April 4, 2016 Regular Supervisor Meeting Minutes

April 4, 2016

The regular meeting of the Westfall Township Board of Supervisors was held Monday, April 4, 2016 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan, Robert Bostinto and Paul Fischer; Solicitor, Robert Bernathy; Secretary, Jodi Hulse and Treasurer, Scott Myer. Also present were Road Master, Bill Schneider, Chief, Rob Llewellyn, Chief, Tom Lamb, Chief, Chad Stewart, Zoning Officer, Wayne Rohner, Emergency Management, Assistant, Mike Fischetta, Josepth Hudak, Kiley Associates, LLC, Beth Koferl, Twila Decker, Jack Wurtz, Jason Ohliger, Thomas Shepstone, Michael Gable, Benjamin Ringus, Dipen Desai and approximately 15 members of the general public.

APPROVAL OF AGENDA:  

A motion was made by Vice Chairman Dotey to approve the agenda. The motion was seconded by Supervisor Bostinto and carries with all in favor.  

PUBLIC COMMENT: Twila Decker addressed the Board and asked the status of the proposed Cell Tower in Mill Rift.  Secretary Hulse said the project is approved but no permits applications have been received by the Township.  She also suggested there be “No Parking” signs required to be installed at The Grill in the area where the lines were painted over in the Township Right of Way.   

MINUTES: March 7, 2016-Regular Meeting Minutes:  A motion was made by Supervisor Buchanan to approve the minutes.  The motion was seconded by Supervisor Fischer and carries with one abstention and three in favor.  Chairman Melvin abstained due to his absence at the March 7, 2016 meeting.

TREASURER’S REPORT: Mr. Myer gave the report for March, 2016 which is on file at the Township Office. He stated the Liquid Fuel funds have been received.  The Katz payment was made.  Taxes are starting to come in.  Mr. Myer said all is in line with budget.

Supervisor Buchanan moved to approve the Treasurer’s Report. The motion was seconded by Vice Chairman Dotey  and carries with all in favor.

POLICE REPORT:  Chief Stewart gave the report for March, 2016.  The report reflects the following for the month of March, 2016:

Monthly Count of Offenses known to police:

1 Rape, 1 Assault, 1 Burglary, 6 Larceny Theft, 1 Motor Vehicle Theft, 7 Fraud, 1 Vandalism, 3 Drug Abuse, 2 DUI, 6 Disorderly Conduct and 1 all other offenses.  Total 30

Monthly Count of Persons Charged for offenses:

3 Larceny Theft, 1 Fraud, 3 Drug Abuse, 1 DUI, 1 Public Drunkeness, 3 Disorderly Conduct. Total 12

Miles patrolled for the month: 6,018 Year to Date:  17,783

Motor Vehicle Accidents for the month: 18 Year to Date: 45

Calls for Service for the month: 183 Year to Date:  515

Supervisor Buchanan asked Chief Stewart about an article in the Dispatch regarding the building condition. Chief Stewart said the Workers Compensation Auditor had issues for the past three years.  The conditions have been brought to the attention of the Borough.  Chief Stewart said the Borough hired Kiley Associates, LLC to do an assessment.  Mr. Hudak stated the report will be delivered tomorrow.  Discussion followed regarding condition and age of the building.

A motion was made by Supervisor Buchanan to approve the report.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

FIRE DEPARTMENT:

Westfall Fire Department: Chief Llewellyn gave the report for March,  2016: 3 Automatic Fire Alarms, 4 Motor Vehicle Accidents, 1 assist EMS,  6 Brush Fire, 3 Chief Investigations, 2 Stand By Transfer, 1 Water Rescue and 1 Structure Fires.   The Total calls for March were 25.  The total fire calls year to date are 38.

The EMS Report for the month of March was as follows: 40 Calls in Westfall Township, 4 Calls in Dingman Township, 12 calls in Milford Township, 2 calls in Milford Borough, 4 calls in Matamoras Borough, and 3 calls in Orange County, New York.  Total calls for February were 65.  Total EMS calls year to date are 173.

The combined Year to Date calls are 232.

Training for the month: Four drills/In-house training sessions held for 138 hours.

Other: 3rd Annual Golf Outing at High Point Country Club will be held on May 16; Westfall Fire Department Tricky Tray will be held on July 23, 2016 at DV School Complex; Pulled Pork Take Out Dinner will be held on August 12, 2016; Westfall Fire Department Hunters Raffle will be drawn on September 10, 2016 and Turkey Shoot Raffle will be held October 16, 2016.

Mill Rift Fire Department: Chief Lamb read the report which stated the following for the month of March, 2016:

Chief Lamb stated the Department sold their tanker. They will be purchasing a larger tanker from Greenville.  He also confirmed with Chairman Melvin that the Department still has drivers in training which usually takes about six months.

A motion was made by Supervisor Buchanan to approve the Westfall Fire Department report and the Mill Rift Fire Department Report for the Month of March, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

HIGHWAY DEPARTMENT:  Bill Schneider gave the report for March, 2016. He said the Department continued to take care of repairs from the previous storm.  They worked on Fire Tower Road which consisted of brush removal with brush hog and trimming the right of way.  The Department answered call from Pike County Communications Center for tree and wires down on Glass House Hill.  They closed the road and re-opened when power was restored.  They also took care of trees down on Cummins Hill Road and Doug Miller Road.  The Department worked on Mashipacong Island for ice diversion channel with Matamoras and Port Jervis.  Mr. Schneider took photos of before and after.  Secretary Hulse sent the photos by email to the DCNR.  Kuharchik was called in for repair on the red light located at Reuben Bell Drive.  The opticon for the Fire Department was repaired.  The master control box at the Lowe’s traffic signal was also repaired.

Mr. Schneider said an emergency repair was done on Heaters Hill by Morgan Site Contractors. He said the street broom will be arriving the week of April 18, 2016.  Mr. Schneider also worked on gathering information for the Workshop Meeting which was held on March 31, 2016.  He also attended the March Road Task Force Meeting.  The Department also hauled stone to the yard for pipe repair.  They also did maintenance on equipment (chipper and lawn mower).  Mr. Schneider met with Scott Maciak regarding paving bids for the upcoming summer season.

The Highway Report was approved on a motion made by Vice Chairman Dotey. The motion was seconded by  Supervisor Fischer and carries with all in favor.

BUILDING/ZONING REPORT:  Wayne Rohner gave the report for March, 2016.  He reported one zoning permit and five building permits for March, 2016.  The fees totaled $2,718.36 for the month.

A motion was made by Supervisor Buchanan to approve the Building/Zoning Report for February, 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

EMERGENCY MANAGEMENT: Mr. Fischetta presented the report for March, 2016.  The report reflected that March was a relatively quiet month.  Mr. Fischetta attended the OEM Meeting on March 30, 2016.  Also, Mr. Ewbank will be attending the Gas Municipal Information Exchange on Wednesday, April 6, 2016 in Goshen NY which is being put on by Orange and Rockland Utility.

A motion was made by Supervisor Bostinto to approve the EMA Report for March 2016. The motion was seconded by Supervisor Fischer and carries with all in favor.

CORRESPONDENCE:  On desk for review.   

OLD BUSINESS:  

Township Building Generator: A motion was made by Supervisor Buchanan to reject bid received and re-advertise the project with specifications/bid package from Kiley Associates, LLC.  The motion was seconded by Supervisor Fischer and carries with all in favor. 

Engineering-Future Road Projects: A motion was made by Supervisor Buchanan to approve the hiring of Kiley Associates to provide the cost of engineering study for the following areas of concern: 

  • Heaters Hill-across from Henchel Road
  • Heaters Hill-Signware Court to culvert wall area
  • Heaters Hill-South of Memis Lane
  • Mill Rift Road-retaining wall area
  • Turnaround area at the end of Mill Rift
  • Decker Lane

The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Apply for DEP Permit-Stream Maintenance-Drillers Pond Outlet: A motion was made by Supervisor Buchanan to send a letter to Matamoras Borough requesting to participate in the Joint DEP Permit process as done previously.  The motion was seconded by Vice Chairman Dotey and carries with all in favor. 

Advertise Sale of 2003 Ford F-550 Mason Dump: A motion was made by Supervisor Buchanan to advertise specifications for the sale of the 2003 Ford F-550 Mason Dump with a minimum bid price of $17,000.00.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.  

Resolution 2016-1 Municipal Authority of the Borough of Matamoras (Water Mains): Solicitor Beranthy read the proposed Resolution.  A motion was made by Supervisor Buchanan to approve the resolution.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

NEW BUSINESS:  

Paddlers Point-Jack Wurtz-Informal Presentation: Representatives present:  Mr. Jack Wurtz, Attorney Jason Ohliger, Mr. Thomas Shepstone and Michael Gable, Engineer.  The applicant appeared on an informal basis and presented a proposal sketch plan for garden apartments on the subject parcel.  After lengthy discussion, the applicant agreed to submit a proposed amendment to the Westfall Township Zoning Ordinance for the Supervisors review and consideration.  It was agreed that the sketch plan as presented was not in conformance with the requirements of the Westfall Township Zoning Ordinance.  No decisions were made or agreements reached between the applicant and the Township.  Solicitor Bernathy noted that any ordinance amendment would need to forwarded to the Pike County Planning Commission, Westfall Township Planning Commission and thereafter scheduled for Public Hearing with advanced notice.

During the discussion a motion was made by Supervisor Buchanan to approve a change of ordinance. The motion was seconded by Vice Chairman Dotey.  Further discussion followed.  Supervisor Buchanan withdrew his motion.  Therefore, the motion did not carry.

Chairman Melvin advised Secretary Hulse to place the matter on the agenda for the May 2, 2016 Supervisor Meeting.

Schedule Spring Clean Up Day: A motion was made by Supervisor Buchanan to schedule and advertise Spring Clean Up Day for May 7, 2016 from the hours of 8:00 am and 2:00 pm with the same pricing schedule as 2015.  The motion was seconded by Vice Chairman Melvin and carries with all in favor.

Letter of Resignation-Twila Decker-Auditor Position: A motion was made by Vice Chairman Dotey to accept Ms. Decker’s resignations.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Letter of Interest-Bessy Gurian-Auditor Position: A motion was made by Supervisor Buchanan to appoint Ms. Gurian to fill the current vacancy for Auditor.  The motion was seconded by Supervisor Fischer and carries with all in favor.

Zoning Hearing Board Vacancy: Secretary Hulse stated there is a vacancy on the Zoning Hearing Board since Ann Marie Catalano passed away.  A motion was made by Supervisor Buchanan to advertise all township vacancies.  The motion was seconded by Supervisor Bostinto and carries with all in favor.

Westfall Hospitality-Hampton Inn-Revision of Tax Assessment:  A motion was made by Supervisor Fischer to approve the revision of tax assessment for year 2016 according to the notice from the Pike County Tax Administration dated March 22, 2016.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Act 14-Municipal Notification-Rivers Edge Town Homes: A motion was made by Supervisor Buchanan to acknowledge receipt of the Municipal Notification.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Letter from Anita Godby-Heaters Hill Storm Water Matter: Beth Koferl was present for her mother.  Discussion followed.  The Board added this area to the engineer review list under Old Business #2.   

SUBDIVISION REVIEW and ACTION:  

Tri-State RV Park-Charles Shay:  Representative present:  Charles Shay

    Solicitor Bernathy reviewed the conditions with the Board.  A motion was made by Supervisor Buchanan to approve the application with the following conditions:

  1. Zoning Ordinance Section 501.B- A letter of adequacy from the Pike County Conservation District (PCCD) for Erosion and Sediment (E&S) Control should be provided prior to any earth disturbance on the site. No E&S Plan or Narrative was submitted with the application.
  2. Subdivision and Land Development Ordinance Section 502.4- Documentation from the Westfall Township Sewage Enforcement Officer shall be provided indicating that adequate sewage for the existing sewage and proposed increase in the number of campsites is currently available within the existing on-site sewage system. Verification of adequate water supply for all existing and proposed uses shall be provided. The letter of adequacy should clarify capacity for proposed ten sites, pavilion and the limit of occupants for such capacity.
  3. General- A construction detail for the proposed gravel drive and gravel campsite areas shall be provided.
  4. General- Construction details of all proposed underground utilities shall be provided.          The motion was seconded by Supervisor Fischer and carries with all in favor.

AR Realty, LLC-GO 24 Store-Revised Final Land Development: Representative: John Fuller, P.E.

Solicitor Bernathy reviewed the conditions with the Board. Mr. Fuller explained the revisions. A motion was made by Supervisor Buchanan to approve the application with the following conditions:

  1. Zoning Ordinance: Section 804.C.1-Required landscaping needs to be installed
  2. General: Note #15 should be added to the general notes, which states that No Parking of Commercial Vehicles will be permitted on Stella Street including the installation of no parking signs.
  3. General: It was requested by the Planning Commission that the LP Tank swap cage be relocated away from the property line and placed closer to the building.-Cage is required to be relocated
  4. General: The final course of pavement and the required pervious pavement has not been installed. Pavement application required.
  5. General: Site pole lighting has not been installed-Installation required
  6. General: Fire Hydrant at the corner of Stella Street and SR 6/209 has not been installed. Installation required.
  7. Stacking of five cars will be indicated/noted on final plan.
  8. Drive through window sales of fireworks and alcohol are prohibited.Discussion was held regarding a no parking ordinance.

The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Arrump, LLC-Roy Rogers/Huddle House (sit down restaurant)-Revised Land Development: Representative: Benjamin Ringus and Dipen Desai

Solicitor Bernathy reviewed the conditions with the Board. Mr. Ringus explained the revisions.  Discussion followed.  A motion was made by Supervisor Buchanan to approve the application with the following conditions and waivers:

  1. Review letter from Pike County Conservation District is required.
  2. Zoning Ordinance: 501.B-A letter of adequacy from the Pike County Conservation District (PCCD) for erosion and Sediment (E&S) Control of the revised plan should be provided prior to any earth disturbance on the site.
  3. Zoning Ordinance: 701.B-A Zoning Permit is required for all proposed business signage
  4. Subdivision and Land Development Ordinance: 403.4.4-A letter of adequacy from the Pike County Conservation District (PCCD) for Erosion and Sediment (E&S) Control of the revised plan should be provided prior to any earth disturbance on the site.

March 31, 2016 Supervisor Workshop Meeting Minutes

Westfall Township, Matamoras, PA March 31, 2016 

The Westfall Township Board of Supervisors held a workshop meeting on Thursday, March 31, 2016 at 7:02 pm at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin; Vice Chairman, Jerry Dotey; Supervisors, Lester Buchanan, Robert Bostinto and Paul Fischer; Solicitor, Robert Bernathy and Secretary, Jodi Hulse. Also present were Road Master, William Schneider; Chief Rob Llewellyn; Chief Tom Lamb, John Dalton, Ralph Burger, Mr. and Mrs. Joseph Sherlock.  Approximately 12 members of the general public were in attendance.

PLEDGE OF ALLEGIANCE took place.

PUBLIC COMMENT: There was no public comment.

OLD BUSINESS:  

Township Building Generator: Discussion followed regarding the project and the expense. Vice Chairman Dotey mentioned a diesel generator which was donated to the Mill Rift Fire Department from the Pike County Administration Building.  Mr. Burger was present and answered a few general questions.  Supervisor Buchanan suggested moving the Emergency Management Office to the Township Building if the installation eventually takes place.

Additional discussion followed.

Mr. Burger stated the unit would take three weeks to come in and then be installed. Mr. Dalton questioned annual maintenance.  Mr. Burger confirmed the cost would be $600 to $700 per year for full service.

Chairman Melvin advised Secretary Hulse to place the matter on the agenda for the April 4, 2016 Supervisor Meeting.

Highway Department: Mr. Schneider referenced an outline which he presented to the Board. He presented photos of four areas of concern (Heaters Hill across from Henchel Road, Wall from Signware Court, River Road-Mill Rift, and Decker Lane) which are in order of priority.  Mr. Bernathy confirmed with Mr. Schneider that none of the issues affect the health, safety and welfare of the residents or public.

Discussion followed. Vice Chairman Melvin advised Secretary Hulse to place this matter (Engineering for future road projects) on the agenda for the April 4, 2016 Supervisor Meeting.  And to also ask Mr. Hudak from Kiley Associates, LLC to be present.

Next on Mr. Schneider’s outline was DEP Permit for clearing Stream at Driller’s Pond. Discussion followed.  Chairman Melvin advised Secretary Hulse to place this matter (Apply for DEP Permit) on the agenda for the April 4, 2016 Supervisor Meeting.

The next matter on Mr. Schneider’s outline was Relocation of the curve in the road near Polatnick property in Mill Rift specifically approval for surveyor to mark out the area. Mr. Schneider explained and showed the map to the Board.  Supervisor Buchanan advised Secretary Hulse to place the matter on the agenda of the Supervisor meeting following Mr. Smith, Surveyor’s response with estimate.

Number four on Mr. Schneider’s outline was “Tort Liability”. He explained the procedure he and the Highway Deparment follows to make sure of compliance for Worker’s Comp requirements.  Discussion followed.  Mr. Schneider wanted to make the Board aware of his procedure.  He reminded the Board that he provided the information to them in the past and also to Solicitor Bernathy for review.

The next item on Mr. Schneider’s outline list was “Sale of 2003 F-550 Mason Dump Truck with plow and sander”. Discussion followed.  Chairman Melvin advised Secretary Hulse to place this matter on the agenda for the April 4, 2016 Supervisor Meeting for review and action.

The next matter discussed was “Guide Rail Replacement”. Mr. Schneider discussed a few areas which need attention.  The Board recommended he obtain pricing and present it at a later date for discussion.

There was a brief discussion regarding curbs and trees in the Township right of ways. Mr. Schneider stated he has brought this to the attention of the Planning Commission for future consideration.

Fire Hydrant Snow removal was the next item on Mr. Schneider’s outline. Solicitor Bernathy stated this needs to be addressed and he is working on it with the Municipal Authority of the Borough of Matamoras.  He addressed the proposed Resolution regarding water line replacement with the Board.  Chairman Melvin advised Secretary Hulse to place the matter (Resolution with Matamoras Water Authority) on the agenda for the April 4, 2016 Supervisor Meeting.

Mr. Schneider stated there is an issue throughout the Township regarding draining of private roadways onto Township roadways. Discussion followed.

The next matter on Mr. Schneider’s outline was Highway Occupancy Permits. He stated someone other than the Road Master should be approving and signing the permits if water runoff is affecting other properties.  He suggested this is an engineering matter.

Mr. and Mrs. Sherlock addressed the Board. They stated that nothing ever changes.  Discussion took place regarding water runoff issues on their property on Delaware Drive.  Additional discussion followed.  Solicitor Bernathy explained that they may possible have a private cause of action against an adjacent property owner for trespass of water.  Discussion was also held regarding the responsibilities of the Board of Supervisors pertaining to Building and Zoning.  He stated that the Board does not regulate residential development.

The next matter on Mr. Schneider’s outline was the Pearce House “cut across”. He showed photos to the Board.

Discussion took place regarding the Pearce House Highway Occupancy Permit.

ADJOURNMENT: Meeting adjourned at 8:40 pm on a motion by Vice Chairman Dotey, seconded by Supervisor Bostinto. Motion carried with all in favor.
