August 1, 2016 Regular Supervisor Meeting Minutes

The regular meeting of the Westfall Township Board of Supervisors was held Monday, August 1, 2016 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan, Robert Bostinto and Paul Fischer; Solicitor, Robert Bernathy; and Secretary, Jodi Hulse. Also present were Road Master, Bill Schneider; Westfall Township Fire Department Chief, Rob Llewellyn; Mill Rift Fire Department Chief, Tom Lamb; Zoning Officer, Wayne Rohner; Emergency Management Coordinator, Bob Ewbank; Treasurer, Scott Myer; John Dalton, Eric Gawel, Joe Hoehmann, Mr. and Mrs. Sherlock, Marie Hollberg and approximately 6 members of the general public.

APPROVAL OF AGENDA:  

A motion was made by Supervisor Buchanan to approve the agenda. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Supervisor Bostinto then requested a change to the agenda. He added #5 under “New Business” as Letter from UDC regarding NYC DEP alerts.

A motion was made by Supervisor Buchanan to approve the revised agenda. The motion was seconded by Vice Chairman Dotey and carries with all in favor.   

PUBLIC COMMENT: Mr. John Dalton addressed the Board regarding his two recent letters submitted to the Board.  He strongly recommends the Board consider updating the Township website to include the monthly treasurer reports.  He stated the cost would be roughly $2000 to $5,000.  Chairman Melvin stated that the matter will be considered during the 2017 budget meetings.

Mr. Dalton also asked the Board if they have done anything about the boarded abandoned home in front of the Price Chopper Store. He had also submitted a letter regarding this.  Secretary Hulse states she would check with the Building Inspector.

Mr. Dalton also addressed an additional issue regarding the budget format presented each month by Mr. Myer. He stated that he would like the format to be “cleaned up” to reflect larger print and “year to date” wording on the monthly reports.  Supervisor Bostinto stated that the fifth column does show “year to date”.  Mr. Bostinto asked Mr. Myer if the report format in question is standard accounting reporting.   Mr. Myers stated that the reports are a user tool and that there is no true standard.  He stated that the reports were reviewed by the DCED in the past for Act 47 purposes and the DCED had no suggestions or comments regarding the format.  He agreed to add “year to date” at the top of the page. Mr. Dalton also suggested moving the table over to allow space for reviewer written comments on the side of the form.

The Board thanked Mr. Dalton for his comment. 

MINUTES:

July 5, 2016- Regular Meeting Minutes- A motion was made by Supervisor Buchanan to approve the June 5, 2016 minutes. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 

TREASURER’S REPORT: Mr. Myer gave the report through the month of July, 2016 which reflects the entire year to date reporting.  He stated that the income at this time is at 100% for the entire year.  Also the expenses are at 58% which is exactly in line for this time of year.  The income is over budget at this time.  Mr. Myer also stated that $397,920 has been collected so far this year in Earned Income Tax revenue.

A motion was made by Supervisor Buchanan to approve the Treasurer’s Report through the month of July, 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

POLICE REPORT:  Chief Stewart was absent therefor Vice Chairman Dotey read the report for July, 2016.  The report reflects the following for the month of July, 2016:

Monthly Count of Offenses known to police:

1 Assault, 18 Larceny Theft, 7 Fraud, 5 Vandalism, 1 Drug Abuse, 1 DUI, 3 Disorderly Conduct and 2 other offenses. Total 43

Monthly Count of Persons Charged for offenses:

4 Larceny Theft, 1 Fraud, 3 Drug Abuse, 2 DUI, 1 Drunkenness, and 42 Disorderly Conduct. 2 Other offenses Total 15

Miles patrolled for the month: 6,363 Year to Date:  42,828

Motor Vehicle Accidents for the month: 19 Year to Date: 122

Calls for Service for the month: 240 Year to Date:  1375

A motion was made by Supervisor Fischer to approve the Police Report for the month of July, 2016. The motion was seconded by Supervisor Buchanan and carries with all in favor.

FIRE DEPARTMENT:

Mill Rift Fire Department: Chief Lamb gave the report for the month of July, 2016:

The Mill Rift Fire Department report was approved on a motion made by Supervisor Buchanan. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Westfall Fire Department: Chief Llewellyn gave the report for July, 2016: 7 Automatic Fire Alarms, 5 Motor Vehicle Accidents, 2 Landing Zone, 3 Brush Fire, 1 Hazmat/Spill Control, 4 Wires Down, 2 Water Rescue, 2 Chief Investigation, 2 Public Service, and  3 Structure Fires.  The Total calls for June were 31.  The total fire calls year to date are 181

The EMS Report for the month of July was as follows: 34 Calls in Westfall Township, 8 Calls in Dingman Township, 6 calls in Milford Township, 3 calls in Milford Borough, 3 calls in Matamoras Borough, and 9 calls in Orange County, New York.  Total calls for July were 63.  Total EMS calls year to date are 479.

The combined Year to Date calls are 660.

Training for the month: Four drills/In-house training sessions held for 122 hours; Three members completed 8 hours of Hazmat Operations Refresher.

Fundraising: Westfall Fire Department Tricky Tray will be held on July 23 at DV School Complex; Pulled Pork Take-Out Dinner will be held on August 12; Gun Raffle tickets are still available with the drawing to be held on September 10, 2016.

Other: Engine 2 took 2nd place in the Rescue Category at the Port Jervis Fire Department Inspections Day Parade on July 9, 2016; Participated with the American Red Cross and Home Depot for a “Hurricane Preparedness” Seminar on Sunday, July 31, 2016; Issues regarding “Go-24” have not been address.  Hydrant and Knox Box have not been installed.

A motion was made by Supervisor Buchanan to approve the Westfall Fire Department report for the month of July, 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

HIGHWAY DEPARTMENT:  Bill Schneider gave the report for July, 2016. He stated the department continued installing culvert pipe on Cummins Hill Road, Bluestone Boulevard, Heaters Hill and Decker Lane.  They maintained the equipment.  The department mowed the right of ways throughout the township, shoulder maintenance, and culvert clearing.  Mr. Schneider attended the July Road Task Force meeting.  Two Department employees attended the Penn DOT Equipment Show.  The Department did cold patch work throughout the township.  Mr. Schneider stated that the Pond Eddy Bridge project has started.  He also informed the Board that new water lines will be installed in the Bell Manor area.  The department attended to trees down on River Road in Mill Rift.  Mr. Schneider is working on obtaining line painting quotes for Route 6 & 209.

The Highway Report for July, 2016 was approved by motion made by Supervisor Buchanan. The motion was seconded by Supervisor Bostinto and carries with all in favor.

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for July, 2016.  He reported six building permits, one electrical permit, one mechanical permit and five zoning permits totaling $3,264.16 in fees.  Mr. Rohner stated that there is an active Zoning Permit on the GO 24 Store.  He will check on the status regarding the fire hydrant and knox box.  Mr. Rohner stated Mr. Altadonna was not present at the court hearing regarding his debris violation.  He also asked for the Board’s approval for a check in the amount of $117.00 for court hearing regarding the Martel property (debris on property).

A motion was made by Vice Chairman Dotey to approve a check in the amount of $117.00 to the District Court for the Martel violation. The motion was seconded by Supervisor Buchanan and carries with all in favor.

A motion was made by Supervisor Buchanan to approve the Building/Zoning Report for July, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

EMERGENCY MANAGEMENT: Mr. Ewbank gave the report for July, 2016.  He stated that July was a relatively quiet month.  A training class for Emergency Management Coordinators scheduled for July at the County Training Center was cancelled.   He did not understand why some Supervisors do have the certifications for the NIMS 100 and 700 courses.   He stated that the Supervisors should take the NIMS 100 and 700 courses and that when he was on the Board, Solicitor Bernathy encourage all Supervisors to take these courses.  Chairman Melvin stated that it takes about eight hours to complete the courses.  Mr. Ewbank stated he would like all Supervisor to complete both courses.

A motion was made by Supervisor Buchanan to approve the EMA Report for July, 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

OLD BUSINESS:

  1. Proposed Loitering Ordinance #167: Chairman Melvin stated that this matter was addressed at the Public Hearing held just prior to the meeting.  A motion was made by Vice Chairman Dotey to adopt Ordinance #167.  The motion was seconded by Supervisor Fischer and carries with three in favor and two in opposition. Supervisor Buchanan and Supervisor Bostinto were in opposition. There was no further comment. 

2. 2003 Ford F-550 Mason Dump Truck- Bids: One sealed bid was received from Michael Badoud in the amount of $16,592.50. 

A motion was made by Supervisor Buchanan to accept the bid from Michael Badoud in the amount of $16,592.50. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

3. Township Building Generator Bids: One sealed bid was received from Pioneer Construction Company, LLC in the amount of $98,300 for the diesel fired generator and $174,300 for the propane fired generator in accordance with the Township Engineer Specifications. A motion was made by Supervisor Buchanan to reject the bid. The motion was seconded by Supervisor Bostinto and carries with all in favor. Chairman Melvin said this matter will be discussed further at budget season.

4. Vacation of Fire Tower Road-Letter from Pennsylvania Department of Conservation Natural Resources-Bureau of Forestry: Solicitor Bernathy read the letter and stated that a survey of the road is required. Discussion followed. Chairman Melvin questioned the cost benefit for the past five year and how much has been received in State Liquid Fuels Funds. Supervisor Buchanan showed concern regarding liability and township responsibility and suggested the road be vacated as soon as possible. Supervisor Fischer suggested obtaining a cost analysis from Mr. Schneider to be reviewed at the September meeting.

            A motion was made by Supervisor Buchanan to schedule the Public Hearing for proposed Ordinance #169-  Vacation of Fire Tower Road for October 3, 2016 at 6:30 pm.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

A motion was made by Supervisor Buchanan to amend the previous motion to add approval of Township

Engineer to provide survey quote and survey for the October 3, 2016 Public Hearing and to obtain three

phone quotes if required.  The motion was seconded by Supervisor Bostinto and carries with all in favor. 

NEW BUSINESS:

 

  1.  Approval of Zoning Officer Hours (August 16, 17, 18, 23, 24)-Office Coverage-Secretary Medical Leave: A motion was made by Supervisor Buchanan to approve compensating Mr. Rohner at his current rate of pay for the coverage of regular office hours of August 16, 17, 18, 23 and 24. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

       Chairman Melvin stated the office will be closed on Thursday, August 25, 2016.

2. School Crossing/Traffic Control Guard: Solicitor Bernathy referred to correspondence and resolution from 2007 from the School District Solicitor. He explained that the matter is regarding adopting an ordinance transferring authority to assume hiring and oversight of school crossing guards to the Delaware Valley School District. 

A motion was made by Supervisor Buchanan to schedule a Public Hearing for Proposed Ordinance #168-transferring authority to assume hiring and oversight of school crossing guards to the Delaware Valley School District for September 6, 2016 at 6:45 pm. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

3. Penn DOT Winter Maintenance Municipal Agreement-Resolution 2016-2: A motion was made by Supervisor Buchanan to approve Resolution 2016-2 (Penn DOT Winter Maintenance Municipal Agreement). The motion was seconded by Supervisor Bostinto and carries with all in favor.

4. Bell Manor Water Lines-Road Opening Permit-Matamoras Municipal Authority:   Discussion was held regarding representation on the Matamoras Municipal Authority Board and length of paving. 

A motion was made by Vice Chairman Dotey to send a letter and road opening permit application to Matamoras Municipal Authority requesting the application and applicable fee submittal to the township. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

5. Letter from Upper Delaware Council-requesting letter of support to New York City DEP regarding emergency public warning systems: A motion was made by Supervisor Buchanan to send a letter of support to the NYC DEP. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Mr. Eric Gawel asked if he could make a public comment since he was not familiar with the meeting procedure and did not comment earlier. The Board agreed. He addressed the Board and stated his concern with the water runoff issue at Decker Lane where he owns property and lives. Mr. Gawel showed concern about the Township installing a pipe on Decker Lane and re-routing water onto his property after he just spend roughly $60,000 in drainage on his property. Mr. Schneider explained the proposed project. He stated he will shoot some grades on the property. Mr. Hoehmann (121 Decker Lane) expressed his concern for the area also. He stated he has applied berm to his property at a great expense. Marie Hollberg told the Board that it was similar to a water fall on her property during the last bad storm which caused some serious damage. Mrs. Sherlock questioned the size of the pipe to be installed. Mr. Schneider said eighteen inches. Additional discussion followed. Chairman Melvin advised Mr. Schneider to contact Kiley Associates for recommendations on this matter.
