinto attended a meeting at the Pike County EMA and the other municipalities. Topics that were discussed was a short re-cap of some of the weather events from last year and the approach the County is looking to take this year with similar events. As well as Code RED which is the alert and notification system Pike County is currently using for severe weather, road closures, and other emergencies.
Discussion followed regarding the township communication radios.
A motion was made by Supervisor Bostinto to approve the EMA Report for the month of November, 2018. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

OLD BUSINESS:
- Westfall Ordinance #173: This matter was handled at the Public Hearing at 6:45 pm just prior to the meeting. A stenographer transcript will be available at the Township Office. A motion was made at the Public Hearing by Supervisor Bostinto to enact Ordinance #173-An Ordinance authorizing an intergovernmental agreement with Milford Township, Milford Borough and the Municipal Authority of the Westfall for the evaluation and implementation of the extension of the Authority’s sewage collections system to serve parts of Milford Township and Milford Borough, as well as an additional area of Westfall Township. The motion was seconded by Supervisor Fischer and carries with all in favor.
- Proposed Fire Code Enforcement Ordinance: This matter was discussed at the November 28, 2018 Supervisor Workshop-Tabled
- Cable Company Contract/Franchise Agreement: Solicitor Bernathy stated he would supply two samples to the Board. Tabled
- Specification Package for base of proposed sale storage building: Kiley Associates, LLC is working on this matter. Tabled
- Fire Protection Contract-Compliance by Fire Departments: Solicitor Bernathy will review the documentation submitted by the Mill Rift Fire Department just prior to the meeting. Tabled until January Supervisor Meeting.
NEW BUSINESS:
- Adoption of 2019 Budget-Resolution 2018-12 and 2018-13: Chairman Melvin read each Resolution. He noted that the total tax mils for 2019 are down 1.2 half of a mil from 2018.
A motion was made by Supervisor Fischer to approve Resolution 2018-12. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
A motion was made by Vice Chairman Dotey to approve Resolution 2018-13. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Pike Health Properties, LLC-Developer’s Agreement:
Solicitor Bernathy stated that he reviewed the document and it is acceptable. He noted the Agreement has the Emergency Services contract attached.
A motion was made by Supervisor Fischer to approve the Pike Health Properties, LLC Developer’s Agreement. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Change Secretary Vacation Day from 12/6/18 to 12/10/18: A motion was made by Supervisor Fischer to approve the change in Jodi Manheim’s vacation day from 12/6/18 to 12/10/18. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Amendment to Regionalization Agreement: A motion was made by Vice Chairman Dotey to approve the amendment to the Regionalization Agreement to change the yearly joint workshop meeting between Westfall Township and Matamoras Borough Council from the third Monday in August to the third Monday in September. The motion was seconded by Supervisor Bostinto and carries with all in favor.
- Appointment of Committee Member-Solid Waste Advisory Committee-Letter form Pike County Planning: A motion was made by Supervisor Fischer to appoint Albert Schneider as Committee Member to the Solid Waste Advisory Committee as representative from Westfall Township. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
- Flood Insurance Renewal Premium Notice: A motion was made to approve the payment of $2,850.00 for the yearly Flood Insurance Renewal Premium. The motion was seconded by Supervisor Fischer and carries with all in favor.
- Mid-Hudson Interpreter Service-Addendum to Sign Language Service Agreement for 2019: A motion was made by Supervisor Fischer to approve the addendum to the Sign Language Interpreter Service which continues the same terms as approved in 2018. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
- Planning Commission Vacancy: Chairman Melvin stated that Marge Tonkin passed away recently and that she was a tremendous asset to Westfall Township and she will be greatly missed. He stated that a letter of interest has been received from Michelle Ransom to fill the vacancy on the Planning Commission. A motion was made by Chairman Melvin to appoint Michelle Ransom to fill Marge Tonkin’s term on the Planning Commission. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
- Township Building Security: Discussion took place regarding the recent shooting at Paradise Township. A motion was made by Supervisor Bostinto to approve spending up to $1,000 for a security analysis for the Township Building Offices. The motion was seconded by Chairman Melvin and carries with all in favor.
Vice Chairman Dotey stated that negotiations with the Police Officers are at a standstill. This matter will be discussed at the next Police Commission Meeting.
SUBDIVISION REVIEW and ACTION:
Letter from Planning Commission-Arrump, LLC-Revised Minor Land Development Plan-Sit Down Restaurant: Representatives: Joseph Gurney, First Capital Engineering, Dipen Desai and Benjamin Ringus-Perez
Mr. Gurney explained the revised plan to the Board. The proposed restaurant will have 125 seats compared to the 75 seats previously approved. Mr. Ringus-Perez confirmed with Solicitor Bernathy the fire alarm at Roy Rogers will be installed within a week and that the grease trap would be removed from in front of the fire hydrant the next day.
A motion was made by Supervisor Fischer to approve the Arrump, LLC Revised Minor Land Development Plan application with the following conditions:
- All comments noted in Kiley Associates, LLC review correspondence dated November 20, 2018.
- Pike County Planning Agency review of all plans
- Fire Alarm and Knox Box Installation required
- Ancil System to be installed according to building code/fire code requirement
- No “to go” alcohol sales on premises
- No alcohol consumed outside of the proposed facility
- All alcohol servers will be certified
The motion was seconded by Supervisor Bostinto and carries with all in favor.
A motion was made by Vice Chairman Dotey to approve the following the following modification/waiver requests for the Arrump, LLC- Revised Minor Land Development Plan:
- SALDO 305.1-Modification Request for a Performance Guarantee/Financial Security and Developer’s Agreement has been submitted by the applicant due to the limited amount of required site improvements necessary.
- SALDO 310-Modification Request for a Traffic Study
- SALDO 404.1-Modification Request for Plan Scale
The motion was seconded by Supervisor Schaldonat and carries with all in favor.
Letter from Planning Commission-Downtown Baseball and Softball Academy-Re-application for Map Signing: Representative: John Fuller, Fuller Engineering
Mr. Fuller explained that he re-applied for the Downtown Baseball and Softball Academy Land Development since the approved maps were not recorded within the 90 day recording requirement. The plan is exactly the same as the approved plan.
A motion was made by Vice Chairman Dotey to approve the Downtown Baseball and Softball Academy re-submission of the same plan as approved on July 2, 2018. The motion was seconded by Supervisor Fischer and carries with all in favor.
A motion was made by Supervisor Bostinto to waive the fees for said application since no resource costs have been charged to the township. The motion was seconded by Supervisor Schaldonat and carries with all in favor.
