September 6, 2016 Regular Supervisor Meeting Minutes

September 6, 2016

The regular meeting of the Westfall Township Board of Supervisors was held Tuesday, September 6, 2016 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisor; Robert Bostinto; Solicitor, Robert Bernathy; and Secretary, Jodi Hulse. Also present were Road Master, Bill Schneider; Westfall Township Fire Department President, Bill Koferl; Mill Rift Fire Department Chief, Tom Lamb; Zoning Officer, Wayne Rohner; Emergency Management Coordinator Assistant, Mike Fischetta; Treasurer, Scott Myer; John Dalton, Twila Decker, Marge Tonkin, Roland MacDonald, Katrina Kolvin-Stilts, Russ Miller, Fred Larca, Gene Ruzanski, and approximately 10 members of the general public.

Supervisors; Lester Buchanan and Paul Fischer were absent. Chief, Chad Stewart was also absent.

APPROVAL OF AGENDA:  

A motion was made by Vice Chairman Dotey to approve the agenda. The motion was seconded by Supervisor Bostinto and carries with all in favor.   

PUBLIC COMMENT: Twila Decker addressed the Board regarding “Derelict Properties”.  She stated four different areas of concern (House in front of Price Chopper, Corner of Margaret/Oak, Corner of Cuddeback, Corner of Graham and Maple Street).  Vice Chairman Dotey stated that Wayne Rohner, Zoning Officer, has been working on some of these areas.  Ms. Decker mentioned high grass on some of the properties.  Solicitor Bernathy stated that the properties would have to be an attractive nuisance to be investigated further and that the Township does not have a maintenance ordinance enforcing lawn care.  Solicitor Bernathy suggested Ms. Decker provide a list of the locations of the properties of concern.

No further Public Comment. 

MINUTES:

August 1, 2016- Regular Meeting Minutes- A motion was made by Supervisor Bostinto to approve the August 1, 2016 Regular meeting minutes. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

August 15, 2016-Joint Meeting Minutes-A motion was made by Vice Chairman Dotey to approve the August 15, 2016 Joint Meeting Minutes. The motion was seconded by Chairman Melvin and carries with two in favor and one abstention.  Supervisor Bostinto abstained since he was absent for the Joint Meeting.

TREASURER’S REPORT: Mr. Myer gave the report through the month of August, 2016.  He stated that August is a slow month.  The income collected is at budget.  All budget expensed are in line.  Mr. Myer stated there was nothing else noteworthy to report.  Chairman Melvin confirmed with Mr. Myer that no tax anticipation notes would be necessary for the upcoming year.  Mr. Myer stated that the financial status of the Township is strong.

A motion was made by Vice Chairman Dotey to approve the Treasurer’s Report through the month of August, 2016. The motion was seconded by Supervisor Bostinto and carries with all in favor.

POLICE REPORT:  Chief Stewart was absent therefore Chairman Melvin read the report for August, 2016.  The report reflects the following for the month of August, 2016:

Monthly Count of Offenses known to police:

1 Rape, 1 Assault, 7 Larceny Theft, 1 Motor Vehicle Theft, 4 Fraud, 6 Vandalism, 3 Drug Abuse, 6 DUI, 10 Disorderly Conduct and 9 other offenses. Total 48

Monthly Count of Persons Charged for offenses:

1 Assault, 4 Larceny Theft, 1 Fraud, 1 Vandalism, 6 Drug Abuse, 4 DUI, 1 Disorderly Conduct, 1 Other offenses Total 19

Miles patrolled for the month: 5,979 Year to Date:  48,807

Motor Vehicle Accidents for the month: 20 Year to Date: 142

Calls for Service for the month: 258 Year to Date:  1633

A motion was made by Vice Chairman Dotey to approve the Police Report for the month of August, 2016. The motion was seconded by Supervisor Bostinto and carries with all in favor.

FIRE DEPARTMENT:

Westfall Fire Department: Mr. Koferl gave the report for August, 2016: 7 Automatic Fire Alarms, 2 Motor Vehicle Accidents, 1 Landing Zone, 2 Gas Leaks, 4 Wires Down, 3 Water Rescue, 3 Chief Investigation, 2 Vehicle Fires, and 1 Structure Fire.  The Total calls for August, 2016 were 25.  The total fire calls year to date are 206.

The EMS Report for the month of August, 2016 was as follows: 59 Calls in Westfall Township, 1 Call in Dingman Township, 1 call in Milford Township, 1 call in Sussex County, NJ, 4 calls in Milford Borough, 5 calls in Matamoras Borough, and 17 calls in Orange County, New York.  Total calls for August, 2016 were 88.  Total EMS calls year to date are 567.

The combined Year to Date calls are 773.

Training for the month: Four drills/In-house training sessions held for 110 hours; two members completed 16 hours of Structural Burn Sessions Training; and Two members completed 168 hours of Firefighter Essentials Training

Fundraising: Pulled Pork Take-out Dinner was held on August 12, 2016; Gun Raffle tickets are available with the drawing to be held on September 10, 2016; Wetdown for 39 Engine 2 will be held on Saturday September 10 from 1pm to 6 pm. T-shirts and mugs are available for purchase.  The event is open to the public.

Other: Issues regarding “Go-24” have not been addressed.  Hydrant and Knox Box have not been installed.  Request to have fire department review construction prior to issuing certificate of occupancy.

A motion was made by Vice Chairman Dotey to approve the Westfall Fire Department report for the month of August, 2016. The motion was seconded by Supervisor Bostinto and carries with all in favor.

Mill Rift Fire Department: Chief Lamb gave the report for the month of August, 2016:

Vice Chairman Dotey thanked the Department for helping during the power outage. They opened the Fire Department Building and offered an air conditioned area for residents.

The Mill Rift Fire Department report was approved on a motion made by Supervisor Bostinto. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

HIGHWAY DEPARTMENT: Mr. Schneider gave the report for August, 2016.  The Department continued replacing culvert pipe on Cummins Hill and Bluestone Boulevard.  They worked on Fire Tower Road stone and ditch repair.  Mr. Schneider stated that the paving has been completed on Cummins Hill Road and Rod and Gun Club Road.  The Department also completed cold patch on pothole and culvert pipes.  The Department was called out for a tree down on Cherry Court.  Mr. Schneider thanked the Westfall Fire Department for their assistance and help with this matter.  There were also wire down on Compton Court.  Mr. Schneider thanked the Mill Rift Fire Department for their assistance and help with this matter.  He also stated that the Department was called out for a tree down on Bertha Street.  Additional culvert pipes were ordered.  Mr. Schneider stated there was a problem with the timing at the red lights and Kuharchik Construction fixed the problem on a Sunday.  He stated their service is appreciated.

Supervisor Bostinto brought up two areas of concern on Delaware Drive. Mr. Schneider stated those areas are Penn DOT’s responsibility.

Vice Chairman Dotey stated that the paving and shoulder work completed was done greatly. Mr. Schneider suggested painting the lines on the shoulders in the freshly paved areas if this was feasible in the budget.

A motion was made by Supervisor Bostinto to send a letter to Penn DOT regarding the Delaware Drive issues. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

The Highway Report for August, 2016 was approved by motion made by Vice Chairman Dotey. The motion was seconded by Supervisor Bostinto and carries with all in favor.

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for August, 2016.  He reported three building permits and five zoning permits totaling $888.89 in fees.

A motion was made by Supervisor Bostinto to approve the Building/Zoning Report for August, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

EMERGENCY MANAGEMENT: Mr. Ewbank was absent.  Mr. Fischetta was present.  Chairman Melvin read the report for August, 2016 which stated that it was a quiet month with nothing to report.  Chairman Melvin confirmed that Supervisor Bostinto is completing the necessary NIMS Courses.

A motion was made by Vice Chairman Dotey to approve the Emergency Management Report for August, 2016.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

Marge Tonkin stated that the Blue Bird Court sign was installed by the Municipal Authority of Matamoras.

CORRESPONDENCE:  On desk for review.

Chairman Melvin confirmed with the Board that #12 under New Business would be moved up. He stated there would be a grand opening for Corning Natural Gas Holding Company who recently purchased from Orange and Rockland.  The grand opening will be held on September 7, 2016 and Vice Chairman Dotey and Supervisor Bostinto would be attending.  Mr. Miller, Vice President of Energy Supply explained his position and the acquisition.  Ms. Colvin-Stilts who is the Customer Affairs Manager introduced herself.  She stated that payments will be accepted at the Westfall Township Corning Office located on Route 6 & 209 next to Tractor Supply and that the office will be open 8:00 am until 4:30 pm Monday through Friday.  Mr. Miller stated that he expects to improve the level of service.

Chairman Melvin confirmed with the Board that the Land Development application be moved up.

Minor Land Development Application-Krieger Storage, Inc.-Reuben Bell Drive (Old Skating Rink)-Tax Map Parcel #099.00-01-38-Change of Use-Trade Shows/Gun Shows/Craft Shows:

Representatives: Mr. Fred Larca     Mr. Gene Ruzanski, Schoenagel & Schoenagel

Solicitor Bernathy read the letter dated August 30, 2016 from the Planning Commission to the Supervisors which reflected eight conditions. Mr. Ruzanski introduced Mr. Larca and explained the proposed Change of Use which is from a skating rink to retail/trade shows.  Solicitor Bernathy confirmed the use is permitted within the zone and that no zoning or conditional use requirements are needed.

There was no public comment.

Mr. Larca stated that there is an event venue which consists of gun shows and craft shows. Solicitor Bernathy stated there are some building code requirements.  Mr. Ruzanski stated there are only handicap accessibility changes on the exterior.  Mr. MacDonald asked if the structure would be used for a shooting range.  Solicitor Bernathy stated the applicant is not seeking approval for that use at this time.  Mr. Larca confirmed.

A motion was made by Vice Chairman Dotey to approve the application with the conditions listed in the August 30, 2016 letter from the Planning Commission to the Board of Supervisors. The motion was seconded by Supervisor Bostinto and carries with all in favor.  

OLD BUSINESS:  

  1. Proposed Hiring and Oversight of School Crossing Guard Ordinance (#168): This matter was addressed at the public hearing just prior to the Supervisor Meeting. A motion was made at the Hearing to adopt Ordinance #168 by Vice Chairman Dotey and seconded by Supervisor Bostinto and carries with all in favor.
  2.  Vacation of Fire Tower Road-Letter from Kiley Associates, LLC re: Survey Cost: Discussion followed. Kiley Associates is working on the survey for the Public Hearing scheduled for October 3, 2016 at 6:30 pm. No action taken regarding this matter.3.
  3. Decker Lane-Kiley Associates, LLC Review: Mr. Schneider explained Mr. Hudak’s review. He reminded Solicitor Bernathy that an easement agreement is needed for one of the owners on Decker Lane. Secretary Hulse stated she would forward the information to Solicitor Bernathy if he needs it. No action taken regarding this matter. 

NEW BUSINESS: 

  1. MJS Engineering Invoice: Solicitor Bernathy stated he reviewed this invoice. He suggested the Board request more specificity and authority for payment of the invoice. A motion was made by Chairman Melvin to authorize Solicitor Bernathy to send a letter to MJS Engineering requesting more specificity. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
  2. Schedule Budget Meetings: A motion was made by Vice Chairman Dotey to schedule the budget workshop meetings for October 17, 2016 and October 24, 2016 at 7:00 pm. The motion was seconded by Supervisor Bostinto and carries with all in favor.
  3. Advertise Truck Sale: Discussion followed. Solicitor Bernathy confirmed with Vice Chairman Dotey that a quote was received by a dealer for estimate of sales price. A motion was made by Supervisor Bostinto to advertise the 2004 Ford F350 1 ton pick-up truck with diesel engine and plow and spreader with a minimum bid price of $10,000.00, in the Pike County. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
  4. New Truck Purchase: Mr. Schneider explained the details of the truck which the Supervisors are considering purchasing. Mr. Schneider said the truck is approved by the Co Star State bid therefore is exempt from bidding requirements by the Township. The truck is a 5500 Mason Dump with a spreader and plow. Mr. Schneider provided the quote from Powell’s Sales and Service and Hondru Dodge with a total purchase price of $83,629.31 for the truck and accessories.

A motion was made by Vice Chairman Dotey to approve the purchase of the Dodge 5500 Mason Dump Truck with the plow and spreader with a purchase price of $83,629.31 from Hondru Dodge and Powell’s Sales and Service. The motion was seconded by Supervisor Bostinto and carries with all in favor.

5. Settlement Payoff: Chairman Melvin stated that this matter is regarding Dombrosky. He stated since the Township received the settlement that the Board should consider paying off the obligation in full.

       A motion was made by Chairman Melvin to pay the Dombrosky obligation in full up to an amount of $230,000 conditional upon no additional fees or pre-payment penalties being assessed.

Discussion followed regarding agreement and terms.  Solicitor Bernathy asked if any public comment.  Ms.  Decker stated to pay the obligation and get rid of it.  No other public comment.

The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Solicitor Bernathy stated that he would contact the attorney for the case.

6. Pike County Hazardous Mitigation Plan Executive Steering Committee: Chairman Melvin explained the purpose of the committee and that he is one of the committee members. No action taken regarding this matter.

 

 

7. Pike County Council of Governments-Right to Know and Sunshine Law Informational Meeting: A motion was made by Supervisor Bostinto to approve attendance of the meeting by Secretary Hulse. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 

8. Pike County Association of Township Officials Annual Convention: A motion was made by Vice Chairman Dotey to approve the payment of $200.00 for the Township’s attendance at the Pike County Association of Township Officials Annual Convention on October 7, 2016 at the Best Western Inn at Hunts Landing. The motion includes Supervisor Bostinto, Vice Chairman Dotey, and Solicitor Bernathy to attend the Convention. The motion was seconded by Supervisor Bostinto and carries with all in favor.

9. Proposed Property Maintenance/Sidewalk Ordinance: Tabled until the October 3, 2016 Supervisor Meeting.

10. Proposed Soliciting Ordinance: Tabled until the October 3, 2016 Supervisor Meeting.

11. Line Painting-Route 6 & 209: Discussion followed. Mr. Schneider stated that he obtained three phone quotes. The job was too large for the one company, no response from one other and the other quote was $13,567.50.A motion was made by Vice Chairman Dotey to approve the payment of $13,567.50 for the line painting quote and to bill the appropriate escrow accounts for the invoice. The motion was seconded by Supervisor Bostinto and carries with all in favor.    

SUBDIVISION REVIEW and ACTION:

  1. Minor Land Development Application-Krieger Storage, Inc.-Reuben Bell Drive (Old Skating Rink)-Tax Map #099.00-01-38-Change of Use-Trade Shows/Gun Shows/Craft Shows-Recommendation letter from Planning Board: Matter addressed earlier in the meeting. 

EXECUTIVE SESSION: None held.

ADJOURNMENT: Meeting was adjourned at 8:13 p.m. on a motion by Vice Chairman Dotey. Motion seconded by Supervisor Bostinto and carries with all in favor.
