January 5, 2015

The regular meeting of the Westfall Township Board of Supervisors was held Monday, January 5, 2015 at 7:27 pm. The meeting was held at the Township Building on Delaware Drive and LaBarr Lane, Westfall Township.

Those present were Vice Chairman, Robert Melvin; Supervisors, Raymond Banach, Lester J. Buchanan and Jerry Dotey; Solicitor, Robert Bernathy, and Secretary, Jodi Hulse. Also present was Zoning Officer, Douglas Olmstead; Scott Myer, Bill Schneider, Chad Steward, Rob Llewellyn,  Bill Koferl, John Dalton, Linda Bostinto, Paul Fischer, Attorney James Baron, Julia Khomut and approximately seventeen members of the general public.

APPROVAL OF AGENDA:  

Vice Chairman Melvin added Public Comment for agenda items to the beginning of the meeting and regular public comment to the end of the meeting.

Agenda approved on a motion by Supervisor Banach.  Motion seconded by Supervisor Buchanan and carries with all in favor.

EXECUTIVE SESSION:  NONE

PUBLIC COMMENT:   No public comment.

MINUTES:  A motion was made by Supervisor Buchanan to approve the December 18, 2014 Special Meeting Minutes.  The motion was seconded by Supervisor Dotey.  Supervisor Banach abstained since he was not present at the meeting.  The motion carried with three in favor and one abstention.

A motion was made by Supervisor Buchanan to approve the December 1, 2014 Regular Meeting Minutes.  The motion was seconded by Supervisor Dotey and carried with all in favor.

TREASURER’S REPORT:  Scott Myer gave the report.   He said the treasurer’s report is for the calendar year of 2014.  Income for the year was over budget on permit fees.  Expenses were in line.  Mr. Myer said it was a solid year as expected.  He said a Tax Anticipation Note is still needed.  The paperwork is in process with Solicitor Bernathy.

A motion was made by Supervisor Banach to accept the Treasurer’s Report.  The motion was seconded by Supervisor Dotey and carries with all in favor.  

POLICE REPORT:  Chad Stewart gave the Police Report.  The report was for the month of December.   The monthly count of offenses know to police were as follows:  2 Assault, 12 Larceny Theft, 1 Forgery, 4 Fraud, 7 Vandalism, 1 Weapons, 4 Drug Abuse, 1 Drunkenness, 7 Disorderly Conduct, and 2 all other offenses for a total of 42.   The monthly count of persons charges for offenses were as follows:  1 Assault, 7 Larceny Theft, 1 Forgery, 1 Fraud, 5 Drug Abuse, 6 Liquor Law, 1 Drunkenness, 2 Disorderly Conduct, and 1 all other offenses for a total of 28.  Miles patrolled for the month were 4,920 and 73,519 miles patrolled year to date.  Motor vehicle accidents for the month were 24 and 216 motor vehicle accidents year to date.  Call for service for the month were 176 and 2,411 call for service year to date.  

Supervisor Banach moved to approve the Police Report.  Motion was seconded by Supervisor Buchanan and carries with all in favor. 

Supervisor Buchanan said at the last Police Commission meeting there was discussion regarding raising funds to purchase new defibrillators for the department.  The Board suggested sending request letters to the box stores for donations of funds or donation defibrillator units.

FIRE DEPARTMENT:

Mill Rift Fire Department:  No representative for the fire department was present.  No report was provided.

Westfall Fire Department:  Chief Rob Llewellyn gave the report for the month of December, 2014. The report includes a call report summary.  For the month of December, 2014 the report was as follows:  5 Automatic Fire Alarms, 2 Motor Vehicle Accidents, 3 Chief Investigations, 1 Vehicle Fire, 1 Gas Leak, 1 Utility Wires Down, 1 Public Service, and 1 Structure Fire.  Total calls for December were 15 and 318 calls year to date.  Total man hours for December were 58 and 2,614 man hour’s year to date.

The EMS report for the month of December, 2014 was as follows:  41 calls in Westfall Township, 13 calls to cover Squad 33 and 9 calls to cover Squad 19.  The total EMS calls for December were 63 and 859 calls year to date.  Total man hours for EMS for December were 105.75 and 1,549.75 man hour’s year to date.

Training for the month was three drills/in-house training sessions held for 72 hours.  Three members completed Emergency Vehicle Operators Training for 48 hours.  Seven members participated in a Structural Burn at PCTC for 35 hours.

The overall calls year to date are 1,103 and Overall man hour’s year to date are 6,032.10.

Chief Llewllyn said the department was called out to provide a final inspection on the new Mavis Tire Store.  He said the amount of tire storage space exceeds the approved amount by the Planning Board.  Attorney James Baron was present to represent Mavis Tire.  Also present was Julia Khomut, Architect for Mavis Tire and Eric Dahlquist, Contractor for Mavis Tire.  Discussion was held regarding the issue.

Solicitor Bernathy requested the applicant’s position in writing for his immediate review.  Attorney Baron agreed to provide it as soon as possible.

Chief Stewart said the applicant needs to obtain a permit from the Police Department for the alarm system.

A motion was made by Supervisor Buchanan and seconded by Supervisor Dotey to provide Solicitor Bernathy the authorization to make any legal decisions regarding this matter.  The motion carries with all in favor.

Vice Chairman Melvin moved to approve the Fire Department Reports.  Motion was seconded by Supervisor Dotey and carries with all in favor.

HIGHWAY DEPARTMENT:   Bill Schneider gave the report for December, 2014.  The department worked through the storms on December 5, December 9, December 22, January 3 and January 4.  Mr. Schneider attended the Road Task Force Meeting.  150 more tons of salt was ordered and we received 125 tons.  The department repaired potholes with cold patch.  The stop sign on Maple Avenue was replaced.  Mr. Schneider said there was a problem with the Stop Light at the Milford Landing Location.  He reset it which did not work.  Kuharchik Construction came out and fixed the problem.  The traffic light at Stella Street/6 & 209 needed the timing readjusted.  Mr. Schneider contacted Kuharchik Construction to fix the problem.  He discussed putting together a committee for risk management.  Mr. Schneider stated he is still in the process of putting a pole list together for the letter to the PUC and utility companies regarding poles in the township right of way.

Supervisor Buchanan moved to approve the Highway Report.  Motion was seconded by Supervisor Dotey and carried with all in favor.

BUILDING/ZONING REPORT:  Doug Olmstead gave the report for December, 2014.  He said there were ten building permits which $12,279.56 in fees were collected.  There were two Zoning Permits which $150.00 in fees were collected.

Supervisor Banach moved to approve the report. Motion was seconded by Supervisor Dotey and carried with all in favor.

EMERGENCY MANAGEMENT:  Vice Chairman Melvin read the report provided by Robert Ewbank.  The report was for November and December of 2014.  November; Bought printer/copier/scanner/fax.  Mr. Ewbank had a fax line installed at the EMA office.  December; Investigated Sewage leak at Westfall Town Center and purchased antenna system for EMA office and also purchased business cards.

Supervisor Banach moved to approve the Emergency Management Report.  The motion was seconded by Vice Chairman Melvin and carries with all in favor.

OLD BUSINESS:    

Earned Income Tax:  Discussion was held regarding the informational session to be held at the February 2, 2015 Regular Supervisor Meeting.

No motions were made. 

NEW BUSINESS:   

Pike County Conservation District-Dirt, Gravel and Low Volume Road Program-January 27, 2015-Appointment of Attendee:  A motion was made by Supervisor Banach to appoint Bill Schneider, Road master, and any other Supervisor who wants to attend, as attendees for the program meeting.  The motion was seconded by Supervisor Dotey and carries with all in favor.

Resignation letter from R. Douglas Olmstead, Zoning Officer: A motion was made by Supervisor Buchanan to accept Mr. Olmstead’s resignation effective January 15, 2015.  The motion was seconded by Supervisor Dotey and carried with all in favor.

Discussion followed.

A motion was made by Supervisor Banach to appoint Michael Rendleman, BIU or Doug Olmstead as temporary Zoning Officer until the hiring of new officer.  The motion was seconded by Supervisor Buchanan and carries with all in favor.

Appointment of Deputy Tax Collector-Form from Laurie Pearce to appoint Zachary Pearce:  Discussion was held regarding possible conflict since Zachary Pearce is on the School Board.  

 A motion was made by Supervisor Buchanan to appoint Zachary Pearce as Deputy Tax Collector contingent upon the legal opinion of Solicitor Bernathy.  The motion was seconded by Vice Chairman Melvin and carries with all in favor.    

PUBLIC COMMENT:  Mrs. Bostinto asked if notices would be posted on the Township Facebook Page.  The Board and the Secretary are not aware of the township having a Facebook page.  Secretary Hulse agreed to look into the matter and contact our website designer to see if he set up the account.

Mr. Fischer brought up the point of having the township provide the permit applications for the police department for the alarm systems.  Secretary Hulse said she would obtain the permit applications from Chief Stewart and include them in the application packets.

SUBDIVISION REVIEW and ACTION: None

ADJOURNMENT: Meeting was adjourned at 8:34 p.m. on a motion by Supervisor Banach. Motion seconded by Supervisor Dotey and carried with all in favor.

January 5, 2015 Supervisor Organization Meeting Minutes

RE:    Supervisor’s Annual Reorganization Meeting 1/05/15

The Supervisors of Westfall Township held their Annual Reorganization Meeting on Monday, January 5, 2015 at the Westfall Township Municipal Building and the following Officers were elected.

Temporary Chairman: Supervisor Buchanan moved to appoint Supervisor Melvin as Temporary Chairman. Motion was seconded by Supervisor Dotey and carried with all in favor.

Temporary Secretary: Supervisor Banach moved to appoint Jodi Hulse as Temporary Secretary. Motion is seconded by Vice Chairman Melvin and carried with all in favor.

Supervisor Banach made a motion to keep the following appointments the same as last year down to and including the Treasurer.  The Secretary office hours were not included in this motion.  The motion was seconded by Supervisor Dotey.  Supervisor Buchanan was in opposition.  All of the following motions carried with three in favor and one opposition.  Each motion reflects this in the following minutes through and including the Treasurer.

Chairman of the Board: Supervisor Flansburg – The position of Chairman was approved on a motion by Supervisor Banach, seconded by Supervisor Dotey. Supervisor Buchanan was in opposition.  The motion carried with three in favor and one opposition.

Vice-Chairman: Supervisor Melvin – The position of Vice-Chairman was approved on a motion by Supervisor Banach, seconded by Supervisor Dotey.  Supervisor Buchanan was in opposition.  The motion carried with three in favor and one opposition.

Supervisor Pro Tem:  Supervisor DoteyThe position of Supervisor Pro Tem was approved on a motion by Supervisor Banach, seconded by Supervisor Dotey.  Supervisor Buchanan was in opposition.  The motion carried with three in favor and one opposition.         

Secretary: Jodi Hulse- Salary shall be set at the rate of $ 30,900.00 yearly. Appointment made upon motion of Supervisor Banach, seconded by Supervisor Dotey.  Supervisor Buchanan was in opposition.  The motion carried with three in favor and one opposition.

Office Hours:  Hours are 8:00 a.m. through 4:30 p.m. Monday through Thursday including Supervisors and Planning Commission Meetings. The office will be closed on Fridays.  Motion made by Supervisor Banach, seconded by Supervisor Dotey.  The motion carried with all in favor.

Treasurer: Scott Myer of Myer & Myer – Compensation set at $21,300.00 yearly. Mr. Myer’s appointment made upon motion of Supervisor Banach, seconded by Supervisor Dotey.  Supervisor Buchanan was in opposition.  The motion carried with three in favor and one opposition.

Supervisors Meetings: The Supervisors set the following schedule for regular meetings for year 2015. Regular meetings will be held on the first Monday of each month except for September when the meeting will be held Tuesday, September 8, 2015 due to Labor Day. Motion to approve schedule made by Supervisor Buchanan, seconded by Supervisor Dotey.  Motion carried with all in favor.

Special Meetings: The Supervisors set two special meetings to be held on Monday, November 16, 2015 at 6:00 pm and Thursday, December 17, 2015 at 7:00 pm for the purpose of introducing the tentative budget and adopting the actual budget for the upcoming year.   Motion to approve schedule made by Supervisor Banach, seconded by Supervisor Dotey. Motion carried with all in favor.   

Supervisors Workshops: Supervisors Workshops will be scheduled as needed.

Designated official Bank Depositories for all Township funds shall be with the Pennstar Bank, The Dime Bank and Pennsylvania Local Government Investment Trust. Motion to appoint banks stated made by Supervisor Buchanan, seconded by Supervisor Dotey. Motion carried with all in favor.

Board of Vacancy Chairman:   William Koferl –   Supervisor Buchanan moved to appoint Mr. Koferl as Board of Vacancy Chairman. Motion is seconded by Supervisor Banach and carries with all in favor.  

Township Solicitor: Robert Bernathy – Salary shall be at the rate of $100.00 per hour for attendance at a Regular or Special Township meeting and Workshops. All development work is reimbursed by the developer prior to final approval. Payable from the Township General Fund. Motion to appoint made by Supervisor Buchanan, seconded by Supervisor Dotey. Motion carried with all in favor.

Planning Board Solicitor:  Robert Bernathy – Salary shall be at the rate of $100.00 per hour for attendance at a Regular or Special meeting or Workshop of the Planning Board. Payable from Township General Fund. Motion to appoint made by Supervisor Banach, seconded by Supervisor Buchanan. Motion carried with all in favor.

Township Engineer: Kiley Associates, LLC – Supervisor Buchanan moved to appoint Kiley Associates, LLC. Motion is seconded by Supervisor Dotey and carries with all in favor.  

Alternate Engineer:  Al Handy, Twin Oaks Consulting, LLC – Supervisor Dotey moved to appoint Al Handy, Twin Oaks Consulting, LLC. Motion is seconded by Supervisor Banach and carries with all in favor.

Zoning Hearing Board: 3 year term

Motion to appoint Kirk Summa & Co. to replace the elected auditors in their duty of making an examination of all the accounts of the township for the 2014 fiscal year is made by Supervisor Dotey, seconded by Supervisor Buchanan.  Motion carried with all in favor. 

Building Appeals Board: 3-year term

Discussion held regarding the vacancies.  Supervisor Banach suggested sending a letter to Shohola Township to inquire about combining Building Appeals Boards.

Motion to appoint Albert Schneider is made by Supervisor Dotey, seconded by Supervisor Banach.   Motion carried with all in favor.

Zoning Hearing Board Attorney: Douglas Jacobs – Salary of $100.00 per hour payable from Township General Fund, as required.  . Supervisor Buchanan motioned to appoint Attorney Jacobs.  Motion seconded by Supervisor Dotey.  Supervisor Banach was in opposition.  The motion carried with three in favor and on opposition.

Supervisor Banach suggested the Board interview representatives for all services which the township spends money.

A motion was made by Vice Chairman Melvin to appoint Supervisor Banach, Supervisor Dotey or Supervisor Buchanan to attend the convention.  The motion was seconded by Supervisor Banach and carried with all in favor.   

Upper Delaware Council:

Supervisor Banach moved to appoint Charles Pranski.  Motion is seconded by Supervisor Dotey and carries with all in favor.

COG Representative: Supervisor Banach moved to appoint Jodi Hulse as Council of Governments representative. Motion is seconded by Supervisor Dotey and carries with all in favor.

Non Uniform Pension Plan Committee:

A motion was made by Supervisor Banach to appoint Vice Chairman Melvin as Supervisor on the Committee.  The motion was seconded by Supervisor Dotey and carries with all in favor.

A motion was made by Supervisor Banach to appoint Jodi Hulse as Plan Member on the committee.  The motion was seconded by Supervisor Dotey and carried with all in favor.

The Board agreed to advertise for the vacancy for the Citizen position on the Committee.  

Road Task Force Representative:  No appointment needed at this time. Albert Schneider is appointed.

Alternate Sewage Enforcement Officer:  The Board agreed to table the appointment of the position.    

Official Newspapers:  Motion was made by Supervisor Buchanan to designate The Pocono Record as official paper. Motion is seconded by Supervisor Dotey and carries with all in favor.

Fire Department Split:  Motion was made by Supervisor Banach to designate the split as 70% of township funds allocation of Fire Protection to The Westfall Fire Department and 30% of township funds allocation of Fire Protection to The Mill Rift Fire Department.  Motion is seconded by Supervisor Dotey and carries with all in favor.

Mr. Myer confirmed with the Board the split of the relief funds would be voted by the Board separately at a later date

A motion was made by Supervisor Banach to advertise all township position vacancies.  The motion was seconded by Supervisor Dotey and carried with all in favor.
