January 3, 2017 Regular Meeting Minutes

January 3, 2017

The Regular meeting of the Westfall Township Board of Supervisors was held Tuesday, January 3, 2017 at 7:38 pm just following the Organization Meeting. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan and Robert Bostinto; Solicitor; Robert Bernathy; and Secretary, Jodi Hulse. Also present were Zoning Officer, Wayne Rohner; Road Master, Bill Schneider; Police Chief, Chad Stewart; Westfall Township Fire Department Chief;  Robert Llewellyn; Westfall Fire Department President; Bill Koferl; Mill Rift Fire Department Chief; Tom Lamb; Treasurer, Scott Myer; Jeff Clune and approximately nine members of the general public.

Supervisor Paul Fischer was absent.

APPROVAL OF AGENDA:  

Secretary Hulse requested to add #2 under Old Business as Rivers Edge Bond Reduction Request. A motion was made by Supervisor Buchanan to approve the agenda with the addition.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

PUBLIC COMMENT: Mr. Jeff Clune addressed the Board.  He referred to an area of Sand Pit Road in Mill Rift.  He stated there are three lots at the end of the cul-de-sac where the paved road ends and a dirt road continues to the property he may purchase.  He asked if the dirt road is Township owned.  Vice Chairman Dotey stated that Solicitor Bernathy has the paperwork previously submitted to Secretary Hulse and will review it.  Solicitor Bernathy stated he would review and have an answer by the February 6, 2017 Regular Supervisor meeting.

MINUTES:

December 5, 2016-Regular Meeting Minutes: A motion was made by Supervisor Bostinto to approve the December 5, 2016 Regular Meeting Minutes.  The motion was seconded by Supervisor Buchanan and carries with all in favor.

December 15, 2016-Special Meeting Minutes: A motion was made by Supervisor Buchanan to approve the December 15, 2016 Special Meeting Minutes.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

TREASURER’S REPORT: Mr. Myer gave the report through the month of December, 2016. He stated that the fourth payment to Katz was made.  Mr. Myer stated that Real Estate taxes were exactly in line with budget and that the Earned Income Tax collection is over budget.  He noted that there is $34,000 which will be carried over into 2017 from the Capital Improvement account.  Supervisor Buchanan reminded the Board of the need of the Township Building parking lot paving.

Mr. Myer stated that permit fees are down at this time by $19,000. He also noted that the Dombrosky matter will be paid in full in the month of January.

A motion was made by Supervisor Buchanan to approve the Treasurer’s Report through the month of December, 2016.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

POLICE REPORT:  Chief Stewart read the report for December, 2016.    The report reflects the following for the month of December, 2016:

Monthly Count of Offenses known to police:

1 Assault, 1 Burglary, 13 Larceny Theft, 1 Fraud, 1 Vandalism, 1 weapons, 6 drug abuse, 3 disorderly conduct and 3 other offenses. Total 30

Monthly Count of Persons Charged for offenses:

1 Burglary, 7 Larceny Theft, 1 Weapons, 4 Drug Abuse and 2 Disorderly Conduct.  Total 15

 

Miles patrolled for the month: 4,435 Year to Date:  71,283

Motor Vehicle Accidents for the month: 18 Year to Date: 207

Calls for Service for the month: 160 Year to Date:  2,400

 

Chief Stewart noted that the Tri-State Shell station gave out $1,200 in $50.00 gift cards for the holiday season.

Supervisor Bostinto suggested revisiting the split for the Regional Police Department contribution between Westfall Township and Matamoras Borough. Chairman Melvin and Supervisor Buchanan stated to keep the current terms and not to change the split.

A motion was made by Supervisor Buchanan to approve the Police Report for the month of December, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

FIRE DEPARTMENTS:

Mill Rift Fire Department: Chief Lamb gave the report for the Mill Rift Fire Department for the month of December, 2016 which confirmed the following:

 

12/6/16: Work Night-Engine 1-Brush Truck

12/12/16: Monthly meeting

12/16/16: Work Night-New Tanker/Driver Training

12/22/16: Wire Down-Pine Terrace/White Birch-Engine 1

 

Total Man Hours: 124

Total Equipment Hours YR: 500

Total Man Hours for the Year: 1064

 

Chief Lamb stated the Department purchased a tanker truck which has been in service for two to three weeks.

 

The Mill Rift Fire Department Report for December, 2016 was approved by motion by Supervisor Buchanan. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

Westfall Fire Department: Chief Llewellyn gave the report for December, 2016:   2 Assist EMS, 5 Automatic Fire Alarms, 3 Motor Vehicle Accidents, 1 CO Alarm, 1 Vehicle Fire, 4 Chief Investigations, 2 Gas Leaks, 2 Traffic Control, 1 Environmental Rescue and 5 Structure Fires.  The Total calls for December, 2016 were 26.  The total fire calls year to date are 301.

 

The EMS Report for the month of December, 2016 was as follows: 51 Calls in Westfall Township, 7 Calls in Dingman Township, 5 calls in Milford Township, 2 calls in Milford Borough, 21 calls in Matamoras Borough, 1 call in Shohola Township and 29 calls in Orange County, NY.  Total calls for December, 2016 were 116.  Total EMS calls year to date are 906.

 

The combined Year to Date calls are 1207.

 

Training for the month: Five drills/In-house training sessions held for 117 hours

 

Fundraising: Fish and Chips Dinner-April 21, 2017; Golf Outing-May 8, 2017; Beer Festival-July 15, 2017; Pulled Pork Dinner-August 14, 2017; Gun Raffle-September 10, 2017; Tricky Tray-October 7, 2017

 

Other: Matamoras Borough has named Westfall Township Volunteer Fire Department Ambulance as their primary BLS provider.  Blue Ridge Ave restoration has not been completed and is in poor condition following water main replacement along with various roads in Bell Manor.

 

Chief Llewellyn noted the third page of the report for December, 2016 is a list of contacts for the Department.

 

Chairman Melvin stated he spoke with Port Jervis Mayor Kelly and Mayor Kelly was trying to get the ambulance service up and running as of December 27, 2016.

 

A motion was made by Supervisor Buchanan to approve the Westfall Fire Department report for the month of December, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

 

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for December, 2016.  He stated the department handled the following storms:  December 10, 11, 17, and 24,26,27,29 and January 2, 2017.  175 tons of salt was delivered (50 tons of treated salt) and 75 tons has been delivered.  Also, Mr. Schneider noted 107 tons of anti-skid was delivered. The department maintained equipment and cleaned equipment after each storm.  Mr. Schneider stated that he had a meeting with Matamoras Water Authority and Kiley Associates regarding Bell Manor and Blue Ridge Avenue.

 

A motion was made by Supervisor Buchanan to approve the Highway Department Report for December, 2016. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

 

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for December, 2016. He confirmed there were 3 building permits, 1 mechanical permit, and 2 zoning permits for the month of December, 2016 totaling $1,150 in fees.

 

A motion was made by Supervisor Buchanan to approve the Building/Zoning Report for December, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

EMERGENCY MANAGEMENT: No representative was present and no report was submitted for December.

 

CORRESPONDENCE:  On desk for review.

 

OLD BUSINESS:

 

  1. Truck Bids-2005 F350 Pick Up- One sealed bid was received which was opened. The bid was in the amount of $5,101.00 from Mike Veneziano. A motion was made by Supervisor Buchanan to reject the bid since it did not meet the minimum bid amount of $8,000 with spreader or $7,500 without spreader. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Discussion followed. A motion was made by Supervisor Buchanan to re-advertise the sale with a minimum bid amount of $7,000 with spreader or $6,500 without spreader in all three Township approved newspapers with bids to be opened at the February 6, 2017 Regular meeting, all terms the same as previous legal notice.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

  • Rivers Edge Bond Reduction Request: Solicitor Bernathy explained the bid reduction request. He stated there is correspondence dated November 8, 2016 from Kiley Associates, LLC that recommends the Board decline the request. 

            A motion was made by Supervisor Buchanan to decline the request.  The motion was seconded by Vice

Chairman Dotey and carries with all in favor. 

NEW BUSINESS: 

  1. Tax Assessment Appeal-Westfall Hospitality Holdings (Hampton Inn)-Letter from Solicitor Bernathy: Solicitor Bernathy explained the tax appeal process which has taken place. He attended a meeting on December 16, 2017 with Mr. Hessling, Business Administrator for DVSD, Attorney Stacey Beecher, Solicitor for Pike County Tax Claim Bureau and Mr. Gene Porterfield, who is an evaluator and consultant for Pike County. He read and explained his correspondence to the Board dated December 14, 2016 which is on file at the Township Office. A motion was made by Supervisor Buchanan to make a payment to the Delaware Valley School District in the amount of $807.50 which is 17% of the appraisal amount fee for appeal number one of $4,750.00. The motion was seconded by Supervisor Bostinto and carries with all in favor.

A motion was made by Supervisor Buchanan to approve the payment of 17% of appraisal amount of appeal number two. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

A motion was made by Supervisor Buchanan to confirm the Board is open to discussion regarding the payment of attorney fees pertaining to the appeals. The motion was made by Vice Chairman Dotey and carries with all in favor.

  • DBI Services-Line Painting Partial Invoice: A motion was made by Supervisor Buchanan to approve the payment of the DBI Line Painting Partial Invoice in the amount of $10,819.75. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 
  • Pike County Council of Government-Use of meeting room request: A motion was made by Supervisor Buchanan to approve the COG using the Township Building for their 2017 meetings. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 
  • Upper Delaware Council Correspondence-Large Scale Solar Energy Systems: Discussion followed.

 

A motion was made by Vice Chairman Dotey to send a letter to the Upper Delaware Council stating the Board disapproves of the construction of any Large Scale Solar Energy Systems in the Upper Delaware River Valley area. The motion was seconded by Supervisor Bostinto and carries with all in favor.           

SUBDIVISION REVIEW and ACTION: NONE

EXECUTIVE SESSION:

None held.

ADJOURNMENT: Meeting was adjourned at 8:19 p.m. on a motion by Supervisor Buchanan. Motion seconded by Vice Chairman Dotey and carries with all in favor.

Planning Workshop Rescheduled

Due to the weather forecast, the Planning Workshop Meeting scheduled for Thursday, February 9, 2017 has been rescheduled for Monday, February 13, 2017 at 7:00 pm at the Westfall Township Municipal Building at 102 LaBarr Lane, Westfall Township, Matamoras, PA 18336.
