The Regular meeting of the Westfall Township Board of Supervisors was held Tuesday, December 10, 2019 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

 

Those present were Chairman, Robert Melvin (arrived at 7:19 pm); Vice Chairman, Jerry Dotey; Supervisors; Robert Bostinto, Paul Fischer and Paul Schaldonat; Solicitor; Robert Bernathy; and Secretary, Jodi Manheim; Zoning Officer, Jeff Cammerino. Also present were Road Master, Bill Schneider; Westfall Township Fire Department Chief Fred Jacobs; Attorney Jason Ohliger, Mike Gable, Boucher and James and approximately three members of the general public.

EXECUTIVE SESSION: The last executive session was held on and November 4, 2019 at 6:46 pm for potential litigation.

APPROVAL OF AGENDA:

Ms. Manheim added “Resolution Number Change” as #6 under New Business. A motion was made by Vice Chairman Dotey to approve the amendment to the agenda.  The motion was seconded by Supervisors Bostinto and carries with all in favor.

A motion was made by Supervisor Schaldonat to approve the amended agenda. The motion was seconded by Supervisor Bostinto and carries with all in favor.

PUBLIC COMMENT: No public comment.

MINUTES:

November 4, 2019 –Regular Meeting Minutes: A motion was made by Supervisor Schaldonat to approve the November 4, 2019 Regular Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with all in favor.

TREASURER’S REPORT: Mr. Myer was absent. The report through the month of November, 2019 is on file at the Township Office.

POLICE REPORT:  No representative present.  The November 2019 Police Report is on file at the Township Office.

WESTFALL FIRE DEPARTMENT REPORT: Chief Jacobs gave the report for the month of November, 2019 which reflects the following:

 

Automatic Fire Alarms: 4

Brush Fire: 1

CO Alarm: 1

Investigation Chief: 2

Investigation Outside: 2

MVA: 8

Structure Fire: 4

Unattended Control Burn: 1

Wires Down: 1

 

Total Calls For November: 24

The EMS Report for the month of November, 2019 was as follows: Dingman Township-9; Matamoras Borough-15; Milford Boro-13; Milford Township-8; Orange County-10; Shohola Township-2; Sussex County-1; Westfall Township-55

Training: 3 training nights for a total of 126 training hours

Solicitor Bernathy stated he received word of a potential inter-municipal agreement for ambulance services.

Chief Jacobs noted that the Assisted Living Center in Port Jervis is producing 6 to 10 ambulance calls per day.

A motion was made by Supervisor Fischer to approve the Westfall Fire Department report for the month of November, 2019.  The motion was seconded by Supervisor Schaldonat and carries with all in favor.

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for November, 2019 which reflects the following:

  1. Most of the month spent preparing for or cleaning up winter storms
  2. Clean up of fallen trees
  3. New salt shed is 90% full of material
  4. 300 ton of anti-skid on site
  5. New highway department part time drivers are working out well
  6. Four trucks out for storms
  7. Cleared out the sub-station for police department use

Supervisor Schaldonat questioned the timing for the flood abatement demonstration. Mr. Schneider stated he would inform the Board as soon as he received the information.

A motion was made by Supervisor Fischer to approve the Highway Department Report for November, 2019. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

BUILDING/ZONING REPORT:  Jeff Cammerino gave the report for November, 2019 which reflects the following:

7 Building Permits $5,911.50; 1 Electrical Permit $184.50; 2 Zoning Permits $150.00

Total Fees $6,246.00

A motion was made by Supervisor Fischer to approve the Building/Zoning Report for November, 2019. The motion was seconded by Supervisor Bostinto and carries with all in favor.

EMERGENCY MANAGEMENT: Mr. Fischetta was absent.  The EMA report for the month of November, 2019 is on file at the Township Office.

 

CORRESPONDENCE:  On desk for review.    

OLD BUSINESS:

Salt Storage Structure-Change order approval and completion of project/payment approval: A change order was reviewed for approval which increased the salt shed base cost by $2,000 due to a change in apron material.

A motion was made by Supervisor Fischer to approve the change order and additional cost of $2,000.00 for a total cost of $108,453.22 of the base structure and to authorize payment for same and payment in the amount of $45,754.00 for the upper portion of the salt shed completion. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

NEW BUSINESS:  

Adoption of Final 2020 Budget-Resolution 2019-4 and 2019-5: Solicitor Bernathy read both Resolutions.

A motion was made by Supervisor Fischer to approve Resolution 2019-4. The motion was seconded by Supervisor Bostinto and carries with all in favor.

A motion was made by Supervisor Fischer to approve Resolution 2019-5. The motion was seconded by Supervisor Schaldonat and carries with all in favor.

United States Department of the Interior/National Park Service-Visitor Use Management Plan-Fee Proposal:

Brief discussion followed.

A motion was made by Vice Chairman Dotey to approve sending a letter of objection of the amenity fee proposal and universal fee proposal to the National Park Service. The motion was seconded by Supervisor Fischer and carries with all in favor.

Flood Insurance Renewal Premium Notice: A motion was made by Vice Chairman Dotey to approve the payment of $2,913.00 for the $60,500 Building Coverage/$22,100 Contents Coverage option for the Township Building.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Newsletter: Supervisor Schaldonat addressed the Board with ideas for a bi-annual newsletter to the township residents to inform them of all going on in the Township throughout the year.  He suggested having volunteers draft the proposed correspondence and mailing out to all residents.

 

Discussion followed. Supervisor Fischer stated the website and minutes serve this purpose currently.  Supervisors Bostinto stated the same.  Chairman Melvin stated that the minutes tell all.

This matter was tabled until the January 6, 2019 Supervisor Meeting.

Road Task Force-Appointment Form to Pike County Commissioners: A motion was made by Vice Chairman Dotey to recommend Albert Schneider’s re-appointment as Road Task Force Member for the three year term vacancy to the Pike County Commissioners.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Resolution Number Change: Chairman Melvin explained that earlier in the year two resolutions were given the same number in error.

 

A motion was made by Supervisor Fischer to change the Monroe County Local Share Grant submission Resolution Number to 2019-3 from 2019-2.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

SUBDIVISION REVIEW and ACTION:  

Paddler’s Point-Garden Apartments-Final Land Development Plan-Letter from Planning: Representatives: Attorney Jason Ohliger and Mike Gable, Boucher and James Engineering

Mr. Ohliger stated the applicant is seeking Final Land Development approval for the Paddler’s Point Garden Apartment project which has received Conditional Use approval.

Mr. Gable stated he has revised the plan to address the October 7, 2019 Kiley Associates, LLC review letter.

Solicitor Bernathy stated the latest Kiley Associates, LLC review letter is dated October 29, 2019 which was just received by the township earlier in the day. Mr. Gable stated he had not received this letter from Kiley Associates, LLC.

Solicitor Bernathy read the letter and went over each comment/condition. He also addressed each comment on the September 24. 2019 Pike County Planning review letter with Mr. Gable.

Mr. Cammerino confirmed the height of the building will meet the 35’ maximum requirement.

Chief Jacobs stated that 11.5 feet access for fire truck access is sufficient.

Mr. Ohliger stated he submitted the Developer Agreement to Mr. Bernathy just prior to the meeting.

No further comment.

A motion was made by Vice Chairman Dotey to approve the Paddler’s Point-Garden Apartments-Final Land Development Plan with the following conditions:

 

  1. All comments noted on the Kiley Associates, LLC review letter dated October 29, 2019
  2. All comments noted on the Pike County Office of Community Planning letter dated September 24, 2019
  3. All conditions noted in the October 3, 2019 Conditional Use HearingThe motion was seconded by Supervisor Fischer and carries with all in favor.

EXECUTIVE SESSION: None held.

Mr. Schneider suggested the Board confirm the flood insurance coverage for the sub-station next to the Township Building. Chairman Melvin directed Ms. Manheim to contact the RC Lain Agency to obtain the information.

ADJOURNMENT: Meeting was adjourned at 7:38 p.m. on a motion by Chairman Melvin. Motion seconded by Vice Chairman Dotey and carries with all in favor.
