February 2, 2015-Public Hearing

Westfall Township, Matamoras, PA

February 2, 2015

A public hearing was held on Monday, February 2, 2015 for the purpose of taking public comment on proposed Ordinance #162-Increasing the Indebtedness of Westfall Township by the issue of a General Obligation Note in the amount of one hundred thousand dollars ($100,000.00). The meeting was held at the Westfall Township Building on Delaware Drive and LaBarr Lane, Matamoras, PA 18336 at 6:30 pm.

Those present were Vice Chairman Robert Melvin; Supervisors; Raymond Banach and Jerry Dotey; Solicitor, Robert Bernathy; and Secretary, Jodi Hulse. Chairman Larry Flansburg and Supervisor Lester Buchanan were not present.  Also present were three members of the general public.

Solicitor Bernathy stated the required legal notice is on file.

There was no public comment.

Motion was made by Supervisor Banach to adopt Ordinance #162.  The motion was seconded by Supervisor Dotey and carries with all in favor.

Solicitor Bernathy closed the public hearing at 6:35 pm.

February 2, 2015-Supervisor Regular Meeting Minutes

Westfall Township, Matamoras, PA

February 2, 2015

The regular meeting of the Westfall Township Board of Supervisors was held Monday, February 2, 2015 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Vice Chairman, Robert Melvin; Supervisors, Raymond Banach, Lester J. Buchanan and Jerry Dotey; Solicitor, Robert Bernathy, and Secretary, Jodi Hulse. Also present were Scott Myer, Bill Schneider, Chad Stewart, Chuck Pranski, John Dalton, Thomas York and approximately 10 members of the general public.

APPROVAL OF AGENDA:  

Supervisor Banach added #4 to “New Business” as Malibu Dude Ranch-Tom York- application for firework display.  He also tabled #1 under “Old Business”.

Agenda approved on a motion by Supervisor Banach.  Motion seconded by Supervisor Dotey and carries with all in favor.

EXECUTIVE SESSION:  NONE

PUBLIC COMMENT:   No public comment.

MINUTES:  A motion was made by Supervisor Dotey to approve the January 5, 2015 Organization Meeting Minutes.  The motion was seconded by Supervisor Banach.  The motion carries with all in favor.

A motion was made by Supervisor Dotey to approve the December 5, 2015 Regular Meeting Minutes.  The motion was seconded by Supervisor Banach and carries with all in favor.

A motion was made by Supervisor Banach to approve the January 22, 2015 Public Hearing Minutes.  The motion was seconded by Supervisor Dotey and carries with all in favor.

TREASURER’S REPORT:  Scott Myer gave the report.   He said the report has been provided to the Board.  Mr. Myer addressed the Board and said the Township needs the Tax Anticipation Note to make the Eastern Pike Regional Police Department payment for January.  Solicitor Bernathy said he anticipates and closing this week.

A motion was made by Supervisor Buchanan to accept the Treasurer’s Report.  The motion was seconded by Supervisor Dotey and carries with all in favor.  

POLICE REPORT:  Chad Stewart gave the Police Report.  The report was for the month of January, 2015.   The following are the monthly count of offenses known to Police:  1 Rape, 2 Assault, 2 Burglary, 14 Larceny Theft, 1 Motor Vehicle Theft, 1 Forgery, 2 Fraud, 1 Vandalism, 5 Disorderly Conduct, 1 all other offenses.  The following is the monthly count of persons charged for offenses:  1 Rape, 9 Larceny Theft, 1 Fraud, 1 Vandalism, 1 Disorderly Conduct.  Miles patrolled for the month were 4,760.    Motor vehicle accidents for the month were 16.  Call for service for the month were 142.

Chief Stewart thanked the Westfall Township Sewer Authority for the donation of a Defibrillator.

 

Supervisor Dotey moved to approve the Police Report.  Motion was seconded by Supervisor Buchanan and carries with all in favor.

FIRE DEPARTMENT:

Mill Rift Fire Department:  Charles Pranski gave the report for January, 2015.  The report is as follows:

January 3, 2015 Call at 131 Rivers Edge Drive; January 8, 2015 Call at Cummins Hill Road; January 13, 2015 Monthly Meeting at Mill Rift Fire House; January 21, 2015 Work Detail at Sub Station; January 28, 2015 Work Detail Sub Station.  Total Apparatus Hours for the Month-3 hours and 35 minutes.  Total Man Hours for the monthy-42 hours and 45 minutes.

Westfall Fire Department:   No representative/report was present at meeting.

The Mill Rift Fire Department Report was accepted by a motion made by Supervisor Dotey.  The motion was seconded by Supervisor Buchanan and carries with all in favor.

HIGHWAY DEPARTMENT:   Bill Schneider gave the report for January, 2015.  The department tended to storms on the following dates:  January 6, 9, 12, 13, 18, 20, 21, 24, 26, 29, 31 and February 2, 2015.  Mr. Schneider ordered 225 ton of salt and received 150 ton so far.  He also attended the meeting at the Pike County Conservation District regarding the Dirt and Gravel Road Grant and attended the Road Task Force Meeting for the month of January.  The department performed maintenance on the equipment.  Mr. Schneider is also continuing to obtain the pole numbers for the letter to the Public Utility Commission.

The Highway Department Report was accepted by a motion made by Supervisor Banach.  The motion was seconded by Supervisor Dotey and carries with all in favor.

BUILDING/ZONING REPORT:  Michael Rendleman was not present therefore Secretary Hulse read the report for January.  She said there were 5 building permits, 2 electrical permits, and 1 Zoning Permit for the month of January, 2015.  Total fees collected were $2,375.08.

Supervisor Dotey moved to approve the report. Motion was seconded by Supervisor Banach and carries with all in favor.

EMERGENCY MANAGEMENT:  Secretary Hulse read the report provided by Mr. Ewbank.  The report stated the following:  January 4, 2015: Assistant Coordinator Jimmy Ellison responded to a fire alarm at Heritage Point.  January 22, 2015: Bob Ewbank attended 8 hour G191 Training at the Pike County Training Center.

Supervisor Banach moved to approve the Emergency Management Report.  The motion was seconded by Supervisor Dotey and carries with all in favor.

CORRESPONDENCE:  On desk for review.   

OLD BUSINESS:    

Earned Income Tax:  Tabled until March 2, 2015 Supervisor Meeting.   This will be placed on the agenda as an informational session.

Appointment of Zoning Officer-Michael Rendleman:  A motion was made by Supervisor Buchanan to appoint Michael Rendleman as Temporary Zoning Officer.  The motion was seconded by Supervisor Banach and carries with all in favor.

Letter from William Lamac regarding Henchel Road Water Issue:  Discussion was held regarding this correspondence.  No motions were made.  

NEW BUSINESS:  

Letter of Interest from John Dalton-Non-Uniform Pension Plan Committee Member:  A motion was made by Supervisor Buchanan to appoint Mr. Dalton to the resident vacancy on the Non-Uniform Pension Plan Committee for Westfall Township.  The motion was seconded by Supervisor Dotey and carries with all in favor.

Letter of Resignation from Supervisor Lawrence Flansburg:  A motion was made by Supervisor Buchanan to accept the letter of resignation from Mr. Flansburg.  The motion was seconded by Vice Chairman Melvin and carried with three in favor and one opposition.  Supervisor Banach was opposed.

Letter from the Faith Family Fellowship:  The Faith Family Fellowship will no longer be renting the lower level of the Township Building.  No action required.

Application for Fireworks Display for June 27, 2015 from Tom York/Malibu Dude Ranch:  A motion was made by Supervisor Buchanan to approve the application with the conditions stated by Solicitor Bernathy and listed in letter to applicant from Solicitor Bernathy dated January 3, 2015.  The motion was seconded by Supervisor Banach and carries with all in favor.

A motion was made by Supervisor Buchanan to appoint Robert Bostinto as Supervisor to complete Mr. Flansburg’s term of office.  The motion was seconded by Vice Chairman Melvin.

Additional discussion followed.

The motion carries with all in favor.

SUBDIVISION REVIEW and ACTION: None 

EXECUTIVE SESSION:  

An executive session was called at 7:35 pm for Personnel matter regarding appointment of Deputy Tax Collector.

The meeting was back in session at 7:42 pm.

A motion was made by Supervisor Buchanan to appoint Kim Pearce as Deputy Tax Collector.  The motion was seconded by Vice Chairman Melvin.  Supervisors Dotey and Banach were opposed.  The motion did not carry.

The matter was tabled.

ADJOURNMENT: Meeting was adjourned at 7:45 p.m. on a motion by Supervisor Banach. Motion seconded by Supervisor Buchanan and carries with all in favor.
