The regular meeting of the Westfall Township Board of Supervisors was held Monday, December 7, 2015 at 7:00 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Chairman, Robert Melvin (arrived at 7:05), Vice Chairman, Jerry Dotey; Supervisors; Lester Buchanan and Robert Bostinto; Solicitor, Robert Bernathy; Secretary, Jodi Hulse and Treasurer, Scott Myer. Also present were Road Master, Bill Schneider, Chief, Rob Llewellyn, Chief, Chad Stewart, Assistant Emergency Management Coordinator, Mike Fischetta, Ed Isaacson, Mill Rift Fire Department, John Dalton, Nancy Buchanan and approximately 4 members of the general public.

Supervisor Raymond Banach and Zoning Officer Wayne Rohner were not present.

APPROVAL OF AGENDA:  

Vice Chairman Dotey added “Personnel” to the executive session to be held later in the meeting. Also, Supervisor Buchanan added #3 under “Old Business” as “The Grill Parking Spaces”. 

A motion was made by Supervisor Buchanan to approve the agenda. The motion was seconded by Supervisor Bostinto and carries with all in favor.  

PUBLIC COMMENT: 

Twila Decker addressed the Board. She spoke about the issue with the parking spaces at The Grill Restaurant on Maple Street.

John Dalton addressed the Board. He spoke about a matter involving Cable Vision and a possible franchise agreement.  

MINUTES:

November 2, 2015-Regular Meeting Minutes: A motion was made by Supervisor Bostinto to approve the minutes. The motion was seconded by Supervisor Buchanan and carries with all in favor.

November 16, 2015-Special Meeting Minutes: A motion was made by Supervisor Buchanan to approve the minutes. The motion was seconded by Supervisor Bostinto and carries with all in favor.

TREASURER’S REPORT: Mr. Myer gave the report for November, 2015 which is on file at the Township Office. He stated that the Earned Income Tax collection is in line with what the Berkheimer Tax Collector projected.  All else is in line with budget and expenses.  The last Katz payment will be made by the end of the year.

Supervisor Buchanan moved to approve the Treasurer’s Report. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

POLICE REPORT:  Chief Stewart gave the report for November, 2015.  The report reflects the following for the month of November, 2015:

Monthly Count of Offenses known to police:

12 Larceny Theft, 2 Fraud, 2 Vandalism, 1 Weapons, 1 Sex Offense, 7 Drug Abuse, 2 DUI, 2 Drunkeness, and 7 Disorderly conduct. Total 36

Monthly Count of Persons Charged for offenses:

2 Larceny Theft, 1 Recovery of Stolen Property, 6 Drug Abuse, 1 DUI, 2 Drunkeness, and 2 disorderly conduct. Total 14

Miles patrolled for the month: 5,304 Year to Date:  55,393

Motor Vehicle Accidents for the month: 12 Year to Date: 181

Calls for Service for the month: 151 Year to Date:  2,174

A motion was made by Vice Chairman Dotey to approve the report. The motion was seconded by Supervisor Buchanan and carries with all in favor.

FIRE DEPARTMENT:

Mill Rift Fire Department:   Ed Isaacson read the report which stated the following for November, 2015:

November 2, 2015: Automatic Alarm @ Lowes

November 4, 2015: work night, checked equipment-Engine 1, tanker

November 10, 2015: Monthly Meeting

November 10, 2015: Chief Investigation-189 Bluestone Boulevard

November 18, 2015: work night, went over pump-Engine 2

November 25, 2015: work night-generator/maintenance-Scott packs/maintenance

Total Equipment Hour Year to Date: 217

Total Man Hours for the Year: 1935

Westfall Fire Department:  Chief Llewellyn read the report which stated the following for the month of November,  2015:

4 Automatic Fire Alarms, 2 Bush Fire, 2 Landing Zone, 1 Pedestrian Struck, 1 Vehicle Fire, 2 Motor Vehicle Accidents, and 3 Structure Fires.  The Total calls for November were 15.  The total fire calls year to date are 276.

The EMS Report for the month of November was as follows: 45 Calls in Westfall Township, 14 Calls to cover Squad 33, and 8 calls to cover Squad 19.  Total calls for October were 67.  Total EMS calls year to date are 805.

Training: Three in-house training sessions were held during November for a total of 114 hours.  Three members completed 160 hours of EMT Training.  Participated in Orange and Rockland Tri-State Emergency Preparedness Drill.

Other: WTVFD has designed a replacement for the 1986 Pierce Arrow Engine. Build of the new unit will begin in early December.  Target delivery is scheduled for May 2016.  WTVFD hosted a blood drive with the American Red Cross on November 20, 2015.

A motion was made by Supervisor Buchanan to approve the Mill Rift Fire Department Report and the Westfall Fire Department Report. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

HIGHWAY DEPARTMENT:  Bill Schneider gave the report for November, 2015.  He stated that he attended an on-site meeting with the Pike County Conservation Department Representative regarding the Culvert Pipe Replacement on Bluestone Boulevard which they assisted with the Low Volume Road Program Grant.  He attended the winter maintenance workshop hosted by Penn DOT at the Conservation District Office.  The Department continued to do cold patch repair throughout the township.  They installed new signs at bridge area on Bluestone Boulevard.  The department also did maintenance on equipment.  They put new tires on the 2008 Chevy.  Also, new brakes were done on the 2008 Freightliner at the dealer.  The department checked all culvert pipes throughout the township.  Mr. Schneider stated that the paving on Bluestone Boulevard is complete.  He said that PennDOT may do some shoulder repair in the area in front of the Township Building.  Mr. Schneider checked all township lights during the power outage this past week.  He said the battery backup systems were working perfectly which he considers a great investment.

The Highway Report was approved on a motion made by Supervisor Buchanan. The motion was seconded by Supervisor Bostinto and carries with all in favor.

BUILDING/ZONING REPORT:  Secretary Hulse read the report.  She said there were four building permits for the month of November totaling 2,079.40 in fees and 4 zoning permits for the month of November totaling 425.00 in fees.

A motion was made by Supervisor Buchanan to approve the Building and Zoning Report for November of 2015. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

EMERGENCY MANAGEMENT: Mike Fischetta read the report which was provided by Mr. Ewbank.  It stated that November was a relatively quiet month.  Mr. Ellison, Mr. Howard and Mr. Fischetta attended the Orange and Rockland Tri-State First Responder drill on November 7, 2015.

A motion was made by Supervisor Bostinto to approve the report. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

OLD BUSINESS:  

1. New Contract-2015 Low Volume Road Program-Grant: A motion was made by Vice Chairman Dotey to approve the signing of the 2015 Low Volume Road Program Grant which reflects a grant amount of $40,000.00. The motion was seconded by Supervisor Bostinto and carries with all in favor.

2.Municipal Authority of the Borough of Matamoras-Hydrant Rental Invoice: Discussion followed. No action taken

3. The Grill Restaurant-Parking Spaces: Discussion followed regarding 4 parking spaces in the township right of way at the Grill Restaurant on the Maple Road side of the lot. A motion was made by Supervisor Buchanan to direct Solicitor Bernathy to prepare and send a letter to the owner of the restaurant requesting the lines be removed and that the owner place temporary cones/signs for their patrons. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

NEW BUSINESS: 

1. Police Contract-Amendment to reflect rotation in member term: A motion was made by Supervisor Buchanan to agree to the Regionalization Agreement amendment to reflect the appointment at the 2016 Reorganization Meeting of two members to serve on the EPRPD Commission. One appointee will serve a one year term and one appointee will serve a two year term. After the 2016 appointments are made, all following appointments will be two years. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

2. Secretary-Vacation Approval: A motion was made by Supervisor Buchanan to approve Ms. Hulse’s vacation dates as November 25, 2015, December 23, 2015, December 24, 2015 (1/2 day), December 28, 2015, December 29, 2015, December 30, 2015 and December 31, 2015 (1/2 day). The motion was seconded by Supervisor Bostinto and carries with all in favor.

A motion was made by Supervisor Buchanan to approve payment to Ms. Hulse for the holidays which fell on Fridays in 2015 more specifically, July 4th, Good Friday, Friday after Thanksgiving, and Christmas.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

3. Bluestone Boulevard Paving Project-Invoice Approval: A motion was made by Supervisor Buchanan to approve payment of the Wayco, Inc. invoice in the amount of $86,506.46 which was $15,072.10 over the awarded bid amount due to the length of paving area. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

 

Mr. Schneider confirmed that all costs were the same as awarded bid amount just that the length of paving increased.

 

4. Resignation of Paul Fischer, Auditor: A motion was made by Vice Chairman Dotey to accept Mr. Fischer’s resignation as Auditor. The motion was seconded by Supervisor Bostinto and carries with all in favor. 

A motion was made by Supervisor Buchanan to appoint Twila Decker as Auditor effective January 4, 2016. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

5. Storage Tank Insurance Renewal Application: A motion was made by Vice Chairman Dotey to approve the application and to have Mr. Schneider fill it out for Supervisor Buchanan’s signature. The motion was seconded by Supervisor Buchanan and carries with all in favor.

 

 

6. Flood Insurance Premium Notice: A motion was made by Vice Chairman Dotey to keep the coverage the same as last year (Option 2 on the invoice) and to pay the invoice in the amount of $2,472.00. The motion was seconded by Supervisor Bostinto and carries with all in favor. 

7.NEPA Membership: No action taken. 

8. Approval of additional snow plow drivers: A motion was made by Supervisor Buchanan to hire Mr. Richard Mai, Jr. as a part time CDL driver at the rate of $15.00 per hour for snow plowing purposes contingent upon Mr. Mai providing proof of physical documentation and that he will comply with the employee manual. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

 

9. Camera Purchase/Zoning Purposes: A motion was made by Supervisor Buchanan to approve the purchase of a camera for the Zoning Officer use at a cost not to exceed $200.00. The motion was seconded by Supervisor Bostinto and carries with all in favor.

 

10. Letter from Al-Dana Mechanical Contractors-request to be added to contractor list: A motion was made by Supervisor Buchanan to ad Al-Dana Contractors to the contractor list. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

Mr. Schneider addressed the board with an electricity concern at the Township Building especially during the election. He suggested an emergency generator be installed.  Supervisor Buchanan added #11 under “New Business”.

11. Generator Quotes for Township Building: Supervisor Buchanan suggested Mr. Schneider obtain a spec sheet from the first company from our list in alphabetical order. A decision will be made at a later date regarding advertising for bids.

 

SUBDIVISION REVIEW and ACTION:

 

NONE

 

EXECUTIVE SESSION: An executive session was called at 8:08 for the purposes of litigation and personnel.

 

The meeting was called back to order at 8:22 pm.

 

A motion was made by Supervisor Buchanan to approve the Settlement Agreement between Westfall Township and Darwin National Assurance Company (a/k/a Allied World Specialty Insurance Company) and Allied World Assurance Company (regarding the Dombrosky litigation) with a settlement amount of $325,000.00. The motion was seconded by Vice Chairman Dotey and carries with all in favor.

 

Chairman Melvin said it is the intention of the Board to reduce the general fund mils by 3 at the budget meeting on December 17, 2015.

 

ADJOURNMENT: Meeting was adjourned at 8:27 p.m. on a motion by Supervisor Buchanan. Motion seconded by Vice Chairman Dotey and carries with all in favor.
