July 5, 2016 Regular Supervisor Meeting Minutes

July 5, 2016

The regular meeting of the Westfall Township Board of Supervisors was held Tuesday, July 5, 2016 at 7:06 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan and Paul Fischer; Solicitor, Robert Bernathy; and Secretary, Jodi Hulse. Also present were Road Master, Bill Schneider, Chief, Rob Llewellyn, Chief, Tom Lamb, Chief, Chad Stewart, Zoning Officer, Wayne Rohner; Robert Myer, and approximately 10 members of the general public.

Supervisor Robert Bostinto was absent. Mr. Scott Myer, Treasurer was also absent.

APPROVAL OF AGENDA:  

A motion was made by Supervisor Buchanan to approve the agenda. The motion was seconded by Vice Chairman Dotey and carries with all in favor.  

PUBLIC COMMENT: Mr. Robert Myer of 125 North Castle Drive addressed the Board.  He referenced a complaint he had submitted in writing to the Board in recent days regarding the Matamoras Rod and Gun Club property which borders his which he has owned for approximately ten years.  He stated the noise from increased shooting has become intolerable.  He explained that sometimes on Sundays this goes on from morning until evening.  He has also complained to the gun club with no response.  Also, to the Eastern Pike Regional Police Department.

Chairman Melvin stated the Township does not have a noise ordinance so there is nothing the Eastern Pike Regional Police Department nor the Township can enforce. Supervisor Buchanan stated he was once a member but no longer.  He stated there is nothing the Township can do.

Solicitor Bernathy stated the Matamoras Rod and Gun Club has a pre-existing use which pre-exists the zoning ordinance. He referred Mr. Myer to an attorney of his choice and stated this is a civil matter.

Additional discussion followed. Mr. Myer asked if a new ordinance could be adopted.  Solicitor Bernathy said a noise ordinance is problematic to enforce.  Mr. Myer once again explained how much noise pollution the club is creating and stated he would be documenting his complaints.  He is trying to get the club to respect local residents.  

MINUTES:

June 6, 2016- Regular Meeting Minutes- A motion was made by Vice Chairman Dotey to approve the June 6, 2016 minutes. The motion was seconded by Supervisor Buchanan and carries with all in favor.

TREASURER’S REPORT: Chairman Melvin reviewed the report and stated that all is on track from a budgetary stand point.

A motion was made by Supervisor Buchanan to approve the Treasurer’s Report for the month of June, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

POLICE REPORT:  Chief Stewart gave the report for June, 2016.  The report reflects the following for the month of June, 2016:

Monthly Count of Offenses known to police:

1 Robbery, 2 Assault, 14 Larceny Theft, 2 Fraud, 2 Recovery of Stolen Property, 2 Vandalism, 3 Drug Abuse, 3 DUI, 7 Disorderly Conduct and 3 other offenses. Total 39

Monthly Count of Persons Charged for offenses:

10 Larceny Theft, 2 Fraud, 1 Rec. Stln. Prop., 2 Drug Abuse, 2 DUI, and 4 Disorderly Conduct. Total 21

Miles patrolled for the month: 6,024 Year to Date:  36,465

Motor Vehicle Accidents for the month: 18 Year to Date: 103

Calls for Service for the month: 235 Year to Date:  1136

Chief Stewart stated that the officers participated in a blood donation at the St. Joseph’s Church. Also, the Department received a grant in the amount of $20,000 for in car computer systems.  Chief Stewart also addressed Mr. Myer’s complaint.  He stated that the Matamoras Rod and Gun Club was founded in 1919 and is a pre-existing use.  Supervisor Buchanan stated that there may be case law regarding this matter.

A motion was made by Supervisor Fischer to approve the Police Report for the month of June, 2016. The motion was seconded by Supervisor Buchanan and carries with all in favor.

FIRE DEPARTMENT:

Westfall Fire Department: Chief Llewellyn gave the report for June, 2016: 7 Automatic Fire Alarms, 6 Motor Vehicle Accidents, 1 Landing Zone,  3 Brush Fire, 2 Gas Leak, 4 Water Rescue,  2 Chief Investigation, 1 Assist EMS, 1 Assist Police and 4 Structure Fires.   The Total calls for June were 31.  The total fire calls year to date are 150.

The EMS Report for the month of June was as follows: 56 Calls in Westfall Township, 1 Call in Dingman Township, 3 calls in Milford Township, 7 calls in Milford Borough, 2 calls in Matamoras Borough, and 10 calls in Orange County, New York.  Total calls for June were 79.  Total EMS calls year to date are 416.

The combined Year to Date calls are 566.

Training for the month: Five drills/In-house training sessions held for 150 hours.

Fund Raising: July 4 weekend coin toss was successfully completed.  Westfall Fire Department Tricky Tray will be held on July 23 at DV School Complex.  The Pulled Pork Take-out dinner will be held on August 12, 2016.  Gun Raffle tickets are still available with the drawing to be held on September 10, 2016.

Other: The Department has taken delivery of the 2016 Pierce Arrow XT PUC Rescue Pumper.  The unit will be put into service this week.  A “wet down” celebration will be planned for September 10, 2016.  The Department will also be attending the Port Jervis Fire Department Inspection Day Parade on July 9, 2016.  An invitation is extended to the Township Supervisors to review the equipment on Friday, July 8, 2016 at 8:00 pm.

Chief Llewellyn also stated that the issues with the GO 24 Store have not been addressed concerning the installation of hydrant and knox box. They have not been installed.  Solicitor Bernathy directed Wayne Rohner to look into the matter and issue a violation notice if necessary.

A motion was made by Supervisor Fischer to approve the Westfall Fire Department report for the month of June, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Mill Rift Fire Department: Chief Lamb gave the report for the month of June, 2016:

6/1/16: Pump Drill-Fill Pool-Engine 1 and Engine 2

6/3/16: River Rescue

6/4/16: Chief Investigation

6/8/16: Work Night-Driver Training Engine 2

6/9/16: Wires down-Bluestone Boulevard

6/12/16: Wires down-River Road

Chairman Melvin asked Chief Lamb about adequate coverage. Chief Lamb confirmed that no calls have been missed to date.  Vice Chairman Dotey stated he and Chairman Melvin had a meeting regarding this matter and that after speaking with Mr. Swartwood from the Pike County Communication center, it has been confirmed that there is proper back up coverage if needed.

The Mill Rift Fire Department report was approved on a motion made by Supervisor Buchanan. The motion was seconded by Supervisor Fischer and carries with all in favor.

HIGHWAY DEPARTMENT:  Bill Schneider gave the report for June, 2016.  Mr. Schneider stated that the Department replaced culvert pipes throughout the Township and trimmed the Right of Way.  The department mowed the Township Grounds and did maintenance on equipment.  They also did shoulder work throughout the Township.  Mr. Schneider attended the Road Task Force meeting for the month of June.

The Highway Department Report for June, 2016 was approved on a motion made by Vice Chairman Dotey. The motion was seconded by Supervisor Fischer and carries with all in favor.

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for June, 2016.  He reported two building permits and five zoning permits for the month of June, 2016.  The fees totaled $1,231.02.

A motion was made by Supervisor Buchanan to approve the Building/Zoning Report for June, 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

EMERGENCY MANAGEMENT: No representative was present.  Chairman Melvin read the report for June, 2016, which was submitted by Mr. Ewbank.  Mr. Ewbank attended the NYCDEP Dam Emergency Action Plan Orientation Seminar on June 10, 2016 at the Best Western Inn.  He also noted that all Supervisors should take the NIMS Courses 100 and 700.

A motion was made by Supervisor Fischer to approve the EMA Report for June, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Chief Stewart stated that he received a notice earlier in the day confirming that the Pond Eddy Bridge will be closed to one lane in the middle of July.

CORRESPONDENCE:  On desk for review.   

OLD BUSINESS:  

Proposed Ordinance Change-Garden Apartment Requirements (Ordinance #166): Discussed earlier at Public Hearing held just prior to meeting at 6:45 pm.  A motion was made by Supervisor Buchanan to approve Ordinance #166.  The motion was seconded by Vice Chairman Dotey and carries with three in favor and one opposition.  Supervisor Fischer was opposed.

2003 Ford F-550 Mason Dump Truck-Bids: Secretary Hulse stated that one bid was received on the municibid auction in the amount of $10,000 (reserve not met).  She stated that no other bids were received.  A motion was made by Vice Chairman Dotey reject the bid and to re-advertise the truck sale in the newspaper only and not on Municibid with a minimum bid price of $14,500 with bids to be opened and reviewed at the August 1, 2016 Supervisor Regular Meeting.  The motion was seconded by Supervisor Fischer and carries with all in favor.

A motion was made by Supervisor Buchanan to add the Times Herald Record and the Pike County Dispatch to the list of approved Township newspapers for legal notice posting. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

A motion was made by Supervisor Buchanan to revise the motion for the truck advertisement to include posting the legal notice in all three approved township newspapers which include the Pocono Record, the Times Herald Record and the Pike County Dispatch. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Proposed Loitering Ordinance:   Discussion took place.  A motion was made by Chairman Melvin to schedule and advertise accordingly in the Pike County Dispatch and The Pocono Record for the Public Hearing for the proposed Loitering Ordinance for August 1, 2016 at 6:45 pm.  The motion was seconded by Supervisor Fischer and carries with three in favor and one opposition.  Supervisor Buchanan was opposed.  

Municipal Expansion: A motion was made by Supervisor Buchanan to appoint Chairman Dotey as the Township’s Representative for the Municipal Expansion project.  The motion was seconded by Chairman Melvin and carries with all in favor.

Vacation of Fire Tower road: Solicitor Bernathy read and explained the opinion letter which he provided to the Board. Discussion followed regarding Liquid Fuels funds and maintenance of Fire Tower Road.  Solicitor Bernathy stated he is waiting for a response from the District Administrator for the Bureau of Forestry and he will then report to the Board.  Chairman Melvin asked Mr. Schneider to provide a cost analysis including fuel and other expenses for the maintenance of Fire Tower Road.

No further action was taken. 

NEW BUSINESS: 

  1. Letter from Attorney James Brown regarding Matamoras Municipal Authority Hydrant Fees:  Solicitor Bernathy read the letter dated June 2, 2016 from the Matamoras Municipal Authority. A motion was made by Chairman Melvin to pay the outstanding hydrant rental invoice to the Matamoras Municipal Authority and to continue to pay the $680.00 quarterly fee. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 

2. Flood Insurance Renewal: A motion was made by Supervisor Buchanan to approve the payment of the Flood Insurance renewal with the coverage of $68,200.00. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 

3. Decker Lane Project-Easement Agreement: A motion was made by Supervisor Fischer to approve Solicitor Bernathy drafting and sending a letter and Easement Agreement to Christopher and Beverly Masone for work to be done on Decker Lane. The motion was seconded by Chairman Melvin and carries with all in favor.

4. Street Light at intersection of Cummins Hill Road/Route 6 & 209: A motion was made by Vice Chairman Dotey to approve the payment of installation (by electric service provider) and billing for a street light at the intersection of Schneider Lane/Route 6 & 209 and Cummins Hill/Route 6 & 209. The motion was seconded by Supervisor Fischer and carries with all in favor.

5. Mill Rift Museum-Donation: Solicitor Bernathy recited the law regarding donation regulation for second class townships. He said the requirement is that the organization is non-profit and that the donation would not exceed one tax mil. A motion was made by Supervisor Buchanan to donate $2,400.00 to the Mill Rift Museum contingent upon the organization being a non-profit entity. The motion was seconded by Vice Chairman Dotey and carries with all in favor.
