Regular Supervisor Meeting Minutes-October 3, 2016

October 3, 2016

The regular meeting of the Westfall Township Board of Supervisors was held Monday, October 3, 2016 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan, Paul Fischer and Robert Bostinto; Solicitor, Robert Bernathy; and Secretary, Jodi Hulse. Also present were Road Master, Bill Schneider; Police Chief, Chad Stewart; Westfall Township Fire Department President, Bill Koferl; Westfall Fire Department Chief, Rob Llewellyn; Zoning Officer, Wayne Rohner; Emergency Management Coordinator, Robert Ewbank; Treasurer, Scott Myer;  John Dalton, Twila Decker, Marge Tonkin, and approximately 8 members of the general public.

APPROVAL OF AGENDA:

Chairman Melvin stated that the date was incorrect on the top of the agenda and needs to be changed to October 3, 2016. 

A motion was made by Vice Chairman Dotey to approve the agenda. The motion was seconded by Supervisor Bostinto and carries with all in favor.

PUBLIC COMMENT:  Twila Decker addressed the Board regarding the condition of the roads in Bell Manor since the Matamoras Water Authority has been replacing water lines.  She stated that the condition of the road is terrible.  Solicitor Bernathy stated that it is contractually the Authorities responsibility to return the street surface to its original condition.  Ms. Decker stated there is a large amount of stone on the road in front of the Verizon Building.  Discussion followed.  Mr. Schneider noted that the Township Engineer will be inspecting the project area to make sure the project is being done to specifications.  Solicitor Bernathy asked that Kiley Associates submit a report to the Township by the November 7, 2016 meeting.  Ms. Tonkin questioned if a construction schedule was submitted to the Township.  Solicitor Bernathy confirmed with the concerned residents that the Authority will receive a notice from the Township.

MINUTES:

September 6, 2016 Regular Meeting Minutes: A motion was made by Supervisor Bostinto to approve the September 6, 2016 Regular Meeting Minutes. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

TREASURER’S REPORT: Mr. Myer gave the report through the month of September, 2016.  He stated that the Police Department final yearly payment has been made along with the Katz payment.  The Fire Department special mills payment has been made.  Also, the Foreign Fire Relief funds came in and will be distributed accordingly.  Mr. Myer stated that the Township is looking very financially sound.  Supervisor Bostinto questioned if the Township would be over budget by the end of the year.  Mr. Myer stated that he did not think so.  Chairman Melvin stated that the Supervisors would be talking about lowering tax mills at the budget workshop meetings and that he and Mr. Myer have been going over preliminary budget figures.  They will be trying to lower taxes by 1 to 3 mills.

A motion was made by Supervisor Buchanan to approve the Treasurer’s Report through the month of September 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

POLICE REPORT:  Chief Stewart read the report for September, 2016.    The report reflects the following for the month of September, 2016:

Monthly Count of Offenses known to police:

1 Assault, 2 Burglary, 5 Larceny Theft, 3 Fraud, 8 Vandalism, 1 Weapon Offenses, 3 Drug Abuse, 1 Liquor Law, 6 Disorderly Conduct and 4 other offenses. Total 34

Monthly Count of Persons Charged for offenses:

1 Assault, 2 Larceny Theft, 1 Vandalism, 1 Weapons Offenses, 2 Drug Abuse, 1 Liquor Law, and 1 Disorderly conduct Total 9

Miles patrolled for the month: 6,281 Year to Date:  55,088

Motor Vehicle Accidents for the month: 17 Year to Date: 159

Calls for Service for the month: 207 Year to Date:  1840

Discussion followed regarding an issue at the new school in Matamoras regarding the radios not working. Chief Stewart stated that he is working on remediating the problem.  Chief Stewart stated there a several issues with the school district and that a letter is being sent by the police commission.

A motion was made by Supervisor Buchanan to approve the Police Report for the month of September, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

FIRE DEPARTMENT:

Westfall Fire Department: Chief Llewellyn gave the report for September, 2016: 6 Automatic Fire Alarms, 4 Motor Vehicle Accidents, 1 Landing Zone, 1 Wires Down, 1 Assist EMS, 1 assist EPRPD, 4 Chief Investigation, 1 Vehicle Fire.  The Total calls for September, 2016 were 19.  The total fire calls year to date are 225.

The EMS Report for the month of September, 2016 was as follows: 42 Calls in Westfall Township, 3 Calls in Dingman Township, 2 calls in Milford Township, 3 calls in Milford Borough, 2 Calls in Matamoras Borough, and 9 Calls in Orange County, NY.  Total calls for September, 2016 were 61.  Total EMS calls year to date are 628.

The combined Year to Date calls are 853.

Training for the month: Five drills/In-house training sessions held for 115 hours; Two members completed State Firefighter I Challenge; One member attended the “Junior” weekend at PCTC

Fundraising: Wetdown for 39 Engine 2 was held on Saturday, September 10

Other:  October is Fire Prevention Month—Home Depot-October 8-10 to 2; DVES-October 13; Lowes-October 15-10 to 2

Issues regarding “Go-24” have not been addressed.  Hydrant and Knox Box have not been installed.  Request to have fire department review construction prior to issuing certificate of occupancy.

Mill Rift Fire Department: No Mill Rift Fire Department Representative was present.  Supervisor Buchanan read the report for the month of September, 2016:

The report also reflected that Chuck Pranski is no longer President of the Department and that Thomas Lamb, Jr. has been appointed until the end of the year.

Discussion followed regarding merging of the Mill Rift Fire Department and the Westfall Fire Department. Chairman Melvin asked Chief Llewellyn if he had a problem with a possible merger.  He said no.  Chief Llewellyn stated he would prepare a report/list of pros and cons.  Chairman Melvin stated that there is nothing against the Mill Rift Fire Department but there is concern for the proper protection for the people of Mill Rift.

A motion was made by Supervisor Buchanan to advertise/scheduled a Workshop Meeting for the purpose of discussion of merging the Mill Rift Fire Department with the Westfall Fire Department. The meeting to take place at the Township Building on September 24, 2016 at 8:00 pm. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

A motion was made by Supervisor Fischer to approve the Mill Rift Fire Department Report for September, 2016. The motion was seconded by Supervisor Bostinto and carries with all in favor.

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for September, 2016. The Department marked out the area for line painting which was scheduled but postponed due to rain.  They also continued replacing culvert pipes on Heaters Hill.  The Department worked on hot patch black top repairs to Cummins Hill and Bluestone Boulevard. The Fire Extinguisher inspection was completed in September.  Mr. Schneider also had a meeting with the Optimum Risk representative.  She inspected the building and requested the purchase of a fire proof cabinet for flammable items.  Mr. Schneider purchased the required cabinet.  The Department also replaced the culvert pipe on Pond Drive.  They mowed the township rights of way and the municipal building area along with maintaining the compost area.  Mr. Schneider worked on the Fire Tower Road report and the Highway Department Budget.  He also took Supervisor Bostinto and Vice Chairman Dotey on a tour of Fire Tower Road.  Mr. Schneider also took a trip to Powell’s Truck Center to check on progress of the new truck equipment which should be done by the middle of October.  The Department started preparing the trucks for winter.  Mr. Schneider spoke with a land owner on Decker Lane and confirmed access.  He just needs the easement agreement to move forward.  Mr. Schneider also attended a meeting in Bell Manor regarding the water line replacement by Matamoras Water Authority.  He will be contacting Kiley Associates to inspect the area since there is a problem with the pavement.

Discussion followed regarding the roof on the Highway Department. Mr. Schneider stated that each nail needs to be sealed as per Tom Lamb.  Supervisor Buchanan stated that this needs to be taken care of.  Chairman Melvin stated that this would be covered under the highway department budget and directed Mr. Schneider to have the job done.

Chairman Melvin confirmed with Mr. Schneider that the culvert pipes throughout the area are cleared before all storms. His concern was the approach of Hurricane Matthew.

The Highway Report for September, 2016 was approved by motion made by Supervisor Buchanan. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Discussion followed regarding the GO 24 Store. Chief Llewellyn explained the issues due to no hydrant in place.  There is no hydrant for 400 feet.  Chairman Melvin stated there will be no Certificates of Occupancy issued without Fire Department Approval.  He directed Secretary Hulse to confirm this with BIU.

A motion was made by Supervisor Buchanan to approve the Westfall Fire Department report for the month of September, 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for September, 2016.  He reported two building permits, two electrical permits and two zoning permits totaling $921.80 in fees.

A motion was made by Supervisor Buchanan to approve the Building/Zoning Report for September, 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

EMERGENCY MANAGEMENT: Mr. Ewbank presented the report for September, 2016. He stated that September was a quiet month and that he attended the Pike County Hazard Mitigation Plan Update meeting on September 30, 2016.  Also in attendance were Supervisors Melvin and Bostinto.  There are several worksheets which need to be filled out for Westfall Township by October 14, 2016 and a Hazard Mitigation Team needs to be assembled and probable meet one time to go over the plan.

A motion was made by Supervisor Buchanan to approve the Emergency Management Report for September, 2016.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

CORRESPONDENCE:  On desk for review.

OLD BUSINESS:  

  • Proposed Ordinance #169-Vacation of Fire Tower Road: This matter was addressed earlier at the Public Hearing. Ordinance did not pass.
    • Truck Bids-F350 Pick Up:

A motion was made by Supervisor Buchanan to re-advertise the Truck Sale with the same terms in the Times  Herald Record, Pike County Dispatch and the Pocono Record with sealed bids to be opened at the November 7, 2016.  The motion was seconded by Supervisor Fischer and carries with all in favor.

  • Proposed Property Maintenance/Sidewalk Ordinance: Supervisor Fischer addressed the Board with this matter. Discussion followed regarding sidewalk installation at the DV School complex and maintenance of other sidewalks in the Township. The Board directed Solicitor Bernathy to draft a Sidewalk Ordinance.
  • Proposed Soliciting Ordinance:   Supervisor Bostinto addressed the Board with this matter. Discussion followed regarding soliciting taking place within the Township. Chairman Melvin stated that there would be an enforcement issue. Chief Stewart stated there has been a problem with a seal coating company taking the money from residents and not doing the work

 

 

The matter was table for future discussion.

  • Municipal Expansion Project: Vice Chairman Dotey stated that a plan is needed from the Township Engineer for the Pike County Conservation District. Chairman Melvin stated this matter will be discussed at the budget workshop. Discussion followed. Vice Chairman Dotey stated he will schedule a meeting with Kiley Associates.

 

No action taken.

  • Pike County Hazard Mitigation: A meeting was scheduled for October 11, 2016 at 5:00 pm between Vice Chairman Dotey, Supervisor Bostinto, Robert Ewbank, Chief Llewellyn, Chief Stewart, Wayne Rohner and Secretary Hulse to fill out the appropriate forms. No action taken for legal advertisement since only two Supervisors attending.

NEW BUSINESS: 

    1. Letter to Pennsylvania Department of Environmental Protection-Sewage Complaint-Foster Hill Road: A motion was made by Vice Chairman Dotey to send a letter to the DEP to respond to their request/correspondence stating no violation was found by the Sewage Enforcement Officer. The motion was seconded by Supervisor Bostinto and carries with all in favor.
    2. Pike County Tax Assessment Office-Real Estate Tax Assessment Appeal hearings-October 11, 2016 and October 12, 2016: Solicitor Bernathy stated he would attend the appeal hearing for the October 11, 2016 hearing. The Board stated they did not feel the need to attend the hearing on October 12, 2016.
  • Non Uniform Pension Plan-Minimum Municipal Obligation: Secretary Hulse announced the contribution. No action taken.
  • Letter from Pike County Conservation District-Request for meeting to discuss their service to the Township: The Board stated discussion would take place when meeting with the PCCD for purposed of the Municipal Expansion. No action was taken.
  • Pennsylvania Township Health Insurance Cooperative Trust-2016 Ballot for Election of Trustee: A motion was made by Vice Chairman Dotey to elect Mike Keller as Trustee. The motion was seconded by Supervisor Fischer and carries with all in favor

 

 

SUBDIVISION REVIEW and ACTION:

  1. Letter from Planning Board-Conditional Use Application-Schedule Conditional Use Hearing-Paddlers Point-Garden Apartments-Tax Map#098.09-01-01: A motion was made by Vice Chairman Dotey to schedule the Conditional Use Hearing for November 17, 2016 at 6:15 pm. The motion was seconded by Supervisor Fischer and carries with all in favor.
