Regular Supervisor Meeting Minutes-October 2, 2017

October 2, 2017

The Regular meeting of the Westfall Township Board of Supervisors was held Monday, October 2, 2017 at 7:05 pm immediately following the Public Hearing for the Volunteer Tax Credit Ordinance and the Public Hearing Continuance for the Malibu Ranch Conditional Use Application for Wellness Center. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin; Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan and Robert Bostinto; Solicitor, Robert Bernathy; and Secretary, Jodi Hulse. Also present were Treasurer, Scott Myer; Zoning Officer, Wayne Rohner; Road Master, Bill Schneider, Mill Rift Fire Chief, Tom Lamb; Westfall Township Fire Chief, Rob Llewellyn, Westfall Township Fire Department President, Bill Koferl;  Bernard Swartwood, Charles Shay, Roland MacDonald, John Dalton and seven members of the general public.

Supervisor, Paul Fischer was absent. Police Chief, Chad Stewart was absent.  Emergency Management Coordinator, Robert Ewbank was absent.

EXECUTIVE SESSION: The last executive session was held June 16, 2017.

APPROVAL OF AGENDA:

A motion was made by Supervisor Buchanan to approve the agenda. The motion was seconded by Supervisor Bostinto and carries with all in favor.  

PUBLIC COMMENT: Mr. MacDonald suggested line painting on Cummins Hill Road.  Mr. Dalton reminded the Board to vote next month. 

MINUTES: A motion was made by Supervisor Buchanan to approve the September 5, 2017 Regular Meeting minutes.  The motion was seconded by Vice Chairman Dotey and carries with three in favor and one abstention.  Chairman Melvin abstained due to his absence at the meeting.

TREASURER’S REPORT: Mr. Myer gave the report through the month of October, 2017.  Chairman Melvin stated he met with Mr. Myer to prepare for the budget workshop meetings.

The Treasurer’s Report through October, 2017 was approved on a motion by Supervisor Buchanan. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

POLICE REPORT: A motion was made by Supervisor Buchanan to accept the Report on file for the month of September, 2017. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

FIRE DEPARTMENTS: 

Mill Rift Fire Department: Chief Lamb gave the report for the month of September, 2017, which stated as follows:

9/06/17: Work Night-Ran and checked all vehicles-went over pump

9/12/17: Monthly Meeting

9/13/17: Smell of Gas-Bluestone Boulevard-Engine 2

9/13/17: Work Night-Driver Training

9/17/17: Structure Fire-Sparrowbush, NY Tanker

9/20/17: Work Night-Pump Engine-went over truck

9/27/17: Work Night-Driver Training-Engine-Tank-went over equipment

Total Man Hours: 59

Total Equipment Hours Year to date: 197

Total Man Hours for the Year: 794

A motion was made by Supervisor Buchanan to approve the Mill Rift Fire Department Report for the month of September, 2017. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Westfall Fire Department: Chief Llewellyn gave the report for the month of September, 2017, which stated as follows:

FIRE REPORT: 7 Automatic Fire Alarms; 1 Motor Vehicle Accident; 1 Hazmat Spill Control; 1 Landing Zone; 3 Structure Fires for a total of 13 calls for September; 206 Call YTD

EMS Calls: 57 Calls in Westfall Twp; 10 calls in Dingman Twp; 6 calls in Milford Twp; 8 calls in Milford Borough; 18 calls in Matamoras Borough; 1 call in Sussex County, NJ; 2 calls in Shohola Township; 5 calls in Orange County, NY for a total of 108 calls for September; 763 calls YTD

Combined YTD calls: 969

Training for the Month: Four drills/In-house training sessions held for 96 hours

Fund Raising: Tricky Tray-October 14

Other: Attended Orange County Fire Association Parade and received a 1st Place for Best Appearing out of County Apparatus and 2nd Place Out of County Marching Unit

Go24 Store has not installed fire hydrant or knox box as requested

Best Western Dry Hydrant is out of service and in need of repairs-issues with management at Best Western in making required repairs.

Discussion followed regarding the lack of Advanced Life Support unit since the Regional ALS has eliminated their service to the area. Chief Llewellyn stated that this will increase the burden of the BLS.

Chairman Melvin asked Mr. Rohner the status of the GO 24 Store matter. Mr. Rohner stated the owner of the GO24 Store is opening the existing Highway Occupancy Permit to change the location of the hydrant.

A motion was made by Chairman Melvin to direct Solicitor Bernathy to send a letter to Mr. Fuller to address the time limits noted in the Subdivision and Land Development Ordinance for the revision to the approved land development plan to change the hydrant location. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

A motion was made by Supervisor Buchanan to approve the Westfall Fire Department Report for the month of September, 2017. The motion was seconded by Chairman Melvin and carries with all in favor.

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for September, 2017.  He stated the department continued sign replacement and now all signed are replaced according to state code.  The department continued the culvert pipe replacement on Heaters Hill.  The office area lawn was mowed.  Pothole patching was done throughout the township.  Mr. Schneider met with the Penn DOT representative to obtain a paving estimate for the budget workshop.  He also met with the Park Service at the Pearce House to discuss the right of way.  Mr. Schneider worked on preparing the highway department budget for 2018.  The department continued clearing brush in the township right of way.  They mowed the shoulders with mower and brush hog.  They also started getting the spreaders ready for the winter season.  New tires were installed on the pick up truck and a new front tire was installed on the back hoe.  The department painted the tunnel off of Rose Lane.  Mr. Schneider attended the monthly road task force meeting.

Mr. Schneider met with the Park Service regarding paving the road in front of the Pearce House. The Park Service representatives stated they would pay for the material if the township supplies the labor.  Solicitor Bernathy asked Mr. Schneider to obtain a contract from the Park Service for the Board’s review.

Mr. Schneider asked to Board to send a letter to Penn DOT regarding the replacement of the fence by Shay Lane (at the end of Reuben Bell Drive). Supervisor Buchanan directed Mr. Schneider to send the letter from the Highway Department.

Mr. Schneider responded to Mr. MacDonald’s question regarding line painting. He said line painting is not required by law in a second class township.

A motion was made by Supervisor Buchanan to approve the September, 2017 Highway Report. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for September, 2017. He reported one mechanical and one building permit for the month which totaled $752.00 in permit fees.

Mr. Rohner noted he is working on obtaining a quote for parking lot lighting. Supervisor Buchanan asked Mr. Rohner to look into the amount of parking spaces required for the parking lot at the township office.

A motion was made by Supervisor Buchanan to approve the Building/Zoning Report for September, 2017. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

EMERGENCY MANAGEMENT: Mr. Ewbank’s report for September, 2017 confirmed no emergency management calls for the month.

A motion was made by Chairman Melvin to accept the Emergency Management Report for September, 2017. The motion was seconded by Supervisor Buchanan and carries with all in favor.

CORRESPONDENCE:  On desk for review. 

OLD BUSINESS:  

  • Volunteer Tax Credit Ordinance: A Public Hearing was held previous to this meeting and was continued until 6:50 pm on November 6, 2017.
  • Conditional Use Application-Malibu Land Holdings, LLC-Wellness Center: Stenographer Transcript will be available from the Public Hearing held immediately prior to this meeting.
  • Gambling Ordinance Draft: Correspondence from the Planning Commission was received. Solicitor Bernathy read the recommended changes/conditions by Planning.   Brief discussion took place regarding the conditions.

 

A motion was made by Supervisor Bostinto to refer the draft with recommended changes to Kiley Associates, LLC to research and make sure the provisions are practical and non-exclusionary in the C-2 and C-3 zones.   The motion also included sending the draft ordinance to Pike County Planning for review and comment.

The motion as seconded by Supervisor Buchanan and carries with all in favor.

  • Proposed Fire Code Enforcement Ordinance:   This matter was tabled until the November 6, 2017 Regular Supervisor Meeting.
  • Emergency Access Road-Township Property-Delaware Drive to Decker Lane: This matter was tabled until the November 6, 2017 Regular Supervisor Meeting.
  • Fire Tower Road: Supervisor Buchanan stated that this matter was brought up last year and needs to be revisited. Discussion followed regarding costs of maintaining the road. Solicitor Bernathy stated he would review the information on file and bring the information to the Board at the November 6, 2017 Supervisor meeting. The matter was table until then.

 

  1. Parking Lot Lighting: This matter was discussed earlier in the meeting. Mr. Rohner is working on obtaining price quotes and specifications.

 

NEW BUSINESS:

  • Approval of Zoning Officer Hours: A motion was made by Chairman Melvin to approve the extra hours worked by Mr. Rohner on 9/12/17 through 9/14/17-24 hours total. The motion was seconded by Supervisor Buchanan and carries with all in favor.
  • Resolution 2017-3 Pike County Hazard Mitigation Plan-Municipal Adoption Resolution: Chairman Melvin read the Resolution.

 

 

A motion was made by Supervisor Buchanan to adopt Resolution 2017-3 as the Pike County Hazard Mitigation Plan-Municipal Adoption Resolution. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

  • 2017 Ballot for Election of Trustees: A motion was made by Supervisor Buchanan to elect Jack Hines and Tim Horner as members of the Board of Trustees of the Pennsylvania Township Health Insurance Cooperative Trust for January 1, 2018 through December 31, 2020. The motion was seconded by Supervisor Bostinto and carries with all in favor.
  • Close NBT Bank Account-Fire Loss Checking Account: This account has been inactive for approximately four years and Mr. Myer was contacted by NBT Bank to close the account. Supervisor Buchanan stated we will open a new account if needed.

 

 

A motion was made by Supervisor Buchanan to close the account. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

  • Payoff Truck Loan financed by Municipal Authority of Westfall Township: A motion was made by Supervisor Buchanan to pay off the subject loan from the general fund in the amount of $44,962.87. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
  • Pearce House-Right of Way: Mr. Schneider presented the Board with photos of the Right of Way area. Mr. Schneider explained that the Park Service is willing to supply the materials to pave the right of way if the Township supplies the labor and maintenance. Solicitor Bernathy asked Mr. Schneider to obtain an agreement from the Park Service for review.

 

 

SUBDIVSION/LAND DEVELOPMENT/CONDITIONAL USE-REVIEW AND ACTION:

 

  • Tri-State RV Park/Charles Shay: Storm Water Management Plan and Flood Plain Application-Letter from Planning: Solicitor Bernathy read the letter from Planning and explained the application.

 

A motion was made by Supervisor Buchanan to approve the application with the conditions reflected on the correspondence from the Planning Commission dated September 26, 2017. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

EXECUTIVE SESSION:

 

An Executive Session was called at 7:51 pm for the purpose of personnel matters.

 

The meeting was called back to order at 7:58 pm. Supervisor Buchanan was not in attendance at this time.

Chairman Melvin stated the purpose of the Executive Session was to discuss the Pension Plan for the Township Employees.

A motion was made by Vice Chairman Dotey to direct Solicitor Bernathy to prepare a draft ordinance to revise the current Non Uniform Pension Plan Ordinance to reflect changes to the eligibility of retirement benefit of the Township Employees.   The motion was seconded Supervisor Bostinto and carries with all in favor.

 

ADJOURNMENT: Meeting was adjourned at 8:00 p.m. on a motion by Supervisor Bostinto. Motion seconded by Vice Chairman Dotey and carries with all in favor.
