The Regular meeting of the Westfall Township Board of Supervisors was held Monday, February 6, 2017 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan, Robert Bostinto and Paul Fischer; Solicitor; Robert Bernathy; and Secretary, Jodi Hulse. Also present were Zoning Officer, Wayne Rohner; Road Master, Bill Schneider; Police Chief, Chad Stewart; Westfall Township Fire Department Chief;  Robert Llewellyn; Mill Rift Fire Department Chief; Tom Lamb; Assistant Mill Rift Fire Department Chief, Robert Mills; Treasurer, Scott Myer; Jeff Clune and approximately six members of the general public.

Chairman Robert Melvin was absent.

APPROVAL OF AGENDA:  

Secretary Hulse requested to remove #6 under New Business (Building Inspection Underwriters-Service Contract) since this matter was discussed and the Board voted to appoint BIU as the Township Third Party Building Inspection Agency at the Organization Meeting held on January 3, 2017. Solicitor Bernathy added that the contract has an automatic renewal clause in it unless one party gives the other party notice accordingly.  A motion was made by Supervisor Buchanan to approve the agenda with the change.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

PUBLIC COMMENT: No public comment.

MINUTES:

Organization Meeting Minutes- January 3, 2017: Supervisor Buchanan moved to approve the minutes of the Organization meeting held on January 3, 2017.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Regular Meeting Minutes-January 3, 2017: Supervisor Buchanan moved to approve the January 3, 2017 Regular Meeting minutes.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Secretary Hulse noted that Supervisor Fischer was not present for either meeting. A motion was made by Supervisor Buchanan to rescind the two previous motions and to approve the January 3, 2017 Organization Meeting Minutes.  The motion was seconded by Supervisor Bostinto and carries with three in favor and one abstention.  Supervisor Fischer abstained since he was absent during both meetings.

TREASURER’S REPORT: Mr. Myer gave the report through the month of January, 2017. He stated that the Dombrosky matter was paid in full and is settled.  This information is not reflected in the report.  Mr. Myers stated that otherwise January has been a slow month.

A motion was made by Supervisor Buchanan to approve the Treasurer’s Report through the month of January, 2017. The motion was seconded by Supervisor Bostinto and carries with all in favor.

POLICE REPORT:  Chief Stewart read the report for January, 2017.    The report reflects the following for the month of January, 2017:

Calls for the month: 145

YTD: 145

Westfall: 99

Matamoras: 46

Chief Stewart presented the Board with the January, 2017 Report and the 2016 Annual Report. He also noted the Significant Happenings which are reflected on the front page of the January, 2017 Report.

A motion was made by Supervisor Bostinto to approve the Police Report for the month of January, 2017. The motion was seconded by Supervisor Fischer and carries with all in favor.

FIRE DEPARTMENTS: 

Westfall Fire Department: Chief Llewellyn gave the report for January, 2017:    5 Automatic Fire Alarms, 2 motor vehicle accidents, 2 vehicle fires, 5 chief investigations, 1 Water Rescue, 1 Trash Fire and 1 Structure Fire.    The Total calls for January, 2017 were 18.  The total fire calls year to date are 18.

The EMS Report for the month of January, 2017 was as follows: 36 Calls in Westfall Township, 5 Calls in Dingman Township, 7 calls in Milford Township, 8 calls in Milford Borough, 11 calls in Matamoras Borough and 6 calls in Orange County, NY.  Total calls for January, 2017 were 73.  Total EMS calls year to date are 73.

The combined Year to Date calls are 91.

Training for the month: Four Drills/In-house training sessions held for 114 hours.  Twenty-seven personnel completed 3 hours of CPR/AED and Bloodborne Pathogens Training.  Fourteen Personnel completed 3 hours of Carbon Monoxide Response Training.

Fundraising: Golf Outing-May 1, 2017; Pulled Pork Dinner-August 14; Gun Raffle-September 10; Tricky Tray-October 7

Other: Go-24 Store has not installed the hydrant or Knox Box as requested.  Code violations in businesses found.  Who is the authority having jurisdiction to review?  Blue Ridge Avenue restoration has not been completed and is in poor condition following water main replacement along with various roads in Bell Manor.

Mill Rift Fire Department: Assistant Chief Mills gave the report for the Mill Rift Fire Department for the month of January, 2017 which confirmed the following:

1/04/17: Work Night-ran and checked all vehicles

1/05/17: Wire Down Pine Terrace Road-Engine 1

1/10/17: Monthly Meeting

1/11/17: Work Night-went over pump truck and Engine 1 and Engine 2

1/18/17: Work Night-Driver Training-Tanker 1

1/19/17: Work Night-Cleaned main firehouse

Assistant Chief Mills stated a grant was received in the amount of $11,844.00.

Solicitor Bernathy stated he would contact Chief Lamb to set up a meeting for later in the week to go over all paperwork requested by the Township and submitted by the Department.

Both department reports were approved by a motion made by Supervisor Bostinto and seconded by Supervisor Fischer and carries with all in favor.

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for January, 2017.  He stated the Department picked up cold patch at Callahan Industries Quarry and patched potholes throughout the Township.  Mr. Schneider attended a meeting with Mr. Hudak from Kiley Associates regarding the proposed Municipal Expansion project.  They also visited the Blue Stone Boulevard and Slatestone Hill area where repairs are needed.  On January 7, 2017 the department was called out due to a traffic signal outage at Reuben Bell Drive.  Kuharchik Construction repaired a wire and solved the blinking light issue.  Mr. Schneider stated that the department was out plowing and putting materials on the roadways on January 11, 12, 14, 16, 18, 23, 24 and 31.  They did maintenance on the equipment and cleaned the equipment after each storm.  300 hundred ton of Anti-skid has been delivered this season.  400 tons of salt has been ordered from November 22, 2016 through January 24, 2017.  Mr. Schneider stated that Mr. Maciak from Penn DOT called regarding Fire Tower Road.  He advised if there was not winter maintenance on Fire Tower Road, the Liquid Fuels funds would not be paid.  Supervisor Buchanan directed Mr. Schneider to maintain Fire Tower Road through the end of 2017 and the matter would be discussed further at that time.  The Board agreed.

Chief Llewellyn questioned the road conditions in Bell Manor. Mr. Schneider stated the Matamoras Water Department would be restoring the roads when the weather breaks.

A motion was made by Supervisor Fischer to approve the Highway Department Report for January, 2017. The motion was seconded by Supervisor Bostinto and carries with all in favor.

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for January, 2017. He confirmed there were 2 electrical permits and 1 zoning permit for the month of January, 2017 totaling $682.40 in fees.

Mr. Rohner requested a check in the amount of $130.50 to District Justice for violation notice/complaint filing fee at 108 Heaters Hill Road.

A motion was made by Supervisor Buchanan to approve the check request. The motion was seconded by Supervisor Fischer and carries with all in favor.

A motion was made by Supervisor Buchanan to approve the Building/Zoning Report for January, 2017. The motion was seconded by Supervisor Fischer and carries with all in favor.

EMERGENCY MANAGEMENT: No representative was present.  Secretary Hulse read the report which was submitted by Mr. Ewbank earlier.  The report noted there were no calls for EMA for the month of January, 2017.  It also requested that Mr. Ewbank requested funding at a budget meeting to replace the department’s iPad and laptop computer and that the Board would have Mike Barth look into the matter.

Brief discussion followed. Supervisor Buchanan directed Secretary Hulse to clarify with Mr. Ewbank the involvement of Mr. Barth.  The matter was tabled.

The Emergency Management Report for the month of January, 2017 was approved on a motion made by Supervisor Fischer and motion was seconded by Supervisor Bostinto and carries with all in favor.

CORRESPONDENCE:  On desk for review.   

OLD BUSINESS:  

    1. Truck Bids-2005 F350 Pick Up- Secretary Hulse stated that no bids were received by the Township. Discussion followed. Solicitor Bernathy read the law regarding the sale of the property.A motion was made by Supervisor Fischer to re-advertise the sale with a minimum bid amount of $5,500 with spreader and plow in all three Township approved newspapers with the bids to be opened at the March 6, 2017 Regular Supervisor Meeting. The motion was seconded by Supervisor Bostinto and carries with all in favor.  
  • Jeff Clune-Mill Rift-Township Road Matter: Solicitor Bernathy stated he would call Mr. Clune to set up a meeting later in the week.
  • Municipal Expansion Project-Kiley Associates (Preliminary Analysis): Supervisor Bostinto stated there would be a meeting the following day with Mr. Hudak from Kiley Associates for a preliminary analysis.

 

  • Fire Department Split: Supervisor Bostinto suggested tabling the matter until further review and until the meeting takes place with Solicitor Bernathy and the Mill Rift Fire Department. The Board directed Secretary Hulse to add this matter to the March Regular Meeting agenda.A motion was made by Supervisor Bostinto to table the matter of the Fire Department Split. The motion was seconded by Supervisor Fischer and carries with all in favor.

NEW BUSINESS:

  • Resolution 2017-1-Compensation of Tax Collector: Secretary Hulse stated this was approved previously but requires a resolution. 

       A motion was made by Supervisor Bostinto to approve Resolution 2017-1-Compensation of Tax Collector which reflects the compensation to be 4.5 per centum of the amount collected effective January 1, 2018.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

  • Resolution 2017-2-Pennsylvania 811 Safe Digging Month: A motion was made by Supervisor Buchanan to approve Resolution 2017-2 recognizing April, 2017 at “Pennsylvania 811 Safe Digging Month”. The motion was seconded by Supervisor Bostinto and carries with all in favor. 
  • Vacation of Paper Road-Portion of Oak Drive: Solicitor Bernathy explained to the Board that he was contacted by council for Mr. Altadonna who may want to purchase a very small portion of Oak Drive which is a section of Oak Drive which only shows on paper. Mr. Altadonna owns the adjacent property surrounding the road. Solicitor Bernathy explained that the Supervisors could vacate the road by agreement without vacation by ordinance and that the Board could determine a compensation if they wish. 

 

Supervisor Buchanan made a motion to direct Solicitor Bernathy to prepare the agreement to transfer the portion of Oak Drive which is located in between Mr. Altadonna’s properties contingent upon all cost incurred including but not limited to attorney costs, recording fees and any other transfer fees to be paid by Mr. Altadonna.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

  • Naming of Road (located between Wenlock and Strand Street): Secretary Hulse explained the location of the road which needed to be named located in front of the proposed Roy Rogers which is under construction. 

Discussion followed. A motion was made by Supervisor Buchanan to name the road between Wenlock Drive and Strand Street as “Delbert Drive” to remember former Police Chief Delbert DeGroat.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

  • Sewage Investigation-Heaters Hill-Letter to PA Department of Environmental Protection: A motion was made by Supervisor Fischer to direct Secretary Hulse to send a letter to the PA DEP pursuant to Chris Wood’s investigation/letter. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 

SUBDIVISION REVIEW and ACTION: NONE

EXECUTIVE SESSION: None held.

ADJOURNMENT: Meeting was adjourned at 7:49 p.m. on a motion by Supervisor Buchanan. Motion seconded by Vice Chairman Dotey and carries with all in favor.
