Minutes-April 3, 2017 Regular Supervisor Meeting

April 3, 2017

The Regular meeting of the Westfall Township Board of Supervisors was held Monday, April 3, 2017 at 7:01 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan, Robert Bostinto and Paul Fischer; Solicitor; Robert Bernathy; and Secretary, Jodi Hulse. Also present were Zoning Officer, Wayne Rohner; Road Master, Bill Schneider; Police Chief, Chad Stewart; Westfall Township Fire Department Chief;  Robert Llewellyn; Mill Rift Fire Department Chief, Tom Lamb; Treasurer, Scott Myer; Jeff Clune, Robin Waizenegger, Ken Butera, Esquire, Carl Braunagel; and approximately five members of the general public.

Chairman, Robert Melvin was not in attendance.

EXECUTIVE SESSION: The last executive session was held at 6:30 pm just prior to the meeting 4/3/17.

APPROVAL OF AGENDA:  

Supervisor Buchanan added #8 under New Business as “Contracts for Mill Rift Fire Department and Westfall Fire Department approval”

A motion was made by Supervisor Buchanan to approve the revised agenda. The motion was seconded by Supervisor Bostinto and carries with all in favor.

PUBLIC COMMENT: No public comment.

MINUTES:

Regular Meeting Minutes-March 6, 2017: A motion was made by Supervisor Buchanan to approve the March 6, 2017 Regular Meeting Minutes.  The motion was seconded by Supervisor Fischer and carries with all in favor.

TREASURER’S REPORT: Mr. Myer gave the report through the month of March, 2017. He stated that $287,000 have been collected in Real Estate taxes and that 95% should be in by the end of May.  He noted there were no findings in the recent Liquid Fuels Funds audit.  Mr. Myers stated there was nothing else noteworthy to report.

Supervisor Buchanan questioned the balance of years for the Katz payments. Mr. Myer stated he believes it to be paid in full at 2029.  Discussion followed regarding possibly paying the debt earlier.  Solicitor Bernathy stated he would check the order of the court for details.

A motion was made by Supervisor Buchanan to approve the Treasurer’s Report through the month of March, 2017. The motion was seconded by Supervisor Fischer and carries with all in favor.

7:05 PM-Liquor License Transfer Hearing-Good Fella’s Pizza:  Present: Ken Butera, Esquire and Carl Braunagel, Owner/President.  Panko Reporting Court Stenographer present.  Solicitor Bernathy stated all legal requirements.

Hearing ended at 7:30 pm. A motion was made to approve the transfer with conditions (referenced in transcript) by Supervisor Buchanan.  The motion was seconded by Supervisor Fischer and carries with all in favor.

The Regular Meeting was back in session at 7:32 pm.

POLICE REPORT:  Chief Stewart read the report for March, 2017.    The report reflects the following for the month of March, 2017:

 

Miles Patrolled: 6,357

YTD: 17,272

Motor Vehicle Accidents: 19

YTD: 46

Calls for the month: 201

YTD: 483

Westfall: 131

Matamoras: 70

 

Chief Stewart presented the Board with the March, 2017 Report. He also noted the significant happenings on the front of the report which are as follows:

 

*Attended DVES DARE Graduation

*CPR/First Aid Certification for all officers

*The EPRPD Foundation in having a Sportsmen’s Raffle to be held June 1, 2017. Tickets may be purchased from any Member

*EPRPD Foundation is having a Wine Tasting event at Malibu on Sunday May 7, 2017 from 3-6 p.m. Tickets are $50 per person

A motion was made by Supervisor Buchanan to approve the Police Report for the month of March, 2017. The motion was seconded by Supervisor Fischer and carries with all in favor.

FIRE DEPARTMENTS: 

Westfall Fire Department: Chief Llewellyn gave the report for March, 2017:  4 Automatic Fire Alarms, 7 Motor Vehicle Accidents, 3 Controlled Burn, 2 Utility Wires Down, 1 Structural Collapse, 2 Chief Investigations, and 2 Structure Fires.  The Total calls for March, 2017 were 21.  The total fire calls year to date are 59.

The EMS Report for the month of March, 2017 was as follows: 32 Calls in Westfall Township, 2 Calls in Dingman Township, 6 calls in Milford Township, 10 calls in Milford Borough, 18 calls in Matamoras Borough,  and 1 call in Orange County, NY.  Total calls for March, 2017 were 69.  Total EMS calls year to date are 212.

The combined Year to Date calls are 271.

Training for the month: Four Drills/In-house training sessions held for 108 hours.  Six members completed 3 hours of Forcible Entry Training at PCTC.

Fundraising: Golf Outing-May 1, 2017; Pulled Pork Dinner-August 14; Gun Raffle-September 10; Tricky Tray-October 7

Other: Go-24 Store has not installed the hydrant or Knox Box as requested.  Code violations in businesses found.  Who is the authority having jurisdiction to review?  Blue Ridge Avenue restoration has not been completed and is in poor condition following water main replacement along with various roads in Bell Manor.  

A motion was made by Supervisor Bostinto to approve the Westfall Fire Department report for the month of March, 2017.   The motion was seconded by Supervisor Buchanan and carries with all in favor.

Mill Rift Fire Department: Chief Lamb gave the report for the Mill Rift Fire Department for the month of March, 2017 which confirmed the following:

3/01/17: Monthly Meeting

3/08/17: Went over equipment on truck

3/21/17: Class Work Mill Rift Fire House-Air Bags and Operation Equipment

3/29/17: Work Night-Driver Training

 

Total Man Hours: 87

Total Equipment Hours YR: 57

Total Man Hours for the Year: 316

 

The Mill Rift Fire Department Report for March, 2017 was approved by motion by Supervisor Fischer. The motion was seconded by Supervisor Buchanan and carries with all in favor.

 

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for March, 2017. The Department filled potholes throughout the township and did maintenance on equipment.  Culvert pipes and ditches were cleared of debris.  Mr. Schneider met with Scott Maciak from Penn Dot regarding paving bid specifications.  He also met with Katrina Colvin Stilts from Corning Gas regarding street light replacements.  He also met with Alison Miskiman regarding the Hazard Mitigation plan and possible FEMA funding for flood areas.  The Department prepared for winter storm Stella.  Approximately 75 tons of salt and 125 tons of antiskid was used for the storm.  Contractors with snow removal equipment were hired for Pond Eddy and River Road.  There were 3 full time employees, 4 part time employees and one private contractor working on snow removal and material application.  Mr. Schneider worked with Jodi Hulse to prepare documentation for possible reimbursement from the state.  He also noted an excavator has been leased to redistribute material at the compost area.  The cost will be shared with Matamoras Borough.  A street broom has been ordered for the next week for the township road clean up.

 

Supervisor Fischer commended Mr. Schneider and the Highway Department for a great job on handling the storm.

 

A motion was made by Supervisor Bostinto to approve the March, 2017 Highway Department Report. The motion was seconded by Supervisor Fischer and carries with all in favor.

 

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for March, 2017. He confirmed there were 24 building permits and 4 zoning permits for the month of March, 2017 totaling $1,471.00 in fees.

A motion was made by Supervisor Buchanan to approve the Building/Zoning Report for March, 2017. The motion was seconded by Supervisor Fischer and carries with all in favor.

EMERGENCY MANAGEMENT: No representative was present.  Secretary Hulse read the report submitted earlier by Mr. Ewbank.   The report confirmed there were no calls for the month of March, 2017.  Also, Mr. Ewbank attended the Pike County Hazard Mitigation Plan meetings at the Pike County Training Center on March 8 and March 31, 2017.

The Emergency Management Report for the month of March, 2017 was approved on a motion made by Supervisor Buchanan and motion was seconded by Supervisor Fischer and carries with all in favor.

CORRESPONDENCE:  On desk for review.   

OLD BUSINESS:

  • Letter from Jeff Clune-Mill Rift-Township Road Matter: Solicitor Bernathy went over each question reflected in Mr. Clune’s letter dated March 17, 2017. The following were his answers to each question:
  • The Supervisors are under no obligation and under the Board’s discretion
  • The information is in the Subdivision and Land Development Ordinance which reflects the township specifications for width and depth.
  • Access must be provided to all lot owners on the road
  • The Township will determine the specifications for the culdesac at the end of the road
  • The Township would provide notice to all bordering property owners
  • The information is in the Subdivision and Land Development Ordinance which reflects township specifications form road surface.

No action taken by the Board. 

  • Liquor License Transfer: Good Fellas Pizza-Resolution 2017-3: Approved earlier during the Public Hearing. 
  • Fire Department Split: Supervisor Buchanan stated this matter will be tabled until after Fire Protection Matter addressed.

 

  • Delaware Valley High School Repeater & Antenna Invoice: A motion was made by Supervisor Buchanan to approve paying half of the invoice provided in the amount of $1,612.43 to the Delaware Valley School District for the cost of the Repeater and Antenna installation at the Delaware Valley High School. The motion was seconded by Supervisor Bostinto and carries with all in favor

 

  • Contract-Altadonna/Westfall Township: Solicitor Bernathy explained the Agreement which was provided to the Supervisor at an earlier date for review. He noted that according to the Second Class Township Code 53PS 67 311 a hearing is not required and this matter can be handled by an agreement.   He stated that Mr. Altadonna’s legal counsel has reviewed and approved the proposed agreement.

 

A motion was made by Supervisor Buchanan to approve the agreement. The motion was seconded by Supervisor Bostinto and carries with all in favor.

NEW BUSINESS:

  • Schedule Clean-Up Day: The Board discussed having the clean-up day free of charge for Westfall Township residents. 

A motion was made by Supervisor Buchanan to approve the free of charge clean-up day. The motion was seconded by Supervisor Fischer and carries with all in favor.

A motion was made by Supervisor Buchanan to approve the advertising of the clean-up day for Saturday, May 6, 2017 from 8:00 am through 2:00 pm. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

  • Pioneer Construction Trailer:  Mr. Schneider was approached by Pioneer Construction, which is the company doing the slide repair this summer in Mill Rift. They would like to lease the area between the Mill Rift sub-station and the Highway Department Building for $200.00 per month. Solicitor Bernathy stated a lease will be required. 

A motion was made by Supervisor Buchanan to approve renting the area to Pioneer Construction at the cost of $200.00 per month subject to lease preparation and approval by Solicitor Bernathy.   The motion was seconded by Supervisor Fischer and carries with all in favor.

  • Ralph Burger-Easement: Vice Chairman Dotey explained that Mr. Burger is willing to provide an emergency access easement from the Municipal Building area to Decker Lane through his property in exchange for a five acre piece of land which is owned by the Township that borders his property. Solicitor Bernathy stated he would need to review appraisals and more information. The matter was tabled.

 

 

  • Mill Rift-Bluestone Boulevard-Slide Repair below Slatestone Gate-two bore sites: Mr. Schneider explained that this project is one listed in the Act 167 Plan. He stated that boring would need to be completed to see the extent of the project. Mr. Schneider said that Kiley Associates indicated the two borings would cost approximately $10,000 each. 

 

A motion was made by Supervisor Buchanan to approve the request from Kiley Associates, LLC to provide advertising specifications for next month’s Supervisor Meeting. The motion was seconded by Supervisor Fischer and carries with all in favor.

  • Long Distance Phone Service: A motion was made by Supervisor Bostinto to approve the Letter of Authorization from Verizon to appoint Verizon as long distance carrier for the Township phone lines. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 
  • Road Bids-Cummins Hill Road (Section 2) and Bell Manor: A motion was made by Supervisor Buchanan to advertise for the three separate paving projects with the right to reject any and all bids. The motion was seconded by Supervisor Fischer and carries with all in favor.

 

  • Township Building Trim Paint: A motion was made by Supervisor Buchanan to request that Tom Lamb provide an estimate for the Township Building Trim Paint by the May 1, 2017 meeting. The motion was seconded by Supervisor Fischer and carries with all in favor.

 

Solicitor Bernathy stated that a contract will be required.

  • Contracts for Mill Rift Fire Department and Westfall Fire Department: Solicitor Bernathy stated he would provide courtesy copies of a Fire Protection Contract to both Departments. A motion was made by Supervisor Fischer to request that Solicitor Bernathy prepare the Fire Protection Contract and provide copies to each Fire Department. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 

SUBDIVISION REVIEW and ACTION: None

EXECUTIVE SESSION:

None held.

ADJOURNMENT: Meeting was adjourned at 8:20 p.m. on a motion by Supervisor Buchanan. Motion seconded by Vice Chairman Dotey and carries with all in favor.
