May 2, 2016

The regular meeting of the Westfall Township Board of Supervisors was held Monday, May 2, 2016 at 7:02 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan, Robert Bostinto and Paul Fischer; Solicitor, Thomas Farley (for Solicitor Robert Bernathy); Secretary, Jodi Hulse and Treasurer, Scott Myer. Also present were Road Master, Bill Schneider, Chief, Rob Llewellyn, Chief, Tom Lamb, Chief, Chad Stewart, Zoning Officer, Wayne Rohner, Emergency Management Assistant, Mike Fischetta, Jack Wurtz, Jason Ohliger, Michael Gable, Mr. and Mrs. Ed Zitone, Miles Hudgens, Nancy Buchanan, Marge Tonkin, George Billeci and approximately 10 members of the general public.

APPROVAL OF AGENDA: 

A motion was made by Vice Chairman Dotey to approve the agenda. The motion was seconded by Supervisor Fischer and carries with all in favor.  

PUBLIC COMMENT: Mr. Zitone addressed the Board regarding an issue related to a property bordering his property located at 136 Mountain Avenue.  His complaint is regarding garbage/debris and unregistered vehicles on the neighboring property.  Mr. Rohner stated the unlicensed vehicle was removed but garbage is still present.  Mr. Hudgens introduced himself at the owner of 138 Mountain Avenue and stated that he has a tenant occupying the property and that he cleaned up most of the garbage.  Solicitor Farley recommended Mr. Hudgens clean up the property and that he follow the ordinance.  Discussion followed.  

MINUTES: March 31, 2016 –Workshop Meeting- A motion was made by Vice Chairman Dotey to approve the March 31, 2016 minutes.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

April 4, 2016- Regular Meeting Minutes- A motion was made by Supervisor Buchanan to approve the April 4, 2016 minutes. The motion was seconded by Supervisor Fischer and carries with all in favor.

TREASURER’S REPORT: Mr. Myer gave the report for April, 2016 which is on file at the Township Office. He stated that two thirds of taxes have been collected in the approximate amount of $830,000.  All else is in line with budget.  A short discussion was held regarding the Earned Income Tax collection and collection process.

A motion was made by Supervisor Buchanan to approve the Treasurer’s Report. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

POLICE REPORT:  Chief Stewart gave the report for April, 2016.  The report reflects the following for the month of April, 2016:

Monthly Count of Offenses known to police:

3 assault, 16 larceny, 1 motor vehicle theft, 1 fraud, 3 vandalism, 1 sexual offense, 9 drug abuse, 2 DUI, and 9 Disorderly Conduct. Total 45

Monthly Count of Persons Charged for offenses:

2 Assault, 11 Larceny Theft, 9 Drug Abuse, 3 DUI and 3 Disorderly Conduct. Total 28

Miles patrolled for the month: 6,495 Year to Date:  24,278

Motor Vehicle Accidents for the month: 18 Year to Date: 63

Calls for Service for the month: 190 Year to Date:  706

A motion was made by Supervisor Buchanan to approve the Police Report for the month of April, 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

FIRE DEPARTMENT:

Mill Rift Fire Department: Chief Lamb read the report which stated the following for the month of April, 2016:

4/0/16: Wires down-White Birch Road-Engine 1

4/06/16: Work Night-Ran and checked all vehicles

4/10/16: CPR Class

4/12/16: Monthly Meeting

4/13/16: Work Night-Driver Training

4/20/16: Brush Fire-Doug Miller Road

4/20/16: Work Night-Engine 2 6×6

4/22/16: Smoke Inv-White Birch Road-Engine 1

4/23/16: Fire Alarm-464 Cummins Hill Road-Engine 1

4/24/16: Mutual Aid 32-Stand By-Engine 1

4/27/16: Work Night-Worked on Boat

Chief Lamb stated that driver training is progressing.

A motion was made by Vice Chairman Dotey to approve the Mill Rift Fire Department report for the month of April. The motion was seconded by Supervisor Bostinto and carries with all in favor.

Westfall Fire Department: Chief Llewellyn gave the report for April, 2016: 4 Automatic Fire Alarms, 2 Motor Vehicle Accidents, 1 Landing Zone,  7 Brush Fire, 1 gas leak, 1 Traffic Control, 1 Vehicle Fire, 1 Water Rescue, 2 Stand by transfer, 3 Chief Investigation, 1 Assist Police and 3 Structure Fires.   The Total calls for April were 27.  The total fire calls year to date are 89.

The EMS Report for the month of April was as follows: 48 Calls in Westfall Township, 1 Call in Dingman Township, 8 calls in Milford Township, 5 calls in Milford Borough, 5 calls in Matamoras Borough, 2 calls in Delaware Township and 8 calls in Orange County, New York.  Total calls for April were 77.  Total EMS calls year to date are 265.

The combined Year to Date calls are 354.

Training for the month: Four drills/In-house training sessions held for 136 hours.

Fund Raising: 3rd Annual Golf Outing at High Point Country Club will be held on May 16; Westfall Fire Department Tricky Tray will be held on July 23, 2016 at DV School Complex

Other: Construction of the replacement of Engine 2 is well underway.  Completion is scheduled for May 23, 2016.  Delivery will be in early June.  Requesting a meeting with the Supervisors to discuss staffing and services provided to the Township.

A motion was made by Supervisor Fischer to approve the Westfall Fire Department report for the month of April, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

HIGHWAY DEPARTMENT:  Bill Schneider gave the report for April, 2016. He reported that the Department did brush work and tractor work on Fire Tower Road shoulder.  They utilized the broom which was rented for one week from Pine Bush Equipment.  Mr. Schneider attended the Orange and Rockland Natural Gas Municipal Information Exchange.  Two members of the Department attended the Flagger Training Class. The Department installed culvert pipe on Heaters Hill.  The Township Office area lawn was mowed and compost area maintenance.  Mr. Schneider met with Joe Hudak from Kiley Associates, LLC for Heaters Hill and Decker Lane assessment.  He also contacted Ellen Enslin from the Pike County Conservation District regarding the Pond Drive stream cleanout.  A permit will be required and the information is available at the Township Office for review.  The Department also cleaned culvert pipes and ditches throughout the Township.  They also moved stone throughout the township for culvert replacement.  Mr. Schneider also provided information which was received from Penn DOT regarding the 1017 repair in Mill Rift.  He said the project will take roughly six to eight weeks and the road will be closed to one lane during the project.

The Highway Department Report for April, 2016 was approved on a motion made by Supervisor Fischer. The motion was seconded by Supervisor Bostinto and carries with all in favor.

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for April, 2016.  He reported one zoning permit and two building permits for April, 2016.  The fees totaled $214.00 for the month.

A motion was made by Supervisor Buchanan to approve the Building/Zoning Report for April, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Discussion followed regarding two properties which are in violation of Section 106D of the Zoning Ordinance.

A motion was made by Supervisor Fischer to move forward with filing a citation with the District Court Justice for the property owned by Mr. Altadonna. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

EMERGENCY MANAGEMENT: Mr. Fischetta presented the report for April, 2016.  The report reflected that April was a quiet month.  Robert Howard and Robert Ewbank attended the Gas Municipal Exchange on April 6, 2016 at the Orange County Fire Training Center.  He also stated that Orange and Rockland Utilities has scheduled a power outage to replace a step down transformer (regular scheduled maintenance) May 4, 2016 at 10:30 am.  This will affect resident of Mill Rift.  Alternate date is May 5, 2016.  This will affect 215 customers for about two hours.

Mr. Fischetta also stated that Mr. Ewbank will be attending a 2016 Community Response Team Drill Friday, May 13, 2016 at the Pike County Training Center. This event is being put on by Orange and Rockland Utilities.

A motion was made by Supervisor Buchanan to approve the EMA Report for April 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

CORRESPONDENCE:  On desk for review.   

OLD BUSINESS: 

Paddlers Point: Attorney Jason Ohliger was present.  He presented the Board with a proposed Zoning Ordinance Change regarding Garden Apartments.  He read the proposed changes to the Board.

A motion was made by Supervisor Buchanan to refer the matter to the Westfall Township Planning Commission for discussion. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Truck Bids: Secretary Hulse confirmed with the Board that there were no bids received after advertising.  A motion was made by Supervisor Buchanan to re-advertise in the Pocono record and Municibid on line auction with the same terms as previously approved.  The motion was seconded by Supervisor Fischer and carries with all in favor. 

NEW BUSINESS: 

Advertise for Paving Bids-Cummins Hill Road: A motion was made by Supervisor Buchanan to approve the advertising for paving bids on Cummins Hill Road specifically according to three separate project specification packets provided by Mr. Schneider.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Municipal Expansion: Discussion was held regarding a preliminary review for construction of a new Highway Department Building and Police Department Head Quarters on the Township property behind the existing Township Building. A motion was made by Vice Chairman Dotey to approve the hiring of Kiley Associates, LLC to do a perc test and engineering study to obtain project feasibility with a cost cap at $5,000.00.  The motion was seconded by Supervisor Buchanan and carries with all in favor.

Nancy Buchanan questioned access in case of flooding issues.

Alternate Sewage Enforcement Officer-Memo from Chris Wood/Letter of Interest from Richard Koehler: A motion was made by Supervisor Buchanan to appoint Richard Koehler as Alternate Sewage Enforcement Officer.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Solicitor Farley reminded Secretary Hulse to obtain a copy of Mr. Koehler’s Certification.

Pike County Planning Commission Member-Nominee:   Brief discussion followed.  No action was taken since the Board did not recommend any nominees for the vacancy.

Approval of street name “Blue Bird Court”-Marge Tonkin property 082.00-01-08 (Right of Way leading to Matamoras Water Authority property 082.00-01-07):   A motion was made by Supervisor Buchanan to approve the street name of “Blue Bird Court” and to send a letter to the Matamoras Municipal Authority to advise the cost of the street sign, the “no outlet” sign, and the repair and maintenance of the signs to be responsibility of the Authority.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Letter from NYC Environmental Protection-Invitation to Seminar and Workshop: No action was taken. 

SUBDIVISION REVIEW and ACTION:  

Westfall Entertainment Complex, Inc.-Lot Combination: George Billeci, Westfall Entertainment Complex, Inc. was present.  The Board was in receipt of letter dated April 28, 2016 from the Westfall Planning Board which recommended approval to the Board of Supervisors pending certain conditions.  Mr. Billeci submitted two waivers and copies of vesting deeds to the Board.  Conditions #4 and #5 on the letter were not satisfied.  Lengthy discussion followed.  A motion was made by Supervisor Buchanan to table this matter until the June 6, 2016 Supervisor Meeting to allow time for the applicant to satisfy the outstanding conditions.  The motion was seconded by Supervisor Fischer and carries with all in favor.     

EXECUTIVE SESSION: The Board held an Executive Session at 8:25 pm regarding personnel pertaining to the Westfall Township Fire Department.

The meeting was called back in session at 8:41 pm. No action was taken.

ADJOURNMENT: Meeting was adjourned at 8:41 p.m. on a motion by Supervisor Buchanan. Motion seconded by Vice Chairman Dotey and carries with all in favor.
