December 19, 2012

The Westfall Township Board of Supervisors held a Special meeting on Wednesday, December 19, 2012 at 7:00 PM. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Ewbank; Vice-chairman, Paul Fischer; Supervisors Raymond Banach and Robert Melvin; Solicitor, Robert Bernathy and Secretary, Lisa Green. Also present were Scott Myer, Bill Jamros, John Stieh, John & Tina Hess, Thomas Mincer, Scott Quinn, Beth Brelje, and seven members of the general public. Supervisor Larry Flansburg was not present.

AGENDA:  Motion to approve the agenda was made by Supervisor Banach. Motion is seconded by Supervisor Melvin and carried with all in favor.

PUBLIC COMMENT: Bill Jamros said he is in favor of the amusement tax however in his research he found that most municipalities were charging upwards of 5% and that 1% is very low. Solicitor Bernathy said that was noted during the hearing.

NEW BUSINESS:

Adopt 2013 Budget: Chairman Ewbank said we have resolution 2012-5 and 2012-6 for the purpose of adopting the 2013 budget.

Resolution 2012-5: Solicitor Bernathy read resolution 2012-5 fixing the millage rate for the 2013 budget year. Supervisor Melvin moved to adopt resolution 2012-5. Motion is seconded by Vice-chairman Fischer and carries with all in favor.

Resolution 2012-6: Solicitor Bernathy stated resolution 2012-6 is for the revenues and expenditures of the fiscal year 2013, the amounts shown on the attached 2013 Budget are hereby appropriated from the funds, equities, revenues, and other financing sources available for the year 2013 for the specific purposes set forth.

Supervisor Melvin moved to adopt resolution 2012-6. Motion is seconded by Supervisor Banach and carries with all in favor.

Set Pay Rate for Robert Howard $15.60 Per Hour: Supervisor Banach moved to approve the increase in salary for Robert Howard to $15.60 per hour. Vice-chairman Fischer asked what Mr. Howard is currently making. He is making $15 per hour. Motion is seconded by Supervisor Melvin and carries with all in favor. This pay increase will be effective January 1, 2013.

Hiring of full-time Highway Employee: Supervisor Melvin moved to hire Dick Mai from part time to full time effective January 1, 2013. This will include all full-time benefits as set forth in Westfall Township employee policy manual. Motion is seconded by Supervisor Banach and carries with all in favor.

Berkheimer Associates Resolutions: Chairman Ewbank said we have four resolutions from Berkheimer Associates for the collection of the Amusement Tax. These have all been reviewed by our solicitor and found to be acceptable. Supervisor Banach questioned if the two-year term is standard, and asked if we found the Amusement Tax was not beneficial for us and we backed out would we be penalized by Berkheimer. Solicitor Bernathy said there are provisions in there for placing either party on notice; however this is a two-year contract unless there’s cause. Solicitor Bernathy further stated part of the resolution is the contract which is on the agenda and he is going task that the contract be subject to his review as there are a few things in the contract that he would like to bring to the supervisors attention. Supervisor Melvin moved to approve the four following resolutions. Motion is seconded by Vice-chairman Fischer and carries with all in favor.

Berkheimer Associates Agreement: Chairman Ewbank said that we have an agreement from Berkheimer for the collection of the Amusement Tax. Solicitor Bernathy asked to make that subject to his review. Vice-chairman Fischer said he is not clear on the answer to the question raised by Supervisor Banach regarding the two-year term. Solicitor Bernathy said there are a number of things in the agreement that need to be addressed. One being parent authority by execution of the agreement, meaning they have settlement authority to resolve accounts in court. There is also jurisdictional concern and concern of the two-year term. Lastly they referred to approving their rules and regulations and Solicitor Bernathy does not know what they are.  Solicitor Bernathy said with those four changes the board can approve the agreement. Supervisor Banach moved to approve the agreement subject to solicitor Bernathy’s review and with the stated changes. Motion is seconded by Supervisor Melvin and carries with all in favor.

Review Zoning as per Signage – Off Site Signs – Size Limits: Mrs. Green said Supervisor Flansburg had asked to place this on the agenda and the board members each have a copy of the sign section of the zoning ordinance. Supervisor Melvin questioned if it would make sense for the board to review the information because there is concern from some of the businesses in town. Supervisor Banach said we need to review the sign information and hold a workshop to discuss the changes so they can be done all at one time. For example the Home Depot needs a sign and our sign ordinance is very restrictive. Supervisor Melvin said one thing that he has heard from Home Depot is that they have the signage from Interstate 84 but no one knows where they’re located off the Interstate. Supervisor Melvin said the last thing that anyone wants is for Home Depot to lose money and go out of business and the Township to have a big box store that sitting vacant. Further stating that he wants to make sure that those businesses can advertise and thrive. Supervisor Banach said we need to have a workshop in order to talk about that and get with the zoning officer. Further commenting that Phantom Fireworks just had a zoning hearing to get signs approved and they had to pay several hundred dollars for an exception. This item will be tabled until January 7, 2013 when we can schedule a workshop meeting to discuss it.

DVSD – Salt / Antiskid: Supervisor Banach said that this came about when he spoke to Bill Schneider. Further stating that he just signed the bills for the month and we are losing money. Supervisor Banach said a previous supervisor made a deal with the school district to allow them to get winter material from us and their maintenance workers come to the township garage use our backhoe and load their truck’s with our antiskid for the school. Supervisor Banach said if he falls it could be a lawsuit. Mrs. Green asked what is the difference between a yard and a ton because we are billing them per yard but we get billed per ton. Discussion followed. Supervisor Banach feels this is a practice that we should disband. Supervisor Melvin asked if this is because the school district does not have their own facility to store it. Vice-chairman Fischer suggested our road crew load it for them. Solicitor Bernathy said a non-township employee should not be operating our equipment and we need to take action on that. There’s also the disparity between what we are paying and what we are charging. Further discussion followed. Mrs. Green will call Marvin Eversdyke, Director of Support Services for the school district in the morning. Mr. Jamros said as a taxpayer he pays school tax and Township tax and questioned why is the school district taking anything from the Township. Solicitor Bernathy said sometimes there are inter-governmental cooperative agreements. In this case a stop will be put to it immediately.

Letter for Sales Tax: Supervisor Banach said he feels we should get the ball rolling again on the County sales tax. Thomas Mincer said that issue has been raised at the Supervisors convention a few years ago and as long as it was directed on the municipal level to reduce property taxes everyone seemed to be in favor of that but it died. Mr. Mincer said the county was supposed to get half and the municipality would get half and he feels if we send a letter to every Township and Borough in the County that a lot of municipalities would get behind us. Mr. Mincer said he is on the board at Dingman Township and if we send them a letter he will make sure we get their support.

SUBDIVISION REVIEW AND ACTION:

Smokers Choice: Representatives – Attorney, Thomas Mincer

Solicitor Bernathy acknowledged that we have counsel here for Smokers Choice and gave the Supervisors some background by stating that the record should reflect that the application for land development as well as for the lot improvement has been reviewed first by the Office of Community Planning and they have no adverse comments and find that the plan as submitted is consistent with the Pike County Comprehensive Plan update and municipal ordinances. The record should also reflect that the application has been reviewed by the Pike County Conservation District. They have determined that the plan is adequate and valid for two years from the date of issuance to address erosion and sediment pollution control. It meets compliance with DEP rules and regulations. The record should also reflect that the application has been reviewed by the Township Engineer, Kiley Associates and the comments as contained in the October 22, 2012 letter have been addressed in the plan that is pending before the Supervisors. Finally and most importantly the board has a letter before them from the Westfall Township Planning Commission that indicates a motion was made with two members in favor and two abstentions with one member absent on October 23, 2012 to recommend approval of the application with the conditions that there is adequate water and sewer, that a Lot Combination Deed be submitted, the Township Engineers comments of October 22, 2012 be addressed and finally approval from the Pike County Conservation District.  Solicitor Bernathy said sitting in with Planning on this review that Planning did its best under the circumstances to ask for alternatives for purposes of ingress and egress as far as the adjacent streets are concerned. They did ask and did receive through the applicant from PennDOT their note that they would not consider one of the existing accesses on Route 6 and 209 as anything other than an exit. Planning did consider that, hoping that maybe that would be an entrance and exit however PennDOT representative Kevin Miluszusky said PennDOT was not interested in allowing an entrance to that property off of Route 6 & 209. Again that review came from planning’s concerns about the impact that that would have on adjacent residential areas. The plan that’s presented to the board now has an exit onto US Route 6 and James St. and away from Elizabeth Street. Other than that it is up for the boards review and consideration.

Attorney Mincer said he is here on behalf of the applicant and he has two witnesses to call. Attorney Stieh asked to be granted standing on behalf of Mr. and Mrs. Hess. Solicitor Bernathy replied that as the Hess’s are adjacent property owners they have standing. Attorney Mincer called Scott Quinn as his first witness. Mr. Quinn brought plans to the Supervisors for their review, stating that the first sheet shows the existing conditions and that this is a lot combination. Four existing lots will be consolidated and the applicant owns all four properties. Supervisor Melvin questioned if this is where the brown house is located and if it will remain. Solicitor Bernathy said that is where the brown house is located but it will not remain and the supervisors will be shown from the plans what to expect. Mr. Quinn said the future plan shows there will be one entrance going in across from the Hess residence and they will be maintaining the existing exit off of Route 6. Solicitor Bernathy said currently the exit is coming out onto Elizabeth Street and lights are shining into the Hess’s house and planning did not want there to be an exit onto Elizabeth Street. Attorney Stieh said there are no headlights shining into their house and disputed where the exit was. For purposes of order Attorney Mincer requested to continue questioning his witness and then allowing Attorney Stieh to do the same. Mr. Quinn and Attorney Mincer reviewed the plans with the supervisors showing the current conditions and the proposed plan. Mr. Quinn spoke of the two drive thru windows that they are proposing and stated the furthest car from Elizabeth Street is about 190 feet. Vice-chairman Fischer questioned if there is a simple way to prevent cars from exiting onto Elizabeth Street. Mr. Quinn answered that they have limited the width of the entrance for the purpose of restricting it to an entrance only and will place curbing & signage off Elizabeth Street. Attorney Mincer said this is one of the agreements the applicant made was to restrict that drive to entrance only. Attorney Mincer asked that the map and everything that has been recorded be made part of the record. Attorney Mincer asked Mr. Quinn if he received technical comments from the Township engineer and whether he has met or exceeded all of those comments. Mr. Quinn said he did receive technical comments and they have been addressed. Attorney Mincer asked if the plans that have been provided for tonight are the final plans. Mr. Quinn said that is correct. Attorney Mincer asked if these plans meet all of the zoning and planning ordinances. Mr. Quinn said yes. Attorney Mincer asked if the applicant has met or exceeded all of the screening requirements. Mr. Quinn answered yes they do. Attorney Mincer asked if there will be better handicap access to the building and handicap parking. Mr. Quinn answered yes that is correct. Attorney Mincer questioned if parking and traffic flows with the new plan will be safer and superior than the traffic flows that currently exist. Mr. Quinn answered yes. Attorney Mincer questioned if PennDOT has made it very clear that there would be no entrance off of Route 6. Mr. Quinn answered that is correct. Attorney Mincer asked if there has to be an alternate entrance. Mr. Quinn answered yes. Attorney Mincer asked if the current entrance onto Elizabeth Street is an entrance and an exit. Mr. Quinn answered yes. Attorney Mincer questioned if that will be restricted to only an entrance now and there will be no headlights coming the other way. Mr. Quinn answered that is correct. Attorney Mincer questioned if James Street is currently an exit and an entrance. Mr. Quinn answered James Street is not a part of the existing plan. Attorney Mincer questioned who owns the properties on the other side of James Street. Mr. Quinn answered the fireworks store. Attorney mincer asked if there were only commercial properties there. Mr. Quinn said that is correct. Attorney Mincer questioned if the zone is appropriate for the use. Mr. Quinn answered yes. Attorney Mincer asked if there were any objections from the Township Planning Commission or the Township Engineer as to any portion of the project. Mr. Quinn answered not to his knowledge. Attorney Mincer said he has no further questions of Mr. Quinn.

Attorney Stieh asked Mr. Quinn if there was anything in the Township ordinance that required an entrance off of Elizabeth Street. Mr. Quinn answered not to his knowledge no. Attorney Stieh questioned if the Township chose not to approve this plan you could still acquire access off of James Street and have both an access and an exit off of James Street and not interfere with the Hess’s property. Mr. Quinn said they looked at just that and it just doesn’t work with this building with the drive thru windows. Attorney Stieh said if you change the configuration of the building you could have access off of James Street isn’t that correct. Mr. Quinn said not with this building. Attorney Stieh questioned if there is a problem with the building or a problem with the parking as it is laid out. Mr. Quinn said he doesn’t understand the question. Attorney Stieh said suppose you move the entrance off of James Street to the south you could still have your drive-in going into the drive-in window couldn’t you. And you can have an exit on Route 6 couldn’t you? Mr. Quinn said possibly. Attorney Stieh said you could have traffic circulation for an exit off of James Street. Mr. Quinn said you couldn’t still have two way traffic off of James Street. Attorney Stieh questioned what Mr. Quinn had up in the front. Mr. Quinn said there is a 30 foot setback to the property line. Attorney Stieh questioned if there is any prohibition to having a driveway there. Mr. Quinn said not to his knowledge. Attorney Stieh stated they could have a driveway across the front of the property have traffic circulate in and out of James Street go through the drive in and not interfere with the use of the Hess’ property on Elizabeth Street. Chairman Ewbank said the only problem he sees with that is the traffic would be going backwards from the way the building is designed. Attorney Stieh said he would have to circulate around. Supervisor Banach said you probably could not have a driveway in the state right-of-way. Attorney Stieh questioned how close a certain parking spot was to the property line. Mr. Quinn answered approximately four to five feet. Attorney Stieh questioned the side yard setback. Mr. Quinn said the back yard setback is 20 feet and each of the three sides must be considered a front yard setback. Attorney Stieh asked if Mr. Quinn looked that section 505.202 of the SALDO which says ‘the total lot area shall be sufficient to provide adequate space for required yards, proposed buildings, off street parking and loading, landscaping, sewer and water systems, and other facilities. And a. Each lot or area plotted for industrial and/or commercial use shall provide, inside of the required yards, an area at least equal to the projected horizontal area of the proposed building, plus such additional area as is required for parking.’ Attorney Stieh said this parking is in fact in the setback. Supervisor Melvin questioned the equation. Attorney Stieh said there was no equation. And reread section 505.202 a. of the SALDO. Plans were reviewed. Solicitor Bernathy said additionally the board needs to note that this is an pre-existing business that has been there for some time and as far as setbacks are concerned you can tell by the pre-existing drawings those setbacks as far as applicability is concerned are superseded by the fact that this is a pre-existing business. So as far as setbacks are concerned you need to take into consideration that this is not an undeveloped parcel and rather this is a parcel that is pre-existing and we have close proximity to US Route 6 and Elizabeth St. so you need to take that into consideration. And of course that business is going to be demolished. Attorney Stieh said this is not a prior nonconforming use. Solicitor Bernathy said it is a pre-existing use and that is exactly what it is and as far as Attorney Stieh’s position is concerned it is a pre-existing use and the setbacks as applicable are already, using your argument, being violated by the conditions of the property. And that is the whole idea behind an existing pre-existing use. Attorney Stieh said this is a new development proposal. Solicitor Bernathy said you have a pre-existing business with the pre-existing footprint and pre-existing parking. Attorney Stieh said that this building is not being built on the same footprint. Solicitor Bernathy said it does not matter it is the parking as it exists now, just so the supervisors are aware. Further stating the attorneys have both made their points. Attorney Stieh questioned if there has been a traffic study done to review the impact of this proposal on the neighborhood. Solicitor Bernathy said there has not been a formal traffic study done. Attorney Stieh questioned if there has been any determination made by anybody other than the applicant’s engineer that this does not constitute a hazard to traffic. Solicitor Bernathy said yes by the Township engineer and he referred to his letter which is the October 22, 2012 letter from Kiley Associates. And if there were they would bring it to the Supervisors attention so therefore it is not an issue. Attorney Stieh questioned how Solicitor Bernathy knows it is not an issue. Solicitor Bernathy answered if it were an issue it would be in his letter. Attorney Stieh questioned what has been done to ensure that there will be no conflicts with homes. Mr. Quinn said he believes they will be making a better situation than what is existing there now by making the building setback further from the home, making the window further from the home, by providing additional stacking that is provided by this plan, and they are taking measures to prevent people from exiting onto Elizabeth Street. Attorney Stieh questioned if he is correct in that the traffic will now pass their clients home and then turn into the store which does not do that now. Mr. Quinn said they can come from Elizabeth Street and also from James Street. Attorney Stieh said that amplifies his point that there is no need for an entrance off of Elizabeth St. Mr. Quinn said that is not correct. Attorney Stieh said his clients’ home is directly across the street from the entrance to the store and questioned if Mr. Quinn knew how long the Hess’s have owned their home. Mr. Quinn said he didn’t know. Supervisor Banach questioned if all of these lots that are being incorporated are in the commercial zone not residential. Mr. Quinn answered yes they are all commercial. Supervisor Banach asked the Hess’s is if their property was in a commercial zone. Mrs. Hess answered neighborhood commercial. Attorney Stieh asked if the lots are nonconforming lots. Mr. Quinn answered it is an existing nonconforming lot combining four lots to make it closer to the requirement it will be just over an acre. Attorney Stieh said that correspondence reflects that is a nonconforming lot. Mr. Quinn answered it is an existing nonconforming use and building but the proposed building was laid out to be conforming with all setbacks. Attorney Stieh questioned what the applicant is going to do to prevent traffic from exiting onto Elizabeth Street. Mr. Quinn said they’ve taken a number of measures to try to prevent people from exiting. They’re installing curbing and signage showing one way and have narrowed the entrance. Attorney Stieh said they have done nothing to create traffic devices to preclude cars from going through there such as tire deflating devices. Mr. Quinn said no they have not. Attorney Stieh said then cars will be able to pull out there if they choose to do so. Mr. Quinn said that is possible. Attorney Stieh questioned if there is anything in connection with this application where the Township is passing an ordinance dealing with traffic signage and enforcement of it. Mr. Quinn said no. Attorney Stieh questioned what the enforcement is. Mr. Quinn answered it would be up to the applicant. Attorney Stieh questioned if Mr. Quinn was the applicant and he saw somebody going out of the entrance onto Elizabeth Street what would he do. Attorney Mincer said he is not the applicant he’s the engineer and he believes that everybody understands Attorney Stieh’s point. Supervisor Banach questioned if these matters were before the planning board. Solicitor Bernathy answered yes over a period of several meetings that were well attended where the Hess’s were present and participated actively and planning tried to answer all of their questions and work with them. Further stating these are not new issues these are issues that were kicked around and discussed somewhat at length. Supervisor Banach asked if there were any concessions made. Mr. Quinn answered there were many concessions. Moving the building as far away as they could within the setback line, the signage, the curbing, the screening, fencing. Solicitor Bernathy said he does not believe the type of fencing that is on the plan was required however the applicant agreed as part of the approval process to install that to create a buffer from the adjacent parcel and the house that is existing there. Supervisor Banach questioned the landscaping plan to create a buffer between the store and the Hess’s. Further questioning the lighting which Mr. Quinn answered was addressed. Solicitor Bernathy said that was asked of planning, and the question is whether the plan as presented is going to cut down on traffic that’s going to appear on the adjacent street. Mr. Quinn answered yes because now it will be entrance only. Mr. Quinn showed the board the landscaping and lighting plans. Solicitor Bernathy said the woman that lives adjacent to the parcel on lot 17 attended the planning board meetings and requested fencing and she was satisfied with that. Supervisor Banach suggested sidewalks down the side of the property for future planning and questioned the storm water basins. Supervisor Melvin questioned if a drive thru entrance sign could be placed along with the main entrance sign to cut back on the traffic flow on Elizabeth Street. Attorney Mincer questioned Mr. Quinn if the Township has any authority to close down an existing access. Mr. Quinn said not that he is aware of. Attorney Mincer said they’ve voluntarily agreed to an entrance only to cut down on the traffic flow and will voluntarily place the signs. Attorney Mincer said there was a question regarding a sidewalk on the side of the property and the applicant has agreed to it as long as the Township engineer agrees that it is safe. Bonding was proposed. Attorney Stieh asked about section 505.301 which states ‘traffic movements in and out of commercial and industrial areas should not interfere with external traffic, nor should it create hazards for adjacent residential areas.’ Questioning what traffic study has been done to determine whether or not there would be any hazard. Attorney Mincer said it has already been noted that no traffic study was done. Attorney Stieh said he believes it is up to the supervisors to determine whether a traffic study is required. Solicitor Bernathy said it is not necessary under these conditions. Attorney Mincer asked if the Township engineer required a traffic study. Mr. Quinn said he did not. Attorney Mincer asked if the Township engineer had any questions regarding the SALDO and their reviews. Mr. Quinn said no there were no further questions as Mr. Stieh has raised. Attorney Mincer asked if the Township engineer made any recommendations as to the existing blacktop as regards to setback on the property. Mr. Quinn stated he had no concerns. Attorney Mincer said he noticed there was no technical review or comment where this has violated any zoning ordinance and in fact they are hoping by this plan to alleviate potential traffic issues. Mr. Quinn answered yes. Attorney Mincer asked if with the money available they have done everything possible to try to make this a safe to the community as possible. Further questioning if the fencing was planned to put the non-permeable light fence in to keep light away from the other side. Attorney Mincer said the Supervisors have now requested a sidewalk along the side of the property as long as the Township engineer says it can be done for safety purposes and questioned Mr. Quinn if he would assist the applicant in doing so. Mr. Quinn answered yes.

Attorney Mincer asked if there were any other concerns that anybody brought up from the Township or the Township zoning officer or other property owners regarding the project. Mr. Quinn answered not to his knowledge. Attorney Mincer had no further questions. Attorney Stieh asked if Mr. Quinn has ever been involved with a situation where the engineer has overlooked something. Mr. Quinn said he does not disagree with that. Attorney Stieh said just because the Township engineer did not raise the issue of the traffic study… Mr. Quinn said it was talked about and determined that it was not warranted. Attorney Mincer asked to make a brief statement to the board stating the plans as presented have been studied and reviewed by all Township officials including the Township Engineer and the Solicitor and the applicant has done everything the Township has asked him to do. The Township does not have the authority to tell them you have to shut the entrance down, further stating it is an existing access way and he could’ve left it both ways however in an attempt to try to accommodate one of the neighbors he has limited that to one-way traffic. It is possible that people are going to violate the signage but the applicant has done everything humanly possible and it will be a much better situation than is there currently. They created a second in and out off of James Street to alleviate some of the traffic. PennDOT will not let them do anything else on Route 6. Attorney Mincer said the applicant has gone above and beyond on a permitted use to be a good neighbor as possible, pointing out that there is a fireworks store right next to the building and the gas station is two buildings down. The majority of property straight up-and-down is commercial in a neighborhood commercial District. They are trying to be at good neighbor and that there will be a more aesthetically pleasing building for the neighborhood. It will be better from the standpoint of lighting and they have met or exceeded every single requirement. Attorney Mincer said Attorney Stieh wants to bring these issues up now and the time for that would’ve been long before when it was in the planning process. The applicant has done everything possible with the exception of closing down the access. Attorney Mincer asked the board to approve this tonight so that they could move forward with the project.

Attorney Stieh said this has been the Hess’s home for 40 years it was a residential neighborhood when they moved in there. The zone was created as a C-1 neighborhood commercial zone, not a C-2 or C-3. The idea the neighborhood commercial District was to create a reasonable interface between the commercial use and residential use. In the zoning ordinance it says the objective of that zone is to avoid intensive commercial uses that are most likely to conflict with the scenic rural character and most likely to cause conflicts with homes and to provide for smaller scale uses that will not be intrusive; to carefully locate commercial areas and commercial driveways and minimize traffic safety congestion problems along the roads. Mr. and Mrs. Hess do not have a traffic congestion problem by their property now. This project Attorney Stieh submits will create that and that will be contrary to the intent of the zoning ordinance. Attorney Stieh further states that the SALDO speaks in several places about the need to look to and be careful about traffic hazards. Attorney Stieh states there is nothing in the world that says they have to have the access off of Elizabeth Street. There is nothing that requires that. It is a matter of their choice and desire and they have to prove that it does not cause a traffic hazard as the SALDO talks about in section 505. The ordinance also speaks to when a traffic impact study is required. Attorney Stieh said that is exactly what they’re asking the board to do is to look at a traffic impact study. Because the applicant has not done so does not mean it’s correct or follows the black letter of the law. Attorney Stieh said this also comes forward without the support of the planning commission because it only had a two member out of five member vote in favor and if he remembers the law correctly that would be a no vote. Attorney Stieh asked that the board would please give consideration to the Hess’s home which has been there for 40 years.

Attorney Mincer said Attorney Stieh made an incorrect statement that out of a five member board the planning commission had two that voted affirmatively and two that abstained and one member was absent. That is not a no vote. Solicitor Bernathy said both attorneys know that the planning commission is a recommending body and asked to move on. Further discussion was held.

Mr. Hess said everybody that comes before the board promises the world and they are saying that they will be better off however he does not feel he’s going to have less traffic down there. Attorney Mincer said now was not the time for this the time for this would’ve been three months ago when I was up planning stage.

Mrs. Hess said she brought this up several times during the planning stage.

Attorney Stieh said this is the first time this public hearing has been before the supervisors and more importantly it is the time for the supervisors to hear the applicant and to hear his clients’ position. Attorney Mincer said that is why they have the planning commission and asked that the board takes action tonight to move this project along this evening.

Solicitor Bernathy said he notes the general extensions granted by the applicant and as far as the traffic study is concerned that is only if required. It is discretionary and you have the opinion of the Township engineer stating it is not required. It is a pre-existing and arguably nonconforming use as it relates to setbacks. There is no record of an existing traffic problem and as far as this creating additional problems you would be engaged in speculation. The record should reflect this being less impactful on Elizabeth Street currently proposed rather than more impactful. If the board desires they could request a traffic study however it was not recommended by the planning commission, the Township engineer, or at Pike County Planning Commission. However the board has options. It could be approved with conditions, it could be denied and those are some of the options the board has at this time.

Supervisor Banach said he believes this to be an asset and with the driveway being all the way down there will be less people backing up onto Route 6 and 209. Mrs. Hess said there’s not going to be any signs or curbing that’s going to stop them. Supervisor Banach asked if there would be a maintenance agreement going along with this project. Solicitor Bernathy said the applicant would be required to have all the signs as stated on the plan and if they do not they would not be in compliance and would get a violation notice from the Township. Mrs. Hess asked who would enforce the traffic. The board answered the Township would enforce the signage but not the traffic. Chairman Ewbank said everything is designed to keep people from exiting onto Elizabeth Street. Further discussion followed. Mrs. Hess questioned where they were going to put the snow. Supervisor Banach questioned Mr. Quinn if the whole area in the right-of-way will be put back to grass and they can use that for snow removal. Further stating the sidewalk there would alleviate parking on the road.

Supervisor Banach moved to approve the Smokers Choice land development and Lot Combination with the following conditions: 1) Water and sewer adequacy 2) Lot Combination Recorded Deed 3)  Comments from October 22, 2012 Township Engineer letter 4)  Approval from Pike County Conservation District 5) Shrubbery added and 6) Sidewalks as agreed with Township engineer. Motion is seconded by Vice-chairman Fischer and carries with all in favor.

A public hearing was held on Thursday, November 8, 2012 for the purpose of taking public comment on the proposed Amusement Tax for Westfall Township. The meeting was held at the WestfallTownshipBuilding on Delaware Drive and LaBarr Lane, Matamoras, PA18336 at 7:02 p.m.

Those present were Chairman, Robert Ewbank, Vice-Chairman, Paul Fischer; Supervisors, Raymond Banach, Larry Flansburg, and Robert Melvin; Solicitor, Robert Bernathy and Secretary, Lisa Green. Also present were Treasurer, Scott Myer, Allen Johns, Beth Brelje, Rick Lander, Dave Jones, Michael Barth, Lisa Mickles, Eric Hamill, Luis Bocaletti, Suparmanto, Manager of the Best Western and approximately 30 members of the general public.

Chairman Ewbank thanked everyone for coming to the meeting stating we would be having a public hearing on the Amusement tax and turned the meeting over to Solicitor Bernathy.

Solicitor Bernathy said this is the date, time and place for the continuation of a previous proceeding that was conducted by the supervisors with specific regard to impose an amusement tax. That proceeding was held on October 2, 2012 and we are going to incorporate the minutes of that proceeding into the minutes of this proceeding. Since we were last here changes were made by way of modification to the amusement tax ordinance and those changes were advertised on three occasions in the Pike County Dispatch and proof of publication with regard to those advertisements will be incorporated into the preceding. When we last were here at the supervisors acknowledge that there was significant discussion and a lot of questions were asked. With that the supervisors as part of the continuation agreed to schedule a meeting with local business owners and invited them to attend a meeting on October 17, 2012. That meeting did occur and unfortunately the only business owner that came to the meeting was for Malibu Dude Ranch indicating that they had no objection to the amusement tax. Since we were last hear we have been able to gather some additional information regarding some of the businesses that are conducted by way of amusement here in WestfallTownship and we are going to supplement the record with specific regard to some information that was put together for us by the Eastern Pike regional Police Department. That is a docket of all of the responses made to some of the businesses that provide amusements in the Township. It is fairly significant as far as responses are concerned and the Township also notes the additional emergency response that is provided by various emergency responders here WestfallTownship. Again for purposes of economy we note that there are persons here who have already been heard at the previous proceeding. What we would like to do is ask if there is anyone present first who did not have the opportunity to be heard at the October 2nd proceeding that those persons be recognized. If there is anything that they would like to say for purposes of the record Solicitor Bernathy asked that they would raise their hands and be recognized.

Suparmanto the General Manager for the Best Western Inn at Hunts Landing said he believes that it is everyone’s responsibility to improve the life   and the continuation of growth and this Township yet he believes that all of those in the amusement business are being penalized. Suparmanto said that he knows it will affect his business because those people that are coming in on bus trips are elderly and any time he tries to raise the rates they say they can’t afford it.

Solicitor Bernathy asked attorney Hamill if he was here on behalf of anyone. Mr. Hamill said he is here on behalf of himself. Solicitor Bernathy asked if he was a resident of the Township. Mr. Hamill is not. Solicitor Bernathy asked if he owned the business and the Township. Mr. Hamill said he is a shareholder and on the board of directors of Slatestone Hunting Club and he is here because he saw the tax in the paper and he feels it has a strange impact on landowners as well as business owners here in the Township. He sees this tax as a strange tax commenting that if he plays a game of pool and puts for quarters and the machine is there going to have to be an extra slot to put the penny in? Otherwise it the 1% will come off the business owner’s gross income. So he believes it is a fairly significant tax even though it seems small. Giving further examples such as football game charging three dollars and having to pay $3.03. Mr. Hamill said someone would have to go down to the bank to pick up change to give out, stating they won’t do that they will just take it off the top of the three dollars and lose money. Commenting that the next step would be hiring somebody to do the tax returns because it’s due by the 10th of the next month. Suggesting this is a significant burden to the business owners. Mr. Hamill questioned if tricky trays and turkey shoots are going to be taxed as well. Mr. Hamill said for the past couple of years he has been contacted by Berkheimer Associates, wanting him to disclose his payroll and employees to see if one of his employees lives in an area where there is a local income tax. Further stating that if he needs to file additional tax returns he will not hire somebody from an area that has a local income tax. Saying the tax is not really being paid by someone else. It’s coming out of the business owners.

Supervisor Flansburg asked Mr. Hamill if he is suggesting that the tax should lie squarely on the backs of the residents. Further stating that everyone is standing up and saying don’t hurt us while all of the residents in the Township are already being hurt. Discussion followed. Supervisor Flansburg said we did not meet the Fire Department budget or the Police Department budget this year and for the additional money that we may collect on the amusement tax it might make that up.

Chairman Ewbank said each year we have to go to Court to ask for an increase above the 14 Mills that we are allowed by law to tax and this year we need to ask a 2.7 mill increase instead of the 1.7 Mills we’ve been requesting for the last several years.

Supervisor Banach said it is not to hurt the businesses, it is to make it fair for the residents commenting that someone who owns a $1 million home in Westfall Township will pay the same tax rate as the Best Western. Further questioning how many times did the homeowner call the Fire Department and the Police Department and have the ambulance come to their house. How many times are they using the service and yet they’re taxed at the same rate. There are people who come into our town and do things. Saying if it’s three cents its three cents and the business owners are saying that doesn’t count. But we are cutting things on our budget that are $10, $20 and $50 and if you keep putting pennies in the jar it adds up. Supervisor Banach further stated yes it may be a little bit of a burden but Solicitor Bernathy often speaks of the Earned Income Tax and we could take every business owner who earns $100,000 and tax them 3% and the School District will tax too and in his opinion that’s not fair because you’re taking the higher earners in the Township and giving them a double whammy. Saying the low income people don’t care because it’s not a big tax for them. This tax the board fails is fairer because it will be passed on to the transient person who uses our facilities.

Mr. Hamill feels the businesses supplement the income of the area as opposed to the households because the households burden the schools and add to the roadways. The business may call emergency responders more, but they are paying more tax.

Supervisor Banach said at the last meeting, it was disclosed that Kittatinny Canoes paid approximately $7000 in property taxes to WestfallTownship, Landers pays $395 and Indianhead pays $633. Mr. Hamill said they also employ the local kid, buy gas here and he feels we are biting the hand that feeds us. Discussion followed.

Chairman Ewbank said we have figures from the Westfall Fire Department showing their cost over the past several years to be over $50,000.

Michael Barth asked if the school is exempt. Solicitor Bernathy said we’ve calculated the figures and the amount of money from the school district would be up proximately $200. Stating we may be able to negotiate with them in order to cut down on what happens internally with the school district. Solicitor Bernathy said we are sensitive to that. However, does not find that the school district is exempt. Mr. Barth said he knows if you use the ambulance you are charged for it and questioned why can’t we charge for river rescues. Supervisor Melvin said the fire department soft bill’s and in doing that after two attempts at billing they do not go into collection. Supervisor Flansburg said we as a Township cannot bill for that.

Beth Brelje questioned of the $50,000 that Chairman Ewbank mentioned to be a cost to the Fire Department how much of that is from private citizens that took canoes on the River as opposed to who rented from the livery owners. Chairman Ewbank said those costs are for the purchase of the boat, boat repairs man-hours and not split up by users.

Luis Bocaletti, who represents the Westfall Township Fire Department wanted to let the people present know that this tax was not the idea of the Fire Department. Stating they may benefit from it but the whole amount of the tax will not go to them. Chairman Ewbank said we cut the Fire Department budget this year and we are trying to find a way to give some money back to them. Supervisor Melvin said in fairness to Luis the Fire Department did not ask the supervisors to impose this tax. Supervisor Banach stated the police and fire are always the first areas that get cut because that is the easiest to cut. And that is exactly what we cut this year. Supervisor Banach continued by stating the Westfall and Mill Rift Fire Departments are doing an excellent job, it is just that their departments were the easiest to cut.

Allen Johns, representing Have a Hoot Family Fun Center addressed Supervisor Banach and said he was out West hunting and that $.50 tax that was brought up at the last meeting is voluntary. Supervisor Banach said in Colorado and Texas he had to pay it and there was no way around it. Mr. Johns continued by stating it is an optional fee and questioned who are the transient people that the supervisors speak of, is that Milford and Port Jervis or is that just 50 miles away. Chairman Ewbank answered that is people that do not live in the Township that use our facilities and roads. Mr. Johns said he did not get notified of the October 17th meeting. Chairman Ewbank said that was at special meeting that was set for the purpose of meeting with the business owners which was agreed to at the October 2, 2012 meeting. Discussion followed. The business owners did not recall setting that date, however the Township recorded it in their meeting minutes. Supervisor Flansburg said we have a letter from the Attorney representing the canoe liveries stating that they would not be there. Mr. Jones said that was news to him.

Mr. Johns said the last time he heard from the Township was when his electrical permit fee got raised from $50-$302. Mrs. Green corrected Mr. Johns, stating that his fee did not get raised. The $50 was a review fee that’s paid at the time of application, and the $304 is the total permit fee. The Township did not raise the fee. Mr. John said in either case he did not know about the meeting. Supervisor Melvin said that Malibu Dude Ranch attended the meeting. Supervisor Flansburg said that it does not mean that the doors closed the Township is still willing to talk before we vote on the tax. Mr. Johns said he would rather pay the Township $1000 then pay a CPA $2000 to do the books. Chairman Ewbank said we still have to see if it is worth imposing the tax. Supervisor Flansburg said he wants to go on record as saying we are still open to conversation.

Mr. Jones said he believes that this tax is going to cost us more than we will earn and he also believes that they are exempt from this tax under two different exemptions. One is federal and one is from the tax itself. Stating his attorney said this is exempt but he really does not want to have to go to court over this. Mr. Jones said he just had a meeting with his accountants who told him he is losing money this year and will either have to increase his revenue or decrease his costs or he would not be around much longer. Mr. Jones continued by saying his business is not really worth anything for someone to buy because it is actually losing money, and he cannot afford a 1% tax on his business. Also having to come up with the gross income by the 10th of the month is nearly impossible. Mr. Jones said if Berkheimer were to audit him they would be there for days and he does not believe that they would charge the Township 3% to have an employee there for several days. Mr. Jones continued by saying this is a declining industry and he spent a lot of money trying to bring tourists to this area, stating that he is better off walking. Supervisor Flansburg asked Mr. Jones if he had seen the report from the Upper Delaware on the canoes that were put in the River last year stating it was shocking and grossly underreported. Mr. Jones did not see the report. Supervisor Banach said it is baffling because we were told to call the National Park Service to get our figures and we did that and it showed Kittatinny Canoes having just over 2000 canoes in the River last year. Mr. Jones said that report is not accurate. Discussion followed. Supervisor Banach said we were given a task to figure it out and we did that and this is what we received. Mr. Jones said in the whole upper Delaware there are less than 200,000 canoes being used which is why he built the zip line.

Chairman Ewbank said we have a letter here that the Pocono Mountains Convention and Visitors Bureau reported that they had a record income of $4,528,928 last year when at the meeting the representative made it sound like everyone was losing money. Mr. Jones said maybe because there’s a lot of growth in many areas. Chairman Ewbank said they get a 3% room tax from every hotel and motel in the Township and we want to know why some of that money can’t come back to us. Mr. Jones said that money goes to promote tourism not just here but in the Poconos. Mr. Jones said he appreciates the calls the police makes to his business but they also make a lot of money off of speeding tickets from their customers. Not that he is defending them because they shouldn’t be speeding, but that brings income back to the Police Department.

Mr. Johns said we’re looking at the River and the natural resources that Westfall has and it seems to be the direction that the Township is going that they think there is a pot of gold out there. Supervisor Flansburg said this is the first step that the Township is taking to offset the prices that our taxpayers are paying. Chairman Ewbank said we would like to not have to go to court and ask for one or two mill increase over the 14 Mills. Mr. Johns said he would sooner donate something to the Township rather than hire an accountant. Supervisor Flansburg said we are not asking for that, but we are open to suggestions.

Rick Lander said he did not know about the meeting either and apologized for not attending further stating that he was waiting for a phone call and a date. Mr. Lander questioned if the Boy Scout groups and the church groups pay the tax also stating it will cost more to administer than the tax will generate. Mr. Lander said he would rather work out an agreement where they pay a certain amount than to have the 1% tax.  Solicitor Bernathy suggested scheduling the meeting stating that the business owners seem to be making an offer in lieu of the imposition of the tax.

Supervisor Melvin said the board is not looking to get into the books of the business owners and this is not a punitive action. Vice-Chairman Fischer said we are looking to get this money off the shoulders of our property owners and spread out this tax. Otherwise either taxes are going up or the Earned Income Tax is going to be proposed.

Discussion followed about the amount of tax revenue that the amusement tax would generate and about the Upper Delaware Scenic and Recreational River stating that the Township went to the wrong department to get their numbers. Supervisor Flansburg commented that the Township went where we were told to go.

Meeting was scheduled for 7:30 PM on Monday, November 19, 2012 to have discussions with the business owner regarding the amusement tax.

Mr. Barth questioned if this tax could be imposed solely on recreation that launch or stop in Westfall Township. Solicitor Bernathy answered that it is where the admission is charged.

Supervisor Banach questioned Scott Myer on the percentage of a two mill tax decrease. Mr. Myer said that would equal 6%.

Suparmanto questioned why those in the entertainment business are being affected by the tax. Commenting that these businesses bring people to the Township that spend money at other businesses such as McDonald’s, Burger King, Shoprite and the gas stations. Chairman Ewbank said that the Township does not get any money from these people such as the 3% room tax that we do not get a part of. Supervisor Melvin said that we are maxed out and we are trying to cut our budget and find ways to generate more revenue. Supervisor Banach that we’re looking at every avenue including the County to try to get a sales tax imposed, however we have not been able to do that yet. Supervisor Banach also commented on the duplication of services that we have such as the police at that school district. Discussion followed. Supervisor Melvin thanked Suparmanto for hosting all of the charitable events that they have.

Mr. Jones said people that come to support his business also spend money in other areas and the transient out-of-towners are not attending the schools. Mr. Jones also said a lot of the money he takes in he spends locally for electricians, body shops, tires, etc. saying that when they bring in one dollar to their business it translates to five dollars spent in the area. Supervisor Flansburg said you’re either part of the problem or part of the solution and the Supervisors would rather the business owners become part of the solution. Chairman Ewbank said we used to pave our roads every 10 years and we are so far behind that schedule now due to budget constraints, mentioning the possibility of imposing an Earned Income Tax in the future.

Beth Brelje said the supervisors on more than one occasion said this amusement tax is the first step that they are taking questioning if the supervisors are going to raise this one percent tax or do something else.

Discussion followed. Supervisor Melvin said we want to be partners with the business owners. Mr. Jones explained the things he does to give back to the community such as letting the fire department use his landing for rescues and the river cleanup that he does each year.

Supervisor Flansburg said he believes the business owners have it wrong because every chance he gets he asks people that come to the area if they were asked to pay $.50 for EMA and they drove here from New York City would they not come here because of the $.50 and every one of those people said they would agree to pay it.      The business owners suggested making it optional. Chairman Ewbank suggested closing public hearing at this point and getting on to the regular meetings since we have already scheduled a time to meet with the business owners.

The regular meeting of the Westfall Township Board of Supervisors was held Tuesday, June 5, 2012 at 7:35 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman,Robert Ewbank, Vice-Chairman,Paul Fischer; Supervisors, Raymond Banach,Larry Flansburg, andRobert Melvin; Solicitor, Robert Bernathy and Secretary,Lisa Green. Also present were Treasurer, Scott Myer; Zoning Officer, Mike Rendleman; Bill Schneider, Luis Bocaletti, Ann Marie Catalano, Chad Stewart, Jay Edwards, Bob Bostinto, Karl Flail, Walter Van Beers, Valerie Pedone, Mary Smith, Dr. & Mrs. Waldman, Mr. & Mrs. Robert DiLorenzo, Don Quick, Jolie DeFeis, and approximately 27 members of the general public.

AGENDA: The agenda was approved on a motion by Supervisor Banach. Motion is seconded by Supervisor Flansburg and carries with all in favor.

Chairman Ewbank stated executive sessions were held on May 8, 2012 for personnel, May 10, 2012 for real estate, May 30, 2012 for litigation and tonight prior to the meeting for the purpose of litigation. Supervisor Banach said just so the public knows they met with BIU on May 8th to review their fee schedule and contract, they met with the Municipal Authority on May 10th to discuss the sale of the Sewer Authority, and May 30th was litigation that the supervisors had to discuss. Supervisor Banach expressed to the public that the board is not trying to hide anything.

PUBLIC COMMENT: Dr. Albert Waldman said last week we went through the exercise of approving the fireworks display and he knows that people and animals from miles around were disturbed by those fireworks. He feels this should never be repeated.

Chairman Ewbank said he was not at the special meeting for that and asked what was resolved.

Dr. Waldman said having fireworks is one thing and we probably aired in making an assumption on thinking we were having fireworks but we had 8 and 9 inch shells. Supervisor Flansburg said the last thing Mr. Ryan said to him was they were going to try to scale it down to 4 inch shells and apparently that didn’t happen. Supervisor Flansburg thanked Dr. Waldman for his comments.

Robert DiLorenzo is a Foster Hill resident in Milford Township. He stated his concern is the safety on the road and the vehicles that travel it. Saturday he encountered a truck driver driving in the middle of the road carrying the Bulls for the rodeo. He said there are also the delivery trucks that come and go. Supervisor Flansburg asked how many people were there. The residents said between 1,500 and 2,000 people. Chairman Ewbank commented that Foster Hill was a Milford Township Road. Mr. DiLorenzo said part of it is and part of it is a State road. Supervisor Flansburg asked if Mr. Quick would like to chime in since he is the Chairman of Milford Township Board of Supervisors. Mr. Quick said the entity itself Malibu Dude Ranch is inWestfallTownshipbut that there are only a few Westfall Township houses that are affected. The rest are inMilfordTownship. Mr. Quick said they had their meeting last night and there were a number of people in attendance. For the record fromW. Harford St.all the way to the top is a PennDOT road and they do not have the road trimmed back in any way shape or form. Mr. Quick said they are not opposed toMalibubeing a successful business but he doesn’t know if the rodeo presents a conditional use application before the planning commission.

Solicitor Bernathy asked to give some assurances to the public regarding the fireworks display of which the Supervisors had a public meeting about on May 22, 2012. Solicitor Bernathy read from his letter of May 10, 2012 to Mr. Robert Nast of Interstate Fireworks listing the seven requirements his company needed to meet prior to hosting this event. Solicitor Bernathy went on to say the supervisors were concerned about safety. This event was regulated. Mr. Quick said he does not dispute that at all and he is not criticizingWestfallTownship, saying that by and large the traffic going by was uneventful. However the impact appears to be the large trucks for various deliveries as well as one ton pickups that are pulling horse trailers and such. Mr. Quick asked forWestfallTownshipto write a letter to PennDOT asking them to trim back the trees on the state portion of the highway.

Solicitor Bernathy said he was born and raised in this area and has been riding horses at the Malibu Dude Ranch since the 1960s when he was eight years old which predates any zoning ordinance the Township ever had. So he wants people to know that we need to look into the conditional use issue. Mr. Quick said this is not an adversarial conversation. He wants to see how they could grow their business but not at the Township’s expense. Chairman Ewbank wished him luck at trying to get PennDOT to trim the trees, stating they don’t cut them in Westfall either. Supervisor Banach asked Bill Schneider if at the road task force meeting he could mention the trimming of the trees and also said since Foster Hill Rd. is a narrow road that possibly Malibu could schedule their deliveries at night to alleviate some of the problem.

Carmen Williams who lives on Foster Hill Roadsaid they have no objection to the Malibu Dude Ranch that it is a wonderful business however they are concerned about the amount of traffic that comes up and down the street at a fast rate. Ms. Williams said the rodeo is starting Memorial Day weekend through the end of the summer every weekend and the residents have to be exposed to it. What they’re asking is that they house the Bulls up at Malibu with the Cowboys or limit the amount of rodeos that they have. Mary Smith said she lives right by the Malibu Ranch and there were over 100 horse trailers that came up and down all day Saturday. She says that it is not so much the deliveries with the soda trucks. Further stating that she just had a fire at her home and she could’ve lost her house if it caught on fire about half an hour later because they had dump trucks and delivery trucks at the same time. Mrs. Smith said if this is going to happen every weekend she is going to have to move. Supervisor Fischer asked if the dump trucks are a steady thing up there. Mrs. Smith said they’ve been there for a year and a half. Mrs. DiLorenzo said it appears as though they’re trying to sneak something and furthermore did they have to apply for a conditional use to have the rodeo up there every weekend. Solicitor Bernathy said that is something that he needs to look into. Because he is not sure what control they have over the ingress and egress over that property. The supervisors can regulate uses if in fact it is a conditional use but you have to be careful about off premise regulation. What we can understand is the impact that has on the road that is the only artery to that property which has been pre-existing for very long period of time. So there are some hurdles. The question is what has been in existence for a long period of time. Is it just a stable did they have other functions up there and for how long those facts have not been determined yet. Mrs. DiLorenzo said it is affecting her quality of life she is afraid for her children on that road, she is afraid for her husband being run off the road by people speeding. Solicitor Bernathy questioned if there’s ever been police presence there. Mrs. DiLorenzo said they have to call the state police because it is a state road. Mr. DiLorenzo said although there is not much that can be done about the road there are safety conditions that must be addressed. Don quick stated that Mr. DiLorenzo is speaking as an individual. Solicitor Bernathy stated he also knows that Mr. DiLorenzo is the code enforcement officer for other townships and lives in the affected area.

Valerie Pedone asked if there is a noise ordinance in Westfall. Mrs. Pedone with stating there are issues during the rodeos with the loudspeakers. Solicitor Bernathy said that we may need to get the history of this property he said we need to use Mike Rendleman our zoning officer to investigate this property and get a position on it within a reasonable period of time. Solicitor Bernathy said that the Township needs 30 days to investigate. The public was not pleased that three or four rodeos would go by within that time. Mr. Rendleman said his office hours are Tuesday and Wednesday evenings between 5:00 – 7:00 PM. Mrs. Smith said for the last 20 years that she’s lived up there the old owner had four rodeos per year that were guest participation rodeos. They were held on the following four holidays: Memorial Day, July 4th, Labor Day, and Columbus Day. Mrs. Pedone said they were ecstatic when Doc Detweiler bought the property and when the fireworks went off while they could think was where were the supervisors? Supervisor Flansburg said he heard them from his house. An unnamed resident said it was like an assault. It was horrible there were stampeding horses out of their minds freaked out and it was dangerous. She said she is begging the supervisors never to let this happen again. Supervisor Flansburg said as far as he’s concerned this was a one-time deal. Dr. Waldman said the rodeos up there before were like kiddie rodeos and these are sanctioned American Rodeo Association business rodeos. Dr. Waldman said the tickets are $20 a person and $15 for children it is on their brochure. Mrs. Waldman asked if Mr. Nast who was performing the fireworks show met all of the requirements that they were supposed to meet. And who pays for all of the public services. Solicitor Bernathy says Malibu Dude Ranch pays taxes just like everybody else. Mrs. Waldman said number one they have loudspeakers that go all away down foster held that you can hear and they have huge buses not little buses and when Mrs. Smith had her fire at our house Doc Detweiler was upset because his buses were delayed by the fire trucks. So does it take the month and four more rodeos? Solicitor Bernathy said all we can do is determine if this is a conditional use and attach conditions if it is in fact a conditional use. We need to investigate and 30 days is a reasonable period of time. Bob Bostinto asked if there was any restriction on the individual homeowners to have discussions with Malibu Dude Ranch themselves. Solicitor Bernathy said there are no restrictions against that at all. Further discussion followed. Chairman Ewbank said they received an unsigned complaint which is not worth the paper it’s written on. Further stating that if someone wants to us send a complaint they need to sign the letter and put their name on.

Ann Marie Catalano from Milford landing wanted to talk to the board about Taco Bell where there is a large mound of dirt on the property. Mrs. Catalano said you can’t see in either direction at the intersection coming in and going around the dirt pile, stating there is a big problem. Mrs. Catalano said she went out and asked them to move the dirt pile herself and they did move the pile some. Mrs. Catalano also stated there is a missing a stop sign by McDonald’s and Wal Mart. The only stop sign is by the Milford landing side. Chairman Ewbank said he understands the problem however those are private roads and we have no control over any of those roads. Supervisor Banach said however we could have the secretary look at the agreement to the land development to see what signs are supposed to be there and send a letter to have the signs put back up. Solicitor Bernathy said he’s spoken to the police department about policing that area as well. Discussion followed. Chief Stewart said they should be able to enforce the stop signs there because it is commercial property and as long as it meets Penn DOT regulations. Mrs. Catalano asked if there was any other business coming on that Taco Bell property. Chairman Ewbank said he heard there was a bank but we have no plans. Supervisor Banach told Mrs. Catalano that the secretary was going to contact the contractor and request that they move the dirt pile.

John Graef who lives in Crawford Hill Estates, President of the Homeowners Association is here about the potential gas line disruption of Cummins Hill road. The neighbors have compiled a dossier of letters, maps and figures etc. Mr. Graef said he has a wife with severe asthma and if he has to get an ambulance to her and they have to travel all through Mill Rift it is quite a distance to go. Jolie DeFeis wants to know why we are allowing them to re-create the seven mile detour why can’t we appeal it. Questioning why can’t we have them go the one-mile that’s already there. Mrs. DeFeis said they have people that are ready to fight. Chairman Ewbank said their worst enemy in all of this is the Superintendent of the National Park Service John Donohue. Mrs. DeFeis said she understands that but he is only one person. The latest information from Tom Marino’s office is the reason that John Donohue is not allowing it to go through is the commission has found the possible presence of the Federally Listed Endangered Dwarf Wedge Mussel. Supervisor Flansburg said “let’s cut to the chase because we know what you’re here for, what do you want from us.” Mr. Flail said they want the supervisors to take a position on this. Tracy Hoffman said they have to find out if we have any endangered species in our neck of the woods and they have until June 27, 2012 to make an appeal. Ms. Hoffman said the real question as to gas lines that we have existing or 56 years old is disintegrating and John Donohue should be grateful that they want to replace them when there are 56 years old and save the 7 miles of forest. Mr. Flail said when they start blasting the town is going to be very upset. Chairman Ewbank asked if they have contacted the conservation district. The supervisors said they will be willing to send a letter to Superintendent John Donohue and FERC. Mrs. DeFeis said sending a letter is not going to do it. She believes that we are an interested party and they need somebody that is an interested party to back and fight the appeal. The residents that are in attendance at tonight’s meeting are not interested parties.

Bob Bostinto questioned if Cummins Hill Road was going to be shut down there is not going to be an alternate route. Solicitor Bernathy asked how long that road is going to be closed. Supervisor Banach said when Tennessee came here a few years ago Mr. Humphreys gave a presentation and said that they would close Cummins Hill Road drop the pipeline and open the road again assuring us they would take care of the citizens to keep them safe. They said that they would meet with all EMS. Supervisor Banach said this is a federally mandated project. In the end the federal government will say yes or no. Even though the Conservation District is fighting them tooth and nail. Mrs. DeFeis said she understands that and she read the 84 page judgment and knows they went by the book she just thinks they have the opportunity to appeal now and she is hoping that common sense prevails. She said during hurricane Irene they were trapped because the road was closed on both ends. Mrs. DeFeis said she met with Robert Winter ofTennesseegas who said they will try not to close the road. Mrs. DeFeis wants to know the position the board is taking on this. Supervisor Flansburg we cannot litigate this but that he would lend his name to any letter that the Township was going to send out.

Bill Wall said he and his wife own the Village Diner and they lives on Cummins Hill road so they are doubly affected by this pipeline and he asked where it is going to go, asking if they were putting the pipeline next to the school. Chairman Ewbank said he has heard from the people who live behind the diner that they were offered money for a right-of-way for the pipeline. Mr. Wall has concerns for the safety of the people in the convalescent home and the children as far as evacuating for emergencies etc. Mr. Bostinto asked if anybody’s invited Tennessee to come here to talk to us. Supervisor Banach said they’ve been here and they’ve been at the Best Western for a public meeting. Supervisor Melvin questioned who we send a letter to because this is a federal thing. Asking if we should send it to the White House. Solicitor Bernathy questioned if they’ve hired an attorney. The residents stated they are not directly affected they live a half a mile to a mile above the area. Supervisor Banach said the pipe is supposed to go by Have a Hoot. Mr. Wall asked if anybody had any idea how much it will cost to fight this. Solicitor Bernathy said he is guessing a retainer for an attorney like that would be between $25 and $50,000. Supervisor Melvin said there’s a similar situation in Minisink, New York, and they have obtained representation. Discussion followed. Solicitor Bernathy stated we do not have the funds to file an appeal. Mrs. DeFeis said we have until June 27, 2012 to file an appeal and asked if there was anyone on staff or anyone from the bar association that would take this fight on. Solicitor Bernathy said you could contact Pennsylvania State Association of Township Supervisors. Debra Banach asked if the people that are impacted are fighting it. Mr. Flail said that Mr. Peckham has been fighting this for two years. Mr. Flail asked why the Township and our politicians are not fighting for us. Lisa Mickles said all she’s ever heard for the last two years is that it would take an act of Congress to get it to go to the one-mile loop. Mr. Wall asked if they are within the legal right to put this loop within the school and the senior care center. Solicitor Bernathy said he is not licensed to give an opinion on federal practice. Supervisor Banach said there are gas lines that go all over the place. National Park Service took over property and ruined people’s lives. Route 209 is our main artery and we can’t travel down that with commercial vehicles. Chairman Ewbank asked Mrs. DeFeis for a letter because the Township has not received anything. Supervisor Flansburg added that there are the dwarf wedge muscles wherever they’re going to cross. And he has seen them close off miles of road because of an Eagles nest and now we are going to drill underneath the road. Supervisor Melvin asked when the start and end dates were on construction. Mrs. DeFeis said the construction is due to begin in 2012 and ended in 2013. Solicitor Bernathy said the Township would have to commit to filing an appeal and we don’t have the resources for that. We need the legal expertise and Solicitor Bernathy doesn’t have that. He believes the appeal needs to be filed with the court of law. Walter van Beers asked that a letter be sent from the Township to file the appeal stating it would mean more coming from the Township and an individual resident. Solicitor Bernathy did not want the residents to believe that by the Township sending that letter it would constitute a legal and binding appeal. Supervisor Melvin said that Lisa will look into drafting the letter tomorrow. Chairman Ewbank asked for any other public. Twila Decker said she wanted to discuss parking by stop signs. In trying to get out ofMaple Avenue making a left-hand turn with Sue’s Café car there and the clap board advertisement sign you can’t see cars coming. Ms. Decker said according to Penn DOT specifications you’re supposed to park 15 feet away from a stop sign. Supervisor Flansburg asked that Ms. Decker show her pictures to the Chief on her way by. She said she nicely went into the café explained her situation and asked them to move them. They did for three hours. Chief Stewart said he knows what she is saying that the road goes in the parking lot. Supervisor Banach said we could look at the development plan and see who approved the parking but it’s probably been grandfathered in because the polar bear has been there forever. Supervisor Banach said possibly the parking spot would need to be moved over. Ms. Decker also wanted to speak about the Verizon building stating she’s contacted Verizon Corporate offices. Saying it was an eyesore and a disgrace to the Township and no way to advertise their business. They said to send them the photos and they would take care of it immediately. She said the last and final thing was the junkyard behind the Apple Grill. This is designated as a parking facility. Bob Bostinto said we addressed this same issue two years ago. Residents stated that because of the junk dumped there people can’t park there. Supervisor Banach asked to dig out the letter or complaint that was sent regarding the garbage.

MINUTES of the April 26, 2012 special meeting were approved on a motion by Vice-Chairman Fischer. Motion is seconded by Supervisor Flansburg and carries with all in favor.

Minutes of May 1, 2012 regular meeting were approved on a motion by Supervisor Flansburg. Motion is seconded by Supervisor Melvin and carries with all in favor.

Minutes of May 22, 2012 special meeting were approved on a motion by Supervisor Flansburg. Motion is seconded by Vice-Chairman Fischer and carries with four in favor. Chairman Ewbank abstains.

TREASURER’s REPORT:Scott Myer gave the treasurer’s report for May stating that this time of year is as expected. We received $68,000 in grant money from FEMA for Hurricane Irene. Supervisor Banach thanked Chairman Ewbank and Bill Schneider for their part in receiving the grant funds.  Supervisor Banach moved to approve report. Motion seconded by Vice-Chairman Fischer and carries with all in favor.

POLICE REPORT: Police Chief Stewart gave the report for May stating there were 6,776 miles patrolled and 210 calls for service. As part of PennDOT’s seat belt enforcement for the month of May they did a presentation at the elementary school and in coordination with the school police and they did a seatbelt program for high school students. They did a seatbelt check on the bottom of Cummins Hill on  May 30 they’re going to do another one on June 6th between four o’clock and seven o’clock. Chief Stewart said just a reminder make sure your cars are locked the likelihood of somebody going through is increasing. Supervisor Flansburg said he would just like to publicly congratulate the chief and his wife on the birth of their child. Chairman Ewbank said he happened to be at the police station the other day and a woman came in stating her car was parked in her sister’s driveway and her purse was in it and she went in the house and came out and her purse was gone. Chairman Ewbank asked the chief if he had anything to offer about the training that they were doing. Chief Stewart said it went well. It goes above and beyond shooting on the stationary target, and he thanked the supervisors for letting them use the facility. Mrs. Green stated she checked with our insurance company and that as long as the Police Department provided their certificate of insurance which they have, our insurance company has no issue with them holding training on our property. Supervisor Melvin moved to accept the police report. Motion is seconded by supervisor Flansburg and carried with all in favor.

FIRE DEPARTMENT: Luis Bocaletti gave the Westfall Township Fire Department Report for May reporting 2 Mutual Aid structure fires, 1 Landing zones, 4 Motor Vehicle Accidents, 1 Auto Alarms – Commercial False, 1 Vehicle fire, 1 Standby, 1 Trees on wires, 1EMSassist. Total calls for May are 12. Westfall EMS calls 37 toWestfallTownship, 12 covering Squad 33, 3 covering Squad 19, for total of 52 calls. Mr. Bocaletti said they also held two classes.

Jay Edwards gave the Mill Rift Fire Department report stating they had engine maintenance on 5/2, monthly meeting on 5/8, O&R natural gas training in Matamoras on 5/9, hard suction draft on 5/16, CPR AED refresh training on 5/17, fire report bonfire on beach 5/27, pump drill on 5/31, mutual aid fire Milford on 6/1, Fire Police Training Center Blooming Grove on 6/3. Equaling 95 man hours for the month 75.5 equipment hours. Supervisor Banach moved to approve fire department reports. Motion is seconded by Vice-Chairman Fischer and carries with all in favor.

HIGHWAY REPORT: Bill Schneider gave the report for May stating that they worked on Bluestone Boulevard removed trees from brook area, secured bank and stabilized with rip-rap, re-did ditch and shoulders, reordered and received 540 inch culvert pipe. Installed eight cross-section culvert pipe 450 feet clear shoulders ditch line on Glasshouse Hill. Mr. Schneider said a decision needs to be made on whether or not we were going to pave the rest of Glasshouse Hill. Supervisor Banach asked if would have the money for that. Mr. Myer said we should have approximately $109,000. Mr. Schneider said there is an issue and Pond Eddy and he inspected the road with Mr. Ewbank. Clearing brush from the right-of-way and intersections cold patch and Township roads. A letter was sent to the Delaware Joint Toll Bridge Commission thanking them for the use of their broom. Performed maintenance on the Township properties as well as on the equipment. They worked with Nelson tree spotting and removing trees and Township right-of-way. Repaired guide rails on bridge on Cummins Hill road damaged by down trees. Supervisor Banach moved to approve the report. Motion is seconded by Supervisor Melvin and carried with all in favor.

BUILDING/ZONING REPORT: Mike Rendleman gave the report for May reporting 3 building permits, and 6 zoning permits, with fees of $988.89. Motion by Supervisor Flansburg to accept the report. Motion is seconded by Supervisor Melvin and carries with all in favor.

OLD BUSINESS:

Act 47 Monthly Report: Solicitor Bernathy stated they are hopeful that this is the last report and we will be removed from Act 47 in July. The Township is operating within the confines of its budget and continues to meet its financial obligations. The Township continues to provide essential services. Solicitor Bernathy says he still awaits word to see if we could remove this from the agenda as a required item. Supervisor Flansburg moved to approve report. Motion is seconded by Supervisor Melvin and carries with us all in favor.

Compost Facility: Chairman Ewbank said we have one estimate for putting a controlled gate on the compost facility and we’re waiting for second proposal. For anyone that doesn’t know it yet, the facility is locked on a daily basis. If you live in Westfall you come up and see Lisa and give her your drivers license and you will get the key to the gate. If you live in Matamoras you will see Nancy and get a key from her. On Saturday we have somebody manning the facility from 9 to 1. Chairman Ewbank said we sent a letter to the Borough of Matamoras regarding paying half of the cost for these things and hopefully they will approve it at their meeting tonight. Chairman Ewbank said we’re going to apply for grant for the controlled access gate however we may not be able to obtain the grant alone without Matamoras because we don’t meet the median income level.  Supervisor Flansburg asked what information he found out about the gate. Mrs. green questioned if we are going to ask for a different type of gate and a different type of arm besides the wooden arm. Chairman Ewbank said he would contact the gentleman and get new proposal.

Amend Vacation Request for Lisa Green: Chairman Ewbank said there is a letter from Lisa green requesting her vacation to be amended from the original date of 7/14/12 through 7/20/12 to add the dates of 7/ 13 and 7/23 instead of 3/28 and 4/6 that were already approved and not taken. Mrs. Green’s total vacation will be seven business days. Supervisor Banach moved to approve the request. Motion is seconded by supervisor Flansburg and carries with all in favor.

Affidavit for Emergency Responders: Chairman Ewbank said we have an affidavit this will be for both the Westfall and Mill Rift fire departments. Luis Bocaletti asked Solicitor Bernathy if they could use their own affidavit that they had prepared. Solicitor Bernathy asked if it was substantially similar to the one he prepared.

Mr. Bocaletti has a copy of one for solicitor Bernathy’s review. Supervisor Banach questioned the fire chief as to whether or not they contacted PennDOT to see if each member had a valid driver’s license when they enroll. Vice-Chairman Fischer moved to approve a motion that an affidavit shall be required on an annual basis by each member of each of the Fire Departments. Motion is seconded by Supervisor Banach and carries with all in favor.

Fire Protection Contract: Solicitor Bernathy said this is something that he proposed. Understanding we’ve had some discussions. It is common to a lot of municipalities. Solicitor Bernathy suggests we give this to each of the fire departments to digest. Tabled to July meeting.

Ordinance # 147 Holding Tank Ordinance: Supervisor Banach said this came up after a discussion with Chris Wood. This fee schedule does not match the holding tank ordinance. Solicitor Bernathy said you could always change the fee schedule. Supervisor Banach said that the ordinance is lower than the fee schedule. We want to make sure that Chris Wood’s fees are covered. Solicitor Bernathy said usually what he puts in there is that the fee will be determined by the Supervisors. Vice-Chairman Fischer moved to advertise the revision of ordinance #147 for July 3, 2012 at 7 PM. Motion seconded by supervisor Flansburg and carries with all in favor.

Township Cell Phone: Mrs. Green said we have Shawn’s cell phone that we are paying for and not using. Supervisor Banach asked if the Rd., Department needed a phone. The phone will go to the Rd., Department. Supervisor Banach asked that they review the telephone policy.

NEW BUSINESS:

Fire Loss Ordinance # 156: Solicitor Bernathy said we need a motion to approve the fire loss ordinance as presented. Mrs. Green said there is a typo on page one and asked if can she correct that. The word against is spelled incorrectly. Supervisor Flansburg moved to approve ordinance # 156. Motion is seconded by supervisor Melvin and carries with all in favor. The record will reflect that this approval follows a duly advertised public hearing that was held at 7:30 PM this evening at which no adverse comment was made.

Draft Road Use Agreement: Chairman Ewbank asked to table the Road Use Agreement. Mrs. Green said she had revised the road use agreement that was received from Joe Hudak and believed that was going to be approved this evening. Supervisor Banach moved to approve the Road Use Agreement that was received and revised from Joe Hudak. Motion is seconded by supervisor Flansburg and carries with all in favor.

Fee Schedule: Supervisor Banach moved to approve the fee schedule to include all the changes that were made. Supervisor Melvin asked if this included the changes that were made during the executive session. Supervisor Banach said it is. Motion is seconded by Supervisor Melvin and carries with all in favor

Zoning Application: Zoning Officer Mike Rendleman said we had revised the zoning application. There are two different forms but they are exactly the same. One is on the long form (legal size) and one is front and back of the shorter form (letter size). Chairman Ewbank stated that the main revision to this permit is the following language “Issuance of this permit authorizes the code enforcement officers of the Township access to the Project/Site during the hours of 7 AM to 9 PM.” Supervisor Melvin asked if that meant that the owner of the property doesn’t have to be there. Mr. Rendleman said this is for inspections on the project and not for any other reason. Supervisor Banach voiced his opinion stating that he does not believe that any Township official has the right to be on the person’s property. He’s had issues with building inspectors going on his property, with Police Department going on his property without permission stating we don’t allow anyone else on private property. Supervisor Banach also stated we should not have the permit expiring in six months. He believes it should be a year. Supervisor Banach said that is just his personal opinion. Chairman Ewbank asked for any other comment. Vice-Chairman Fischer asked if Supervisor Banach was opposed to the way it was written. He is. Solicitor Bernathy said we are asking for peoples’ permission that is the nature of having the language on the application. Discussion followed regarding trespass and liability. Supervisor Banach wants the language emphasized said that the resident needs to sign off on it. Mr. Rendleman also stated the zoning permit is void within six months of date of issue unless the work has started. Mr. Rendleman stated the permit will not expire until July 2013 because of the Senate Bill 1042 that was in place since 2008. Further discussion was held. Chairman Ewbank asked for a motion for the following changes on the zoning permit. Where it states this permit is for the within six months of date of issue unless work has started a block will be added to that where it can be initialed by the permittee and “Issuance of this permit authorizes the code enforcement officers of the Township access to the Project/Site during the hours of 7 AM to 7 PM.” A person can initial this if they want to allow this or not. Supervisor Flansburg moved to approve that motion. Motion is seconded by supervisor Banach and carries with all in favor.

Floodplain Manager: Lisa green stated she needs to speak to Mike Mrozinski about exactly what the floodplain manager needs to do. Right now all she knows is thatRobert Ewbank is that our representative. Supervisor Banach asked if one can be shared. Chairman Ewbank asked Mrs. Green to gather more information.

Tunnel Painting: Chairman Ewbank stated that the Highway Department was out today painting the tunnel. Home Depot supplied the paint but was not able to do the job for us because they could not name us as an additional insured on their insurance policy.

Hiring Of Gary Babb-Man Compost Facility Saturday 9 -1: Chairman Ewbank stated Gary Babb has been manning the compost facility on Saturdays between 9-1. He has been there for the past three Saturdays. Matamoras borough is going to share the cost with us a 50-50. Supervisor Flansburg moved to hire Gary Babb at a rate of $10 per hour to man the compost facility on Saturdays between 9 AM and 1 PM as needed. Motion is seconded by Supervisor Melvin and carries with all in favor.

Letter to Municipal Authority Re: Act 537 Sewage Plan Update: Mrs. Green stated this letter is for the board to sign so that the sewer authority gets reimbursement for the Act 537 plan update. Supervisor Flansburg moved to sign the letter. Motion is seconded by Supervisor Melvin and carries with all in favor.

Letter to Matamoras Council and EPRPC: Tabled

SUBDIVISION REVIEW AND ACTION:

Delaware Valley School District Gym Addition: Mrs. Green stated theSchool District has waived the 90-day requirement for deemed approval and provided us with that letter. Supervisor Melvin moved to approve the extension for the DelawareValley school district gym addition. Motion is seconded by Supervisor Flansburg and carries with all in favor.

A public hearing was held on Tuesday, June 5, 2012 for the purpose of taking public comment on the proposed Fire Loss Ordinance forWestfall Township. The meeting was held at the Westfall Township Building onDelaware DriveandLaBarr Lane,Matamoras,PA18336at 7:30 p.m.

Those present were Chairman,Robert Ewbank, Vice-Chairman,Paul Fischer; Supervisors, Raymond Banach,Larry Flansburg, andRobert Melvin; Solicitor, Robert Bernathy and Secretary,Lisa Green. Also present were Treasurer,Scott Myer; Zoning Officer, Mike Rendleman; Bill Schneider, Luis Bocaletti, Ann Marie Catalano, Chad Stewart, Jay Edwards, Bob Bostinto, Karl Flail, Valerie Pedone, Mary Smith, Dr. & Mrs.  Waldman, Mr. & Mrs. Robert DiLorenzo, Don Quick, Jolie DeFeis and approximately 27 members of the general public.

Solicitor Bernathy stated this ordinance has been advertised for public hearing at 7:00 PM however the board was in executive session and it is now 7:30 PM. In any event the ordinance has been advertised and the proposed ordinance is an ordinance of Westfall Township pursuant to act 98 of 1992 providing that in fire losses the insurance company, association or exchange shall transfer insurance proceeds to a designated officer of Westfall Township as a portion of the insurance proceeds to be held as security against the total cost of removing, repairing or securing the damaged structure, providing for fees, providing for penalties for violation and establishing procedures and requirements regarding insurance proceeds and to the implementation of Act 98 of 1992, as amended by Act 93 of 1994 inWestfall Township.

Solicitor Bernathy opened the floor to public comment.

Karl Flail asked if his house burned down and he has access to his insurance company does that mean that the town has access to his insurance funds. Solicitor Bernathy said yes that is the case. That is what this ordinance is about to see that the properties are cleaned up. That is if they are not implemented accordingly.

Solicitor Bernathy said we want to make sure that properties are cleaned up in that blight is managed. Further stating there are claims out there that are not honored and there’s no way for the Township to get money to help clean up the property. Mr. Flail questioned if it affects properties that are decades old and the owner has just disappeared. Solicitor Bernathy said no because there is no entity to get the money from.

Bob Bostinto asked if the money would be placed in an escrow account. Solicitor Bernathy said yes and the insurance proceeds will be held as security and used to repair or replace the home.

Public hearing closed at 7:33 pm on a motion by Supervisor Flansburg. Motion is seconded by Vice-Chairman Fischer and carries with all in favor.

The Westfall Township Board of Supervisors held a Special meeting on Tuesday, M ay 22, 2012 at 7:05 PM.   The meeting was held at theTownshipBuilding on Delaware Drive andLa Barr Lane,WestfallTownship.

Those present were Vice-Chairman,Paul Fischer; Supervisors Raymond Banach,Larry Flansburg, andRobert Melvin; Solicitor, Thomas Farley and Secretary,Lisa Green. Also present were Debra Banach, Thomas York, Tom & Debbie Ryan, Dr. and Mrs. Waldman, Mary Smith, Evelyn DiLorenzo, and Valerie Pedone. Chairman,Robert Ewbankand Solicitor, Robert Bernathy were not present.

AGENDA:  Motion to approve the agenda was made by Supervisor Flansburg. Motion is seconded by Supervisor Banach and carried with all in favor.

PUBLIC COMMENT: Supervisor Banach suggested the public wait until the people fromMalibu give their presentation stating there is only one item on the agenda this evening.

NEW BUSINESS:

Veterans Charity Rodeo Roundup: Tom Ryan introduced himself to the board as the gentleman who has put this event together with Doc at the Ranch. He said they do a lot of charity work for Veterans organizations. This event is called “Hunts for Healing.” Luzerne Foundation Hunts for Healing gets no public funding. They take wounded veterans and veterans with PTSD and give them an opportunity to experience the outdoors like we do here inPennsylvania, they take them hunting, on hikes, trips, fishing etc. Mr. Ryan had them on his boat last year. Mindy the proprietor of Hunts for Healing purchased a barn and converted it into living quarters. She was aVietnam vet and a nurse inVietnam she houses 5-7 wounded Vet’s at a time. They come with mentors out ofBethesdaMaryland or Walter Reed. Mr. Ryan said if you’ve ever been around severely disabled veterans they are living longer due to the field hospitals and it is a struggle to live. Not having the experience of coming home to overwhelming joy from the Vietnam War, he and other vets have said this is never going to happen again. So this is one thing they are doing with having the rodeo to support to raise money for Hunts for Healing. We’ll have the rodeo, the bounce house, the mechanical bull, the pro-rodeo, food, The Cowboy Larry Show, and if the Township approves the fireworks we’ll have the fireworks show. It will be 4:00-9:30 event. Mr. Ryan said as of recipient of the Purple Heart it’s an honor to help fellow veterans. Supervisor Flansburg thanked Mr. Ryan for his work with the veterans.

Dr. Waldman of Foster Hill Road said he is a veteran and veterans don’t need fireworks. It scares them with bombs going off with PTSD, he is opposed to the fireworks stating it makes no sense. Supervisor Banach clarified that this is one event.

Valerie Pedone commented that the country and fireworks don’t mix she is married to a veteran as well.

Mary Smith said she lives right next to the Malibu Dude Ranch she will personally have to move her horses, as fireworks to not mix with horses. Mrs. Smith said she cannot lose a horse they are very dear to her and they’re dear to the ranch also. Her father is 92 years old and a WWII vet.

Supervisor Banach questioned if the ranch ever had fireworks before. Manager, Thomas York answered they’ve had fireworks on Fourth of July and New Year’s. Supervisor Banach asked if they’ve ever had permits. Mike Rendleman said they’ve never come to us for permits. Mrs. Smith is concerned if we approved this event we will set a precedent. Mrs. Pedone asked why they need the fireworks. Supervisor Flansburg said he believed the fireworks would entice more people to come. Mrs. Pedone said they need to leave the fireworks out. Supervisor Flansburg asked if we could reach a compromise. Mrs. Pedone answered Fourth of July because that is to be expected. Further discussion followed. Solicitor Farley questioned the zoning officer as to whether or not there is anything in the zoning ordinance regulating fireworks. There is not it is all regulated under the state law.

Thomas York said there is not going to be fireworks on Fourth of July nor the weekend before or after. Supervisor Flansburg asked if a compromise could be reached since there was no fireworks planned for the Fourth of July could they let this it then go for June 2, 2012. Supervisor Banach asked if the ranch would be able to help Mrs. Smith move her horses. They agreed to help anybody who needed it. Mrs. Smith asked how would they be assured that they were not going to have fireworks. Supervisor Melvin said there is a list of criteria that they need to follow that the state of Pennsylvania imposes, such as being registered with the Attorney General, having a $1,000,000 insurance policy. That the fire chief is ultimately responsible who is there for fire safety. Mrs. Smith said she is under the assumption that if it’s dry they will not have the fireworks. The fire chief said their setbacks are well within their property line. They need a 500 foot setback. Mrs. Waldman asked if all the requirements have been met and how many events does this cover. Supervisor Melvin said yes they have been met. Vice-chairman Fischer said this is for this one event. Supervisor Banach asked if they’ve contacted our police department, the state police, and Milford Borough to make sure traffic is flowing. Mr. Ryan said he has contacted John Curran the constable at Dingman who has spoken to Eastern Pike Regional Police Department and will be meeting with the State Police and Milford Borough. They also need to get the ambulances which Milford covers. Supervisor Banach asked for the anticipated number of people. Mr. Ryan said due to the cause were expecting a fairly large crowd and every dollar is going to the cause. Supervisor Flansburg directed his comment to Mrs. Waldman saying although he did not speak to Mrs. Dubinsky he delivered packages to Dr. and said there would be public comment tonight if they had any concerns whatsoever and Dr. Dubinsky said that the horses heard gunshots all the time, that there is a shooting range there and for the benefit of the veterans they have no problem with their horses. Mr. Ryan said that Interstate is the one that’s doing the fireworks and they are very professional organization.

Supervisor Banach questioned if they have done everything on the letter that we have asked them to do. Solicitor Farley said he believes everything is being sent to his office. Supervisor Melvin said before Bob left on vacation he received the insurance certificate and the letter from the Attorney General. Solicitor Farley said when he was President of the Chamber many years ago They used interstate to do fireworks atMatamorasAirportParkeach year and never had a problem.

Supervisor Flansburg said if he could ask everyone who came in objection if we could reach a compromise to not do fireworks for the Fourth of July and allow this event on June 2, 2012. Discussion followed. The public wanted to be assured that if the event was approved for June 2, 2012 that they would not do fireworks on July 4 or any other day. Evelyn DiLorenzo  asked if Milford Township could be notified because everything that’s going on up at the ranch with the rodeo is going to affect Milford Township.

Supervisor Melvin moved to approve the Fireworks event conditioned upon the May 10, 2012 letter prepared by Robert F. Bernathy, and that no other fireworks will be displayed unless they come before the Westfall Township Board of Supervisors for approval in the future. Motion is seconded by supervisor Flansburg and carries with all in favor.

Supervisor Flansburg said he will speak to Milford Township tomorrow.

The fireworks display will go off at 9:30 PM. Mrs. Smith asked why the fireworks were being displayed at 9:30 PM. Mr.Yorksaid they needed to get the Bulls out prior to the show.

Mr. Ryan said thank you on behalf of the veterans.

Supervisor Banach asked for a report back from the neighbors to get feedback on how it went, to see what was good, what was bad, what could be changed with or without fireworks in the future. Supervisor Melvin invited the public to our June 5, 2012 meeting saying this will help shape us in what we do in the future. Maybe it’s not Malibu but will be somebody else doing something in the future. Mrs. Waldman said she will come back, she does not live on Foster Hill Road that there is a house there that is owned by someone who is not here this evening and is being rented on June 1, 2012 to a fine tenant, a new priest of the Episcopal Church and Milford. Mrs. Waldman is concerned that she will be waking up on June 2 finding out about this rodeo. Supervisor Banach suggested flyers be made and circulated. Supervisor Melvin said hopefully the landlord clued the tenant in on that. Dr. Waldman asked if we had a website for people that were not able to come to post their comments. Supervisor Flansburg said on the website is his e-mail address and cell phone number and he tries to answer all of them within 24 hours. Mrs. Green said the addresses www.westfalltownship.org .

 The regular meeting of the Westfall Township Board of Supervisors was held Tuesday, May 1, 2012 at 7:08 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman,Robert Ewbank, Vice-Chairman,Paul Fischer; Supervisors, Raymond Banach, Larry Flansburg, andRobert Melvin; Solicitor, Robert Bernathy and Secretary,Lisa Green. Also present were Treasurer,Scott Myer; Zoning Officer, Mike Rendleman; Police Chief, Chad Stewart; Roadmaster, Bill Schneider; Luis Bocaletti, Jay Edwards, Lisa Mickles, Nate Oiler of R.K.R. Hess, Jonah Mandelbaum, Lara Dodsworth, Ann Marie Catalano, Lee Cokelette, Matt Osterberg, Judee and Jeff Doughman, and approximately 22 members of the general public.

Prior to the start of the meeting a 6:30 PM presentation was given by Peter Wulfhorst on Marcellus Shale and its impacts. The meeting was opened with the Pledge of Allegiance.

AGENDA: The agenda was amended to add # 11) the hiring of a third person part-time for the highway department and # 12) Compensation forLisa Green for clean up day. Supervisor Banach moved to approve the agenda. Motion is seconded by Supervisor Flansburg and carries with all in favor. 

Public Comment: Anne Marie Catalano of Milford Landing asked if there is any progress with the widening of 209 with PennDOT regarding the storm water run off especially around Milford Landing, because she had received a letter from their engineer about a year ago thatMilford landing could not take on anymore storm water especially from 209. Chairman Ewbank said the only thing we know about it is the plans they have and that it’s supposed to start in 2013 to be a four-lane roadway from the school to Price Chopper. Mrs. Catalano said she just wants to bring to the board’s attention that they really need to pay attention to the storm water runoff and what PennDOT is going to do, and what it’s going to do toMilford landing because this is a very low area by the school. Stating Mr. Miller’s property is raised above Milford Landing. Solicitor Bernathy said Mrs. Catalano has to understand that this is a state project and the Township has very limited regulated authority. However, we are cognizant of it. 

Judy Doughman commended the town along with the Police Department for taking care of the tunnel. She hasn’t noticed any other illicit activity. She apologizes for missing the last meeting and questions if there was any information gathered on the camera system or long-term solution for the tunnel. Supervisor Melvin said they were looking to get bids. Chief Stewart said he did not get the bids yet, however they did indicate it will be expensive.

Supervisor Flansburg requested donations for the military as he will be going to the Pennsylvania State Association of Township Supervisors Convention this weekend. He asked if the residents would find in their heart to donate he would appreciate it.

MINUTES: The Minutes of the April 3, 2012 regular meeting were approved on a motion by Supervisor Banach. Motion is seconded by Supervisor Melvin and carries with all in favor.

Minutes of April 26, 2012: Tabled

Minutes of June 7, 2011 meeting were approved to add the name of Shawn Bolles to the list of people in attendance at the meeting; he was not named in the original minutes. Motion is made by Supervisor Banach. Motion is seconded by Vice-Chairman Fischer. Supervisors Flansburg and Melvin abstain. Motion carries with three in favor.

TREASURER’s REPORT:Scott Myergave the treasurer’s report for April stating that this time of year is as expected. Supervisor Melvin questioned if there is anything we were overspending at all. Mr. Myer mentioned we are 33% through the budget and that there is nothing noteworthy to report. Supervisor Flansburg moved to approve report. Motion seconded by Vice-Chairman Fischer and carries with all in favor. 

POLICE REPORT: Police Chief Stewart gave the report for April stating there were 6,650 miles patrolled for the month and 176 calls for service. Supervisor Banach moved to approve the police report. Motion is seconded by Vice-Chairman Fischer. Motion carried with all in favor. Chairman Ewbank asked the chief about the letter he received from Assistant Chief Eric Stewart regarding police training at the compost facility. Chairman Ewbank said that Asst. Chief Stewart was talking to him about bringing cars up to use them for ballistic testing and such, and his concern was whether or not we would be held liable even though it had been done in the past. Solicitor Bernathy questioned if our insurance carrier was aware of that. Stating the first thing would be to put them on notice. That may resolve the issue, because if we have insurance for it, and it is the police there would be no issues for it because they are using it responsibly. Solicitor Bernathy questioned if the police policy covers that sort of training. Chief Stewart said it does. Solicitor Bernathy asked if the police policy would addWestfallTownshipas an additional insured. Mrs. Green will contact our insurance carrier tomorrow. That will solve the issue. Supervisor Banach asked if the Police Department had caught burglars because there is a rumor going around that they had. Chief Stewart said they did not get them. They did catch some but not the ones on Cummins Hill.

FIRE DEPARTMENT: Luis Bocaletti gave the Westfall Township Fire Department Report for April  reporting 5 Mutual Aid structure fires, 2 Landing zones, 3 Motor Vehicle Accidents, 1 Smoke Investigation, 4 M/A brushfire, 2 Vehicle fire, 2 Brush fire, 2 Haz Mat, 1 Standby, 1 CO alarm. Total calls for April are 23. Westfall EMS calls 46 toWestfallTownshipfor covering Squad 33:2 covering Squad 19: for total of 52 calls.

Jay Edwards gave the Mill Rift Fire Department report stating they had a brushfire on Cummins Hill road on 4/7, pump training on 4/8, monthly meeting on 4/10, brush fire mutual aid station 26 4/14, brush fire mutual aid Milford 4/14, ran pump military tanker 4/17, drive for training 4/18, high angle rescue drill Hawks nest to Mill Rift 4/29. Mr. Edward said there is a total of 80 man-hours and 53.5 equipment hours for the month

Supervisor Melvin questioned if there was any progress on the hepatitis C testing for any new members. Mr. Bocaletti answered they have had progress. There have been two new members for Westfall Township Fire Department. Solicitor Bernathy asked if they were up to date on suspensions and if there were affidavits on a yearly basis on license suspensions, questioning where we are on that. Mr. Bocaletti said they are trying to do a yearly information packet. Mr. Bocaletti said they’re on the self reporting basis right now. They do history checks on new members. Discussion followed. Solicitor Bernathy suggested that they sign an affidavit on a year to year basis from the time the history check is done and that will be done from now on for both departments in the Township. Motion to approve the reports made by Vice-Chairman Fischer. Motion seconded by Supervisor Flansburg and carried with all favor.

HIGHWAY REPORT: Bill Schneider gave the report for April stating that they worked on the compost facility, cleared roads and intersections, worked with Nelson tree service, set up for primary day, set up for the dumpsters for cleanup day on April 28. Set up for the planning board meeting. Started work on Decker Lane and worked on Glasshouse Hill project. Worked with the Delaware River Joint Toll Bridge Commission to sweep the roads. Worked on Bell manner on some shouldering. Supervisor Melvin moved to approve the highway report. Motion is seconded by Supervisor Banach and carries with all in favor.

BUILDING/ZONING REPORT: Mike Rendleman gave the report for April reporting 10 building permits, one electrical, one sign and five zoning permits, with fees of $18,219.50. Motion by Supervisor Flansburg to accept the report. Motion is seconded by Supervisor Melvin and carries with all in favor.

CORRESPONDENCE: On dais for review.

OLD BUSINESS:

Act 47 Monthly Report: Solicitor Bernathy stated as is common knowledge the township is past our two year anniversary of the Federal Bankruptcy Courts signing the order confirming the Townships Bankruptcy Plan as well as the Act 47 Recovery Plan which amounts to final disposition of the bankruptcy plan. The Township is operating within the confines of its budget and continues to meet its financial obligations. The Township continues to provide essential services. Solicitor Bernathy says he still awaits word to see if we could remove this from the agenda as a required item. He believes that Chairman Ewbank spoke to Matt Domines from the DCED. Mr. Myer said it should be out of Act 47 by July. Supervisor Banach moved to approve report. Motion is seconded by Vice-Chairman Fischer and carries with all in favor

Compost Facility: Chairman Ewbank said the compost facility will be closed through Wednesday, as there are still dumpsters there that need to be removed. There was talk about the facility being closed Monday, Tuesday and Wednesday and open Thursday, Friday, Saturday from 9 to 5 and having someone monitored the gate. Chairman Ewbank asked if we still want to do that. Supervisor Flansburg asked what information he found out about the gate. Chairman Ewbank said he met with a gentleman about the gate today he was supposed to send a quote but it hasn’t been received. The gate is around $3500 and we have to run the electric. He suggested we don’t have the facility open 24 hours a day because there’s a liability issue because it’s not lighted. Solicitor Bernathy said that is a carrier issue. His suggestion was to leave the existing gate there and lock it for the evening, while leaving the armed gate up. Supervisor Banach said that we did advertised having the facility closed so we will have somebody out there for the three days. Further discussion was held about the gate. Mr. Myer said that there was $300 collected this year and none last year for fees. A Highway employee will man the gate for the three days that it is open this week and next.

Fire Loss Ordinance: Solicitor Bernathy said there is a notice that he has prepared in front of the board that needs to be advertised for public hearing at their next meeting. Supervisor Flansburg moved to advertise the notice for public hearing of the fire loss ordinance for June 5 at 7 PM. Motion is seconded by Supervisor Melvin and carries with all in favor. Supervisor Banach asked Solicitor Bernathy to clarify the ordinance. Solicitor Bernathy said this is so that we have sufficient funds to clean up after a fire in the event of problems.

NEW BUSINESS:

Joe Popowycz/Team Depot-Tunnel Painting: Chairman Ewbank Joe Popowycz will be painting the tunnel with his team. They will supply the paint, the manpower and everything to paint the tunnel. However they supplied us with their certificate of insurance not naming us an additional insured. We did tell him that we need to be named. Mr. Popowycz was going to come tonight but his son is receiving an award. The date scheduled to paint is June 14, 2012 with a rain date of June 21, 2012. Mrs. Green will follow up with the insurance.

Pike County Training Center Dedication Ceremony / Sunday, June 3, 2012: Chairman Ewbank said the Pike County Training Facility is going to have a dedication ceremony at 1 PM to 4 PM we need to RSVP by May 15th.

Commissioners Request Assistance of all Fire Police for Sunday, June 3 from 11 to 4 For Training Ctr.: Chairman Ewbank said the Commissioners are requesting all Fire Police be available for the training center. Jay Edwards said this is the same day as the Fire Police annual picnic. Solicitor Bernathy said the Commissioners want some advises that the Fire Police will be there. Luis Bocaletti said they’re Fire Police will be there. Ken Zielazny said their Fire Police will be there as well. Mr. Bocaletti is requesting permission to be out of town that day. Supervisor Banach moved to grant permission to the Westfall Fire Department and Mill Rift Fire Department to be out of town June 3, 2012 to the training center inLords Valley,PA. Motion is seconded by Vice-Chairman Fischer and carries with all in favor.

Lease Agreement/ Westfall Township and Faith Family Fellowship: Solicitor Bernathy said we have a lease that he has prepared and approval is needed to forward that to Faith Family Fellowship. Supervisor Banach moved to approve the lease with Faith Family Fellowship motion is seconded by Supervisor Melvin and carries with all in favor. Lee Cokelette questioned if it is all right if they use the building another night of the week aside from Sunday morning for Bible study. Solicitor Bernathy said our understanding is for any type of religious services and that is one of the religious services you provide. Supervisor Flansburg said he believes he is asking to use on Wednesday or Thursday evening. Solicitor Bernathy said he understands that what he is saying is that the lease provides for that. It is on a per day basis and if we get a full-time tenant Faith Family Fellowship has the right of first refusal. The rent is $20 per day on an as needed basis. The secretary said we did receive the insurance certificate.

Request by Keith Raser, Director of Transportation to attend Township meeting on July 3, 2012: Chairman Ewbank said Keith Raser would like to come to the meeting on July 3, 2012. The secretary will let him know he is welcome to attend.

Draft Road Use Agreement: Chairman Ewbank asked if these were from Joe Hudak. Mrs. Green said one is from the County and the other two were received from Joe Hudak. Supervisor Banach said the one he received from Joe Hudak is more useful with the exception of number eight which should be changed from upon completion to during and upon completion. Discussion followed. They will be tabled for now.

Termination of Waste Management Contract: Chairman Ewbank said we had the contract with Waste Management with the charge of $61.60 per month. Mrs. Green said they used to charge that they are now charging $87. We have a quote from Marangi for a price of $45 for the same service. Supervisor Banach asked for contract term. Mrs. Green didn’t get a contract term yet. Solicitor Bernathy said you have a copy of the contract that was signed on August 10, 2009 he wants to be careful that were not subject to liquidated damages. Any motion that we make will be subject to contractual provisions of the service agreement. Mrs. Green said the rates increased. Solicitor Bernathy said pursuant to the contract they need to give us written notification of the rate increase, questioning if they had done that. Mrs. Green said they did not. Solicitor Bernathy said them we may not be responsible for liquidated damages. Mrs. green said when she called them they told her she could terminate the contract as long as she gave them 90 days written notice. Chairman Ewbank said they are not terminating the contract they are just not renewing. Solicitor Bernathy said the motion would be to direct Mrs. Green to send them notice Supervisor Flansburg moved to send that notice. Motion is seconded by Vice-Chairman Fischer and carries with all in favor. Mrs. Green said she will obtain phone quotes for other waste haulers.

Resolution 2012-2 List of Records to be Disposed of: Chairman Ewbank read the resolution 2012-2 and the list of records to be disposed of which is attached to these minutes. Chairman Ewbank said that he received an e-mail from Cintas saying they could come to dispose of the records on May 16, 2012 and asked the secretary if that would work for her. Mrs. Green agreed to the date. Supervisor Flansburg moved to approve the resolution. Motion is seconded by Vice-Chairman Fischer and carries with all in favor

Westfall Senior Apartment Project: Representatives: Nate Oiler, R.K.R. Hess, Associates, Jonah Mandelbaum, Warwick Properties, Lara Dodsworth

Solicitor Bernathy commented that we would agree as we did at the past meeting that this is informal and you are not to rely on any representations made by the supervisors, understanding that this is going to be pending before the supervisors for purposes of land development and conditional use. Mr. Oiler agreed and said that this is the Westfall Senior Apartment Project which is proposing a 94 unit affordable housing project. This is at the end ofHulst Driveand was the proposed Phase 2 Paddlers Point Project. It consists of 94 single bedroom units. Mr. Oiler introduced Jonah Mandelbaum from Warwick Properties, the Developer. Mr. Mandelbaum said this rendering is the exact same building as the one in New Windsor. Everything is incorporated inside the building. The rents will be running from $369-$739. Income starts from $13,800-$27,600 Supervisor Flansburg said being it is a senior complex do you have problems with the second and third floors. Mr. Mandelbaum said the floors all have ADA Compliant Elevators. Supervisor Flansburg asked Mr. Mandelbaum how old the building was in the picture, stating it looks like he does very good maintenance. Mr. Mandelbaum said Jeff could attest to that he used to work for him. Mr. Mandelbaum said they had their own maintenance team that works on the building. Mr. Gregory said his mother lived at Water’s Edge and the buildings were very well maintained. Mrs. Catalano asked if they are going to have handicap apartments. Mr. Mandelbaum said they are all inADAcompliant. Supervisor Banach asked how a resident gets on the list. Mr. Mandelbaum said three months before the C/O they start putting people on a list, sometimes with the Township Clerk. Solicitor Bernathy said he prefers that it be kept private with Mr. Mandelbaum’s office rather than with the Township. Supervisor Banach asked where we go from here. Solicitor Bernathy said we’ve gone through a lot of the details at our past meeting commenting that Mike Rendleman wasn’t available at that meeting. Solicitor Bernathy said they’re going to need land development approval. He further stated that we’ve been comparing and contrasting Age Restricted Housing and theIndependentLivingRetirementCenter’s we provide for and this will have a lot less impact. Solicitor Bernathy said he does not feel this is a use we specifically provide for within our ordinance and therefore he believes they should apply for conditional use approval based upon the size of the site. Mr. Rendleman said his concern was not about the parking however under townhouses and apartments in the zoning ordinance the zoning law is eight units for any building. Solicitor Bernathy stated that one of those tenants needs to be age 55 or older. Mr. Rendleman stated again the regulation of eight units for any apartment building further adding that the independent living retirement center we already have does not meet our ordinance however it was constructed under the former ordinance. Mr. Mandelbaum said the height of the building will be less than 35 feet. The first three floors are occupied. The building will be sprinkled. Supervisor Banach questioned where they go next. Solicitor Bernathy said they submit their land development application, and their conditional use application, they paid their fees and they’re on their way in front of the Planning Commission.

Meet with BIU to Set Fee Schedule: Chairman Ewbank said they need to meet with BIU in executive session to go over their fee schedule. Solicitor Bernathy questioned if this should be in public. Chairman Ewbank said they just wanted to have a workshop with them. Solicitor Bernathy said they could have an executive session and announce that their next meeting.

Chairman Ewbank said at their last meeting last Thursday night they decided to terminate the building inspector for cost conserving measures and in turn hired BIU to replace him. Solicitor Bernathy stated they are a third party company. It will be a total turn key operation and the contract is being reviewed by the solicitor.

Hiring of Part-Time Highway Employee: Discussion was held regarding the hiring of a part-time Highway employee and the funds available for that. There are funds available that are being saved from the building inspector’s salary. Mr. Myer said we are ahead in the Road Department budget. Supervisor Banach moved to hire Richard Mai at will, part time, as needed for the Hwy., Department at a rate of $15 per hour as he is a CDL driver. Motion is seconded by Supervisor Flansburg and carries with all in favor.

Compensation of Cleanup Day for Lisa Green: Chairman Ewbank said that we just had cleanup day andLisa Green was here for six hours collecting money. Since this is out of her job scope we need a motion to pay her. Supervisor Flansburg moved to pay Mrs. Green. Motion is seconded by Vice-Chairman Fischer and carries with all in favor. Mr. Myer questioned if this was at her normal rate of pay. It is.

SUBDIVISION REVIEW AND ACTION:

Delaware Valley School District Gym Addition: Representatives: Rock Stahovic-Greenman-Pederson, Inc.

Rock Stahovic introduced himself to the board stating the project is a joint project. The first is to demolish the existing elementary school main campus. They will then build a brand-new school in MilfordTownship. On the high school campus where the existing elementary school is they will be adding a gym that’s going to be attached to the Natatorium side of the school. That’s going to run between the PE building which is right in back of the elementary school. Also as part of this project they’re adding bleachers to the visitor side of the football fields, the concession Fieldhouse to the visitor side and brand-new dugouts for the baseball fields. The parking is going to be reorientated. There is going to be the same amount of parking it’s just going to be reconfigured. Another athletic field is going to be added. Mr. Stahovic stated they were in front of the planning commission last week and they received the review comments from the Alternate Engineer. The planning commission made the recommendation to forward the application to the supervisors. There are two conditions were to address Pike County Office of Community Planning comments, which they have not received as of today and also the NPDES permit which is in the review process right now.   Solicitor Bernathy said there are also two waivers. Mr. Stahovic said the first waiver is for the sidewalk. They are requesting a waiver from section 608.5 of the Subdivision and Land Development Ordinance. Mr. Stahovic stated this property has been previously developed and there are no sidewalks along any portion of the frontage of this property or even any property in the vicinity of the DelawareValleyschool district property. There is concern for the safety of any pedestrians polluting the students of DelawareValleythat by adding a sidewalk along the frontage you’re inviting pedestrians to the SR 6 and 209 is a very busy throughout even during the hours when school is starting and letting out. DelawareValleySchool Districtdoes not want to entice students use the sidewalk along this portion of the SR 6 and 209 and jeopardize her safety and well-being. The second waiver is concerning the bleachers. Mr. Stahovic states the bleachers require federally mandated ADAaccessible ramp to access handicap seating. This ramp will be located approximately12 feet into the side setback adjacent to the Walmart property. The land for these bleachers was originally purchased from Walmart for the purpose of installing bleachers. Section 803.B.2. Projections Into Required Yards state steps stoops fire escapes, handicap ramps and landings necessary to provide entrance to buildings may be located within a required setback. At the April 24WestfallTownship planning commission meeting it was the unanimous opinion of the commission that the bleacher should be left in the location currently indicated and that the ramp should not be considered a violation of the zoning ordinance. We respectfully request your concurrence. Supervisor Banach said they would agree to the bleachers but not the sidewalks. Supervisor Melvin agreed stating they would like to encourage the use of sidewalks in the Route 209 corridor. Further stating it is a free-for-all on Friday nights. Chairman Ewbank asked if we had agreements with some of the businesses to install sidewalks once the widening of 209 was complete. Mrs. Green stated she believed there was with Advanced Auto Parts and Taco Bell. Chris Lordi from theDelawareValley school District stated that he believed the sidewalks within the Walmart and the Taco Bell and the other stores are not on Route 6 and 209. Vice-chairman Fischer said he believed they were all in agreement with the sidewalks. Discussion was also held that the widening of Route 6 and 209 which is stopping at the school district’s property line. Supervisor Banach stated that he and Mrs. Banach wrote a letter to the school to have a guard rail put out the kids were running out onto the highway to get soccer balls. And now this offense up also. Chris Lordi said he believes if they have to put the sidewalk in it will be a sidewalk to nowhere. Supervisor Banach said we’ve been working on this for several years to get sidewalks along Route 6 and 209 and eventually all the businesses will have them. Solicitor Bernathy said we have review comments from the Pike County Conservation District stating the NPDES permit is incomplete and we cannot give approval and till we receive that approval. Solicitor Bernathy said we are not in a deemed approval scenario and he is asking the school district for a 90 day extension. That will be done. Solicitor Bernathy said that they have setbacks in the planning commission unanimously approved the waiver for the bleacher setbacks. You have your engineer review comments you await the comments from thePikeCounty planning commission, it is not right for disposition. With that said this will be an item that will be carried on the supervisors agenda and we for the County review.

Westfall Township, Matamoras, PA

April 26, 2012

The Westfall Township Board of Supervisors held a Special meeting on Thursday, April 26, 2012 at 7 PM.   The meeting was held at theTownshipBuildingonDelaware DriveandLa Barr Lane,WestfallTownship.

Those present were Chairman,Robert Ewbank; Vice-Chairman,Paul Fischer; Supervisors Raymond Banach,Larry Flansburg, andRobert Melvin; Solicitor Robert Bernathy; and Secretary,Lisa Green. Also present were Bill Schneider, Debra Banach, and John Dalton.

Chairman Ewbank announced that an executive session was held for personnel on April 9, 2012 at 2 PM and prior to tonight’s meeting at 6:30 PM.

AGENDA:  Motion to approve the agenda was made by Supervisor Banach. Motion is seconded by Supervisor Flansburg and carried with all in favor.

PUBLIC COMMENT: None

OLD BUSINESS:

Compost Facility: Supervisor Banach mentioned that one of the township residents suggested having a gate installed. However until such time as we do that Supervisor Banach thought we should have the Matamoras residents contact the Matamoras office to obtain the gate code and have the Westfall residents contact the Westfall office for the gate code this way we would share the burden and could compare notes at the end of the month. Chairman Ewbank stated that one Township resident did suggest getting an armed gate with the gate card and he has contacted someone who gave him a price of approximately $3,500. That would come with a Keypad with a number. It would open when you went in and close behind you. You would also be able to track the usage by the cards. Chairman Ewbank explained the situation that happened with American Tree Service of Port Jervis driving in the back to dump. The supervisors expressed the need to do something quickly. Supervisor Flansburg questioned if the $3500 included electricity. Chairman Ewbank did not know stating the gentleman was going to come up and speak to him. Further discussion followed regarding the gate and the card readers. This cost will be split with the Borough of Matamoras. A motion was made by Supervisor Banach to proceed forward with looking into the gate for the compost facility. Motion is seconded by Supervisor Melvin and carries with all in favor.

NEW BUSINESS:

BIU Presentation: Carl Fregoni, representing BIU “Building Inspection Underwriters” introduced himself to the board stating he is the Regional Manager forNortheast PA. Mr. Fregoni said they been in business 55 years. Out of 2600 Township’s they are in operation in 600. They perform all commercial plan reviews in house. All commercial drawings are typically reviewed within two weeks. Residential plan reviews are typically done in the Township. Mrs. Green stated they have completed eight plan reviews for the Township since April 10, 2012. Mr. Fregoni stated there is an error on page 7 of the contract where it refers to the zoning officer; that should be the inspector or secretary. Certificates of Occupancy must be generated by BIU because they must be. The law says they must be issued within five days. Everything else is mentioned in the Contract. They don’t do Milford Borough,MilfordTownship, Lackawaxen or Shohola. There are two townships inPikeCounty have chosen to use their own building schedule. So the prices in this contract are consistent with the prices around town. The prices in Westfall are considerably different. So if you choose to use our services we can do it either way you can charge used your fee schedule all and we will bill you are fee schedule all that it is up to the governing body. We will bill at our fee schedule. Mr. Fregoni said he did not know what else to say we’ve tried to come in and the in the interim and help you out which we have done. Supervisor Flansburg questioned if BIU made a mistake what the Township’s liability was. Mr. Fregoni said there is no liability. The Township is held harmless, that is in the contract.   If there is the problem he will give us the number for his attorney. Mr. Fregoni said these would be criminal complaints and they would be providing an attorney or paying for an attorney up to reasonable amount to the district magistrate. Once it goes up to the DA the Township Solicitor would have to take over. Solicitor Bernathy questioned if BIU is filing criminal complaint with the district magistrate stating that’s not criminal in nature. Mr. Fregoni stated it is a summary offense, Solicitor Bernathy said that is not a criminal complaint subject to 90 days in jail. Mr. Fregoni stated that the board of the uniform construction code would fine up to $1000 per day and each day would be a separate offense. There is no incarceration. If the magistrate fined them it could be appealed to the DA. Solicitor Bernathy asked what Title that is. Mr. Fregoni said it is Title 35: Violation 72.10 903. Solicitor Bernathy said the Township will be either be provided an attorney or compensated by BIU for the township attorney for the building part of the case. Discussion followed concerning the attorneys covering the criminal cases. Mr. Fregoni said they don’t just go out and issue citations. Solicitor Bernathy asked if they issue a violation notice and give them 30 days to abate the violation might be. Mr. Fregoni said sometimes they give them 30 days sometimes they give them 90 days; it depends on what the violation is. Solicitor Bernathy questioned if this covers commercial and residential. Mr. Fregoni said yes it covers everything solicitor Bernathy asked to compare contrast costs for what it is that the Township has now and what it is that BIU is offering Mr. Fregoni said the secretary has cost comparative sheets for what BIU is offering. BIU’s has their fees in the right column and Westfall has their fees in the left other column. Mr. Fregoni they said most Township fees are higher than theirs. Most Townships’ charge an administration fee of 20%, inWestfallTownship there was a commercial job they just reviewed that generated $8500 in fees and their fee was $3500. If you choose us and use your fee schedule we will charge you our fee schedule and bill you based on our fee schedule. Of course we will pay rent. It all depends on how you wanted to. Solicitor Bernathy asked who we have as the face of BIU. Mr. Fregoni said the gentleman that does the residential inspections is on his way toOcean CityMaryland on a golf trip. Paul Bunnell who is here tonight does the commercial reviews and inspections and also some residential inspections. Mr. Bunnell has been with the company for three and half years. Mr. Mistysyn has been with the company for six years, and Mr. Fregoni has been with the company for 18 years. BIU is currently engaged in every municipality in the County besides Milford Borough,MilfordTownship, Lackawaxen, Shohola and Westfall. Chairman Ewbank asked if he were to build the house and called in for an inspection how long would it take for that inspection to be done. Mr. Fregoni he said the inspection would be done between 24 to 48 hours after it’s called in. Discussion was held on the way the inspections were handled. No work is farmed out and re-inspection fees are not charged. Supervisor Melvin asked if BIU makes the recommendation what the homeowner what the contractor needs to do when an inspection fails Mr. Fregoni said they are not allowed to do that. They cannot tell them what to do they can point them in the direction of how to do it to meet code.

Mr. Fregoni said for the record there is something circulating that he would like to get cleared up. They were separated with BIU of New Jersey in 1999. What happened is Cherry Hill NewJerseya municipal official thought that maybe one to make a little extra money and he was called for income tax sedation. They put a wire on him and he asked the president of BIU New Jersey for $5000 to stay inCherry Hillthe president gave him $5000 and he was arrested. That has nothing to do with BIU of Pennsylvania. They have no affiliation with BIU of New Jersey and have not had any affiliation with since 1999.

Supervisor Banach thanked Mr. Fregoni for stepping up in our hour of need. He said he’s met Mick and he has received phone calls from people who were ecstatic with the work performed by BIU. The secretary has been pleased in working with them and bond that has been formed has been very nice. You had one commercial job that was waiting for weeks to go out. There was a nondesign nonstructural issue that you are able to make a comment on the job when out the door 5 min. and they were very proud of that. Supervisor Flansburg said he was here that morning and you came in made something out of the nothing he was looking at and made us look good and you should be commended for that. Mr. Fregoni said that Mike Rendleman are zoning officer already works for BIU and he doesn’t have a problem with my continuing as are zoning officer as long as he is working nights and weekends. But he couldn’t do building inspections inWestfallTownship. Solicitor Bernathy said he would need to think about this Mr. Fregoni said Mr. Rendleman was our zoning officer before BIU may be coming on board. He would not want to take that away from them. Supervisor Flansburg said there are a few contractors in town that would like to have a private number to call for the building inspector. Would it be possible for the contractor to have private numbers? Mrs. Green said she was told not to give out cell phone numbers. Mr. Fregoni said they would have the toll-free number for the office and they can get messages up to twice a day. They don’t make a habit of giving out cell phone numbers. However many of the contractors already have the building inspectors phone numbers. Mr. Fregoni stated we’re not a strange company that’s coming in to town. Discussion followed about the inspections and who will be doing them and that they will be happening during business hours. Mr. Fregoni further stated it’s not that he doesn’t want to be straightforward but he doesn’t want to be giving out all the inspectors’ cell phone numbers.

Albert Van Etten questioned Mr. Fregoni on what days during the week inspector will be available at the Township office. Supervisor Flansburg introduced Mr. Van Etten as one of our contractors. Mr. Fregoni said they will be here two days during the week approximately 2 hours per day. Mr. Van Etten asked if it will be one inspector for plumbing, one inspector for electric, and one inspector for building. Mr. Fregoni said it will be one inspector for all phases of building. Mr. Van Etten asked if they called the 800 number will they get an answering machine. Mr. Fregoni said there are four secretaries in the office who take messages for the building inspectors. They get their messages in the morning and at 12 o’clock in the afternoon. Mr. Van Etten questioned if they had their own application and ifWestfallTownshipwill be using it or the current building application. Discussion Followed. Mr. Fregoni said he would prefer to use BIU’s forms because they include electrical mechanical and plumbing whereas theWestfallTownshipform does not. Mr. Van Etten agreed. The Supervisors stated it would be total turn key, we may useWestfallTownship’s fees for now; but we would use BIU’s permits. Mr. Fregoni said the contract withDingmanTownshipstated that BIU would never charge more than what the Township fees are and it should be in our contract, right now it is not. Supervisor Banach has concerns over the commercial rates explaining what the movie theater had to pay for its building fee and then what Jakes and Yo Cups had to pay on top of that just for tenant fit outs. Peter the manager ofWestfallTownCentergave Supervisor Banach an earful about our commercial fee schedule. Supervisor Banach feels once you own the property and are doing a renovation the building on the building that was already there you’ve already collected money the first time our current rates would be pretty exorbitant. Mr. Fregoni saidDelawareTownshipcovers their own fees,DingmanTownshipused their fee schedule the first year and the second year they adopted BIU’s commercial fee schedule. Mr. Fregoni says BIU will do it anyway we want. He just feels the clause should be in there stating BIU’s fee will never be more than the Township fee. Solicitor Bernathy said if they consider this it should be based on Solicitor Bernathy’s review of the contract and our ability to negotiate any changes that we might like to make. Mr. Fregoni said 90% of the municipalities put in a 20% administration fee which covers rent, lights, and administrative duties. Mr. Fregoni stated there is a municipality that took a 50% fee and it was challenged. Solicitor Bernathy questioned what plan reviews there working on for the Township at this time. Mr. Fregoni said they are current with the plan reviews in the Township that this time they’ve completed each plan reviews and have just completed the plan review for Monroe LBL LLC in approximate 5 days. Mr. Fregoni said commercial plants no longer have to be sent to L & I saving significant time.  They have three residential plan reviews that came in yesterday. Solicitor Bernathy stated as far as references are concerned his firm representsDingman Township,DelawareTownship, and Lehman that BIU is providing services to. Mr. Van Etten and questioned who is providing inspection services as of today? The supervisors answered BIU.

Supervisor Melvin moved to eliminate the towns building inspector position as cost cutting measure effective immediately. Motion is seconded by Supervisor Flansburg and carries with all in favor. Solicitor Bernathy asked if that was unanimous. Chairman Ewbank said it is unanimous.

Supervisor Melvin asked to make an additional motion to hire BIU as a third-party inspector for theTownshipofWestfallsubject to our attorneys review of the contract and the fee schedule; with the specific provision that our current code enforcement officer Mike Rendleman does not do any code inspections for BIU within theTownshipofWestfall. Motion is seconded by Supervisor Flansburg. Motion carries with all in favor.

Westfall Senior Apartment Project: Representatives: Nate Oiler R.K.R. Hess Assoc.  Jonah Mandelbaum   Warwick Properties Inc.,  Lara Dodsworth, Esquire.

Nate Oiler Stated they talked about the affordable senior housing project at the last meeting. Solicitor Bernathy stated as he had indicated that the previous meeting the supervisors are not bound by any representations nor should the representatives rely on them for purposes of any review and they should understand that. Mr. Oiler said it is understood. They presented a typical floor plan. Mr. Mandelbaum said he had asked the residents what they thought they should do in a new building because they live there and they encompassed a few of their ideas. Everything is going to be indoors. All the floors are identical, all apartments are identical, the tenants will all have the same apartment. It does not matter how much money they make. Mr. Mandelbaum said as long as they get zoning in place, go to the planning board, go through the process, get approvals and get funding from the state. Then they will get the building permit and pay the fees and move on to build the building. Solicitor Bernathy asked how big the parcel was parcel is. It is 5 acres. Mr. Oiler said there are some zoning issues and they are asking for some direction because it is not a use that is addressed in the zoning ordinance it could be considered a conditional use. Solicitor Bernathy questioned what in their opinion distinguishes this from what the zoning ordinance currently provides for which is age restricted housing. Mr. Oiler said the size of the apartment and the size of the unit which impacts sewer and water, and that significantly lessens the impact of the property Mr. Mandelbaum said this would be a total affordable apartment stating it would only be one bedroom all the units would be identical it would significantly lessen the impact. It would only be half a parking space per unit because not everyone has a car. They would also have to be 55 years old without children. There would be an on-site live-in manager. Solicitor Bernathy asked what the impervious coverage was. Mr. Oiler answered less than 50%. Building coverage to be less than some of the other categories. Discussion was held about the current properties that Mr. Mandelbaum owns with regard to their community parking. Solicitor Bernathy asked if the buildings would have sprinklers. Mr. Mandelbaum answered that they will. The sleeping quarters will have sprinklers. Solicitor Bernathy asked if the fire chief had any issues. The chief asked for fire hydrants. He does not have any issues as long as the building is sprinklered and they have hydrants. Solicitor Bernathy asked about security. Mr. Mandelbaum said the parking lot is always lighted. The whole perimeter of the building has cameras. They are on 24 hours a day seven days a week. The front door is open at 6 AM and locks at 8 PM magnetically you need it key to get in after that. Mr. Mandelbaum said they’ve never had an issue with security. The super is there for all issues. Supervisor Melvin questioned what emergency services would be given. Mr. Mandelbaum said emergency services would have a Knox box they would buy the box and install it and the emergency services would have the key and the master key would open every door in the building. Chief Koferl questioned if each apartment would be tied into the alarm system. Mr. Mandelbaum answered only the common areas. The mailroom was discussed. Garbage was discussed. Solicitor Bernathy asked if there were any impact on any adjacent properties. Mr. Mandelbaum answered there’ve been no complaints regarding noise. Solicitor Bernathy questioned if there are deed restrictions regarding the age. Mr. Mandelbaum answered there could be a deed restriction. Discussion was held on the age requirements. Head of household must be 55 years old. There could be two occupants in the apartment, with no live-in children. Solicitor Bernathy questioned what if they are disabled. Mr. Mandelbaum answered it would be up to the state. The Pennsylvania Housing Finance Agency Regulates that. Supervisor Flansburg questioned what is it you need from me today. Solicitor Bernathy answered that’s why he is asking this of them today because this does not fit in our ordinance. They are giving us a breakdown of comparing and contrasting what it is they are in proposing compared to what we have in our ordinance. Supervisor Flansburg said is it us that’s determining what it is they can have and we will be deciding if they can do their project. Solicitor Bernathy answered he is waiting for a decision from the state on this. This is either going to be a use that’s not provided for and if it doesn’t fit they will need to come before the Board of Supervisors and get a conditional use approval through a public hearing; or it is provided for as Age Restricted Housing and they require a lot more acreage and they would have to challenge the validity of the ordinance by a change. Solicitor Bernathy said because this is something we haven’t addressed as Affordable Senior Housing in our ordinance it is a conditional use and the board can set any conditions on the project based on health, safety and welfare upon the project. Otherwise it would be Age Restricted Housing and you’re going to have to challenge our ordinance or come in with an amendment to our ordinance. Mr. Oiler said they would be comfortable with the conditional use application. Supervisor Fischer said they already have Heritage Point solicitor Bernathy questioned if we’re ready have records on heritage point. Mrs. Green will have records on Heritage Point to the Solicitor tomorrow. Discussion was held about Heritage Point. Supervisor Banach said Attorney John Stieh prepared an amendment to the zoning ordinance for Heritage Point. Solicitor Bernathy stated that our zoning ordinance was adopted in 2005. Further stating that this project is so much less impactful. Mr. Mandelbaum invited this any of the supervisors to see the building. The board asked for pictures of the building either by e-mail or to bring them with him to the meeting. Solicitor Bernathy asked Mr. Oiler to talk to him about State and County’s soil and erosion and storm water. Mr. Oiler said they reserved a large area for storm water and sanitation. They’ll have to meet’s all the new NPDES regulations. Mr. Mandelbaum was advised that the areas in the floodplain. He was aware of that. He’s had other projects that were in the floodplain and built the area up. His project never flooded. He said he guarantees he will raise it’s far above where the water will ever be. Egress lighting was discussed. They will be at the meeting on May 1, 2012. 

Act 167 Discussion: Supervisor Flansburg said it’s been called to his attention that the 2012 Hazard Mitigation   has some back door things in it that would allow them to institute things into our ordinances that we were not aware of, and if you read this paper they called into question Act 167. Supervisor Flansburg has been reading through the hazard mitigation plan which is 280 pages and said he’s been highlighting the things he doesn’t like and it does look like if we don’t implement things within two years they’re going to come in and do them without us. Supervisor Flansburg said he wants the board to be aware of that because he thinks we signed it without reading the whole thing.MilfordTownship rejected it wholeheartedly. Supervisor Flansburg has been working withMilfordTownship. Supervisor Melvin questioned ifMilfordTownship adopted it first and then said no. Supervisor Flansburg said no they rejected it from the beginning. Chairman Ewbank said he spoke to Mike Mrozinski today and then he spoke to Susan Beecher’s office and then he got a call from Karl Wagner’s office. Further stating just because we approved the Hazard Mitigation plan does not mean we approved Act 167. Solicitor Bernathy said that was his understanding. Commissioner Wagner is going to send a letter to that effect, which he will also send to Shohola. If we don’t remain in the Hazard Mitigation Plan and we have a major disaster we will not get any funding. Chairman Ewbank said a lot of people have misinterpreted what it has said; the Act 167 plan has been 4 years in the planning. It has been put out in a draft, reviewed by the municipalities and rejected by most of them. It is back on the drawing board again and is not something that’s going to be forced down anyone’s throat. It is probably two or three years down the road. Supervisor Flansburg said his worry is the last paragraph said if we didn’t implement it within two years they would implement things for us and he felt that this would be binding legally. Chairman Ewbank and Solicitor Bernathy both said they did not believe that to be true. Supervisor Flansburg said there are things in the plan that made him question that like the paying and clearing ofMashipacongIsland. Supervisor Banach said we already do that and added that when we get the letter from Commissioner Wagner he would like to see it. Chairman Ewbank said signing the Hazard Mitigation Plan does not approve the Act 167 plan. But if we take ourselves out of the Hazard Mitigation Plan we give up the right to funding if a disaster occurs. Supervisor Melvin said he needs to look back on his notes but there’s some OEM certification that all of the supervisors need. Chairman Ewbank said its NIMS training and they need 100, 700, and it wouldn’t hurt to take 200, and 800. It’s on the FEMA website. Chief Koferl explained where the classes can be found online. Chairman Ewbank said they are supposed to be running a 300 and 400 class inGoshen the summer.

 Tax Collector Salary: Supervisor Banach said this is something we need to take action on because of next year’s election. We are paying an extra $15,750 to the tax collector because of the Katz tax. Supervisor Melvin asked when Katz was done and official. The tax took effect the year 2010. Supervisor Melvin questions if this was discussed during the budget process and suggested looking at what the rate of pay was at that time and adding a 3% increase. Supervisor Melvin then questioned how much time we had to get this done. Chairman Ewbank stated in need to be finished by February of the upcoming year stating it should be done by the end of December. Solicitor Bernathy stated there is a 30 day review period after that. Discussion was held. The supervisors will act on this to reduce the percentage prior to the required timeframe. Supervisor Melvin added that reducing the percentage from 5% to 4% would drop the salary down to approximately $48,000.

 File Cabinet Municipal Office: Mrs. Green said she received a quote from ATD American for $245 but their shipping was $99. So Mrs. Green went on the Quill website and found a cabinet for $249.99 with free shipping. Supervisor Banach moved to purchase the file cabinet at a price of $249.99. Motion is seconded by Supervisor Flansburg and carries with all in favor.

 Digital Recorder: Mrs. Green said Mr. John Dalton suggested that we buy a digital recorder to record the meetings and at the time she was not in favor of that. However, her tape recorder began eating the meeting tape of April 3, 2012. So she had called several board members to get approval for the purchase of the digital recorder. Supervisor Flansburg commented that Mrs. Green even received a good deal on the purchase. Mrs. Green said that Supervisor Melvin was here at the time of the purchase and that she did save $25 on the deal through the coupon that she had with Staples. The cost of the digital recorder $124.99. Supervisor Banach said that Mr. Dotey supplied the Township with Dragon software. Mrs. Green said that he did however it is not compatible with the digital voice recorder and we need the Premier edition which we were able to purchase from Nuance at a cost of $79.99. Staples was selling it for $129.99 so we got a good buy. Supervisor Flansburg asked if the old recorder ate the whole tape of last month’s meeting or if it’s still usable Mrs. Green answered that some parts are still usable it is just the April 3, 2012 minutes. Supervisor Flansburg asked if you can retrieve information off the tape. Solicitor Bernathy asked how the minutes were done. Through the tape and notes. Solicitor Bernathy asked Mrs. Green to preserve whatever she could from the tape. Motion to ratify the purchase of the digital voice recorder made by Supervisor Flansburg. Motion is seconded by Supervisor Melvin and carries with all in favor.

 Temporary Burning Ban: Supervisors and Fire chief agree that it is not necessary.

 Loitering Ordinance: Supervisor Flansburg said he did not want us to forget that the police had asked us about a loitering ordinance. Supervisor Banach questioned if the chief provide us what he was looking for. Supervisor Melvin said he thinks what he was looking for was something like what Matamoras has. Solicitor Bernathy said he will find some loitering ordinances that the state has and bring them to our next meeting. Discussion was held about the loitering ordinance relating to Milford Landing and being a security force for the box stores.

 Pedestrian Underpass: Supervisor Flansburg said the police have done us a huge favor by stopping there and it seems to have stemmed the problem for now, but we should look into it to see if we can amend the contract or not, because the problem will be coming back.

The regular meeting of the Westfall Township Board of Supervisors was held Tuesday, April 3, 2012

at 7:00 pm. The meeting was held at theTownshipBuildingonDelaware Drive and LaBarr Lane,WestfallTownship.

Those present were Chairman,Robert Ewbank, Vice-Chairman,Paul Fischer; Supervisors, Raymond Banach,Larry Flansburg, andRobert Melvin; Solicitor, Robert Bernathy and Secretary,Lisa Green. Also present were Treasurer,Scott Myer; Building Inspector,Shawn Bolles; Zoning Officer, Mike Rendleman; Police Chief, Chad Stewart; Roadmaster, Bill Schneider; Luis Bocaletti, Jay Edwards, Lisa Mickles, Twila Decker, Jerry Dotey, Nate Oiler of R.K.R. Hess, Jonah, Mandelbaum and approximately 13 members of the general public.

AGENDA: The agenda was amended to add litigation to the executive session. Supervisor Flansburg moved to approve the agenda. Motion is seconded by Vice-Chairman Fischer and carries with all in favor.

Public Comment: Jerry Dotey from Mill Rift said that last night he met with Michael Green who is opening Jakes Wayback Burgers in theWestfallTownCenter and he said that he saw a completely different man than the one he met a year ago who was so excited to be opening a business. Mr. Green seemed despondent now saying that his plans and drawings were being sent toArizona and he was being held up. Further stating that every time he turned around there was a new charge for something else. Mr. Dotey said here is a man who wants to come and open a business and hire people from around here and it’s taking a year to open. He sees tobacco stores opening in six weeks all around us, asking what is the difference. Chairman Ewbank said he knows they go to a third party inArizona. Mr. Dotey asked whyArizona? Shawn Bolles said the third party plan reviewer who we have been using for sixteen years has a ten day turn around time and the ICC does plan reviews in 30 days. Further stating that the applicant chose to do deferred submittals which meant they wanted the permit reviewed and issued so that they could do the walls first, than a month later do the underground plumbing, than mechanical, than electrical system etc. They were told back in September that doing the review this way would be a nightmare for them but they decided to do it that way with deferred submittals. Mr. Green said his architect had been jerking him around since July. Mr. Bolles said the smoke shops have everything on their plans at one time and have the plans reviewed at one time.  Mr. Bolles further said he had decided after this project that we would not accept anymore deferred projects. Supervisor Flansburg said 14 days seems a little long for a plan review. Mr. Bolles said we offer expedited review at an increased cost to the developer if they choose. Supervisor Flansburg asked if this is something our own engineer can review. It is not. He does not have the certifications. Supervisor Banach asked if these drawings are designed by an engineer with a PE Stamp and if we are sending them out to be looked at by an engineer. Mr. Bolles said we are sending them out to be looked at by a certified plan reviewer with a state license. Supervisor Banach also questioned why we were having someone else going out on inspections. Mr. Bolles said because he was out on Medical leave and has been for the last year and a half. Supervisor Flansburg questioned the plumbing that needed to be ripped out. Discussion followed. Supervisor Melvin said he felt we should do everything that we can do to expedite the openings on these stores. Mr. Bolles said we are doing that. Supervisor Melvin questioned if we can use a firm inPennsylvania and streamline the process. Supervisor Melvin asked if it was 30 days each time they came in with new plans. Mr. Bolles answered yes technically it is. Chairman Ewbank said that is 30 business days. There was no more public comment.

MINUTES: The Minutes of the March 6, 2012 regular meeting were approved on a motion by Supervisor Banach. Motion is seconded by Supervisor Melvin and carries with all in favor.

Minutes of March 21, 2012 workshop meeting were approved on a motion by Supervisor Flansburg. Motion is seconded by Supervisor Melvin and carries with all in favor.

TREASURER’s REPORT:Scott Myer gave the treasurer’s report for March stating that this time of year is slow financially. Tax money starts coming in in April. We are where we expect to be this time of year. Supervisor Flansburg said we would like to speak to Mr. Myer after the meeting if he could stick around. Supervisor Melvin said we spent 20% of the budget through 25% of the year. This is a good thing. Discussion followed. Supervisor Banach moved to approve report. Motion seconded by Vice-Chairman Fischer and carries with all in favor.

POLICE REPORT: Police Chief Stewart gave the report for March stating there were 6,711 miles patrolled for the month and 190 calls for service. Chief Stewart said they did a few traffic studies for speed. Two of the roads done wereCummins Hill Road and theOld Milford Road. They found cars doing 65 plus onOld Milford Road and have been enforcing that road based on the traffic studies. The department is using a radar box which shows the lanes, date, time, and speed. This data is printed on a graph and is available to the Supervisors. Chief Stewart said they’ve also been doing constant patrols on the bike tunnel and did some investigating and found that there is a geocaching site in the tunnel. There are 176 people that found the site and 16 people did not. This is bringing a lot of traffic to the area. Chief Stewart said he found a lot of people who walk to work and he does not see any reason to close the tunnel. He looked into getting cameras but did not get a quote back yet, however he was told that it was going to be expensive because they do not have a line of sight from the tunnel to the police department and they do not have a direct connection. Chairman Ewbank asked if the Chief could give us any information on the robberies that happened onCummins Hill Road.  Chief Stewart said they put out a Nixle alert. There were two burglaries, one at the top of the hill and one at the bottom and there was a vehicle broken into as well. Chief Stewart said they are following up on several leads and they are processing evidence from the scene. Supervisor Flansburg said they are getting a lot of positive comments about the tunnel and people are feeling really good about it and asked the Chief if the department can keep on doing that until we can get the answers. Also questioned on the back road toMilford if we are thinking it is kids getting out of school beating the school bus. Chief Stewart said it is around after school hours and the four people that were cited were young adults. Supervisor Banach said he wanted to thank the Chief also for taking care of that stating it is also nice to have the police presence there. Supervisor Banach said the Westfall Township Police Department was formed in the 1960’s because of a burglary in Mr. White’s house on Cummins Hill. Supervisor Banach said the more we see the Police department out there the more we like them. Chief Stewart said they are trying to keep a happy medium. Supervisor Banach moved to approve the report. Motion seconded by Supervisor Flansburg and carried with all in favor.

FIRE DEPARTMENT: Luis Bocaletti gave the Westfall Township Fire Department Report for March reporting 2 Mutual Aid structure fires, 2 Commercial Auto False Alarms, 1 Standby, 3 Motor Vehicle Accidents, 1 Vehicle Fire, 2 Mutual Aid to 32, 1 Smoke Investigation, for a total of 13 calls for the month. There were 40EMS calls for the month, 28 in Westfall, 11 covering squad 33, 1 covering squad 26. Supervisor Flansburg asked to speak to Mr. Bocaletti after the meeting and asked if he had the numbers for the Hepatitis C tests. Mr. Bocaletti will get them to us. Supervisor Melvin commented on the fundraising event the fire department was going to have on April 13, 2012. Mr. Bocaletti said it is a take out dinner only and tickets are on sale for $10.00 each.

Jay Edwards gave the Mill Rift Fire Department report stating they did driving training for the month of March. Their monthly meeting was 3/13, they prepped trucks on 3/20, had a controlled burn along theDelawareon 3/21 and assisted atMatamorasAirportParkon 3/24, and the township on 3/28. They had 260.5 man hours for the year. Supervisor Melvin questioned if the two fire departments met this past month. They did. Supervisor Flansburg said he will brief Supervisor Melvin after the meeting. Motion to approve the reports made by Vice-Chairman Fischer. Motion seconded by Supervisor Melvin and carried with all favor.

HIGHWAY REPORT: Bill Schneider gave the report for March stating that they worked on Heater’sHill Road,Sand Pit Road,Old Milford Road andSchneider Lane by Luhr’s. They worked on pot hole repair and cold patch on various township roads, as well as working on removal of anti-skid and loose stones from intersections around the township. They performed regular maintenance on the composting facility, and serviced the 2008 Freightliner Dump Truck and 2008 Chevy Pick-Up. The men also worked on Glass House Hill Estates replacing culverts with new plastic pipes and cleaned and redefined ditch area and shoulders on Glass House Hill. Mr. Schneider sent a letter to Jean Pomager of the Delaware River Joint Toll Bridge Commission for possible use of their broom inWestfallTownship. They will be assisting us with their broom.  Lisa Green and Mr. Schneider composed and sent a letter to Steve Cunningham from Jacobs Engineering on the 6 & 209 upgrade project; who passed it on to the other engineering firms involved with this and is coordinating what items have already been addressed and will tweak the letter, make recommendations as to how the letter should be addressed. Mr. Schneider spoke to a representative from the Nelson Tree Service about the disposing of wood chips at the compost area. He wanted to know if the chip material was from Westfall or Matamoras if it could still be disposed of in the compost area. Lisa Greencontacted a representative from Home Depot and they said that they would do the painting of the tunnel sometime in May. Mr. Schneider attended the Road Task Force meeting.  Lisa Greensaid “Team Depot” is going to come in and paint the tunnel in May or early June. Joe Popowycz Manager of Home Depot will be at our May 1st meeting and said they are having the paint donated so it will not cost the township anything. They will have a certificate of liability insurance dropped off. Supervisor Flansburg questioned Mr. Schneider about the tree company and if we are getting chips from outside sources. Supervisor Melvin asked if we have heard anything from the FEMA representative. We have not. Supervisor Melvin also questioned if we have a lot of winter material left over going into next year. Mr. Schneider said he has to check. Supervisor Banach moved to accept the report. Motion is seconded by Vice-Chairman Fischer and carried with all in favor.

BUILDING/ZONING REPORT: Mike Rendleman gave the report for March reporting six building permits, one sign and two zoning permits, with fees of $ 1,668.00. Motion by Supervisor Banach to accept the report. Motion is seconded by Supervisor Melvin and carries with all in favor.

CORRESPONDENCE: On dais for review.

OLD BUSINESS:

PA DCNR Greenway Plan: Chairman Ewbank said Nicholas Dickerson was here from the County and explained what they are looking for which is a commitment of in kind contribution of hours. They are not looking for monetary support. Supervisor Banach moved to send a letter of support. Motion is seconded by Supervisor Flansburg and carries with all in favor.

Shredding Services: Chairman Ewbank said he andLisa Green met with Mike Wincovitch of Cintas to discuss the shredding of documents either on site or offsite. Supervisor Banach said we had discussed this at our workshop also. Chairman Ewbank said they have an option of leaving a 65 gallon container here on a 12 week cycle. If we are not ready to have it picked up we could postpone it. Robert Bostinto asked who from the Township would certify that the documents were destroyed. You would have to have someone verify it. The supervisors decided to have it done on site and said the Secretary would most like verify it. Mr. Bostinto asked if the township had a document retention policy. We do. Supervisor Banach moved to hire Cintas to perform the on site destruction of documents. Motion is seconded by Supervisor Flansburg and carries with all in favor.

Alternate Attorney ZHB: Chairman Ewbank said at our workshop we had interest from Tony Magnotta to be our Alternate Attorney at a rate of $125.00 per hour and since then we have had interest from Eric Hamill who said he would serve at the rate of $100.00 per hour. Chairman Ewbank said Douglas Jacobs said in twenty years of serving as Zoning Hearing Board Solicitor he has only had one conflict and Anthony Waldron has agreed to do that hearing at $100.00 per hour for that case. Supervisor Banach moved to hire Eric Hamill at a rate of $100.00 per hour. Motion is seconded by Vice-Chairman Fischer and carries with all in favor. The secretary will send a letter to Attorney Hamill notifying him of his appointment.

Composting Facility: Supervisor Melvin said this was discussed at the workshop, we are trying to figure out a way to police the facility. Supervisor Banach said back in 2009 a load of chips for a commercial company was $20.00 per mason dump and $30.00 for a larger truck. According to the minutes the secretary sent a letter to Matamoras Borough notifying them of the fees. Supervisor Banach asked Mr. Myer if he knew how much had been collected for the composting facility. He did not know. Mrs. Green said it was not a lot. Discussion was held. Supervisor Banach suggested using some money from the road department budget to hire someone to man the gate while they are watching for people to come in. Mr. Schneider said he does need to be careful with his budget because he has a lot to accomplish in the upcoming months where he will need an extra man.  Mrs. Green said she knows that several businesses are not paying and she has called a few but they have not come in and paid. Supervisor Melvin said the first step may be to send a letter. After further discussion the Supervisors decided to close the compost facility on Monday, Tuesday and Wednesday and open it Thursday, Friday and Saturday from 9:00 am to 5:00 pm. This will take place from Monday, April 30th through Saturday, May 12th. This change will be posted on the website. Supervisor Flansburg moved to change the regulation for the compost facility. Motion is seconded by Supervisor Banach and carries with all in favor.

Draft Road Use Maintenance Agreement: Tabled

NEW BUSINESS:

Pike County PennDOT / Conservation Meeting May 4th 9-11 RSVP by April 16th: Chairman Ewbank said he will attend as Emergency Management Administrator and Bill Schneider will attend as Roadmaster. The secretary will notify PennDOT.

 Employee Working Hours: Tabled.

 Employee Policy Manual Correct Medical Benefits: Supervisor Banach said it was brought to our attention by a part time employee that a correction needs to be made to our employee policy manual to correct medical benefits with regard to regularly employed employees. It was stated that this language needs to be stricken from the policy manual and the Supervisors will amend the policy manual at a later time.

Abatement of Taxes: Palestra Milford: Lisa Green said a correction is being made. They were being taxed for the Dialyses Center. This is part of the Milford Landing Property. Supervisor Banach moved to approve the abatement of taxes. Motion is seconded by Supervisor Flansburg and carries with all in favor.

 Additional Assessment: Biasbas, Betty C. Trust: Lisa Green said this is also a correction of an additional assessment. Supervisor Banach moved to approve the additional assessment. Motion is seconded by Supervisor Flansburg and carries with all in favor.  

 Rental of Downstairs Office Space: Chairman Ewbank said there is a letter from Faith Family Fellowship requesting the rental of the municipal building. They had met previously in the Milford Borough hall from 2010 – 2012 as part of the Lost & Found Bible church. Supervisor Flansburg asked Matt Osterberg if there was any reason why we would not rent to them. Mr. Osterberg said no. Supervisor Banach asked what they paid in rent. Mr. Osterberg said they paid $5.00 per hour. Chairman Ewbank said they want to use the building two hours per week. Supervisor Flansburg said he has no problem with them using it. Solicitor Bernathy said this must be subject to the execution of a lease and a certificate of insurance. Discussion was held regarding the amount to charge for the lease and whether they would have their own keys. The supervisors said they needed to cover their expenses. The amount of $20.00 for two hours was agreed upon. Jay Edwards asked if there is maximum occupancy for the downstairs. Solicitor Bernathy said there are provisions in the lease that would address that. Supervisor Flansburg moved to approve the rental for $20.00 per day each Sunday between 10:00 am – 12:00 pm. Motion is seconded by Supervisor Melvin and carries with all in favor.

 Nate Oiler R.K.R. Hess / Westfall Senior Apartment Project: Nate Oiler of R.K.R. Hess introduced Mr. Jonah Mandelbaum of Warwick Properties, Inc. and said they wanted to address the board to give them some information regarding the Westfall Senior Apartment Project which they felt would be beneficial to the township to provide affordable senior housing. Solicitor Bernathy said the record will reflect that this is informal, the Supervisors are not bound by any representations that are made and Mr. Oiler is not to rely upon them going forward. Solicitor Bernathy further stated that he does not want there to be any misunderstanding regarding our prejudging what would amount to be our terms and conditions of the townships ordinances. Asking do we have an understanding. Mr. Oiler and Mr. Jonah Mandelbaum said yes we do. Mr. Oiler said the site that has been selected is the Paddlers Point Phase II and Mr. Mandelbaum has an agreement to purchase five acres of that site. He has looked all overPikeCounty for a site and has found this spot. This meets all the criteria of the PA Housing Finance Agency. The issue they have is that there are two types of senior housing that are permitted in our zoning ordinance. An independent living retirement center and an age restricted housing. The project they are proposing is somewhat of a combination of the two and also is an increased density because we are a one bedroom apartment and the units are small. They are proposing .7 spaces per dwelling unit for parking and in Mr. Mandelbaum’s experience this tells him it is enough. Not everyone has a car. They are trying to keep down the impervious area and be consistent with cluster housing and conservation and subdivision design. Maximum building height is 35 feet it is a 3 story building. Age restriction is 55. However, it does require zoning relief. Solicitor Bernathy asked what type of zoning relief a variance? Questioning Mr. Rendleman if a use is not specifically provided for it is a conditional use by definition. Mr. Rendleman answered yes. Solicitor Bernathy said it is not the up to the Supervisors to fashion some type of regulation to suit this particular use. They may need to get a zoning variance or come forward for a conditional use. Supervisor Banach asked how you monitor the age. Mr. Mandelbaum answered it is very simple. It is handled through the management team. Discussion was held about finances and what people earn. Mr. Mandelbaum said no one knows who makes more or less. All tenants are treated equally. Supervisor Fischer questioned how this differs from Heritage Pointe. It differs somewhat in that there would be different income limits and different qualification limits. This project may be able to get lower rents. Chairman Ewbank questioned what would happen if grandchildren want to come to visit. Mr. Mandelbaum said they would have a three night maximum. The management and the neighbors would monitor that. Mr. Gregory says he has experience with the Port Jervis facility and it is an excellent facility and is very well maintained. Supervisor Flansburg asked about flooding and said if they have no cars how will they evacuate. Mr. Mandelbaum said they will work out an evacuation plan with the fire department.

Supervisor Flansburg decided to have a meeting on April 26, 2012 to discuss the Westfall Senior Apartment Project. Motion is seconded by Supervisor Melvin and carries with all in favor.

Nicholas Dickerson PA DCNR Greenway Plan: Nicholas Dickerson said the County is looking to put in a grant for the Pennsylvania Department of Conservation and Natural Resources. They are trying to put together an action implementation plan for a greenway that would go from the Delaware River Corridor from the Wayne Pike Border all the way to the Milford Boat access. This is a greenway plan that would take all of the open space plans that have just been completed in the County and craft together an implementation plan. Similar things are taking place in Sullivan County and because they are doing the plan on that side of the river a Greenway Corridor is really not complete if it is not done on this side of the river as well. Mr. Dickerson said we are looking to take these plans from all municipalities and craft together a vision that will use those Municipal plans; the County open space plan as well as theCountyRegional plan and various other plans. Mr. Dickerson further stated they are trying to craft a vision to use for our side of theDelaware River and he is asking for the Township’s support. Chairman Ewbank confirmed that it was not financial support. Mr. Dickerson said he is asking for an in kind contribution. It would be a matter of attending these meetings and the time it takes for the meeting to take place. Supervisor Flansburg questioned if it will be detrimental to any of our property owners along the river. Mr. Dickerson said they are not intending for that to take place. Stating it is those concerns they want to use as part of the Greenway planning process. Most of theUpper Delaware is privately owned. The problems that are happening inSullivanCounty are that rafters are using private property to use the restrooms, dump garbage, camp, etc. They want to make proper signage to direct people and this in no way wants to restrict development. Supervisor Banach asked where this start and ends. Mr. Dickerson said it starts from Delaware River at the Pike / Wayne Border as well as the Lackawaxen River at the Pike / Wayne Border it’s about 58 miles at length and all the up to Milford Borough. Supervisor Banach questioned how they would interact with the Park Service who already regulates the River. Mr. Dickerson said they have their letter of support and they are already working with the partners on the other side of the river and they have their management plan in place so it would be a matter of Mr. Dickerson working with them to get recommendations off the ground. DCNR wants to see all municipalities start to implement plans. Supervisor Banach asked if the funding was coming from the government. Mr. Dickerson said the funding was coming from a donation of their services and a match of DCNR funding. Chairman Ewbank said we will act on this at our April 3, 2012 meeting.

 

Update SALDO Traffic Lights – Maintenance Fees & Design: Supervisor Banach said the SALDO only says we would follow PennDOT’s recommendation and if there is any more development technically we should have it in there already that we want generators, etc. Supervisor Banach said he believes we should change the wording on it now so that everything that goes on the traffic lights including the fire departments opticom system. Chairman Ewbank asked if this has anything to do with the Route 6 & 209 project. Mr. Schneider said not exactly but Supervisor Banach is talking about new development. Supervisor Banach said the township should not be going down to plug in generators on the traffic signals and all the bells and whistles that could be there should be there and the developer should be paying for them because he is the one making the money. Chairman Ewbank asked if Joe Hudak could elaborate. Mr. Hudak said the equipment would have to meet PennDOT’s standards. Supervisor Banach said also the maintenance fees should be looked at as our insurance costs increase. Supervisor Melvin asked about the LED lights. Mr. Hudak said sometimes they are not adaptable. We need to see what PennDOT has to say about that. Mr. Schneider said we had a grant that changed to LED lights some time ago. Discussion was held regarding the snow because the LED lights do not generate heat. Supervisor Banach suggested that the secretary contact PSATS for some sample ordinances. Supervisor Banach also suggested that the maintenance fees for the traffic signals be paid quarterly as opposed to annually.  

 

Agreements for Pedestrian Underpass: Chairman Ewbank read the letter submitted from Solicitor Bernathy dated March 12, 2012. It is Solicitor Bernathy’s recommendation that the Supervisors consider making specific findings of fact regarding the pedestrian underpasses continued use in relation to that which may negatively impact its use including, but not limited to, the cost to the township for maintaining the underpass and the lighting facilities which is his understanding is nominal. The letter went on to say that should the Supervisors consider permanent closure of the pedestrian underpass, that a public hearing with advance notice to all Township residents be considered for purposes of fielding any information which could be useful in the Supervisors determination of terminating the contract with the Commonwealth. Supervisor Flansburg said he didn’t believe they talked about closing the tunnel permanently only gating it and keeping it open between 6:00 am and 9:00 pm. Chairman Ewbank said there are a lot of options, he believes we need to find out from the State what they will allow us to do or if they will give the tunnel to

us and let us do what we want. Supervisor Melvin said one of the things that came out at the Police Commission meeting last week from the Chief and Assistant Chief is that they have really stepped up their patrol of the tunnel and they have done some investigating and found that there is a geocaching site on the internet which is very popular among teens and young adults and the tunnel is one of those gps geocaching sites. Supervisor Melvin went on to explain that these treasure hunter people who like to do things at night go around and visit these sites and sign a piece of paper that they were there and upload it to the internet. Supervisor Melvin said that nobody has control over the web, nobody can take these geocaching sites off of the web, but the Chief and Assistant Chief found out that some of the traffic at the tunnel coming through is not all crime related. The geocaching site is one of the attractions that are adding to the traffic there. A lot of the traffic at the tunnel is from people that are playing this game and many of the cars are out of state plates. Supervisor Melvin said there are a lot of things that are going on and he likes the idea that it be gated at night and opened in the morning. We have to figure out the costs involved with that. Chairman Ewbank said we need to research with the Commonwealth what we are allowed to do. Vice-Chairman Fischer said he remembers the statement that if there was one person who uses the tunnel we would not be allowed to close it. Supervisor Flansburg said we may be allowed to amend the agreement. The board will have the Solicitor send a letter to PennDOT’s attorney to see if they want to amend or terminate the agreement or what the indemnifications are to us if we do terminate.  

 

Shredding Services: Chairman Ewbank said that he andLisa Green met with a representative of Cintas today and he gave us a proposal for $225.95 to come out and do a one time clean out of approximately 8 boxes plus all the extra land development plans that we have on site. Or the other proposal was to do an offsite clean out at a cost of $188.95. Chairman Ewbank said he contacted three companies but Cintas was the only one that responded. Another service would be to have a 65 gallon container on site on a regular basis with a twelve week cycle. This cycle could be extended if necessary. Supervisor Flansburg said if he had his choice he would rather have the records destroyed on site as opposed to risking an accident and having our records strewn around.  Supervisor Melvin questioned if there is indemnification or confidentiality. Chairman Ewbank said either way they do it they give us a certificate of destruction. Vice-Chairman Fischer said just forinformationPikeCounty Licensing uses Cintas for their Motor Vehicle records. Further discussion followed. This item will be added to the April 3, 2012 meeting agenda.     

 

Alternate Attorney: Chairman Ewbank spoke toDoug Jacobs last week who recommended Tony Magnotta for an Alternate to the Zoning Hearing Board. Attorney Magnotta said he would work for $175.00 per hour and Chairman Ewbank said that is the problem we have now that our alternate Anthony Waldron’s rate is $175.00 per hour and we can not pay that. Mr. Magnotta agreed to work for $125.00 per hour. Mr. Jacobs told Chairman Ewbank that in twenty years he has only had one conflict. Supervisor Melvin said that $125.00 is better than $175.00. Supervisor Flansburg questioned if paying Mr. Magnotta $125.00 when Solicitor Bernathy and Attorney Jacobs make $100.00 per hour would create a problem. The rest of the board did not think so because the other attorneys were getting steady business. Chairman Ewbank saidDoug Jacobs, Solicitor Bernathy and Attorney Magnotta’s office were a handful of attorneys that do zoning issues. Supervisor Banach questioned if anyone responded to our ad. Mrs. Green said we did not receive any letters. It was advertised in the Pike County Dispatch and theNews Eagle. This item will be added to the April 3, 2012 meeting agenda.  

 

Composting Facility: Supervisor Banach said his understanding is we do charge now for commercial businesses and asked how many are paying. Mrs. Green said only four or five. His feeling is we should lock the gate and they need to come in and sign in and out. Chairman Ewbank asked about residents and whether they should come in and sign in as well. Supervisor Melvin asked Mrs. Green what it will do to her. She said it will take a lot of time out of her day. Discussion was held regarding the amount of people that come per day. There are both Matamoras and Westfall residents that it is open to. Bill Schneider said the secretary would get nothing done if she had to operate the gate all day. Supervisor Flansburg suggested adding it to the agenda and thinking about it for two weeks to come up with ideas. Supervisor Melvin asked if there were peak times. Supervisor Banach suggested putting a combination lock on it and having them come in and register. Supervisor Melvin questioned how much we charge per year such as the tree trimming companies. Mrs. Green said $300.00 per year and that was intended for commercial businesses such as the landscaping businesses. The questioned was raised if we made enough money per year to hire someone to sit out there and man the gate. This item will be placed on the April 3, 2012 meeting agenda.

 

Draft Road Use Maintenance Agreement – related to Shale Gas activities: Mrs. Green said she had given this to the Solicitor and when she spoke to him today he said for the Supervisors to review it and to put it on the April 3, 2012 meeting agenda. She did speak to Supervisors Melvin and Flansburg about this previously. Chairman Ewbank asked Mr. Hudak if he has any input on this. Mr. Hudak said it is largely Mike Mrozinski’s project but he could look into it because he has modified it for Milford Township when they were doing gas line expansion. Chairman Ewbank said that he believed it was basically for use if and when the infrastructure is going to be put in for Marcellus Shale. Mr. Hudak said yes that is true and if they want to look at an agreement that has been used before. The board asked when the deadline is. It was February 29, 2012. Supervisor Melvin said he read the agreement and said he did not know if the $12,000.00 bond was sufficient. Mr. Hudak said you may want to adopt the PennDOT standards or come up with something else coming up with a road inspection before and after. Mr. Hudak will prepare something for the April 3rd meeting. This item will be added to the April 3, 2012 meeting agenda. Supervisor Banach questioned if this agreement would go to the owners of the companies or the individual construction companies. Because his experience is like Chesapeake Energy bonded the roads for all contractors. Mr. Hudak said that is his understanding that the prime company would bond the roads. Supervisor Banach said if you had four gas companies you would have four bonds. Mr. Hudak said that is correct.  

 

NEW BUSINESS:

 

Employee Working Hours: Supervisor Banach said this was spoken about before regarding not having employees working on holidays. Supervisor Melvin said he and Supervisor Flansburg are working on job descriptions and they have a lot of work before them. They need to decide who reports to who. The board all has to get together and they need to decide working hours. Supervisor Melvin questioned Mrs. Green as to whether or not the Employee Handbook Notifications were received. Mrs. Green said all employees received them but she is missing a few receipts. Supervisor Melvin said it is important that they are all received. Supervisor Banach said going forward he feels the board should set some hours and not have the employees working on holidays. Supervisor Banach suggested that Supervisor Flansburg and Melvin meet with the other supervisors two at a time to get this done sooner. This item will be added to the April 3, 2012 meeting agenda.

 

Computer Protocol: Supervisor Banach said he believes there is no computer protocol and he feels we need to get something in the employee policy manual. The board agreed that something needs to be added regarding computer protocol. Supervisor Flansburg asked if now should be the time to bring up about the Hepatitis C testing. Supervisor Melvin said that the policy manual says Hepatitis C Testing will be done for all employees for the ambulance and fire at the expense of the Township. Supervisor Melvin said if it is in the policy manual we should follow it. It is for all new members when they join. Bill Koferl said it does make a lot of sense because if you test positive when you started you have a baseline. But if you test negative it is assumed you acquired Hepatitis C from your job. Discussion followed. Supervisor Banach questioned how the fire department andEMSlogs their fluids. Mr. Koferl said there is a whole protocol. If there is exposure the secretary receives notification. Supervisor Melvin said he and Supervisor Flansburg saw it in there and they both felt that it needed to be followed. Supervisor Flansburg suggested the fire department get a list of new members. Supervisor Melvin mentioned the fire department compliance officer should keep the records. Further discussion followed.

 

Pictures for Website: Chairman Ewbank said our webmaster thought it would be a good idea to take a picture of each board member to put on the website. The board agreed and the secretary will ask Mr. Cena to come to the next board meeting. Supervisor Banach said that Mr. Cena should be sent an “at a boy” for a job well done for the website stating we received a high rating from the Pocono Record since Alex came on board to do this for us. The secretary contacted Mr. Cena and he will come May 1st to do the pictures.

 

HIGHWAY DEPARTMENT:

 

Letters to PennDOT 6 & 209 Upgrade /Overall HighwayInformation: Bill Schneider said at the last meeting several things were talked about including the redesign of the 6 & 209 construction improvement project. Mr. Schneider said they are going to be replacing four culvert pipes onReuben Bell Driveand we would like to see that they blacktop that. Also discussed were replacing street name signs along the corridor, converting the red lights wire operation overhead and underground to radio controlled signal. Mr. Schneider said that PennDOT would like to change the old style of loop sensors in the pavement to overhead video cameras for traffic control. Mr. Schneider said they would be drafting a letter to Jacobs Engineering with these issues for PennDOT. Vice-Chairman Fischer said that Ken Thiele had addressed the issue of the left hand turn on 6 & 209 a while ago. Supervisor Flansburg questioned if the letter was being drafted. Discussion followed.

 

 

MUNICIPAL AUTHORITY:

 

Plant upgrade, new pump stations, sewer lines toRose Laneresidents: Mr. Schneider stated he gave the Supervisors the bids for the sewer improvement project, the installation of the sewer line extension intoRose Laneand the financial statement as to how the three grants were applied to the projects.

The regular meeting of the Westfall Township Board of Supervisors was held Tuesday, March 6, 2012

at 7:00 pm. The meeting was held at theTownshipBuildingonDelaware DriveandLaBarr Lane,WestfallTownship.

 

Those present were Chairman,Robert Ewbank, Vice-Chairman,Paul Fischer; Supervisors, Raymond Banach,Larry Flansburg, andRobert Melvin; Solicitor, Robert Bernathy and Secretary,Lisa Green. Also present were Treasurer,Scott Myer; Building Inspector,Shawn Bolles; Zoning Officer, Mike Rendleman; Police Chief, Chad Stewart; Roadmaster, Bill Schneider; Luis Bocaletti, Jay Edwards, Judee & Jeff Doughman, John Dalton, Lisa Mickles, Twila Decker, Jerry Dotey and approximately fourteen members of the general public.

 

AGENDA: Supervisor Banach moved to approve the agenda. Motion is seconded by Vice-Chairman Fischer and carries with all in favor. 

 

Public Comment: Twila Decker said she was away and did not make the last meeting where the I 84 Tunnel was discussed. She has great concern that a resident or resident’s property is going to be injured and if that does happen she is puttingWestfallTownship on notice that she will have to seek legal council. Ms. Decker said she also has pictures showing what the tunnel looks like now. Supervisor Flansburg asked if Ms. Decker thinks the injury might come from someone in the tunnel. She said yes, she is being awakened at 2:00 and 3:00 in the morning and she has great concern because things get strewn around. Ms. Decker said she would like to call the boards attention to a letter that was sent to the Westfall Supervisors on November 6, 1997 stating that the tunnel was not being maintained properly and she also has a copy of the agreement stating that it needs to be maintained and needs to have lighting. She does not think that possible criminal activity should be going on there. Stating that the original petition for a tunnel was for emergency vehicles to go under it and they can not fit under it. There is also a bar in the middle of the tunnel. Ms. Decker said that this needs to be addressed and something needs to be done whether it is closed or whether it is closed from 6:00 pm to 6:00 am. Further stating that when the police are called the perpetrators run out the other side of the tunnel. Ms. Decker said she was told that the perpetrators had to paint the tunnel to make restitution and she didn’t see that done; stating she also volunteered the services of herself and another person to paint the tunnel because it is an atrocity. Ms. Decker said that she has previously complained and she is stating again that if they are harmed it is going to come back to Westfall because they have been notified. Solicitor Bernathy said with all due respect he completely disagrees with Ms. Decker’s position regarding the law. The Township has immunity initially and there is a contractual obligation going back to 1969. Ms. Decker said like the Pennsylvania Blue Laws it can be amended, adjusted or revoked. Solicitor Bernathy said the Supervisors at their last meeting said that they were going to move in that direction and reach out to PennDOT. Ms. Decker said she would be happy to reach out to PennDOT and send copies to her liaison there. Supervisor Melvin said he and Supervisor Flansburg went to a Supervisor training and met with PennDOT representatives and they are finding out what they legally can and can’t do at this time and he assured Ms. Decker that it has not fallen on deaf ears and it will be dealt with. Ms. Decker says she appreciates any forward movement on this matter. Chairman Ewbank stated that if one person uses the tunnel it can not be closed and we have letters from people stating that they use the tunnel. Solicitor Bernathy said he is aware of what the contract says and the township can attempt to continue to try to amend the contract. Further stating he does not believe the municipality has any liability and he does not think Ms. Decker is threatening the township. She said she is not, but she does have recourse. Further discussion followed. Supervisor Flansburg said to let it be said that the supervisors are not happy with the tunnel themselves and they are looking into everything they can do about it. The most popular thing they have heard so far is possibly gating it at a certain time and opening it at a specific time. However until they hear back from PennDOT their hands are tied. Ms. Decker suggested signs that said the area is being monitored to deter activity. Supervisor Banach suggested looking into the cost of obtaining video cameras to be monitored by the police department.

John Dalton said he would like to add a digital recorder to the agenda. Dragon will translate voice to text. Jerry Dotey said he would donate the Dragon software free of charge to the township. Mr. Dotey explained that you would talk into the computer and it would transcribe voice into text. Supervisor Flansburg asked Secretary Lisa Green what she thought and if she had a backup for the transcriber. Mrs. Green said she is happy with the transcriber and there is a backup. The Planning Commission Secretary has one also. Chairman Ewbank said Mr. Dalton’s comments are duly noted.

 

Jerry Dotey said it is the Solicitors’ job to look out for the township and he could appreciate that but it is also the people that need to be looked after as well.

 

MINUTES: The Minutes of the February 7, 2012 regular meeting were approved on a motion by Supervisor Flansburg. Motion is seconded by Supervisor Banach and carries with all in favor.

 

TREASURER’s REPORT:Scott Myer gave the treasurer’s report for February stating that January and February are typically slow months. That is basically what we expect for this time of year. As far as expenses things are in line with budget. Mr. Myer said we are fine this year. Supervisor Melvin commented that we do not need to do a bridge loan or anything like that this year. The answer was no. Supervisor Melvin moved to approve the report. Vice-Chairman Fischer seconds the motion. Motion carried with all in favor.

 

POLICE REPORT: Police Chief Stewart gave the report for February stating there were 5,331 miles patrolled for the month and 157 calls for service. Chief Stewart asked if we have an offsite advertising law because we get signs especially on the fence across from Wal Mart from all over and they leave them up until they rot off the fence. Solicitor Bernathy said off premises signs are prohibited. Supervisor Banach said the state has to enforce it we can’t enforce it. Mike Rendleman said the state can enforce it they have something on the books, for the town to enforce it the Zoning Officer has to find out who has the sign up and send an enforcement notice and allow 30 days for the sign to be removed. Supervisor Banach suggested sending a letter to PennDOT asking them to remove the signs. The Chief said he is more than willing to send a letter. Chief then asked if the township is looking into a loitering ordinance. Solicitor Bernathy will look into that. Supervisor Flansburg asked if he heard correctly in that the department arrested the perpetrators in the armed robbery. Chief said they did. He was actually apprehended inNew York through a BOLO. Supervisor Flansburg congratulated the department on a job well done. Supervisor Banach moved to approve the report. Motion is seconded by Supervisor Flansburg and carried with all in favor.

 

FIRE DEPARTMENT: Luis Bocaletti gave the Westfall Township Fire Department Report for February reporting 2 Mutual Aid structure fires, 3 Commercial Auto False Alarms, 1 Landing Zone, 2 Commercial Fire Alarm, 5 Motor Vehicle Accidents, 1 EMS Assist Environmental Rescue, Carbon Monoxide alarm, for a total of 15 calls for the month. There were 51EMS calls for the month, 36 in Westfall, 12 covering squad 33, 3 covering squad 19.

 

Jay Edwards gave the Mill Rift Fire Department report stating they had a Drill Night on 2/8, a Monthly Meeting on 2/15, a Pump Drill on 2/22, a Winter Access /Rural Water Supply Pump Drill on 2/26 and a Mutual Aid- Assist ambulance crew moving patient on 3/2. Total man hours 68 and total equipment hours 22 and total man hours for the year are 175.5. Supervisor Melvin questioned the merger of the departments and whether the departments have met. Mr. Edwards said they have met once. Mr. Bocaletti said they need to meet again and depending on the outcome of that meeting they need to decide if this is what they want to do. Supervisor Flansburg asked if there was a date for the meeting and said he would like to attend if possible. Motion to approve the reports made by Supervisor Flansburg. Motion seconded by Vice-Chairman Fischer and carried with all favor.

 

HIGHWAY REPORT: Bill Schneider gave the report for February stating that on 2/10 and 2/12 they were out for Winter Storms. They performed regular maintenance on the composting facility, vehicles and equipment. They cleared brush and debris along shoulders, drainage ditches and right of ways onOld Milford Road,Cummins Hill Road and Glass House Hill. Performed shoulder work onHeaters Hill Road andOld Milford Road. Mr. Schneider met on seven occasions with FEMA representative Bob Gaunt, two times on site at Decker Lane and Heaters Hill looking over storm damage and repairs and other times doing paperwork on damage caused by Hurricanes Irene and Lee. Met also with Mitigation representative Bill Meyer on Heaters Hill and at the shop along with Bob Gaunt about the funding of the reimbursement of the project. A lot of time was spent on paperwork this month, and the forms required a lot of detail. Bob Gaunt was very helpful with what paper work was needed and very supportive of our project. Bob Wyant was also helpful with the hazard mitigation proposal. Lisa Green and Supervisor Ewbank were very helpful also. Hazardous Mitigation is a recommen-dation from FEMA on how to improve the site so it does not happen again and this is the reimbursement paid by FEMA, Category A: for clean up of trees, debris from the roads after the storm: $3,719.00. Category B: Emergency Protective Measures, (did not qualify) Category C: Permanent Work: roads, bridges, culverts etc. forDecker Lane $8,726.34, for Heaters Hill $54,292.88 Total Reimbursement from FEMA: $66,738.22. Mr. Schneider also had a meeting with Steve Cunningham from Jacobs Engineering discussing recommendations for the redesign of the 6 & 209 construction improvement project. These concerns were discussed:  Replacing street name signs along the 6 & 209 corridor, converting the red lights wire operation overhead and underground to radio controlled signal. PennDOT would like to change the old style of loop sensors in the pavement to overhead video cameras for traffic control. Requesting battery operated backup for the red lights at 84 ramp atStella Street and 6 & 209 and atReuben Bell Drive and 6 & 209. Requesting that the overhead illuminating lights for the entrance toReuben Bell Drive be reinstalled. There were winter storms on 2/24 and 2/29. A list of street name signs that are either missing or faded will be ordered now that the inventory is complete. Also waiting for the DEP permit to do Heaters Hill culvert pipe project. The winter has been mild. The department has been able to work on shoulders and right of way clearing normally done in the springtime and to continue clean up and repairs from Irene and Lee. Supervisor Flansburg asked if the end ofRiver Road in Mill Rift can be attributed to the floods. Mr. Schneider said it cannot be directly attributed to the flood. The damage was done over time. Discussion followed regarding getting an engineer in to look at the problem and the possibility of turning a fire truck or ambulance around there. Vice-Chairman Fischer asked about the request from PennDOT to change from coils to cameras stating obviously it is an expense. Is Mr. Schneider going to have a conversation with PennDOT about that and will the cameras be remote access aiding in traffic. Mr. Schneider said their purpose is to keep traffic flowing so it will not back up. Supervisor Banach questioned the fire chiefs with regard to the opticom system. Luis Bocaletti said they are working. Chairman Ewbank asked if the opticom system will work with the cameras on there. Mr. Bocaletti said he believes they will still work. Vice-Chairman Fischer moved to approve report. Motion is seconded by Supervisor Flansburg and carried with all in favor.

 

BUILDING/ZONING REPORT: Mike Rendleman gave the report for February reporting three building permits and three zoning permits with fees of $658.00. Motion by Supervisor Banach to accept the report. Motion is seconded by Supervisor Melvin and carries with all in favor.

OLD BUSINESS:

 

Act 47 Monthly Report: Solicitor Bernathy stated as is common knowledge the township is coming up on the two year anniversary of the Federal Bankruptcy Courts signing the order confirming the Townships Bankruptcy Plan as well as the Act 47 Recovery Plan which amounts to final disposition of the bankruptcy plan. The Township is operating within the confines of its budget and continues to meet its financial obligations. The Township continues to provide essential services. Supervisor Flansburg asked if we are going to be out of the Act 47 Plan soon. Chairman Ewbank said he and Lisa Green met with Matt Domines this past week and Mr. Domines stated he would be getting us out of the Act 47 Plan within the next couple of months. Supervisor Banach moved to approve report. Motion is seconded by Supervisor Flansburg and carries with all in favor.

 

Re-Appointment of Planning Board Member Joseph Banach: Supervisor Melvin moved to appoint Joseph Banach to the Planning Board to a term running through December 31, 2012. Motion is seconded by Supervisor Flansburg. Supervisor Banach abstains. Motion carries with four in favor and one abstention.  
Purchase ofEmergency Road Signs: Supervisor Banach questioned Bill Schneider as to how many road closed signs we have. The township had two and ordered two more. There are no detour signs. Mr. Schneider said they cost about $500.00 each. Supervisor Banach said there should be a little bit extra cash because some of the supervisors did not take their salary. Supervisor Banach said he would like to notify people that roads are closed ahead. Chairman Ewbank said in the past when we’ve had to have signs PennDOT has staged signs along the road and Emergency Management has gone and placed them when they needed them. 

 

Cleanup Day – Electronics Recycling:  Lisa Green spoke with Frank Funicella at Advanced Recovery to set up the date for April 28, 2012 to coincide with our cleanup day. Supervisor Flansburg asked if we can open it up to everyone. Supervisor Banach asked if they will manage it. Mrs. Green said they will send a 24 foot truck with three men. Supervisor Flansburg suggested doing the electronics recycling in the front parking lot and continuing to do the cleanup day in the back at the composing facility. Chairman Ewbank said we will have the township cleanup day strictly for township residents for $10 per car load $20 per truck and $ 30 per large truck. The electronics recycling will be open to all county residents and business free of charge. Supervisor Banach questioned if we need insurance to protect us. Solicitor Bernathy said we do and that Advanced Recovery should name the township as an additional insured on their policy.  

 

NEW BUSINESS:

 

Exoneration of Previous Years – Delinquent Taxes Only: Miles Hudgens: Chairman Ewbank stated that

the building value was reduced due to a square footage correction in the total amount of $204.66. Supervisor Flansburg moved to approve the exoneration. Motion is seconded by Supervisor Melvin and carried with all in favor.

 

Resolution 2012-2: Disposition of records. Tabled.

 

Backup Generator Municipal Buildings: Chairman Ewbank stated we need to look into a generator for the municipal building. Supervisor Melvin stated he and Supervisor Flansburg learned about the Costars program where we can leverage businesses to find better prices at their Supervisory training a few weeks ago. Supervisor Banach said we also need to find out what size generator we really need. Supervisor Melvin said a few years ago when they had a large power outage Pike County Light & Power had a program where they went out to check the buildings to see what size generators were needed and with the boards permission he could go back to Pike County Light & Power and see if they would still do that for the Township. Supervisor Banach said the question would be what buildings were needed? Does Mill Rift have generators or the Westfall Fire Department? Chairman Ewbank said if we get a major flood all the buildings are all inaccessible and all underwater. Discussion followed. John Dalton said he was pleased to hear the board say something about a generator. He has a 20,000 watt generator and his strongest recommendation is not buying one through Home Depot nor Lowe’s but to go through a contractor like Voltron. Mr. Dalton described the workings of his generator with propane gas. Supervisor Flansburg said he would lend the township his generator. Mr. Schneider said it would cost more to wire the building then to purchase the generator. Supervisor Melvin will check with Pike County Light & Power to see if they will let us know what size we need for the township building.

 

Backup for Office Computer: Lisa Green said she initially spoke to Chris Wood when she found out that her on site back up went bad. Mr. Wood recommended Carbonite an offsite computer backup company. She then spoke to Barry Bernathy who is our Information Technology Technician, who highly recommended the company because all of our data will be stored offsite. We will receive a 10% discount for being a non profit municipality so the cost will be $206 per year. Supervisor Flansburg questioned what it would cost to replace what we had. Mrs. Green said approximately $200 but then it would be onsite. Mrs. Green said she is using a 30 day free trial now. Supervisor Flansburg asked how she liked it. Mrs. Green said she likes it. She doesn’t notice the program, it doesn’t slow down the computer and it backs up every stroke so it she forgets to back up the program does it for her. Supervisor Banach said it is worth the $206. Supervisor Flansburg moved to approve the purchase. Motion is seconded by Supervisor Banach and carries with all in favor.

Severe Repetitive Loss Grant / Ed Eshleman: Lisa Green said she heard from Gary Orben with the Commissioners Office that the Grant was never closed out with the County so the County is going to continue with the project. Supervisor Banach moved to delete this item off the agenda. Motion is seconded by Vice-Chairman Fischer and carries with all in favor.

 

Zoning Hearing Board / Letters of Resignation: Chairman Ewbank said we have a letter from Martin Greenwald who respectfully resigns his position from the Zoning Hearing Board. We also received was a letter from John Shewchuk who regrets that he can not serve on the Zoning Hearing Board. Vice-Chairman Fischer moved to accept both letters. Motion is seconded by Supervisor Fischer and carries with all in favor. 

 

Zoning Hearing Board / Letters of Interest: Chairman Ewbank said we have a letter from William Gregory ofDelaware Drive. Supervisor Banach asked if Mr. Gregory would be willing to serve as a member as opposed to an alternate. Mr. Gregory agreed. Chairman Ewbank said we also have a letter from Jolie Defies who is interested in the Alternate Position to the Zoning Hearing Board. Supervisor Banach moved to appoint Mr. Gregory as a member to the Zoning Hearing Board for a term of 3/6/12 – 12/31/13. Motion is seconded by Supervisor Flansburg and carries with all in favor. Supervisor Banach moved to appoint Jolie Defies as an alternate member to the Zoning Hearing Board for a term of 3/6/12/-12/31/14. Motion is seconded by Supervisor Flansburg and carries with all in favor. Supervisor Banach asked to send a letter to Marty Greenwald thanking him for all his dedicated years of service. Supervisor Flansburg questioned if we still had an alternate position open. We do, there is one alternate position open now. 

 

Pike County Commissioners Resolution 12-07 / Pike County Conservation District Resolution 2012-01: Mrs. Green said we need to send a letter of intent stating that we received their notice of intent to participate in the Pike County Scenic Rural Character Preservation Program and we support the general intent of the project for groundwater baseline water quality study. Supervisor Banach asked if this was the same as they had done in the past. Lisa Mickles said this is different this is for the fracking. Supervisor Melvin stated this is to get a baseline before they drill so that we have the baseline study to compare to. Supervisor Banach moved to send the letter of support. Motion is seconded by Vice-Chairman Fischer and carries with all in favor. Chairman Ewbank said they are looking for a grant of $135,000 for this project.  

 

Vacation Request / Lisa Green: Chairman Ewbank read Mrs. Greens vacation request asking for the following 10 days as a portion of my 2012 vacation. Mrs. Green said she has taken into consideration payroll and meetings. March 28th Tentative, due to the fact that Lisa is expecting her first grandchild. April 2nd, 5th, 6th Tentative, July 16th through 20th and July 23rd”. Supervisor Banach moved to approve the request. Motion is seconded by Vice-Chairman Fischer and carries with all in favor.  Supervisor Flansburg asked for clarification on the March 28th tentative date questioning if Mrs. Green may come back and ask the board for a different date. Mrs. Green said that is correct it depends on when her daughter in law goes into labor.  

 

DCNR Greenway Plan / Lackawaxen and Upper Delaware River – Request for Letter of Support: Chairman Ewbank said they also want a letter of support. Mrs. Green said this will be a little more involved. They are requiring two meetings of the Board of Supervisors and approximately 40 hour’s worth of time as an in kind contribution. Supervisor Banach questioned if it had to be a Supervisor or if it could be Alex Cena from the Upper Delaware Council. The board will table this item until the workshop.

 Solicitor Bernathy stated regarding the loitering ordinance the Police Chief asked about there is a General Powers provision in the 2nd Class Township Code Section 1506 which permits the Supervisors to enact or adopt ordinances, bylaws, rules and regulations not inconsistent with or restrained by the Constitution and laws of this Commonwealth necessary for the proper management, care and control of the township and its finances and the maintenance of peace, good government, health and welfare of the township and its citizens, trade, commerce and manufacturers.

 SUBDIVISION REVIEW AND ACTION:

 Monroe LBL LLC:  Signing of Plans: Land Development was approved September 6, 2011. Plans were just received now. The last item they needed was the NPDES Permit and that was received about ten days ago.

Lisa Mickles questioned what the plans were for. Mrs. Green said it says Monroe Optical.
