Supervisor Meeting Minutes-March 2, 2015

Westfall Township, Matamoras, PA

March 2, 2015

The regular meeting of the Westfall Township Board of Supervisors was held Monday, March 2, 2015 at 7:05 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Vice Chairman, Robert Melvin; Supervisors, Raymond Banach, Lester J. Buchanan and Jerry Dotey; Solicitor, Robert Bernathy, and Secretary, Jodi Hulse. Also present were Scott Myer, Bill Schneider, Chad Stewart, Robert Ewbank, John Dalton, Laurie Pearce, Rob Llewellyn, John Bell, William Hessling, Paul Fischer, Pete Sigretto, Aileen Sullivan, James Hunt, Attorney Ashleigh Zimmerman and approximately 15 members of the general public.

Supervisor Bostinto was not present.

APPROVAL OF AGENDA:  

Secretary Hulse removed #5 under “New Business” and added #6 to “New Business” as Appointment of voting delegate to authorize the Chairman to cast the Board’s vote for purposes of a quorum on any matters which may come before the annual meeting of MRM Property & Liability Trust on April 9, 2015 and #7 to “New Business” as general policy for posting of non-profit links on township website.

Supervisor Banach added #8 to “New Business” as Discussion of unauthorized taking of township property by former Supervisor/Police Commissioner.

EXECUTIVE SESSION:  NONE

PUBLIC COMMENT:   Robert Ewbank addressed Solicitor Bernathy and asked the status of the several complaints he filed regarding burning by his neighbor.  Also, complaint filed against 1005 Pennsylvania Avenue, LLC regarding fence issue.  Solicitor Bernathy said he has a letter drafted for the first issue and Mr. Rendleman is working on the second issue.  A letter will be sent out this week as to the status and proposal to fix.

Vice Chairman Melvin suggested moving #1 under “Old Business” forward.  Solicitor Bernathy read his legal opinion.  James Hunt from Berkheimer Associates was present.  He gave a presentation regarding “Earned Income Tax”.   John Bell, Superintendent, and William Hessling, Business Manager, were also present from the Delaware Valley School District.   They provided information and analysis handout sheet regarding “Earned Income Tax” and spoke about the tax.

Discussion/Comments took place.

The Supervisors asked if there were any questions or comments from the public.  None were received.

A motion was made by Supervisor Buchanan to move forward and schedule the Public Hearing.  The motion was seconded by Vice Chairman Melvin and carries with three in favor and one opposition.  Supervisor Banach was in opposition.

MINUTES:  A motion was made by Supervisor Banach to approve the February 2, 2015 Public Hearing Minutes.  The motion was seconded by Supervisor Buchanan.  The motion carries with all in favor.

A motion was made by Supervisor Banach to approve the February 2, 2015 Regular Meeting Minutes.  The motion was seconded by Supervisor Buchanan and carries with all in favor.

TREASURER’S REPORT:  Scott Myer gave the report.   He said the income has been slow for January and February.  We received our Tax Anticipation Note in the amount of $100,000.  The Liquid Fuels Funds will be arriving in March.  Tax Revenue will be coming in soon also.

A motion was made by Supervisor Banach to accept the Treasurer’s Report.  The motion was seconded by Supervisor Buchanan and carries with all in favor.

POLICE REPORT:  Chad Stewart gave the Police Report.  The report was for the month of February, 2015.   The following are the monthly count of offenses known to Police:  2 Burglary, 5 Larceny Theft, 1 Fraud, 3 Vandalism, 1 Sex Offense, 2 Drug Abuse, 4 Disorderly Conduct and 2 all other offenses.  The following is the monthly count of persons charged for offenses: 3 Larceny Theft, 1 Drug Abuse, 1 Disorderly Conduct and 1 all other offenses.  Miles patrolled for the month were 5,572 Year to Date 10, 332.    Motor vehicle accidents for the month were 17 Year to Date 33.  Call for service for the month were 141 Year to Date 283.

Chief Stewart said Officer Prey and Officer Parks responded to a call and rescued two people from a burning building.

Supervisor Buchanan moved to approve the Police Report.  Motion was seconded by Supervisor Dotey and carries with all in favor.

FIRE DEPARTMENT:

Westfall Fire Department:   Rob Llewellyn gave the reports for January and February 2015.  They were as follows:

January 2015:  7 automatic fire alarms; 13 motor vehicle accidents; 1 chief investigation; 1 landing zone; 1 assist EMS; 1 vehicle fire; 1 water rescue; 1 trash/dumpster fire and 5 structure fires.  Total calls for January were 31.  Total man hours for January were 517.25 and total man hours ytd are 517.25.

EMS Report for January: 35 calls in Westfall Township; 33 calls to cover squad 33 and 10 calls to cover Squad 19.  78 calls for January.  155.6 Man hours for January.  155.6 calls ytd.

Three members completed 16 hours of ice rescue training.  Four drills/in-house training sessions held for 190 hours.

February 2015:  2 automatic fire alarms; 6 motor vehicle accidents; 2 chief investigation; 2 landing zone; 2 public service; 1 utility/tree and two structure fires.  Total calls for February were 17.  Total man hours for February were 207.75.  48 fire calls ytd.  725 man hours ytd.

EMS Report for February:  38 calls in Westfall Township; 27 calls to cover Squad 33; 10 calls to cover Squad 19.  75 calls for February.  159.4 man hours for February.  153 Total EMS calls ytd.  315 man hours ytd.

15 members completed CPR/AED Certification.  Four drills/in-house training sessions held for 180 hours.

The Westfall Fire Department Fire Department Reports were accepted by a motion made by Supervisor Buchanan.  The motion was seconded by Supervisor Banach and carries with all in favor.

Mill Rift Fire Department Report:  No report submitted.

HIGHWAY DEPARTMENT:   Bill Schneider gave the report for February, 2015.   Mr. Schneider said he attended the Road Task Force meeting.  He also had a meeting with Aileen Sullivan from Orange and Rockland regarding poles on Schneider Lane and a meeting with Pike County Conservation District regarding grant applications for two projects in the Township.  Process is now started.  The Highway Department handled numerous winter storms and kept the roads passable.  They maintained equipment.  There were new tires put on Freightliner.

The Highway Department Report was accepted by a motion made by Supervisor Dotey.  The motion was seconded by Supervisor Banach and carries with all in favor.

BUILDING/ZONING REPORT:  Michael Rendleman gave the report stating there was one building permit for the month of February totaling $514.00 in permit fees received.

Supervisor Dotey moved to approve the report. Motion was seconded by Supervisor Banach and carries with all in favor.

EMERGENCY MANAGEMENT:  Mr. Ewbank said there was not much to report in February.  He reminded the Board that all Supervisors should have the NIMS Courses completed.

Supervisor Buchanan moved to approve the Emergency Management Report.  The motion was seconded by Supervisor Banach and carries with all in favor.

CORRESPONDENCE:  On desk for review.   

OLD BUSINESS:   

Earned Income Tax:  Took place earlier in the meeting after Public Comment.

Appointment of Deputy Tax Collector:  A motion was made by Supervisor Buchanan to appoint Kim Pearce as Deputy Tax Collector.  The motion was seconded by Vice Chairman Melvin and carries with all in favor.

Attorney Ashleigh Zimmerman confirmed there would be no compensation to Mr. Pearce for the position.

Advertise Public Hearing-Revision of Ordinance 161-PSATS Unemployment Compensation Group Trust and Pennsylvania Townships Health Insurance Cooperative Trust:  A motion was made by Supervisor Buchanan to advertise and schedule the Public Hearing for April 6, 2015 at 6:45 pm.  The motion was seconded by Vice Chairman Melvin and carries with all in favor.

A motion was made by Supervisor Buchanan to schedule the Public Hearing for the Earned Income Tax for April 6, 2015 at 7:00 pm with the regular meeting to follow.  The motion was seconded by Supervisor Dotey and carries with three in favor and one opposition.  Supervisor Banach was in opposition.

Letter from James Baron, Esquire regarding Matamoras Municipal Authority-Hydrant Fees/Westfall Representation:  Solicitor Bernathy said will do research to see if there was an agreement in the past.  Discussion followed.  

NEW BUSINESS:  

Appointment of Chairman/Board Positions:  A motion was made by Supervisor Buchanan to appoint Robert Melvin as Chairman.  The motion was seconded by Supervisor Banach and carries with all in favor.

A motion was made by Supervisor Buchanan to appoint Jerry Dotey as Vice Chairman.  The motion was seconded by Supervisor Banach and carries with all in favor.

A motion was made by Supervisor Buchanan to appoint Robert Bostinto as Pro Tem.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Letter from Westfall Municipal Authority –Stipend Increase Request:  A motion was made by Supervisor Buchanan to approve the stipend increase of $25.00 per member per meeting.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Resolution 2015-1 Appointment of Authorized Representative for Berkheimer Tax Information:  A motion was made by Vice Chairman Dotey to appoint Secretary Hulse as representative.  The motion was seconded by Supervisor Buchanan and carries with all in favor.

A motion was made by Supervisor Banach for Secretary Hulse to send a letter to Berkheimer to approve the automatic deposit of the Amusement Tax instead of sending a check for payment.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Pike County Power and Light-Pole located at Tractor Supply Property:   Discussion was held regarding delivery trucks hitting poles at Tractor Supply.   Aileen Sullivan explained the situation.

A motion was made by Supervisor Buchanan to approve the installation of temporary sub-poles in the township right of way at the Tractor Supply property conditional upon owner approval, township waiver/hold harmless agreement/indemnification and poles meeting roadway obstruction standards and specifications.  The motion was seconded by Vice Chairman Dotey and carries with three in favor and one abstention.  Chairman Melvin abstained.

Administrative Office Decisions:  Removed

Appoint Voting Delegate to authorize the Chairman to cast our vote for the purposes of a quorum on any matters which may come before the annual meeting of MRM Property & Liability Trust on April 9, 2015:  A motion was made by Supervisor Buchanan to appoint Chairman Melvin as delegate.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

General Policy for posting of non-profit links on the township website:   A motion was made by Supervisor Buchanan to decline approving posting of any non-profit links on the township website.  The motion was seconded by Vice Chairman Dotey and carries with all in favor.

Discussion regarding unauthorized taking of township property by former Supervisor/Police Commissioner:  A motion was made by Supervisor Banach to press charges against a former Supervisor who took township property.  There was no second.  The motion did not carry.

SUBDIVISION REVIEW and ACTION: None 

EXECUTIVE SESSION:  

An executive session was called at 8:38 p.m. for purposes of litigation.

The meeting was back in session at 8:49 p.m.

ADJOURNMENT: Meeting was adjourned at 8:49 p.m. on a motion by Vice Chairman Dotey. Motion seconded by Supervisor Buchanan and carries with all in favor.
